Members of the board, I appear before you now to hear any road or highway concerns that you may have so that I can bring them to the attention of the North Carolina Department of Transportation. I do want to ask the question in regards to that you get a call today from Mr. Jones pertaining to the Roams Chapel and four or three for as the four way stops. I did, Commissioner Branch, and I've got that. I was going to give you that during the announcements, but now it's a proper time to do that, so I'll bring it to your attention. The Northland Department of Transportation has advised that in an effort to foster better communication between DOT and the Board of Commissioners, our elected leaders and also the citizens that the two always stops that were scheduled to be installed at NC 403 in Roans Chapel and the other one at NC 403 and the Graham Road will be installed on March the 15th. So in case you get any questions, March 15th is the date that both of those intersections are scheduled to be installed with four way stops. Also I have a list here in an email of all of the plan full way stops for Dupland County. And I want to give those to the board members. So you'll have a complete list in case someone questions you about it. Of course, I think all of these have already been brought to your attention, but I just wanted to put it in your hand so you'll have a reference. And there's no chance of talking them out of the full way stops. No sir. And if you'll read the email here that's associated with the list from Mr. Gray who is the regional traffic engineer, he gives sites some reasons and some statistics that DOT uses to justify the insulation of the full way stops. But if you have any questions after reading this, I'm sure he would accept a phone call from you or an email. Or if you have questions that I can bring to their attention, I'd be glad to do so on your behalf. Or any member before. I just know there's been a lot of citizens that's not satisfied, at least with one one down towards the the winter area. I mean not teacher area. They wrote them. I've had several calls on that myself. Yes sir. One thing that I did asked and I can't answer it and I wish I think he probably made me become and talk to us one night. But you go to every surrounding county, take friends that's up and down 55 in Wayne County. I was even in Green County the other day and I saw something green in the north. And so how, what, why don't they go ahead and do that? I can't ask answer. I understand, I mean. Yes, sir. Other than just to answer you by saying, I did make an inquiry last year when they installed them at Bowden Road and Ward's Bridge Road at Sea of Outlaws. They told me that they had to have a whole years worth of data regarding accidents before they would make any determination as whether additional signage, additional lighting, or rumble strips were warranted. Well, that's not correct, because on Fee2Five, when they installed them, they were initially missed they went straight with the lights. Right and that is a different district. That's a different district so they may have they probably shouldn't have different. All of these because they're all DOT but I understand what you're saying and I have seen some four way interstations in other areas of the state that do have flashing lights warning you that you're approaching one. I mean, one of the arguments I would make was 55s of North Carolina highway. What they just did on 17th, that's a US highway. Right. So I mean that highway cures a larger designation than a state highway. Right. Well, I would like to say that there has been some additional discussion about what you're saying. And Mr. Gray is currently looking into what it would take to go ahead and put additional notices out there, especially on the U.S. 117 in Bay Road. But it's like a lot of things. It just takes time before there's some feedback. But I've had that conversation with them. And to your point, Mr. Chair, in terms of being able to figure out a different way to achieve what's taking place with them, their minds are kind of set, but they're aware of the fact that it may not be in the best light of our citizens. But the number one goal was to make sure that they communicate, to make sure that we are aware and everyone that's in that link That's aware so that we can effectively communicate about the changes that's taking place. So it won't be a overnight switch around Okay, the Yes, sir, I hate to break it up again, but the sign on the 24-in to break it up again. Also, that list that we have is impossible to that might be circulated on the letter that other people could be in different other than in this early installation that might help these people minds as well. So I'm here to recommend to the Board of Commissioners, as we all conduct a hearing that we amend the following ordinances to subdivision ordinance, the Mobile Home Park Wardens and the Airport Land Development and High Extrace Laws. I said that right there. It's Airport Development and the Wardens. They've got a couple of them and land use and high Extrace Laws. Land use and high Extrace Laws and High Extrace Laws. Which currently they all have if somebody applies for a permit with planning and they're denied, it goes through process, currently their appeal or variance as it's known, and legal terms goes before the planning board. It is my recommendation due to the student government government best practices of the Canada's around us, the Canada manager of the Canada attorney myself and unanimously by the Air Court Commission, the Gennock Development Commission and the planning board, all the members that are recommending that y'all entertain the form and effort of adjustments to hear people's appeals. As I stated to those three boards, to me, it's not fair or ethical for the same person to turn you down to hear your appeal. So I think this would be fair in just for the citizens. So that is my recommendation, Mr. Chairman. Okay, unless somebody from the board is going to comment, I'm ready to open up for the public hearing. What would be any cons pertaining to what your question is? Probably the biggest con is finding five people want to serve on a very technical committee that's not going to be used very much. Most jurisdictions don't have a two or three variants here in the year. That's probably the biggest con. The second one is just an additional board but that's not labor intensive on the staff. That's four of that goes. It is an additional meaning whenever we do have a variance for the county attorney to be there representing the county because it is a quasi-judicial hearing. So the best way I could explain that is, it's like a jury of five people that county comes in that would be myself and the county attorney represent the county saying these are ordinances and this is why we believe they should be upheld. The plaintiff or the person asking for the variance would state their case as to why. They have to be the four findings of fact why they have to do before findings of fact and they have to also argue in the matter why they did not create a new hardship where they created a hardship why they want the variance. So that's the only common I can think of as finding five people, but I feel pretty confident in doing that. I've already spoke to a couple of people in the community, but it would be at the pleasure of this board, and certainly I'd be soliciting your eager health to find people that would represent our community across the county. So there's no con that is actually in violation of any type of ballroom. This is best practices. It is recommended by the Institute of Government. It is if you want, what everybody else is doing. We're just kind of shifting gears a little bit, making a fair for the citizens. And our bordering counties are in order with this process? Yes, sir. And it's just the fact finding that you've discovered as a lot of being in the role that this wasn't in play. Yes, sir. And there are certain procedures we have to follow today. And we've been, we've instituted those procedures for, we have somebody that actually did a verbal request today and we're getting the paperwork together to them for a variance. And there's certain procedures by law that don't count on state law, not our county law, it says you got to follow us and we're going to make sure we follow this, everybody have a fair shake. So as it stands now, the perception could be that everyone don't have a fair shake. I wouldn't say they don't have a fair shake, but make sure that everybody is represented. One of the things I think that we might have forgotten to do is to notify the surrounding land owners when somebody asks for an exception. Say Chairman Edwards asks for an exception and you all, the other four of you commissioners are contiguous land owners, we have to notify you because you have what's called standing, an objection to or in favor of the So if we put that effort in place, but may not secure five people How does that play in the process? I'll be back to you looking for more people, but I feel confident I can find five people out of 58,000 serve to you looking for more people but I feel confident I can find five people out of 58,000 serve. Mr. Wilson you know of anything? No and just to be clear the current system is in place with the planning board operating in this judicial capacity it is legal to do it that way but again it is not recommended by the school government and reason being the the quasi judicial component to it, there should be five independent people that are just hearing it for the very first time and have not been consulted with in anything along the way. Mr. Briss, do you have anything to add? I would agree. I just don't think it's fair to have the planning board render a decision and then you have to appeal their decision to the same body. They've already made a decision so you need an independent group who can look at the facts again and make a decision. Inspector Woodjacks, but yes sir. And if I understood correctly from the conversation that we had last meeting is for instance if we served as that body and someone called one of us just to share their complaint then we would have to remove ourselves from voting. That was one of the advantages of having a separate board versus the commissioner board because you really don't want to do anything to create people not feeling they can call the commissioner. Correct. And to go once that further Mr. Chairman just a clarification is, if you remove yourself because of the X Part A communication rule, which legally and ethically are required to do, your vote automatically counts against them. And the way the state law is set up, it's an 80% has to vote for them no matter what the quorum is, 80% of the sitting board. So if you have five members, four, we've got the vote for them. If one of you gets contacted, that automatically is a no. The other four have to unanimously agree with the person. So having a separate board, it also, I mean, as I've had some discussion, I mean, I think it protects y'all individually politically so that if somebody can't get upset, you got a separate board. He's appointed and they're hearing the evidence for the very first part of the time. This board would they be under the same circumstances as we would be as far as an individual reaching out to them and they would have to surrender. Yes sir. That was a leads to my question that I was going to ask. So we'll put this five-member boy to me and I don't know what the law states Mr. Wilson. Normally we post who is on our boards. I think it will be in the best interest of this board for it not to be post. Is that legal? No I think it's be in the best interest of this board for it not to be posted. Is that legal? No, I think it's got to be posted. I think I asked me legal. It has to be posted. We don't have to post phone number for them, right? Those communications should now go all to Mr. Rollins and the planning board, which will remain in place for Q&A advisory opinions, and then hopefully insulating the board adjustment to handle the quasi-judicial proponent independently. Mr. Davis, we had any such issues that such board would be required over the years that you do a call. The planning board in recent years has been granting a lot of variances and not turning down many if any Mr. Rollins and your record keep that you can find but I don't think we've been doing things the way they should be done as far as best practices and he's he's trying to institute best practice. So I am making requests. The Sheriff's Office has state drug restitution funds which they wish to purchase two Chevrolet Tahos at a cost of $38,869.78 each for a total of $77,739.56. These funds were acquired through proceeds from the unauthorized substance tax, which is an excise tax imposed on controlled substances such as marijuana and cocaine. Elicit spiritual liqueurs such as moonshine, mash, and elicit mixed beverages. State and local law enforcement agencies can generate revenue from their narcotics investigations if during the investigation a taxable quantity of drugs is discovered and the agency submits the appropriate referral to the North Carolina Department of Revenue, which our sheriff's office has. Thus, these vehicles are being purchased with non-general fund monies. The total amount of funds in the Sheriff's Office State Drug Restitution Fund is currently $257,462. The Tahoe's, as I said, are a little over 38,000, I believe Captain Brock's not here tonight, but I think we're paying around 42 to 43,000 for Dodge Durango's. You cannot get Dodge Chargers anymore. I heard the last price for F-150, you may know, but $45 to $48,000 to be on what you get on it. So I think these taos are at a decent price considering the climate we're in currently. I'm here tonight to request that we conduct the public hearing and it is for Project Freeze, ash to bear with us. As you see, at this point, a potential state incentive. So, company name will not be divulged. But what we're looking at is an existing industry in Dupland County, a leading supplier and grower across the nation is looking to expand, add 19 new jobs, approximately a $2 million investment and as the board knows a incentive from the state requires a match from the county and that's what we're here to discuss tonight. Okay I would like to open up for public area. Any comments from the public feel free to ask your questions. Mr. Scotty will truly ask them. Scotty, I think it would. For the record, if you could state the amount of the county match that you would be asking for. Yes, sir. The, uh, initially when we thought that this was coming about we were looking at a state incentive of approximately $130,000 and then upon them reviewing the paperwork had deemed the investment at $2 million to type of jobs that would be created they would be able to do $170,000 incentive. So the county match would be 5% and it's $8,500. Thank you. There's just no budget amendment is being requested. This is money that the County Economic Development Commission does have. And the Economic Development Commission does support the incentive. Public? Here in no request, I'm going to close the public area. Now come back to the board. And again, a $2 million investment, a much more to companies, much more than covered their portion. Even, I had an amount less than that we're talking about as far as the tax base created would be in excess of $14,000. The understand. Okay. At this time I would entertain a motion from the board. Kim Whipple some Careful for you tonight with regard to Additional opioid settlement funds that are on the table, proposed settlements that are before the board denied and before all the counties and local governments throughout the country that have participated in this, what we're... what I'm seeking is a board, a lot, adoption of a resolution of authorizing the county manager. That's one thing that is a little bit different than what we had in the packet. We had originally drafted it to authorize me to enter into those agreements, but Mr. Brinson's name is on version of the resolution list Mr. Brinson instead of me. So that's the motion that I'm asking for is for the board to approve a resolution authorizing Mr. Brinson to sign on to the latest round of opioid settlements and the associated agreement with the Attorney General's Office regarding distribution of those funds. Just a little bit of background on this because I know Mr. Edwards is new and may not be totally up the speed on this. So the suits in this matter were originally filed back in 2018, 2019, local governments, like I say both in North Carolina and across the country, suit the distributors and manufacturers of opioids in relation to the opioid crisis that we all confronted all across the country. There was previously a $26 billion settlement with Johnson Johnson Cardinal Health, AmeriSource and McKesson that was entered into back in 2021. We took part in that. Duke McHalley's portion of those funds was $2,465,617. We began receiving some of those funds last year. The payments are made on the schedule that runs through 2039. So it's a quite a long period that will be continuing to receive these funds and figure out plans as to how to best spend that money for prevention, treatment of, it's a pretty wide range of categories that we can spend the money on and we're going to talk with you guys more about that on Friday during the retreat. We're going to have the health department and some representatives from the Sheriff's Office to walk through some of those things. Kind of bring you guys up to speed on what the plan is on those funds but bringing you back to why I'm here tonight and that's there's a new round of settlements. This time the settlements last time they're 26 billion this time they're around 20 billion. These settlements are with CVS Walgreens, Wal-Mart, Tiva and Allergent. We have been in consultation the manager and I with the Attorney General's Office, the attorneys that represent us both at local or state and national levels and then also the North Carolina Association of County Commissioners and they all unanimously recommend that we proceed with entering into these agreements. So that's what's on the table right now is the settlement agreements with all five distributors and then the agreement that's got to be signed with the North Carolina Attorney General's Office, which controls the disbursement of funds, all the funds go to them, and then they are disperse to the counties pursuant to that agreement. If it pleases a commission, I can read the resolution on to the record. I'll defer to you all if you want me to get through that. Go to it. So the proposed resolution that is with the gout the guidance of all the parties I just named, the Attorney General's Office and the Office of the Association of County Commission has been drafted and Mr. Brinson tweaked it to make it unique to us. It reads, whereas the opioid overdose epidemic has taken the lives of more than 32,000 North Carolinians, 2003 to 2021, whereas the COVID-19 pandemic has compounded the opioid overdose crisis, increasing levels of drug misuse, addiction, and overdose death. And whereas the Centers for Disease Control and Prevention estimates the total economic burden of prescription opioid misuse alone in the United States is $78.5 billion per year, including the cost of health care, loss productivity, addiction treatment, and criminal justice involvement. And whereas certain counties and municipalities in North Carolina joined with thousands of local governments across the country to file lawsuits against opioid manufacturers, pharmaceutical distribution companies, and change drug stores to hold those companies accountable for their misconduct. And whereas settlements have now been reached in litigation against Walmart, Tiva, pharmaceutical industries, limited allergen finance, LLC, allergen limited, CVS health corporations, CVS pharmacy, Inc. and Walgreens Co. as well as their subsidiaries, affiliates, officers and directors named in the settlements, whereas representatives of local governments, the North Carolina Association of County Commissioners and the North Carolina Department of Justice have negotiated and prepared a supplemental agreement for additional funds to provide for the equitable distribution of the proceeds of the settlements and whereas by joining the settlements and approving the SAAF, the supplemental agreement for additional funds, the state and local governments maximize North Carolina share of opioid settlement funds to ensure the need to resources reach communities as quickly, effectively and directly as possible. Whereas it is advantageous to all North Carolinians for local governments, including Dukeland County and its residents to sign on to these settlements and SAAF and demonstrate solidarity and response to the opioid overdose crisis and to maximize the share of opioid settlement funds received both in this state and this county to help abate the harm whereas the SAAF directs substantial resources over multiple years to local governments on the front lines of the opioid overdose epidemic while ensuring that these resources are used in an effective way to address the crisis. Now therefore be it resolved that the Board of Commissioners of Dupland County hereby authorizes the county manager to execute all documents necessary to enter into opioid settlement agreements with Wal-Mart, Walgreens, CVS, Allergen, and Tiva to execute the SAAF and to provide such documents to Rubris the implementation administer.
