You move people who don't have cloud around on the agenda. You don't have evening meetings. It's the only municipality that does not have evening meetings. You have them in the morning where people who don't have cloud cannot come and be a member of this proceeding. You don't recognize people in history, even those who worked in this county court building of color, Zach Lawrence, you don't recognize him. You don't put very much black history on the square. Well, there's none on the square. Not even about Quaker Town and how those people had experienced genocide and were moved from where they lived on the square. Not even about Quaker Town and how those people that experienced genocide and were moved from where they lived to, where you moved them, you not you, but people, authority like yourself moved them. As I demonstrate out in front of the moral on the weekends, people tell me things and I'm surprised at how many county workers are not happy about the raises that you lack of raises that you have given them. If I won the commissioners court, I'd make sure those people were compensated like they should be compensated. And lastly, the cemetery in St. John's cemetery in PowerPoint. No help at all from this commission's court. And you have the authority and you have the funds and you don't help with those people. Imagine going up, not knowing who your father, mother, or any people like that were. And you imprison all your life, and none prison, in slavery all your life, and then be buried in a place at St. John's cemetery and no one's taking care of that place. And they're forgotten. Well, I've been working out there for the last few weekends and I can tell you it restored faith in my heart about people and where I came from and things like that. But this Commissioner's Court has done nothing to help that in that situation. Members, I know that Mr. Huskis doesn't like me to jump around in the agenda, but he might make an exception today. We're going to take up item 13b and 13c on the agenda. 13b is a provol building use request from Mr. Willie Huskis to use the Card House on the Square Commission's courtroom for a runoff election candidate form on Saturday, May 7th. I don't think it's just May 7th. It's not also the 24th as Cheryl. Just May 7th, it says 24th also, but I think it's just May 7th, is it not? Okay. And this is from 9am to 12pm. And then 13C is approval of the building news of Christ and Mr. Will has supposed to use the cardus on the square commissioners courtroom to show a documentary on on Monday, May 16, 2016 from 630 to 830 PM. Mr. Hutsbeth has asked that the fee for building use has been would be waived and I have absolutely no problem with that. But he's also asked that the security guard payment for security guard be weighed. And he was advised that that would be a commissioner's court decision. I will tell you that it is a customary for people that want to use the facilities. When they're not already open and the security guard already here for that party to pay for the security guard not only for security but to lock up the building and make sure nobody's left in the building when it is locked up and that's sort of business. So Mr. Hussby, you had asked to speak on this item or actually both of these items. I need to go through the main and all that again. First I want to speak to the use of the building for the candidates for them. The candidates are county candidates. They are candidates that are running in the county for public office. They are running for offices that the public needs to know about where they stand and the information that they can gleam from questioning them. That's a good thing. That's candidates for the public to be informed. The two, the organization that's putting on this form is the NAACP. It's a public service for our organization and anyone else who would like to hear from the candidates. And why would a municipality, where these candidates are running to represent and to show their stance on issues, need to be charged to do that. It is not the fee, the moon, it's the principal. It's for the county, it's free. We're not partisan. We are just trying to get them information out. So that's my... I, just be along that. Secondly, the movie that you asked, I wanted to show the movie with my three minutes that I get every day, to try to communicate why I feel the way I feel. The young women girls who were murdered in Alabama in 1962, 1962, at a bombing at the church, that document, that documentary just shows the agony that those parents went through, the frustration that the people went through, the just other other hopelessness of the situation. It's just heart-wrenching. It's just hard to watch. It's difficult to look at. It communicates very well how I feel when I come before the fabulous prize. You treat me like I don't. I'm a Vietnam vet and I was here when you recognize the Vietnam veterans. You don't treat me. You treat me like they treated me when I came back from Vietnam. You're worse. You treat me worse than they treated me. This group, I feel the way I feel because the same way that those pants feel in that document we're gonna do on the 16th. Again, I don't think that I should have to pay or I'm not paying for that one. So those are my arguments or notes. Okay, Commissioner Marchin. Those are my arguments or no. Okay, Commissioner Marchion. First of all, you've already heard from the judge that those fees that we usually charge, yes. Those fees that we usually charge are not going to be charged to you. Second of all, we have several organizations within this county, mainly the Ditten County Republican Party, the Ditten County Democratic Party, that they have an understanding with us as well, that if anything, any candidate forum, any meeting that they have in any county facility that is outside the normal business hours that they have to provide a security guard. Now whether they provided in the form of a constable that's volunteering their hours to be there to make sure that the county facility that your tax dollars are paying for are protected and nothing comes of harm to those facilities Are they pay someone to be there to open the door and to lock the door and make sure that nothing happens to county property so I don't know why we would Let me ask you this anybody from an NAACP or anybody that you know or swarm peace officers yes well they be attending that meeting I don't know these two organizations that I've mentioned that I know that have had candidate forms have actually provided documentation that they will have someone that will be there that is a sworn piece officer. And at that point we waved and waved the feed that we would ordinarily pass through this court to them for them being there to protect the property of Denton County. So I would suggest to you sir, either hire a security guard as the policy said to be at those events or you find somebody within the community or the NAACP that can sign a document with this county that they are a sworn peace officer and they will be there in the best interest of the county That's my It's for the use of the building Mr. Hussby and I purposely email Cheryl and ask if we've ever Waved the security fees and I was told no and I told her to proceed on because if we don't wait for anybody, one else we're not going to wave them for you either. As Commissioner Marchin has said, there are a lot of constables that will secure the building for you that we can work with and I suggest you do that. I don't think we're treating you any different than we're treating anyone else. And I don't know about anyone else up here but I'm really taking the fence to you saying that I treat you different because I don't treat anybody different. I love you like I love everyone else in this courtroom because you know what? I'm going to heaven and I'm not going to room because you know what I'm going to heaven and I'm not gonna lie or anyone to keep me from going to heaven and so I'm not going to treat you any different I'm gonna always treat you with respect as I do everyone else, but I'm not gonna vote To wait those security fees as long as we don't do them for anyone else if we've made Allow for anyone else. Working with Peggy and her team, it was a great opportunity for us to work together. We like to look at the people that were recognizing. I have a resolution here. I'd like to read this as a resolution honoring Peggy Cards for 40 years of service to Denton County. That's remarkable all by itself. Denton County Commission Court, Denton County, Texas during the regular session on the 12th day of April 2016 considered the following resolution. Whereas Peggy Carr began her career with Denton County adult probation as a probation officer on January 14th, 1976, and will retire on April 29th, 2016. And whereas Peggy served the citizens of Denton County for 40 years, 14 years as a line officer, 11 years as a supervisor, 10 years as the assistant director and five years as director. And whereas Peggy is looked upon statewide as a leader due to her involvement with the Texas Prohibition Association, serving as the member Prohibition Association, serving as a member of the legislative committee, finance audit committee, and program committee. She also served her local community as a member of the Denver County Community Justice Taskforce, Denver County Policy Committee and the University of North Texas Criminal Justice Professional Advisory Council. And whereas Peggy also was a major contributor to the Texas Corrections Association, a serving as the chair of several committees and also as president in 2005, 2006. And, whereas Peggy has been recognized by her co-workers for her excellent performance, by being nominated for the Johnny Scott Award on two separate occasions, and being named the TCA Line Officer of the Year for the Northeast Region of Texas. And whereas Peggy has been recognized by other directors across Texas as being a calm rational voice in the midst of the fray and quote an influence on others to make a career out of being a probation officer in quote and as one who cares deeply about her profession, her department and her community and whereas Peggy has contributed immensely to the success of Dem County of Drawl probation and she will be greatly missed. Now therefore be resolved in County Commissioner's Court and County Texas. Does hereby extend to Peggy Car a sincere and grateful appreciation for her dedicated service to Denton County? Excuse me. She is our candidate for 4-8-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6-6 for the past three years prior to that, she was the show-hurt manager at Stowers, Limousine and Bridgeport and was on the breeding research team for Chromaton, incorporated in New Deal. She has a bachelor's degree from Texas Tech and Agricultural Interdisciplinary Agriculture and a master's degree from Talton in Agriculture and Consumer Resources. Jessica will be completing her first step training program during the next month, and during that time she'll be in a neighboring county working alongside other county extension agents. She will be paid, her salary will be paid during that month by Texas A&M AgriLife Extension Service, and then she'll be officially in the county on May 16th. She told me earlier, and I didn't realize this, but she has her roots here in Ditton County and was a former forager and served as an ambassador. So back in the day when she was in her forage career. That's pretty remarkable if you think about it. Okay, this is a proclamation honoring Edna Westbrook Treg, whereas Edna Westbrook Treg served in county as the first county home demonstration agent in the state of Texas and pioneer in the mission and work of agents across the state and the nation. Whereas Edna Triggs was born in 1868 and raised in Miland County Texas, shared her skills with rural communities there as a school teacher in principal was invited in 1911 by the youth department of agriculture to accept the position of collaborator in Milam County where she received recognition statewide for her work with her girls tomato clubs, guiding girls as they raised in cantamethas for local residents in one prizes in statewide competitions of the State Fair of Chexes. And in 1916, she accepted the position of County Home Demonstration Agent in Denton County. And whereas Edna Trigg educated and mentored the people of Denton County by teaching demonstration classes in canning schools, visiting homes throughout the county on a daily basis and providing advice on gardening food preservation, canning, sewing, cooking, household management, family health, poultry raising, crop management, and growing practices and other aspects of daily life. And where's Edna Triggs 40 years of service to Dent Denver County from 1916 to 1945 was given nationwide recognition in 1991 when she was inducted into the National Agricultural Hall of Fame for her work as a key contributor to the foundation of the County agent who today is served by Texas by AgriLife Extension and an educational outreach agency of the Texas A&M University system. And whereas Denton County celebrates the legacy of Edna, I'm sorry, Westbrook Trig on Saturday, April 16, 2016, with the dedication of the State of Texas Historical Marker made possible by Texas A&M Agor Life Extension, the drop extension education club and Denton family and consumer science committee. Now therefore it will be resolved that the Denton County Commission's court recognizes the dedication service and longstanding achievements of Edna Westbrook Trigg, the first county home demonstration agent in the state of Texas. And pays homage to her work and her, homage to her and her work which paved the way for thousands of professional county agents across Texas and the nation who have followed in her footsteps. Independent auditor's opinions in the SAS 114 year report. Thank you Judge and commissioners, the county's annual financial statement and audit to the financial statement and actually single audit report has been presented to you. On pages 44, 45, 46, you have a lot of background information on the audit, findings of audit, and also on the financial results of the county for the year. I'm giving a lot of detail on that. We'll not propose to cover all of those, but answer any questions you have. I will say just add under legal information, the report has already been filed with the Security Exchange Commission as required on time. It has also been filed with all of the grantor agencies, both state and federal level, that the county accepts federal grant money from, those also required, those all within the deadline. And it's already been reviewed by the bond rating agencies and because we just finished up the bond refunding last week. That's it. I want to turn over to John Manning, partner with Patel O'Brown and Hill. Good morning. Thank you for being here. Thank you commissioners. Thank you for letting us be here. Excuse me. Well, I'm going to go over some of the highlights of the financials. I just wanted to point out that this document has now grown to about 150 pages. I don't try to go over all of those now, so don't start packing a lunch just yet. But it is separated into four sections, and I'm just going to go over some of the highlights. Obviously, on page one is what we refer to as the independent audit report, and that's why we're here. This 150 pages is the responsibility of the county. All responsibility is to audit those numbers and render an opinion as to whether those numbers and disclosures are correct in accordance with prescribed accounting guidelines. And that's what we say on page one is what we refer to as an unmodified opinion. Meaning we did not have anything in the report that we needed to modify our opinion for. Of the four types of opinions that we can give, this is the highest level of assurance that we can offer as an outside auditor. And just by looking at this, this doesn't even begin to scratch the surface on how many departments we talk to, reports we look at at controls that we review so having them modified opinion Although it's only three pages in here. There is a lot of work by a lot of people throughout the county to ensure that the county continues to have that Page four is the MDNA this is actually a very meaningful document in the report We don't offer an opinion on it, but we do redo it make sure it meets prescribed guidelines This is actually written by the County Auditors Office and kind of offers the readers of the financials and narrative of what happened during the year. Instead of having to go through 150 pages and try to figure out what all happened, James and his office do a very good job of going through here and kind of hitting a lot of the highlights, talking about a lot of your capital activity, talking about refunding debt issues, talking about the big points that impact the financial. So, you know, I know you can't go through 150 pages page by page, but if you do have time to look at one section, I would recommend looking at that at an MDNA. Looking at page 17, one of the things that we always like to talk about is reserves, the county ended, the general fund had about, right at $42 million in it, which sounds like a lot, but considering your budget's about $130 million or more. That's right line with where GFLA recommends that those reserves be. So applaud the county on making sure that you all have those required reserves. On page 18, you can see the amount of capital activity that are being done with all the bonds that have been being issued. And also on page 18, you can see that there was a $30 million refunding in FY 15 to allow the county to take advantage of better interest rates to save money in the long term. On those service expenditures. Page 20 is a budget to actual. Well, you actually, I know you all are getting ready to do the budget process again, but you all were able to generate more revenue than was budgeted and spent less in your expenditures than was budgeted. And both of those things are a credit to the county monitoring all the reports that James gives you guys looking in all the departments and making sure that they stay under budget. Also on page 24, the self-funded insurance plan has quite a few claims being paid and things going through there. And those reserves are up to over $11 million. So I know that at one point that had gotten a little bit lower. I know you all have done some things to make those reserves get higher. So those things have been working and those reserves are in a better place. From a reporting standpoint, really the only thing that changed this year was we had to implement what's called GASB statement 68, which is essentially recording an actual early crude liability. We've already done it for the OPEBS or for your retirement health plan. Now we have to do it for your actual retirement plan. So we had to implement that this year and Jameson and got all the disclosures put in. We reviewed those and what that ended up doing was adding about 27 million dollars of essentially debt with no offset. A lot of times when you issue bonds, you issue debt, then build a project so you have a liability, you have an asset to offset it. This one is just a liability, and we've been talking about this thing for years, it shouldn't be anything new. But the county was able to absorb that and talking to bond rating agencies and people that had been speaking about the impact of this. They've essentially been looking at that number the entire time when they're doing their bond rating process. As this number has never had to be recorded in the financials, these numbers have been being shown in the notes. I've been doing this for 21 years. It's been in there the entire time where it shows what their value in the assets that you've put in, evaluating how much that you owe and disclosing that amount. It's just never been booked in the financial statements before. So this year, it actually has. So that's from a reporting and accounting standpoint, that's really the only thing that changed. And that's one of the reasons why this got up to 150 pages. It's just disclosure, used to be about a page and a half. Now it's about eight pages. They've added two additional RSI schedules that are in here. Are those things required by gas being gapped? So that's not something I wanted to put in here for fun to try to get to 150 pages, but it is very important. And we have been discussing that over the last few years. The middle part of the report is essentially your notes and a lot of your non-major combining schedules. I'm not going to spend a lot of time on those, but towards the back of the report, it has what we call the SEFA and the SEFA, which is your schedule of expenditures of federal and state awards. And because you all spend over $500,000 of federal funds, we have to do our audit into the single audit act. And we actually had two programs for federal and two programs for state this year. and we did not have any significant deficiencies or material weaknesses there. And also we did our audit under government auditing standards, and we did not have any material weaknesses or significant deficiencies there as well. So really the big change was Gaspi 68. The report looked very good. The numbers will be get them look a lot like what y'all look at. We don't make adjusting entries so the numbers that you've been getting don't change from what you're, you know, what's showing up in the audit report and that has a lot to do with the auditor's office and the time that they spend on these. Everybody that we deal with at the county, we go out to places that collect money to look at their controls. We talk to different departments and everybody is always very helpful. They make sure we get what we need and I think it's a real team effort and making sure that the report looks like it does. It's not us, it's not just the auditors, it's the entire county. And we've always enjoyed working here and the people giving us the attention that we deserve to make sure that we're getting 150 page report to you. On time to be able to be involved with the various people that James mentioned as well as being able to continue to submit this for the GFLA reporting excellence award, which I believe this year we only had one comment, which was a new record. We'll probably generate a few more next year with the new 68 inclusion, but we're not the only ones that look at this a lot of other places due to. And I want to especially thank Donna Stewart, and not like she doesn't have enough going on right now anyway, but she set aside time to get this done for Judge Garcia and also for the Sheriff's Department. There were certain requirements in the grant application that we needed a medication from the Sheriff's Department and they scrambled yesterday to get that done. It's a federal grant. It'll cover some overtime for the Bay Look to actually make visits to monitor the veterans as well as some other software expenses, et cetera.
