Item B, Mr. Evans, text amendments to the zoning's related to all premises directional signs. This is Mr. Mayor, members of Councilor Biddy. And this is a public hearing. I should open the public hearing list. Thank you. It's a good question. I'm sorry. Thank you. You know, in this case is two deals, an exactly way LLC represented by Mr. Tupis-Metal. You request specifically as to an article 500 of the zoning movements relating to sign regulations, specifically relating to off-term misdirectional signs signs allowing these to be eliminated. That is the reverse note of the gap. And that's how the off-spaces applied to the D1B and the D1C are to the five-ended mid-sphere. Specifically, the African-As-Requested Amendments to that section of the D1A, this address is off to these direction signs, which is defined by the zoning that has a sign which may advertise a message providing directions to an establishment or a stylish move, not located on the premises where the sign is located. So just for a point of illustration, let's clarify what's being referred to as an off-premise directional sonic. You see the first example here we have is the established name of it. That would be the only type of message of how it's in sort of advertising such as what you see in this second example, which has the establishment name that has a mention of their specialties and we're any other sort of advertising message. That would be considered an off-crimsonous advertising building. That's not part of the request. Also, off-crimson-directional real estate signers, the word chirps sign would the country considered part of this. The movement permits off-premise directional signs, located in industrial-dominant districts, specifically I-1, I-2, and I-3, and some commercial zoning districts, B-1, B-2, and B-3, as it doesn't permit these in residential districts. And the signs are only permitted under certain conditions and circumstances, which I want to detail in just a moment, and those are found in their 12 logical platforms. And the after-gets request and I have required all situations in which off-premise directional signs are permitted rather than for a specific range use or a specific location. And specifically the application acquires us to a men's table 500 dashboards to allow off-premises directional signs to be eliminated. I'm eliminated and to add a provision to their 12th of the next to take a 500, stating that signs may be eliminated. That's the section that gives the requirements for opportunities and directional signs. And the staff has worked with the applicants who have played us in working through the some of the concerns that first brought with this in mind. And in doing so, we just proposed a modified version of the request. I feel much more narrowly addressed to some of the issues highlighted by the faculty. I'll get to that in a moment. To start off with, we just want to very, very briefly go through one of our requirements are, we're losing at these off-premise directional signs. The open and allow-sword is only administrative to issue a permit for a single off-premise directional sign provided there's no other directional of sign in the locate round the law. So only one of these signs would be from a permanent zoning law. And then the principal use, if it's located in OASIX, B1, B2, B3, or industrial district, and that would be for the actual establishment, the sign is directly tracking two rather than where the sign is located. The establishment of located-winged districts, if it does not have frontage on a major minor thoroughfare, the Shalom-on-thee thoroughfare plan, or has friend-general-only one direction of a one-legged street. So these are the conditions in which an optimal directional sinus is to be affected. For example, if you had a business located on a local side street up to maybe major minor third-fair. As far as the size of the signs, up to 16 feet is permitted for signs for one establishment and up to 48 square feet is permitted for three or more establishments. And if the off-grid's directional signs are for multiple establishments, the signs must be unified design. So we're clearly allowing a direct brief. Yes, sir. Yes, sir. The off-grid's signs don't allow any advertising messages, I just mentioned that they're not committed to their residential districts and they're not committed to cyclists trying where they will be locked in visibility or cyclists. And if you have two establishments there, just have a look. We usually only have one sign. When two establishments only the subsection be there, it would allow up to 32 squared feet, because it would be for 16 feet per establishment. But it would have to be a unified design, in the words that you would have to make sure the design was compatible with the existing design. The off-premise directional signs that make sure only allow one per zone to lock, where the signs are permitted, and the four-jury permission of the property allers required for the signs to be read in the arrest issue of zoning premier. What the applicant is requesting is simply to add a statement onto the occupational science section that those sounds may be eliminated. And that wouldn't change any of the other current requirements that are in the world itself. But it cannot be flashing, right? No, sir. That would not be permitted. You know, I'm going to say from the interior elimination, not external spot lock, right? Paul, what is it? Yes, I guess it will. Mr. Mayor, that's what we've been working with the application concerning. And that's what the application would be, as far as internal variation. as far as internal elimination. And so what the applicant is asking for is the statement that the signs may be eliminated and then in the corresponding section of the sign table, instead of saying that the sign may not be wired to be the applicant is requesting that the sign, the sign is being allowed to be able to make it. And I think to answer that question to staff, that's one of the issues that the staff in Oregon with the applicant felt like we needed to be more specific about. So what the staff's recommendation would be, in terms of just the lighting for our permission of science, we would also propose these to be allowed in TH districts or which is for the hospitalality districts, if we had a rezoning locations that they would be permitted there. And then under the invited section, in general, we would still say that signs do not be allowed to be lit, but we would include one exception. And that would be for signs located along US 64 and 49 if properties have direct friendly junk that poor, just because of the nature that poor are being fairly neat in terms of design and in terms of how other sections of the sign movements have addressed signage along that core. So in terms of what status proposing, the only other clarifying when we propose is clarifying that the principal use that is located in overnight over night districts, Mark and Phil were tourism-positual districts, just to clarify where the actual established and their use is going to be going there. To match our current commercial zone districts, we were not changing any of the other portions of the ordinance that I reviewed at the moment. In terms of what staff imposed based on how we're 64-4-0, or a Dixie Drive based on traffic patterns and volumes of the designs to multiple travel lanes of the wings in the nature of the core catering to three traffic as identified by NCB or T as a state watch or TG-4 or serving as an alternative to operating item five between Rally and Charlotte. The prohibition of sign elimination applies to external elimination when evaluating off-premise directional signs located on properties with direct furnished home US, 964, or even east of US 240 bypass, and zones, nor is the properties where the signs would be permitted to be eliminated would be, have to be zoned, be to general B2 general commercial and TX tourism off the valley. And only operand's directional signs meaning this narrow exception may be internally illicit. So we would still prohibit any external elimination for all operand's and signs as far as our recommendation. So it knows not right to an external source of light, but the lighting will have to be within the actual sawing, it's like cabinet. And because of the nature of 64-indexy drive, catering to your free traffic and the road design and road speed, and working with the applicant as a safety precaution for type of businesses that are not going to at nine. To be filled with that will be the area to really narrow that down by the end. So based on that analysis. Staff's recommendation would be to approve that modified version of the request. With the statement that there are certain circumstances in which elimination of signs can improve way by the mean of measures, particularly in districts that K-Earth Edwards and the Military and Public, such as the B-2 General Commercial, District and the Tories and the Commission, such as the TH-4's Hospitality District, and the staff of the Hunges is further narrowing the locations in which operas, directional signs may be eliminated to a T-Z commercial district, some NICC drive, be it a traffic patterns, and the predominance of three traffic zones quarter compared to other major quarters. And furthermore, these amendments will not result in increased allowance in the number of high or area sites. Yes, sir. Back up, two slides, right there. high or area science. Yes sir. Back up two slides right there. And near the latter part of that, it says properties are with direct frontage on US hours 64. Now this hotel we're talking about is not direct, direct, fronting on 64 is all right. Yeah, you think that's what it is? direct direct the front end on six towards our right yeah it does yeah we tell that to him we tell him no there's sweets but the sign is going to be at the end so a bit of directory and the director is going to clean the be on the 64 loft. Okay. But can that be the same if you look at it like across the street where the sawyer's place is? That's not on 64 either. I mean, they could put a sign over there at the road. Or something. I'm just thinking of these reds that are off to the side, saying direction to share here and here. In that particular case, Broward Chapel Road would be a minor thoroughfager. And in some of the other intersections, such as Cliff Road, Zook Parkway, Cox Street, Parkway, Cox Street, Park Street. Those would all be you major or minor there. And off-premise directional sign would not be permitted at those locations. And wouldn't it be browners? That's correct because for a business that's located on Browse Chapelade, if the establishment that the directory sign is directing traffic to, if that has for an adjone a major minor thoroughfare, then they would not have the opportunity to have an operating directional sign. And I'm missing something. How about the, where these, the sweeps are? Is that going to be the Hampton and then the sweeps that are back in there? Is that gonna be everything? I'm gonna have to play that on the stadium street. Right, that's a stadium street. So what's the difference? You're on the big street, you can't have no sign of it. You're on the little street to give a sign of it. Yes, you're that, exactly. I ain't that what you said. That's the concept. It's only the businesses that don't have friends on a major or minor third. I don't know whether I draw that same distinction, but that's what I hear you say. Yes, yes, and that's actually under the current requirements that businesses that don't have friends on a major minor third. I'm going to say I like that, mate. What am I supposed to do? Right. If there's not any other directional sign there on the libel and DC driver 42, then it's very possible they could have a sign. Well, they need it to us. They can add to it. I'm assuming they reach some agreement about the directory. So they can have it at 64 and 42, they don't have to be on this 42's on my computer. It had to be on 64, because they can't put one on 42. So it's one on 42. It is an applicant driven process so we took the application and worked. But we're in our general orders. I'm arguing that. I think the staff worked pretty hard to draw, to try to achieve, try to draw a pretty narrow, narrow, to find amendment based on previous. Why does paintfully obvious? Previous character. I'm so direct. I think they're by my age and youth. I think we have, it's just that same case that we keep pointing out is we keep changing our staff that we've just finished maybe not long ago. We keep changing stuff. Whole thing. Well, I like this for quite a bit. I think the existing rules we have, especially in this narrow area, and I think perhaps even in the broader areas, way, way too strict, you know what I mean, it's like we're scared for somebody to find us. You know, I'm from the area, but when I go to this place with that, the old sign I start for the hotel, it tells me where to turn it down to service, so it's very, very helpful. I mean, or not to be eager. I mean, or not be, I mean, I'm not, yeah. Sound a little light. Traffic down a little bit. This player's maybe, like, on things happening. And I'm confident that with the quality of the institutions that will be served by these directional signs, I'm confident that the quality of the sign will be good as well. There is one archival number of refrigerators on the property and properties of the consistent approximately two to four acres. The existing land use includes industrial bank structure. It's a picture that I have a moment. Looking at an area view property, I can see there There is an existing industrial structure that came from the property. And property is fairly limited, round of it. It is, you'll see here, we'll, the existing manufacturing structure that's currently vacant. This would be looking north along North Ashford School Road. Here you see the subject property would be to the left. This would be looking south along North Ashford School Road, head toward the schools and you see them in their residential areas, area. And then this would be looking west along the Spera Road, if you're just north of the property, looking toward the Air State or P.J. Interstate and the Spera Road, the people use five-packs air change. And finally, this would be looking at East along Sphera Road, from the North Asheville School Road, and some property would be just over in this area. This property is located outside the city limits. The city water and sewer is not currently available. North Asheville School Road is a state-maintained road. There is, as you saw, an industrial structure currently on the property. And areas characterized by individual property, residential de-use, and schools. And as you saw, the property is located 375 feet east of the 220 bypass, which places that property. It is just beyond the distance that would require, I'm reviewing within the 220 overlay, measured out just a little bit further away from where that will be required. The putters that Lane Use Map designates the property as an employment center and the blended all the claim described as the intent of the employment center as integrating a mixture of commercial, office, and institutional, industrial, and open space uses into the fabric of the community with ample sidewalks, street trees, all street park and public communities and the public streets. The Red Development Play Grish had, you're not visiting it's the property of Greenland economic development. The straws of the LVP as areas with prime access to a major furrifier, and or highway interchange with a high potential for economic development expansion and a suitable economic development sites within the DA should begin at a high level of encouragement and the cinemas is provided in policy 1.23. And the request is to resolve the property to I2 general industrial. So it's for a straight rezoning and many sites specific user conditions will be considered with this particular request. The property is located also within the watershed balance area and not one limit the coverage of impervious surfaces such as buildings and parking of any redevelopment to 12% of the properties area and the coverage of additional permeate surfaces beyond that 12% man will recur what the special use could have. This one's one out of the 12% coverage for only applying any lead development for the parking or structures that are currently located on the side. We can looking at the land development planer and innovations. The great strategy map shows is being in the economic development area and the proposed land use map shows that it's designated as a proposed pool in it. And also looking at the land development, playing those in policies for guidance. There are several goals of policies that intended support for us. Only one specifically being in the watershed area policies that intended to support the request, only one specifically being the watershed area that would tend to be negative toward the request. And overall, the staff's recommendation on this request was to approve this with the following reason, that the property is designated by the winded up plan proposed land use map and the Northeast small area plan as part of the employment center and the LDP plan tool yet incorporates industrial uses into the employment center which is being the industrial request. Some of them wanted the desegging the property within an employment center is the properties proximity to the US-220 and future, out 73 out 74, where as the intersects with Sierra Reddy, which is also a major third-fair. And additionally, the historic use of the property since its development has been for industrial purchases and considering all these factors that believes that the rezoning is within the public interest in supporting a reasonably use of the property. And after his passing, he sold the military and they were operating the time we bought our property and to me it's been industrial. It's a, they were good neighbors then. At the time we knew they were learning three shifts out of day, the week I sure wish they were doing it again because the Lincoln people, we need some graduate work in this community as far as I'm concerned, it was always industrial and it should be industrial. And it's something that we deal with and we do it. We really would love to let her have. It's just a matter. We would still be able to serve the evening. It's a sign that she would need to be served for parking dogs after hours of things of that nature. And they do have someone on the staff on call after hours in emergency situations, which we just had years, two weeks ago, for a pit bull. Our guys couldn't have. And we didn't have a civilian on staff with us now that does that during the daytime. But after daytime, they really really ran against staff. But we're just able to take it. And be quite honest, I think it'll be a wonderful fit to allow them to take it. And to be quite honest, I think it would be a wonderful fit to allow them to have it. They did take it from the county. I know you were a bad off sheriff, so they love it. They love it. It's a chance to come. Yes. Yeah, yeah. Anyway, how do we handle after hours now? How do we handle dangerous, vicious dog identification in that. Well, we have to kind of ask Herbert to think in that way. So we're already having some of the pretty marries with me. It's very, very good, Mary, but we could be a whole lot better situation in that. And we discussed in detail, before the hour half the other day, how we'll handle such situations better than we could think of. And if we're quite honest, the only issue that they work with, we have a human-situations where they have a warrant, so that we would be glad and circle for our films and the detailed investigation. We actually, so by filming the investigators, that would be like a fused amount of money. Somewhere on that animal, how do we review? We have a lot of accounts. We have a lot of accounts? We have a county head, Laura Hound, we have that main inside the city, is my name, Dr. Olson Carrot, who's much more. Occasionally a large snake. Remember the, after hours a week, our response to the large snake was to have a place off the shooting. Yeah. And this is a bullet constrictor in the dumpster because it bit the own and our guys weren't prepared but the crime and all of that was the snake didn't do anything and lost his life. The people that are better prepared to deal with that should be dealing with that. And I am very welcoming this proposal. I think the days coming where you guys are are gonna be out there looking for a lot in the middle of the night, or an ostrich or an emulor. You know, that happens. That happens. We are here for hire for our, I'll be honest with you. So back to the situation where the county asked us to come in and work with him in particular, a time of day, and I'll of the year. And the first time we went on was taking us to the course of the session we made. And it was up in the very heart of the county and difficult to call the shift. So we're here to prepare the courses that we're talking about. I welcome this very much. Maybe would you like to add any comments or information? We've made this offer to all the municipalities around the county, but pass it several years and it's on a per capita basis. The charge is just for the annual health services. You have, you now have the services of our shelter. It's not separately charged to municipalities. We operate the early shelter, public shelter in the county. And we're a place that you're considered. You are the largest municipality that brings animals to our shelter. About 500 in the last fiscal year that I can in which is a little less than 10% of what comes into the shelter. That's almost two a day. Yeah. Maybe think we were 220 days, it is two a day. I mean, 50 days, it's amazing. We were all, and there was that. I insist you're out of the certain nail when she has a difficult call. And we have an animal control officer, I'm called 247. And the back of, if you don't get that officer, as you get, our supervisor, like the sales were my sale. And we're good. So, you know, I know you're bad, but like many times you get horses. Right, we live in a horse in North Ashford last year to get to the shelters. It isn't a health department because it's a public health issue. Ray Bees is the basis. But when you take animal control, you take all of the pieces with it. And we've strived to, right now we're trying to see our way to building a new shelter where without burden what we have, and we've led the heavy on board and be able to provide the service fully. And we work very well with Chuck Wilson and his alt-sters and it looks like it's been a great I appreciate your offer. I think we will take that under the advisory. I just think it would be it's a great idea to have it under one entity instead of it being the county it was the city and nobody knew who to call and if they call we didn't have anybody that can come out blah blah blah and this would put it all in one spot and everybody would know. I know that will serve us after five o'clock is somewhat so embarrassing. So I mean not to point finger but you guys aren't set up to do that. So. I would, as I say, I welcome this and I would also ask you to, in moving forward, you know, trying to strengthen our exotic animal warden, and Randall County, and make that a model because I know you work real hard on that and we just need to make sure that we need to adopt some exotic animal ordinance for the city of Ashbur, that coincides with yours. If you come aboard with us the requirements that you adopt the Randolph County ordinance because we can enforce Ashbur City's ordinance in the city and the counties and the county. Our ordinance, I looked at yours and I think ours is more stringent and almost every year. I think your ordinance has a limit on how many animals are personally running and there is no limit in the county. So that's the thing that I call this is different. So how would we do like nuisance animals? We dress nuisance animals, I think, in our city code, right? Like typically we get the, you know, you get the dog going out. We still go out and investigate, but it doesn't have to be collected or taken out. So you would still respond to it, bark and dog, it two in the morning. Do we have some information for that? It's all we have. Hold it to the back. It's a right there. It's not taken by a little off. That's a drug you'd normally first. So that's a third time you have some information. We have a copy of a candidate that said he can work out there. There's a whole section on New Sense. There's a section on exotic animals that prohibited. In some ways, some are prohibited. Others are restricted to a balance and under a certain concept care. We do your dangerous job now. If you have one, I'm the person who declarates your jobs in the city of dangerous. And our appeals here, here are those cases of action for individuals. We're already pretty fond of it. And some of the things that this would put us is that if we were to merge, we actually have a use for animal patrol after another division. We actually have some. I have some of it. I've got an agenda prepared. I've got to work with. Absolutely. I've got an agenda prepared. I've got to do it. I just want to do it in my district and here in Wheatwood. I'm going to do it in a place called Wheatwood. We'd like to use this to be in the principal. This mayor I did have more concern about this in terms of the adopting of the county ordinance. You've made reference to it, maybe. There are some instances with respect to our illness. They're more restrictive than the county. And I'm afraid that if we go into it without addressing those concerns, the number of animals, certain large animals that are restricted or prohibited, they're not prohibited in the county. They might have an unintended consequence of having too many dogs, pigs, other large animals that catch. I just nod a dime against it, but I think we need to address their own subject. And those incidents where our world is more restricted is just something that would make it easier. How does this affect our leash law if you want? We have to work all that out, I think. Now, of course, technically, where lease law is running at large, they can be under psychological control. If you learn the dollar cash, the rest of you may have the money. There's a piece in here that talks about was strictly an animal. But the bottom line is a mature animal. And the property or some other signage. If it's a small piece of property, we ought to be able to see what animal can find it. And we ought to be able to see a famous bird. Maybe he's a tender, maybe something else. I can't. If it's a tiger. The visible fence is hard to see. It's the right. The first time you saw that, or you can see the barrier, that is the human call. And if it's working, then all of a sudden, they won't be able to see it. They won't be able to see it. If the property is over a certain size, we don't necessarily have to see their environment. But you can't, don't mind, their animal has to take a care of it. Are we almost to the point where we can address a countywide tethering? That's a shame. I'm going to say sorry. I think it's more than possible. Mary, we didn't encourage. Like so this was just a part to bring this to your attention. And if you would take counting as ordinance and take guys and look at it and feel free to call Chief Wilson or Director Cooper and ask them all the questions. Call me. Here I applaud this effort. I've lived through ever imaginable hogs, pots, win, win, my real property was in the county. All the home parks have a animal control ordinance, but the county does not. The next door neighbor's dog runs through there and all of a sudden I'm responsible for it. That was a with you know with the pick-mouse having that rules so but in the city I like that room again We don't have much of me by the hell we trapped 68 cats this week Took them over you that cats is our problem. They are prolific breeders You spell out Cat cats head over. Yeah That's the same animal belong to the owner. We don't care about kind of animal. We can't get away with a client. We can get about the climate of the community. Yeah, we can get about that. We have the effect there. Well, as far as we continue to look at this issue, I would request from staff that we have some indication of what the budgetary is back would be making this transition. Sure. Thank you. I'm sure it's a very appreciated. But how should I let us, where you have major concerns as far as there is a slight differentiation between the county ordinance and the city ordinance. There's a huge amount of specifically that we ask if you have the real interest in the paintings, something that might be more strict. Let us know that you'll be debating about a risk in the summer. I don't even know if you've decided for you because it's a court decision. We do think, don, Mayor, just the professionalism and the coverage is, and if we can work through any administrative hurdles, the three of us can't. The eight sides of the selected is being in general the Senate's seat and also they were selected because they are currently listed for sale and the four signs for sale and that's a lot. The next column is the ask the signs to be assigned from the listing over earlier. The column, the following column is the attack state. The next column is the area acres and to give you an idea of what size we need is to look at the North-East Rail Fire Station. It's currently on the 1.7-pacre log. Based on our preliminary design, it appears like the region that leads to the level acre. North-East Rail Fire Station The current zoning is listed for each one of these lots, all of them are V2 and subpolytes, which is V1, and a fire station would require, especially if the book gets based on the note below. Over the course of the next week or two, a couple of weeks as you have time to digest this, Chief and John are available to answer your questions, have your conversations. And we talked today, Mayor, Chief and I did. We worked on this for months and we understand all this and we just didn't want to just come to this council and say, look, we've made all these great ideas and you guys kind of need to go out there and see what's out there and think about what's available and what can and can't be. Having this map, you know, this proverbial picture is worth a thousand words. And there could be other properties, if I didn't. And when we start this process tonight, where I would have... We as a council, and this is what you know, I talked about, we as a council need to know be comfortable with the decision we make for the 2025, 30 year life of this station. And while they're probably giving us their best examples. And one of the things that they pointed out in this radio piece was that their problems began about 100 years ago when the industrial people left that area to go south and the tax base gradually has declined for years and years and years and was replaced by low income residents and so at this point the city has declared bankruptcy and that brings in the question all kinds of concerns about providing services so once again I'm tremendously impressed with the quality of the staff and that they do keep us in line and financially so, I had to miss the last month's City Council meeting. I was attending the State Board of Community College meeting and I will share with you that at that meeting. I was elected as the vice chair of that State Board of Community Colleges. So that was a rather important meeting for me. I did not want to miss that. So I thank you for your indulgence to let me be away last month. Thank you. Congratulations.
