Good morning ladies and gentlemen. Denton County Commissioner's Court for Tuesday, August 8th is now in session. This morning our invocation and our pledges will be led by Don Phillips, he's assistant county service officer will you please stand if you're able. Let us pray. Lord, we have meeting today to conduct matters of business. Guide our hearts and our minds in the spirit of fairness, right thought and speech. our minds in the spirit of fairness, right thought and speech, in part, just a premium wisdom upon our activities so that our affairs may reach a successful conclusion. Thank you for being our source of guidance today. Amen. I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. Honor the Texas flag. I pledge allegiance to the Texas one state, under God, one, and indivisible. It's too bad I didn't have a camera from this angle. Would have been disrespectful I think but the view out there was fantastic. All of you standing in solidarity and that was beautiful sight. Well good morning. Welcome to everyone. Item one is for public input for items not listed on the agenda. If there's any member of the public that would like to address Commissioner's Court, we ask that you please complete a public comment form. They're available on the side table. Want to remind everyone to please turn off cell phones, pages, any electronic device that might be disruptive. We have one public comment formed this morning's for Mr. Willie Hutsmith. Good morning, Mr. Hutsmith. You had three minutes, sir. Fox, so good I can stay on time because my teacher taught me in debate at the University of North Texas. We need to have a beginning, a body, a middle, and a end. I didn't get to do my end last time. My name is Willie Hutchworth. I live at 623 Newton. I noticed when I mentioned salaries to a person up there, you all reacted. Some verbally, I don't know how to say anything, but I mentioned salaries and I thought that the people your employees should get more money. I said that your priorities should be, this is my thought. County, the voting public, secondly, the employees. And I begin to say, and I don't know this for a fact. That's the thing I want to make sure that everyone knows, because you know I don't know what the budget entails. I don't know any of that, but what I thought was, you ought to take care of your employees. You should do something to make sure that the health cost is at a point in which they can reasonably take care and you should make sure that they get something. I mean anything as far as an increase You say you're getting 5% Okay, how about throwing in something else into that to make them feel good? I think your employees should feel good about their employee here. I have to do that with my people and I think that's just a good thing. That's just my thoughts. Now, to other business, the Confederate monument, I've asked you for years now, it's over 20, I think, since 2000, not 20, about 17. I said, first I started out with remove it. It's offensive to me. I would like for you to remove it. Then I went to no, maybe it's not. Why don't you add some more history out there since it's a historical site? Then I said, turn the water back on. You know, there was a time when only one race could drink from those fountains. And I'm seeing turning on everybody could drink from it. To this day you've done none of that. You have compromised, you haven't done anything. I think government working together for the people should at least entertain the compromise, put some other history on the square. Then one of the people who came by as I was demonstrating said to me, why don't you get if the commissioners and the judge thinks it's not a bad idea to have that Confederate monument there, offer the time for them to come and take a picture with you under it, or picture by themselves under it, so that it can be photographed with them. And then let you use that photograph to say, this is what your county government believes is the right thing to do for our county. Thank you. for our county. Thank you. Let's go first to item 3a which is approval of proclaiming Denton County a purple heart county. You have a special guest with us this morning. We have John Lunkhurst who's the military of purple heart commander. If you would come on up to the microphone please. I'm going to read the resolution and then we'll call the user. Thank you for being here this morning. This is a proclamation whereas the people of the county of Denton have great admiration and the utmost gratitude for all the men and women who have selfishly served their country in this community in the armed forces. Whereas the Purple Heart is the oldest military decoration in present use and was initially created as the badge of military merit by George Washington in 1782. And whereas the Purple Heart was the first American Service Award or decoration made available to the common soldier, and is specifically awarded to members of the United States Armed Forces who have been rooted or paid the ultimate sacrifice in combat with a declared enemy of the United States of America. And whereas the contributions and sacrifices of the men and women from Dentland County, Texas, who served in the armed forces have been vital in maintaining the freedoms and way of life enjoyed by our citizens. And whereas many men and women in uniform have given their lives while serving the armed forces. And whereas many citizens of our community have earned the Purple Heart Medal as a result of being wounded while engaged in combat with an enemy force construed as a singularly, maritalist act of essential service. Now therefore be it resolved that the Denton County Commission's Court hereby proclaims Denton County, Texas as a purple heart county for honoring the service and sacrifice of our nation's men and women in uniform wounded or killed by the enemy while serving to protect the freedoms enjoyed by all Americans. Done an open court this eighth day of August 2017 by motion by myself. Seconded by Commissioner Eidz, Allen favor, please say aye. Aye. Aye, pose aye, nay. Motion does carry unanimously. All right. You're none on favor please say aye. Aye. Opposed to the name. Motion carries. 8 a.m. is approval of medical plan changes for plan year 2018. What's calling the staff? The George Commission is from morning. Before you, you have the changes that we are presenting for fiscal year 2018. I'm going to go one by one so it would be easier to follow. I'm in the PPO plan as as you all know, we have a virtual visit, a copy right now. It's a $25 copy, where we are asking the court to reduce it to a $0 copy. That is a benefit for all the employees who have minor, serious conditions to make the visual electronic interaction with the doctors at CiroCos. That is something we already have in place. Now we are just charging $25. We are asking you to remove that copy. With the preventive care medication, there are several prescriptions that we are asking the court again to reduce the copay to a single copay. These prescriptions that are listed here maintain of these prescriptions to reduce the cholesterol level. So that is a benefit for somebody who sees on maintenance medication effective January 2000 and change that we will have to pay any copies. We are also announcing that the benefit plan is going to start covering 3D mammograms with a $0.00 copy. The next one is to approve to cover PCODNA testing, which basically will replace the screening through a colonoscopy. The doctor considers that it will be okay for you to have this DNA test and will eliminate the need to have the colonoscopy. Again, this will be covered as a preventive care. Zero copy 80 and 40. On both plans, H is a high deductible plan and the 50 of plan. Regarding the high deductible plan, the IRS approved to increase the HSA contributions. We will go for single coverage from 3400 to 3450. Family coverage will go from 6750 to 6900. Then we have the catch up contribution of $1,000 for anyone which is five years of age and all that. The next one is the maximum out of packet protection program. Basically what this means is we have a specialty drug. Whoever is on a specialty drug is familiar with Acreo. Acreo is the company that manages this type of prescription. What happens is some of the pharmacy companies assist the employees assist the patient with a copay assistance. But we are asking the court is that this copy assistance is not going to go towards the maximum amount of packet. In other words, we are asking that the employee, the only thing that we go to the maximum amount of packet would be what the expense, the employee, the member actually has to pay. Now they know whatever the pharmacy pharmaceutical company is paying for them. It's just what the employee actually, the actual out of packet from the patient. Okay. Nadi Dale, Repel, what we are asking is if a patient has maintenance medication, rather than using the main order prescription, they can go to the pharmacy and get the 90-day supply at the pharmacy, rather than going through the main order prescription. The copy will be the same, nothing will be different. Then we have the next one is the cholesterol care program that is a PCSK9 injectable and basically the doctor thinks that you can use that. It will be approved by the doctor and it will go to a creed as well. to agree the last one. The last one, well, the one before the last one is basically if you are prescribed to have a specialty drug, you will have to go through a career to do it. There is not going to be more of the courtesy field. In other words, sometimes employees will go to the pharmacy and say, I need this prescription today. Well, and they will give them a cortacy refill. They are going to eliminate that now we have to go to a credo. It's not going to mean that the employees not going to get the medication, which is means that it's not another year course this is a perfect year. Last but not least, this is just to confirm that employees who choose to use a non-EPAM pharmacy will pay the $10 penalty, which will no longer work at a packet of funds. With that, that's the only changes we have for the benefit plans for nature. I don't know, you have any questions? Members, do we have questions? I think we did a good job of increasing percentage wise, the employee was contribution from what 16 to 14%. We're carrying a much larger load and you've got to have the employees contribute but they're paying a smaller percentage, which I think is positive. Need the premiums are rising. Okay, we need a motion for approval. I move for approval. Second. We have a motion for approval by Commissioner Coleman, seconded by Commissioner Marchand, I get further questions or comments. Here none all in favor, please say aye. Aye, pose aye. Nguyen. Motion does carry. 8B is approval. Part time employee, medical premiums, covert premiums, dental and vision premiums for employees and retirees, as well as vendor rates for our plan year 2018. Two weeks ago, I'm sorry, I provide the call with this summary of the full-time rates. The call approved these rates two weeks ago, but I just wanted to have it as a reference. So we can talk about the part time rates. Basically, the part time rates are half of what the full time employees pay. Right now, we have five part time employees that take our insurance plan. So we are asking the court to continue with the same premium share that we have currently which is 50-50. Employees for pay 50%, the county pays 50%. We are also asking the court to approve the court at rates. Basically the former employees paid the full percentage plus 2% administrative cost. We are doing the same thing we have done in three years. The downtown division rates, those are paid 100% by the employee, there is no increase on the vision of dental rates for premiums for this year. So we are asking the court to approve. The only vendor rate that is changing for next year is the stop loss carrier. The premium went from $38.97 to $40.92. It's an increase of $1.95. We are asking the court to approve those rights as presented. Thank you. Are there questions from May we support it? Do we have a motion? Shall we? Motion by Commissioner Marchant. Second. Second by Commissioner Coleman here. No questions? All in favor, please say aye. Aye. Posts a name. Motion is carried. In 8c is the proof of employer seed money to employees enrolled in high deductible health plan, paired with a health savings account for Plain year 2018. With this item, we are asking the court to continue the seed money of $500 for employee only and a thousand dollars for employee or family for those employees who are participating in the high-grade of the whole plan. We have a motion by Commissioner Eads. Chair will second the motion. This is all incorporated in the budget too, should be noted. Any questions or comments? Hearing none all in favor, please say aye. Aye. Opposed, aye. Any? Opposed, aye. Motion does carry. And 8D is approval of the retiree medical insurance premiums for a plan year 2018. In this item, we are asking the court to approve the premiums as presented. I want to make an emphasis on the fact that the rates that we are presented for senior supplement plants, they include the ACA insurance fees. At this time, we don't know the federal government is going to remove that fee or not, but I would think that if we approve the highest rate and if the federal government reduces that fee, we can come back to the court and ask for the new approval or we can use directly charged below a rate. charge in all of the rates. Do they have a question? Questions? Did I miss the employee plus spouse, Medicare plus Medicare spouse? I see none Medicare spouse over 6.65. But I don't see a retiree plus Medicare spouse. On page three or four? I've got three or five. But I keep seeing none Medicare spouts. Those are for Medicare. The first section is the retiree age 65 and over it. Uh-huh. retiree spouts. With Medicare eligible, then you have the next session is retirees 65 and over retirees under age 65, American, and with the family. The first section you have PMA is a senior supplement, but then everybody is very small. You have the retiree only retiree espouse. The next one is the PSS which is the pure senior supplement plant which includes retiree and retiree and espouse. So is that the one you're looking for? I was looking for retiree and espouse Medicare. That would be. We don't charge Medicare that we only are asking for the senior supplement. Okay. The Medicare rates are said by Medicare which we've done. Okay. Well, we don't get to set that. Right. For the questions or comments. So. What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What is the retiree? What in the retiree increase in their medical premiums, but we didn't give them a raise. So kind of an essence that they were depending on that. That's a pay cut. We didn't, we do not tend to increase the color for retirees, which is the race, because we would have a big impact on the financial numbers. I think we did it for a few years, but we did it last year, but I think in 2009 we did it like four years in a row and it gave us a really big impact. I think the financials will be affected, the pay increases drastically. So we are trying to do it like maybe every three, two, three years. To do a cola or a colo. For the retirees. I just saw a couple of them just doing the math. It was between, I just got in my mind average 15% for somewhere like 11%% for the retirees depending on whether it's the under 65 retirees or the others. I just brought that up because I anticipate some phone call. Oh no, I'm not retiring. But no, I mean I know. But, no, I mean, I know. Why are you looking over here, Hugh? No, I'm just, I've known, I have a lot of friends who, you know, I've known since I was working with the Sheriff's Department and stuff, and they all got my cell phone number. And I don't want it in particular, you used to work for me, who was the director of planning, who's probably going to call me. Oh, okay. It's very insurance, especially for under 65. It's very expensive. That is why a few years back we created the tier. So the county will take on more of the percentage of the insurance premium. But yeah. That's going to be tough for Bobby since she was a commissioner since she was like 12 Senior supplement plans Even though they have increased I mean those rates are it is my belief that those rates that Pretty good beyond 40 times But I agree the the the the insurance for the tire is 165 is very expensive. I just said that. I just looked at the percentage increase. I didn't know how it was going to match up. It's basically an 80, would you say an 81 dollar increase for the non-65 retirees and then that was roughly 15 and some of the other ones figure a lot smaller and some of the other ones are bigger but I just thought we need to be well informed consumers before we make those decisions knowing that some people will probably be happy with us, some people will probably not. You know, I think we've done it. Despite what Mr. Hutzpiz says, I think we've done very well for our current employees. Yes. And I'm still looking for the slush fund that we've been looking for. We've been looking for that money tree for a while. I would like to, we had four. Yeah, he said we had four of them. I'd like him to point them out. I'd give it to Polster, so we don't have to give him any more bond money. Frankly. But I'm paying for 2180, you know, you know, I just, it's tough to take care of everybody. Yep. In one budget year, I just was, as good as- Well, not knowing what's going to happen in Washington too, it may as made PBC decisions if the cult. And, well, it's tough to take care of the way they want to be taken care of. I think we're taking care of them. It's just not their quality. The Atari benefits is a it's one of the things I sell. The fellows who come work for us. They run bridge and some of the people I know who work at the bottom line jobs at the jail. And if they're going to invest that kind of time in working for us, you only want to take care of them after they work for us in my opinion. We have any more questions or comments concerning retiree medical insurance premiums or do we have a motion? Careful. Motion for approval by Commissioner Mitchell. I just want to make sure if for what reason the federal government decides not to charge this fee, do you want me to bring the new rates to you or we are okay with approving these and they don't include the fee. We can adjust if we need to or can. So these include the fee or they don't include the fee? Includes the fee. This is the worst case scenario. Right. Every move the fee that rates will be lower. Would you want to see that again? Please. Yes sir. Okay. We have a motion in a second with the additional instruction to bestow it or bring it back to us. Should there be a change that we can adapt to? Any further discussion on favor, please say aye. Aye. Opposed, Cine? Motion is carried. 12a is approval of the third amendment to the Master Service Agreement between Denton County and Securus Technologies. I move for approval. Motion by Commissioner Coleman. Seconded by Commissioner Marchin. Any questions? Hearing none all in favor, please say aye. I, policy and aim. Motion is carried. 12B is approval of updated law enforcement agency application for participation in the Dantle County Sheriff's Office and the Department of Defense Law and enforcement support office program. I'm moved for approval. Motion by Commissioner Coleman, seconded by Commissioner Mitchell. All in favor, please say aye. Aye, post- aye. Aye. Post and a motion does carry 13 a is approval of legislative policy statements and or resolutions and discussion or approval of other matters relating to the first special session. The 85th legislative session, hopefully there won't be a second, but the time will tell on that. Members, the resolution I have today or the policy statement is, Denton County supports House Joint Resolution 31, a Constitution on Amendment to restrict the power of the legislature to mandate requirements on a municipality. Well, actually it says the municipality are county, but it's not really to restrict their power to mandate it. It's to yeah, unfunded mandates. How joint resolution would prohibit unfunded mandates on counties and is identical to how joint resolution 73 by Dwayne Burns Johnson County. That was passed overwhelmingly during the regular session. Specifically, the legislation would amend the Texas Constitution to provide that a law enacted by the legislature on or after January 1, 2018 that requires a city to establish, expand or modify a duty or activity that requires expenditure of funds is not effective until the legislature appropriates funds for the payment or reimbursement of a cost and incurred for complying with the requirement. In other words, they're against unfunded mandates. That's my motion. Thank you, we have a second. We'll change that wording at the very beginning to put unfunded mandates. All in favor, please say aye. Aye. I pose in a motion to this carry. That's the only one I have. And I talked to both tech social and association of counties and urban counties and basically told them that if I contacted my legislators anymore concerning revenue caps, they would charge me the harassment. So I think they're well aware of our position on the issues. And the counties and cities have grown up to be down if they legislate on tomorrow to show opposition to the tax bill. So that's the one I've got for you today on 13A. 13B is the approval of the use of excess funds from the Southwest Courthouse Construction Budget 2015 tax notes. This is auditor number 7275-319060 for the purpose of purchasing additional items needed for the security guard station at the Southwest Courthouse. Motion by Commissioner Eads, seconded by Commissioner Mitchell, questions or comments. Hearing none, no in favor, please say aye. Aye, post, aye. Motion does carry. 14A is approval of additional right away funds and conjunction with the local project advance funding agreements between the state of Texas acting through the Texas Department of Transportation in Denton County for FM 2181 FM 423 North and FM 423 South projects with Denton County agreeing to contribute an additional amount, excuse me, $644,318 of funds in the amount of $126,000, and $10.94 to be transferred from FM720 North-Waddening, TRIPO8 2014 PI bonds. I'm not going to read all the auditor numbers. This goes to FM721 and 81. And then to be, I'm sorry, 195,725 dollars and 32 cents to be transferred from FM 720 North, widening, triple, 82014, pay I bonds to the 2181 project. And 321,671 dollars1.74 to be transferred from FM 544-TRIBLO 82013 PI bond funds to FM 423. Questions or comments? Do we have a motion? Also moved. Motion by Commissioner Coleman, seconded by Commissioner Eads. Hearing the questions, all in favor, please say aye. Aye, pose, aye. Motion is carried. 14b is approval of termination of interlocal cooperation agreement between Denver County, Texas, and the town of Providence, Village, Texas. Group pairs to the fish trap road. Commissioner Fist is one. Motion by Commissioner Coleman. Seconded by Commissioner Marche. Any questions? No, no, in favor, please say aye. Aye, pose aye. Motion does carry 14c is approval of a dendom number nine to the Master's Service Agreement between Devin County, Texas and Alliance Geotechnical Group incorporated to provide geotechnical engineering and construction materials testing services on the Bill Cook Road Construction Project with the in the amount of $1885 to come from the Road and Ridge Engineering Survey's titles and testing. This is auditor number 205-395-850. Motion by Commissioner Eads. Seconded by Commissioner Mitchell. Hearing no questions, all in favor, please say aye. Aye. Posed nay. Motion is carried namously. I'd like to point out under future meetings that we made a little switcher rule here on the public hearing. The one on August 22nd will be at 10 a.m. right here. And the one on August 29th will be at 7 p.m. in this room. And then the public hearing on the proposed budget, the adoption of the budget and the adoption of the tax rate will be September 5th at 7 p.m. And with that, we've concluded our business. We're adjourned. Everybody have a great day. Hey. Everybody have a great day.
