I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the All right. Good morning, everyone. The commissioners court for Tuesday. November 1 is now in session. This morning, the invocation is be given by Martin Men. And our pledges be led by Kevin Carr, cheted Information Officer, will you please stand? Well, how do I follow that? Well, good morning, Judge and commissioners. Today, I would like to start out with Proverbs 4 verses 5 through10. Get wisdom, get understanding. Do not forget, and return away from the words of my mouth. Do not forsake her and she will preserve you. Love her and she will keep you. Wisdom is the principal thing. Therefore, get wisdom and in all you're getting, get understanding. Exalt her and she will promote you. She will bring you honor when you embrace her. She will place on your head an ornament of grace. A crown of glory she will deliver to you. Here and receive my sayings and the years of your life will be many. So Lord, we thank You for Your word. We thank You that You are a God of wisdom and you give to us liberally as we ask you for wisdom. I thank you for the wisdom that has come through this court for the development of Denton County I ask for a blessing on fresh wisdom to come to them in the future so that the development of Denton County will be so that the development of Denton County will be released through your wisdom. We also ask for special blessing on the elections that are in our nation and we ask for your wisdom to be with every voter that they will hear you and wise leaders will be elected in this nation in Jesus' name. I pledge allegiance to the flag of the United States of America and to the republic for which it may be one nation under God, indivisible. The liberty and justice for all. Honourable, the Texas flag. I pledge allegiance to the Texas one state under God, one in indivisible. Okay, thank you very much. We're going to jump around a little bit because we've got a couple people that need to get some place out. So we're going to first take item 4a on the agenda. 4a is a public hearing to consider, to specify, to prove. Under our take appropriate action on the reply of a plain hill of states, lot one and two blocks. See this is 10.0813 acres and Commissioner precinct free. First need a motion for our public hearing. Motion by Commissioner Mitchell. Thank you. Seconded by Commissioner Eads. On favor, please say aye. Aye, opposed say nay. Motion does carry. Gary, good morning. The purpose of this replat is to just the acreage on two lots, one and two and one in two are. This met all the subdivision rules and regulations. We sent out seven certified letters. We got two return, they were in approval, there was no opposition. Thank you. Does anyone understand what it would like to address commissioners court on this issue of the proposed replat? Anyone that's intended to see their own favor over a post to that would like to speak. Hearing none do we have a motion to close the public hearing? Motion by Commissioner Marchen. Second. Seconded by Commissioner Eads. On favor please say aye. Aye. Posts and in motion carries and we now need a motion for approval. I move for approval. Motion by Commissioner Eads, seconded by commissioner Mitchell. All in favor, please say aye. Aye, pose, aye. Motion does carry. We're also going to jump to item 16a, which is another public hearing. To consider discussing or approve the request for a special use permit in the Lakebury Roberts Land Use Ordinance Effect of February 24, 2009 is recommended by the Lakebury Roberts Planning and the zoning commission in the Denton County Public Works Planning Department. This property is located. It's account number R59835 abstract 792 J Morton survey track 87 4.17 acres precinct one in motion for public hearing. Motion by Commissioner Coleman. Seconded by Commissioner Marchand. Go on favor, please say aye. Aye. Aye, aye, pose, aye, aye. Motion carries. Terry. Good morning. That's the commissioners. On September the 19th, the Lake River Roberts Commission held a meeting to discuss the special use permit request from Mr. and Mrs. Lovely Good. They were wanting to put a second home on their property so that their parents could move and be close to them. Being R2, the special use permit is required. We sent out seven public notices and we had no response either in favor or opposed. So the Lake Railroberts Commission did vote unanimously to approve the special use permit, and we also recommend approval. Thank you. So anyone who tends to like to address commissioners card on this issue, they're in favor of or opposed. Hearing none, do we have motion to close the public hearing? Second. Motion by Commissioner Marchant, seconded by Commissioner Coleman, all in favor, please say aye. Aye. Posting in. Motion carries, and I mean now need a motion for approval. Move. Motion by Commissioner Coleman. Second. Seconded by Commissioner Eads, all in favor, please say aye. Aye. Posting in. We're going to be back Commissioner Eads on favor please say aye. Aye. Opposed any motion carries. All right. They can get off to their, you have some training going on. I understand this morning. Members, we're going to go to item one, which is for public input for items not posted on the agenda. There's any member of the public that would like to address Commissioner's Court. We ask that you please complete a public comment form. They'll be on the side table. When you remind everyone, please turn off your cell phones, pages, any electronic device that might be disruptive. I have three public comment forms this morning. The first one is from Jacob. Is that rumour? Romy, I'm sorry. Good morning. You have three minutes sir. Hello. Good morning everybody. I am Jacob Bromi, a political science student at UNT and president of the college Democrats on campus. First off I would like to talk about the time of the meetings. I understand that it's been done in the past where they tried to have some compromise with maybe having meetings in the evenings. I understand that it's been done in the past where they tried to have some compromise with maybe having meetings in the evenings and stuff like that. There wasn't great attendance, but I can only speak on behalf of students at the University of North Texas and TWU that this still is not a very efficient time for us. As students, we are missing class to attend these meetings on Tuesdays, and I do not believe missing class or work should be the price of participating in something as cool as participating in a commissioner's court meeting. Students in my own organization have come to me and want to come and participate in a meeting like this and simply cannot. I like the court to consider the fact that the time of this meeting is marginalizing participation in our local democracy when it comes to the students in this community. As for the Confederate statue on the square, obviously this issue that we come here for almost every Tuesday. I do not believe personally it is a good representation of our community. When I think of Dint and County, I think of a place that is diverse, vibrant, and loving. I moved here from out of town and when I've come to Dint and it has been nothing but been extremely great and I hope to even have a future life here after college. I definitely do not feel like there's a place for a monument to white supremacy in my own opinion, should be front and center in our community. And as of my personal opinion that the statute should be removed entirely and it does nothing but reflect a historical aspect of this community that is full of hate and division. That being said, I understand the reality of the situation. I understand that the Texas Historical Commission has a large part in this and that there is compromise to be had. There's not just one way to solve this issue. That is why I would also like to advocate for the additional monuments and things added to our courthouse that represent every community in Denton County that makes us so great. An Anglo and German history is not the only history in Denton, and I think it's imperative that we have as many different cultures represented that have made this community what it is today. I also understand that the Texas Historical Commission has a part in this as well. But I do know that the Commissioner Court also does have a part in this. We must be able to provide plans to you guys for approval that then will be sent to the Texas Historical Commission. And from there, once approved funds will have to be created on our own. I can say on behalf of the students in this community and the people that are here today that we will do what we have to do to get that done. I can say I probably as early as next week that we would have plans ready for something like that to bring to the commissioners court and we hope that you guys will consider them. So thank you so much for your time. Thank you. The second public comment form I have is Susanna Denon. I'm sorry. I need to go before her. My name is Riley Cruz. Oh, Riley. Okay. I'm sorry. Yeah. Okay. All right. So as I said, I'm Riley Cruz. Today I'm here to discuss with you guys the plaque that is accompanying the Confederate Soldier Monument outside. As my colleague, Vanaria, addressed last time we spoke with you last Tuesday, we can see that the current plaque was meant to be a hand across the table moment as she put it. However, the plaque still leaves quite a lot to be desired and I would like to give some constructive criticism and suggestions on how we could work together. To make the plaque a more adequate description of the context of this monument. The example that I would like to cite is obli enough for Warner Brothers pictures. Before re-airing some of their older cartoons that have some very derogatory depictions of people of color, they provide a disclaimer that reads thusly. The cartoons that you are about to see are products of their time. They made to pick some of the ethnic and racial prejudices that were commonplace in American society. These depictions were wrong then and they are wrong today, while the following does not represent one of those views of today's society. These cartoons are being presented as they were originally created because to do otherwise would be the same as claiming that these prejudices never existed. And see, this adequately addresses all of the separate parts of this issue. If the plaque accompanying the statute denounced the ideologies and prejudices associated with the Confederacy, but went on to explain that avoiding the start part of our history would be a disservice to those who were and still are affected by the systems and institutional racism that exist because of the Confederacy, this would provide proper context for this monument. As it stands, the statute serves to show that Denton supports the ideals and prejudices set forth by the Confederacy. And of course, we know this to be a gross misstatement of our community's true feelings. I believe that making this change would show your constituents of color that you not only support their demarginalization, but you are prioritizing it. Thank you so much for listening to me. Thank you. Now for listening to me. Thank you. Now Suzanne Event. Morning. Good morning, Council. My name is Suzanne Elise Danheim and I am a history student at the University of North Texas. I've come here today to talk to you all about the lack of historical context that the statue contains and the need for the prioritization of this issue. Next to the statute, there is a plaque that is your compromise and it reads, apologies for using my phone, but I took a picture of it as I walked in. It reads, Denton County Confederate Soldier Memorial. The Denton County Confederate Soldier Memorial was erected in 1918 by the daughters of the Confederacy. The monument stands as a reminder of historic events and is intended as a memorial to the Denton County citizens who sacrificed themselves for the community. Now, let this be a testimony that God created all men equal with certain inalienable rights. We are all one citizens of Denton County. Now, as Riley mentioned earlier, it leaves quite a lot to be desired for historical context, and personally, I think she put it very kindly. This plaque gives absolutely no acknowledgement of the grossness treatments of people of color in the past, nor does it acknowledge the lasting implications of the Confederacy. In section nine of the grossness treatments of people of color in the past, nor does it acknowledge the lasting implications of the Confederacy. In Section 9 of the Confederate Constitution, it states no bill of attainer, expose facto law, or law denying or impairing the right of property in Negro slaves shall be passed. Now, is this really something that we want to literally put on a pedestal and praise? Because this is one of the most disgusting moments in American history, and it's certainly not something that we want to literally put on a pedestal and praise? Because this is one of the most disgusting moments in American history, and it's certainly not something that we should be proud of. And honestly, it's not like this is something that is strictly of the past. I got that quote from confederateleagion.com, and there's a Facebook page for them where you can log in and chat with your fellow white supremacists and organize your ridiculous Confederate Christmas party. And I think that's ridiculous, but sorry, back to the point. Historically, there have been moments in every civilization where the people are not proud of their actions. For instance, in Germany, the swastika has been outlawed as well as all Nazi propaganda. However, the concentration camp still stands as a reminder of the history that happened and as a warning to all people who lived there. And that it's heinous, and that the heinousness of race is nonexistent anymore. To wrap up your running out of time. Yes, ma'am. As Riley said, tearing down the statue would be a disservice to those who were and are affected by the ideologically ideology brought forth by the Confederacy, but leaving it as it is doesn't make it much better. I would hope for y'all to consider making this a part of your agenda so that we can discuss it. Thank you for listening, and I'll see you next Tuesday. Members, item two is a consent agenda. Are there items on the consent agenda you need some discussion on? Do we have a motion for approval? Motion by Commissioner Marchand. Okay. Seconded by Commissioner Coleman. This is the service that we have right now. This is the contract that was awarded for FY 17. We are aware we have numerous problems. We are working with facilities on those, and in fact, I have staff working on some new issues this morning. This contract, though, is formalizing what action court has already taken, and we really need the contract approved further establishes all the terms and conditions. Are you recommending that we adopt the contract? Yeah, the contract needs to be. You've already made the award. And then we'll continue to work on performance issues, utilizing the terms in the contract. What if we don't, if those issues are not taken care of, because let me assure you, it it's they're not doing anything in all good terms. I'm having a skate class. So how long do we have to give 30 days? You know we've already had a couple of meetings and there are some very specific issues that we're working on. Facilities is the one in charge of the contract and we're working with them. But we'll need to follow the terms of the agreement and our hope is that they will perform. Anytime we make a change from one service to another there's an adjustment created. There he is. And this one had a lot shorter mobilization time than our normal time just due to how late it was awarded in the year. We usually give him a lot more time to hire and get set up and we knew that from the beginning but it has been difficult. The length of the contract is a year? Yes, it's on the year basis with renewals for options. The day lady does a great job, but at night they sweep nothing. They don't replace a toilet paper and paper towels unless you ask them to do it. And we have constant complaints from everybody in the building about. They're a lack of cleaning the building. I'm picking up anything. We've got that in several areas. So. I'll make none of it in. Mission are just for the record. Complaints do need to be forwarded to facilities. We can act on them and and they are fully aware of the issues that are going on. I've done it constantly does that. Okay, we'll stay on top of it. We don't have a motion. We have a motion by Commissioner Marchin. We will motion by Commissioner Marchin. Charyle, second the motion. Further discussion? Hearing none, all in favor, please say aye. Aye, pose in aye. Aye. Kevin is that going to be that much every year? That's a lot of money. That is an annual rate that covers about 2100 computers, 1800 county employees, all the Microsoft software licensing and services email, SharePoint, things like that. Or, the intersite is what we thought SharePoint. I'm sorry. The motion for approval by Commissioner Eads. I'm not seconded by Commissioner Mitchell. Questions go ahead. All right. All in favor of the motion, please say aye. Aye. Opposed, aye. Motion carries unanimously. Now comment. I have just been a bless your heart. Bob, you have nominated for the position of TechShare Committee. Thanks a lot. So we met a first meeting and definitely a TechShare. Yeah. I think that's one of the discussions that they're having is to whether to continue the urban counties to continue being in the software business. And since we are a participating county, it would be very, very advantageous to get your feel on that. I know that we're on our own, on Odyssey, on the JP side of that. And then the juvenile and then the court system programs that we have. They have been approached by several other states on selling that software. And they're trying to decide now whether they want to be in the software business. It scares me a little bit, it's spreading themselves that thin, then the support for us who are the pathfinders on putting up the money to create some of those programs. We need to make sure that we're rewarded in an appropriate way and that the service to us are not, uh, does not suffer. So, uh, if you have any feedback on that, if you could send it to me in email, uh, we have a meeting. I believe on the 10th again, uh, that I can share with them exactly, uh, the comments that, that, uh, my IT department has, uh, uh, has about to subject. I'll do that. I just don't want to be flying that wings. We did discuss them going outside of Texas to do some texture services. I don't believe we have the support of the bullet for us to do that. Many of us said no, we didn't want to do that. So I don't think we do. Well, I want to make sure that another issue that is before that TechShare Committee is allowing other counties to join and then what basically to charge them for the after we've already developed it. So those are other. The reason I have the request that you'd be on that committee. Thank you, Ken. Thank you. Okay. That motion did carry unanimously. On to 14F, which is approval 1 to rescind previously approved resolution, the tax abatement agreement in court order 16-0798 signed October 18, 2016, and 2 replace that action with adoption of resolution approval, the tax abatement agreement between West Colerricraft Harbor Corporation and Denton County, Texas, I recommend that you kind of finish your pressing for. I know this will come as a real big surprise to you all, but I mean it was fake that day. So I asked John Felt to repost this to rescind the court order of October 18th and let you all vote for it today so I can vote no. Basically that's what we're doing. I'm not approval. And yes, comments. I was surprised last week when we were brought with the resolution to be signed and I saw that the commissioners court reflected that it was a 5-0 vote. That I could just told you that was my fault. Well, what happened was, I then wrote a note to the clerk in the DA asking them to look at the video because I had extensive questions and I may have irritated because I know you said that you don't like me inquiring things. But I asked and inquired as to what was going on and then when Commissioner E. Heads had some satisfactory, satisfactory, quite answers to the questions that we then proceeded to vote 5.0 publicly and on the record. Then the next week we followed up with the resolution. Needless to say, I was surprised to see that it was marked four of us voting yes and you voting no. So I then, because don't want to make any thing controversial, not ask the clerk and the DA to tell me, well, maybe you need to read the video. Maybe this is a technicality or a mistake because people make mistakes. And I was told that after the meeting, you approached the clerk and told her to alter the court order to reflect you voting in the negative. Now, we do not longer, we no longer pay for a stenographer to take minutes. So our video is the actual court record. It is completely inappropriate for somebody to tell the clerk to change their action once they have publicly voted. Now I'm glad that you've readdressed this to give yourself the opportunity, but we should not be doing that. Just got through seeing I made a mistake. That's why it's reposted. But for the fact that I brought it up, this wouldn't have happened. I've been to change anything. It's still going to pass. I've acknowledged. You can't alter the public record because it's for politics. I acknowledge the commissioner calling you. You feel better now. Do you? This is not personal. Mary, but if you want to make it personal by making accusations like that. I'm more than willing to discuss it. I acknowledge I shouldn't have done it. I did it. I apologize. Okay. Correction has been made. Potions been made. All in favor. Please say I. But your baseless statement that it makes me feel happening now is a pejorative attack that's undeserving. Okay. We have. So I'll accept your apology for that comment. I don't think I did that. We have everybody in favor, please vote aye. I vote as Mr. Rezane. I vote as Mr. Rezane. I vote as Mr. Rezane. I vote as Mr. Rez nay. I believe we did. All right. I'm sorry. We're getting discombobulated here. We have a motion in a second. Just for clarification. I believe we have four in favor. Correct. All in favor. We have four in favor. And one oppose that would be me. I think the remainder. I'm going to vote against it. You're voting against it. I'm going to vote against it. Feel free and favorite. So motion carries. All right. Moving right along item 14 G is a approval of one parking regulations on property real property owned by Denton County, Texas, to prohibit parking of motor vehicles between hours at 10 p.m. and 6 a.m. Sunday through Saturday on the parking lots of Denton County precinct three government center located at 400 North Valley Parkway. Louisville, Texas 75067, real property located at 401 North Valley Parkway, Louisville, Texas 75067, real property located at 198 Civic Circle, Louisville, Texas, 75067 and real property located at 190 North Valley Parkway and two approval of authorizing Denver County Public Facilities Department to post signage at each of these properties to inform the public of the above parking regulations and to authorize the toy of any motor vehicle parked in violation of these parking regulations Currently we've got a real parking problem down there. We have a parking problem and we have people since we have new people new Departments in the building who work with people who leave their cause when they're arrested or whatever and they leave their cause and leave them for months and not and we're Really need parking places and so we've noticed that people complain about parking so we call John and John worked on it for us So we can have a legal authority to move those calls Under this is 615.001 Texas local government code that Provides for the commissioners court to regulate parking on county property This order only pertains to the The Lewisville the new Louisville government center and the other County-owned buildings in Louisville or you can call it our campus or complex if you like buildings in Lewisville or you can call it our campus or complex if you like. There may be other county owned properties that you want to address with parking regulations in the future. We can do those on a case by case basis. So just let us know. And we, I don't know. The advantage to this regulation is that we can't have the vehicles towed and they will be towed and then stored at the vehicle owner's expense. And I think- Let me ask you this. Can we essentially do that on the other properties specifically in a building use policy that's adopted by the court itself? I think the court order. I think you need a court order. You could have a court order that have as many of the facilities in there as you'd like. In this particular one, we just prohibited parking from 10 p.m. to 6 a.m. There might be other types of parking regulation that you might want to impose. Now we are going to need to have signage to give people notice that if they park overnight that their vehicles can be towed. And that's something that we'll have to get with facilities and try to come up with adequate signage. So you're saying you could do a general order of specific properties like this order and name specific properties to it. I know I have a guy that has a bago that loves to park on the property on the weekends. And so. I think we have some other properties that have issues as well. Some do, some don't, but in this case we've had some vehicles parked out there since it's been viewed. Let me ask again, purchasing a bet is when you put these things up, you contract with a towing company. And in other words, there's a towing company that when you put this signage up, that there should be an alternate towing company who's going to tow the cars. In other words, we don't have a towing business. So most of the time there is a, in the signage, I know when I was a JP I heard, I heard them. And so when you have to put in that signage you have to put not only the times, the violation, that makes it a violation but you have to talk, put in the sign where they can recover the vehicle. And so along with this signage, you're going to have to contract with the towing company to validate it, or we're not in the towing business. So has that been thought through at all? I mean, just to put it up there, I mean, what do you do? Call, call, is the consul's office going to call a towing company at there? They can't even do that, can they? I mean, well, there was an issue in another county where it turned out there was a record company that had towed and impounded a lot of vehicles. Dallas County did it on Greenville Avenue. And then I think there was a lot of publicity about that. So now as far as going to purchasing and figuring out, if it's one-towing company, if it's going to be a round robin approach to calling towing companies, and who's going to be a round robin approach to calling telling companies and who's going to make the decision, who gets that call, that's not going to address. But it needs to be addressed because there's no way of enforcing it legally, that there's no way of enforcing that sign. In my opinion, there's no way to enforce that sign if you do not put that proper information on it. Now if we want to vote to get a tow truck and put it at one of the road bridges and it beat that and the car end up at road bridge so bit but it has to have notification on that sign because there's a lot of cases that are for false toeing that they have to prove up within a JP court signage where it was towed to all those alternative information. So I didn't know you had to have it on the sign. Absolutely. So I've seen many signs that say it's showing that. That may be the case, but that may be the case, but to do it legally, you'll have a number of... You have a number of words the vehicle has been picked up. Okay. Toad 2. So Bobby, how bad of a problem is it? We had three or four calls there for months. This June wasn't it, Donna? It's possible not to put like a stick in there. Five calls. But he'd not put a stick around him and say they were abandoned and had some income. He probably would. Donner's been a police in the situation. I know at the jail when people sometimes go to the courthouse. Sometimes they don't leave the courthouse. Yes, and that's right. And their car cities have a community supervision in the building and when they, somebody coming in for probation, they take them to jail. So their cause is just so. I just want to make sure that if you do have towing signs, you know, we need a legal remedy, remedy that is posted on that sign and the people that may have their car illegally towed, they have to have a remedy as well. And especially because I know towing companies that all they do is cruise around looking for those types of situation. It's one minute past 10 pm and the car gets towed. And so, I mean, that's what their business is. And so, I agree, I think that's... I'd be my recommendation that if we put up any... And I don't want to stop you from doing that by this... But we have to do it, Lee, can we go down up? By my conversation, but in my in my opinion You're gonna have a contract with the telling company City of Carolinas come with Graham record City of Lucio have a contract to with them. Yeah, so you have to have a contract with them to tell them where the call is It's most open. We have the city of Losville. The. The very record that would be very convenient. You don't want to know they may have a Louisville happy with a singer. Oh, I just have you in Losville. We'll let you piggyback on top of there. I think that's where you know for Beth and you have places to check out and do an interlocal with them or something. Well, that way I proved that concept and it will work out absolutely. A remedy the next step. It's part of the language on the sign. It's, it's meaning the commissioners court shall erect an appropriately worded sign at the place to inform a driver of a vehicle of the restrictions or prohibitions, so But it doesn't give the driver the remedy to find the vehicle So as far as working out the language on the sign That comes under appropriately word appropriately worded is That comes under appropriately word appropriately worded is Gonna be what this court decides it is best and in Danny Bromley can get with city of loose film See if we can't piggyback on that contract and hopefully we don't have to use it a whole lot We have a move to approve it motion by commissioner commons seconded by commissioner Mitchell further discussion questions Senator Coleman, seconded by Commissioner Mitchell.
