I want to thank the Division of the High-End Times for a presentation of Jesse Day, P. Mark Triad Regional Council concerning updates to the Ashburton Comprehensive Transportation Plan. Mr. Day, welcome. Good to have you here tonight. Thank you. Your time and the other council members' time. And I will respect that by keeping my remarks short. We're here to talk about comprehensive transportation plan for the city of Ashbro. That NCDOT has selected to move forward with the city of Ashbro beginning later on this month with our first year in committee. And I wanted to just briefly give you an overview of what the process is, to be a better form going through this process, Randolph County recently, after having planned. But the purpose of the plan, and I've included this presentation at your table here as well. First of all, what is transportation planning, basically looking at long range future deficiencies in the patient system, how to address those in a multi-modal fashion. What are the feasible solutions to address those problems and then information and data that will be useful for you all in planning and future transportation systems. So, the end of the process, you will have a not-grants of transportation plan to consider for adoption. So here are kind of the different components. Multi-modal, relocate existing infrastructure, future needs based upon future land use and transportation growth. And you can see that, you know, Iowa categories are growing down there as well, so there will be different recommendations for all those modes and different classifications of roads. The benefits of having a conference of transportation plan are listed there. You know, the idea is that if you plan, you can think more efficiently about how to build your future transportation system, more, lots of different areas including transportation, you know, looking at reducing traffic congestion and identifying projects that make sense for the future based on future land use. So does not make promise to build roads. It's not physically constrained. So, you know, looking at 30 years out of the future, you just can't anticipate what kind of funding is going to be available. And I'll show you the difference between the transportation improvement program and the conference of transportation and this is second. And it doesn't determine our pinpoint location with new roads. So, I'll just ask for a small print. but your comprehensive transportation plan is basically 25 to 30 year horizon. Your transportation improvement plan, which is probably something you're more familiar with, is called the TIFF, is a seven year plan of which the first five years are 90% delivered in terms of the projects in those five, about seven years, 90% of those projects were built. So both are adopted by the Board of Transportation. Comprehensive Transportation Plan is not visculex and strain like the TIP is. It does not need to go through our quality conformity analysis like TIPS does and then of course your time rises are a little bit different. The mission is that Randall County has a current self-recented transportation plan and probably new made then while we're not in process. So the Metro lasted a thorough fair plan in 1999. And then you can see the other municipalities around the town will take all of those other municipalities need about these. the first order of business for the steering committee is the first order of business for the steering committee is the first order of business for the steering committee is the the first order of business for the steering committee is the the steering committee is the first order of business for the steering committee is the first order of business for the steering. And this will be guided partly through the future land use plan that exists in the Ashroam. I will help guide some of the study that we've got through the transportation plan. So these are the data involved in the developing ZDPBL, we'll read through all of them, but basically you're looking at some existing data with the future scenario for land use. And then you know, developing alternatives, looking at those future transportation impacts and the capacity of existing roadways and existing transit systems and existing classical pedestrian infrastructure and are coming through with a recommended plan and then the dot process. And then you can see also there's a flow chart from CINU's all the way up to the set. So, if there are any questions that you have to entertain them today or through the plan process, you can always reach out to myself. My information's up there. The project engineer assigned to the project is him all shot. And information is also up on the screen in your packet. Do you have any questions after tonight? Questions or miss good day? I will open a public hearing on the condition of the permanent application and subdivision sketch designed flat review for Section 2 of Old Town Village, Mr. Evans. This is a once actually here. It's a really big one. Sir, I'm getting you Mr. Mayor and members of Council. This matter is the combined hearing of 181, 12-0, and CQT will available for home-bound buildings in the big unit. Just to give you a quick review of the combined agenda items, what's the infrastructure tonight and what's the look at the two. I have a few spoke by some of the sketched comments on which includes that several variants of the sudden vision, and also the consideration of the conditional use of the four-cleanian of development. I wish the system of those. Thank you. The reason for this item is coming back before the campus, what made it very familiar. There were certain modifications for items of student development, differences in the consumer circulation, the architectural styles of buildings, and the elimination of the real estate sales office as part of the project that would be considered modifications of the conditional use for the, so that's why it's required a new sketch design and conditional musical unit. And the separate voting vote applications would be required to expand the sketch design Just to general overview of the properties, the applicant in this case is three vehicles available in the LLC. These properties located on the south side of Old Lexix Road. There is one Randolph County parcel identification in the river line. And the property is just under approximately 22 acres. So, just to show you an after-the-property location, this will be located along the whole Exit 2 Regs, section 2 is where the cleaning and development request is concerned. There is a future development area that you also see on the outside of the exception here, and the actual cleaning and development is owned. See you on our team. All the surrounding property is our team. Again on the aerial photograph, you see some construction on this was taken. So there has been quite a bit of development already occurring. And as you see, there is a two-hundred-h hidden structure that's already in place, some of the streets are on park really, middle, and so on, and then we're dry as well as a city pump station and some of the sidewalks are in place. Looking at the proposed cycling which you have at your place. The property includes a number of single family detached child dwellings 30 facilities as well as a 22 attached single family style dwellings as part of the part of the putt and there are six units of volume constructed. Again, when this was reviewed, it was considered. This is a photo looking at the property. This would be from Olex and Kin Road looking at the old town partway. And you'll notice there is a zoning sign. So I will mention that this property has been posted and properly advertised. And the notices have been sent to the joining property owners. This would be looking west along the Alexa Ture from the development. You do say a turnlight has been installed previously. This is looking on the middle to circle from Old Town Parkway. Again, there's a couple of the detached homes that have been constructed. There are some private alleys to the rear of middle to circle existing, and this is one of those. The, this is showing the current terminus of Old Town Parkway as you're looking into what's labeled on the site plan as the future development area. And then there is a milford drive from Old Town Parkway if you're standing at the roundabout and you see the townhome style dwellings at this location. The existing zoning is CUR's here. There are a total of 52 lots plus some common area. And the average of lot size is just under 35 feet. The existing land use includes a plenium development that's been under development. And the adjoining land uses, as I mentioned, are a primarily low-density residential with some undeveloped property to the east as well. Looking at the land development clear recommendations, the road strategy map recommends a long-range road area for this property, and the proposed land use map indicates the property as a suburban residential. So before I move into the subdivision items, are there any general questions about the property? And the question is, what is the use of the word in the law to make sure that we are required to use the discussion on that works in various ways that word granted previously the discussion on it. And these various are to the subdivision, it's not the zoning ordinance. And they related to the right-of-way widths along some of the pavement streets within the subterranean. And so the new sketch design requires the council to review these various again. And again, some of these streets have already been constructed or applied. The conditions upon in the subvisional ordinance in which the council was greater variance relate to severe typographical or other conditions peculiar to the site. In this case it's strictly here so the provisions of the ordinance will cause a necessary hardship. The council upon recommendation of the cleaning board may authorize the variance in terms of this ordinance only to the extent that it's absolutely necessary and not to an extent which would violate the intended rules. And all requests for variances by materials providing sufficient evidence to support the plan of partnership. So the applicant's representative will need to speak to this as part of the sketch design. Specifically the variances that are requested, again, these are the same variants of the brand previously, include the variances to the width of the upward wide-rowed, which in street trees are within the sub-the-right-of-the-right-of-the-right requires a 60-foot wide wide-row area. And the applicant is requesting a 50 feet of right-of-way area. And the applicant is requesting a 50 feet right-of-way along a portion of Old Town Parkway and 56 feet of right-of-way along Middleton Circle. The applicant is also requesting a variance, again in the right-of-way width, not the street width. In certain sections of the development where there are no street trees proposed within the development. And that includes, it's calling a requesting a variance from the 50-foot right-of-way, reducing that balance to a 40-feet of right-of-way, along both Milverick Drive and Frickton Court. Those are the two roadways on the northern part of the property where you see the townhome style of the well. And for those portions of where there is existing infrastructure, there were guarantee submitted for certain improvements, such as the final layer of asphalt, sidewalks, and some landscaping along the pump station area and as for the development and so those we have received a guarantee for those items where there is an infrastructure already in place in those locations. Okay, I'm looking at some comments from the various departments of the engineering department. Again, this is reinterrating the previous comment. They are stating that plaque corrections are addressed through a proposed condition to the conditional use permit. We will get to the exact plaque corrections and what they involve when I get into the conditional use permit portion of the request. Another comment from engineering is that there's certain types of street trees where you do have a narrower right-of-way that are more viable. And those trees should be centered more closely closer to the side of all the streets within the cleaning street just for maintenance and other issues that may arise and that several varieties of street trees such as the green, alpha-worn and laral shrub should be avoided because of certain site distance issues and also the crab apple tree should be avoided. So there are certain types of trees that the engineering, clothing are really not the best fit for that type of narrow right away. The cleaning department also had the comment that there are some plot corrections needed again. We'll get to that in the condition of use permit portion of the request. And we also would just emphasize, as we do in these other similar requests that homeowners documents restricting RB parking shall be recorded with the final plan and you do see that later on the slide plan that RVs and boats will be prohibited through the homeowners documents. Yes. In terms of the staff recommendation on the subdivision portion of the request, we would recommend approving that, noting the corrections, comments, and successful approval of the subdivision ordinance variances. Implanable would also review this request and concur with staff in terms of the subdivision portion of the request. There are any questions on the subdivision portion. We'll move right along to the conditional use permitted portion of the request. And again to emphasize the request is for a planar development which will propose to consist of a total of 30 detached single family homes and 22 attached town home stock dwellings. And that is differs from the original request, which included 26 attached town homestyl dwellings and 26 detached single family dwellings. So there's slightly more single family detached dwellings. And as I mentioned, the public streets and private alleys are incorporated into the design. And this request was originally released in 2007 and there were modifications most recently approved by Council in 2009. I mentioned some of the changes to the request. The reason this is coming back before City Council are the applicant is not changing adding any additional units. There are certain changes to the architectural style of the units. Instead of having two-story dwellings, the applicant is proposing one-story dwellings and the applicant is also proposing eliminating alleyways throughout a portion of development so that the garages would be accessed from the front of the unit rather than the rear. And as I mentioned, there's a change in the ratio of the number of dwellings, or the proportion of single attached versus single family detached dwellings. And also the applicant is proposing eliminating the commercial sales office that was on the previous floor. There are some areas of steep slopes and 100 year floodplains and development is proposed entirely outside of this area. Staff has some suggestive conditions if the council chooses to approve this request. Those are as follows. Number one, additions located to the rear of individual dwellings or the enclosure of patios and porches shall not be considered a modification of this permit. Number two, homeowners, documents, prohibiting recreation and illegal proceedings both are committed to the divided by the subdivision ordinance shall be submitted and recorded with the final plat. Number three, all storm sewers not in the public right away will be maintained by the Homeowners Association. Number four, a 25-foot wide city of Ashbur, a sanitary sewer easement will be provided alone. All eight-inch sanitary sewer lines that are not in the public right away. Five, a 20-foot wide city of Ashboro water line easement will be provided along all water lines connecting to the city of Ashboro water system to the fire hydrants and meters that are not in the public ride avoid. Okay, number six and I should mention that number six has been revisanced the original report that was in your packet. You should have the revised to the report's there after places. That is the reference to when receiving the slight plan that was submitted by the deadline date for review. We did see a few clear point errors and emissions and essentially pulling down to some items that needed to be laid in the room and clearly on the site plan. So we would suggest a condition as follows that clear point errors and emissions were identified on the site plan and subdivision sketches on plan that's dated April 2012 and revised on May 21st 2012. They were related to letter A, the white blue open and recreation space, which is detailing the recreational area that is proposed in Jason's to walk 1623. B, the flood zone boundaries, C, A, R-5, C, A, R-1, C, D, C, limit boundaries, E, street names and street right-away widths, which include corrections to the right-away boundaries that are shown on the outside side. to the right-of-way boundaries that are shown on the outside floor. Letter F, street maintenance responsibilities, and finally letter D, delineation, or baselines. As part of the clerical corrections, the applicant shall submit a revised slide plan and plot reflecting these corrections forward view and inclusion in the file without further review by City Council. And these corrections shall not be given to the modifications of the land used proposed on the site plan and subdivision sketches on the plan that were submitted in a timely manner as part of the conditional use permit application. Okay, for post-conditioned number seven, in addition to demonstrating compliance with the City of Ashbrough subdivision ordinance, any subdivision cloud submitted for review and approval shall provide adequate turnaround and maneuvering space on existing and future public streets for municipal vehicles, specifically including garbage trucks and fire trucks, again to ensure those vehicles have added space to turn around. And finally, condition 8, prior to the issuance of a zoning compliance permit for the proposed land use. The owners of the zoning locks shall properly execute and deliver to the zoning administrator for recordation in the office of the Randolph County Register of Deeds, a Memorandum of Land Use restrictions, which is prepared by the city attorney for the purpose of placing notice of the conditions attached to this conditional use permit in the chain of title for the zoning law. And again, that's been a condition that's been standard for some time as a reason, to make sure that whoever may acquire the property that that's recorded as part of the title to the property. There are some only proponents who suggest the conditions seven there. I, on the rest of us here, what's garbage trucks grows nominally over the last 15 or so years? As far as I know, every time I turn around, it works with all equipment that we have now. Is there any information to the contrary of that? I mean, this seems kind of kind of open ended. That would address if there is any type of phasing with the project that... I want to protect them. If they sort of go thought I want to protect them from we trade garbage trucks, and then I'm certain they've got something they've not designed to do, and they come. Right. The condition is addressing if there is any phasing with the property where if it's not developed all at once in all the streets or not and start all at one time, that there be a provision for a turnaround for the... I understand what it's for. I'm going to go on my behalf. Mr. Mayor, if I may, the inquiry will be commissioned. Mr. Evans, I believe that the councilmember specifically trying to end down on you greatly if I'm wrong, and I asked this, is he conceivable that with the trucks, the city now has an escape, garbage or fire, that are some of the linings that there's a concern that they could not have added a current space. Is that current condition? Right now, but is that a deliverable approach to income? Yes, sir. That's what we're trying to address, is that right? Yes, sir. To tell me again what I won't remember. Right now there could be a problem with the struggles leading to the round. Asking the struggles. As constructing, but it's not going to be much longer than the rest of the game. The rest of the game, but there's some dead ends and things I've tried to have have been completed. As I understand, that would be a few clarifying and it was very, not the usual. So we'll get to that was he gets there but yes, but yes, current quit it's not a matter of future quit but it's not understanding anything. It's not you're not worried about unknown but like you're talking about known but right now on the city fleet that could have a problem. Yeah, that was really what Mark question would have been. And my answer to that is what? Is it yes or no? Yes, yes sir. Well, can we add the word current so that would be dated with this meeting? I will immediately objection I mean, I think you know just That's right Consider very much the city has to apply for a truck. It's a different size public safety always an interest on this Well, man, but you got ten million other models. The city had already just two But they're what in front of you right now, from passing the test on, a woman or a sergeant is for the city vehicles, or taking up garbage, which can be a health hazard, that you can't get in there and get in the fire trucks. Those are your concerns. That's something you need to consider as you move forward, whether or not it poses a risk. Well, for safety. forward whether or not it poses a risk. Well, I'm confused. Do you mind? Are these streets big enough for our trucks? Please. And I'll ask the question again. I will sort of make you clear in the record this one here and have an opportunity to ask these questions. I'll be able to confuse things even more than to do that. I'm sure. All right. You can't be counting that. So that's it. Okay. Mr. Bunker, the streets that are constructed out there now in the original subdivision, one that are curved and gutted and round about and turn around where the garbage is. They are currently constructed or are constructed to allow adequate access for the vehicles we currently have on stock. The plan is added with what's completed. Now, presently, many, many, many, many, many completed and there are sections in phase one is being completed. And there are sections in phase one that do not have a turn around adequate at this time. Which will be built in phase two. If the project proceeds straight to phase two, and then it's 100% completed according to the plan, turn around and I'll be able to get out. Okay. Alright, you know, for 12 years, 16 years I've been sitting there fussing about the cold sack of miles. And just last week the garbage truck backed into my tree. Brunker doesn't leave limbs off of it. The cold sacks in his town are not big enough for our vehicles. Or one might have argued for me on already owns 400 cul-de-sacs, maybe he bought a garbage truck to be. Our cul-de-sacs got smaller. But there you go. Potato, potato on it, but I'm just saying there needs to be a match up, but all I've got is, and I didn't want to see them think that they're pricing X, Y, and and Z go forward and then we trade garbage trucks and now they got to build LM and eat your stuff. Yeah, I'm going to see the reaction of your comment. Yeah, I'm saying this reaction to the particularly. Oh, this is what we own now and everybody's on the side of the page. I'm going to see something. And yes, I'm in there. They're constructed to meet the equipment we currently have. That's a far too side of our phone. Proposed with CIS being announced, Mr. Evans, could a final plan be reported or a units are occupied and we would not have a turnaround for the trucks? Is that the word you're trying to address in that condition? Yes, sir. Okay. I get it. We've seen streets, you know, that have a big bill, you know, in phases and we've put a T-turn around that. We provide a turnaround till we get to the coldest site. That's often done. I mean, I don't, I'm, there's got to be a method that works at our home. Is that what you're trying to accomplish? No matter where in the face and it is, there has to always be a method. Is that what you're trying to accomplish? Correct. Yes, sir. Well, look. He's under arrest. I'm not. All right. Well, and we'll move on in a little bit. So Mr. McGarry, just as you said. 100. Thank you. Sorry. Thank you. Sorry. Mr. Evans, that's right. This is public hearing and I will in the applicant to come forward, they sworn. And anybody that you would like to answer any questions, have them sworn out also. We know that's right, Rachel. Thank you. Mr. Mayor, if I could, I wanted to. I guess, maybe this will be a term or just how long my presentation is. I can't do this. Oh yes, for the record, my name is John McEary and I'm here representing the applicant. So this matter, the first thing I want to do is figure out if there's anybody who has a client who's meeting with us in the next elections, I'll think there is. It doesn't look like it. So I'm going to give the short version of this presentation and try to touch, first of all, on all the findings that are required to be made. I'll talk very briefly about subdivision variants. The folks who have just informed on the developer and the issue here for this project, and they all want to see pictures of what's going in, and ask them questions about what they've been to the past, and so on. They are here to answer those questions, if you're satisfied with what I brought to say to you, maybe we don't have to go that far, but let's try it the short way first. So look at the first finding the fact that the youth will not materially name it as public health and the youth is located where it will pose and develop according to the plan as submitted and approved. First of all, I want to be clear that when I'm talking about developed according to the plan, that means including all of the conditions that staff is recommended to you, as well as the ones that have been approved by the plan. Those are accepted by the applicant, and I say according to the plan that's in the end all of these conditions that we've been focused on. Obviously, this is a little different from your ordinary condition of use for quest. And you're not really changing a whole lot. There is already a condition of use, not a condition of the district, but actually the existing condition of the department. You can play. And when you consider these tests, I think you have to take into account how it zones in all the way and what's in existence there, particularly just seeing nothing added in the bed. What the cat is a partially-concluded development. Very similar to it. And I think it's like in 32-what we've talked about this evening. There are some changes, and I'll go into that in just a minute. But like the previous condition, we've determined the one that's replacing it, has no ways, has no concept of freedom, has no industrial development. You're not going to have any increased traffic over what's been its already zone for. It's the same number of units. There's nothing there that exists that has created any danger to the public health of the public safety. I think that one is fairly adequate. Clear. The second one is the thing you see so over for our conditions and specifications. And you clearly see it does, as you just heard from Mr. Evans, provided we important all conditions that planning staff is recommending. We do accept that. When the plaque is resubmitted with all of the additional matters and provisions that planning staff is asked for, we do mean, as it be technical requirements, and zoning orders, I don't think it's been questioned about that, except for the cut and dry. As to the third matter, that the use will not substantially enter the value of joining a voting property or that it's a public necessity is not public necessity obviously. As it is owned right now, you have the same number of units there, there would be a little taller if we were to develop the way it is now, and there would be a commercial use in there. And that's being eliminated. Other than that, there is no detriment whatsoever. What we're doing is probably improving the value of the engineering landowners. One, because this plan, I think, is a little more neighbor friendly in this. You don't have any two-story buildings. You have more detached single-bounded problems in the original plan and you're eliminating your commercial use, which I think probably would be a little objectionable to some of the neighbors. Nonetheless, you all have already gone through this one time and approved the conditionally used permeate for higher greater storage, commercial use, and fewer completely detached buildings. On top of all that, what's there right now? I'm not going to say it's an eye store, but it's incomplete. It's, I just heard and didn't realize before, as it's there right now, if nothing further happens, you don't have to turn around and keep the a knee to high. The part of the road is going to be rough. That is the Christmas Day. When this is developed and all roads are put in, you will not lose. So it actually increases the public health and safety. And it should increase the value of the government and the landowner's property. With regard to adjoining landowners, Mr. Mayor mentioned to me that Judge Hale had a request for a rezoning that was on the calendar. He's not going to reach it tonight and mention that to me. He's the only neighbor I have spoken to directly. But I'll get go to the union and he'll join this property. And speak with them to show them the plan before I accept it. I'm employment because I wanted to show they didn't have a problem with it. I can tell you what they've done. Hadn't spoken to anyone else. I'm not going to be able to sell my house. There would be some people here who are explaining that too. And the fact that there are not, I think, something to that point. I do have illustrations of what's going to be there. I'm not going to ask you to look at that at this point. A lot of times we'll retain and the prazer to give you a professional opinion. I think there are plenty of facts before this council to base an opinion that this will not suffice to prepare the value of your land and the property without hiring someone to take a look at it and give an expert opinion. If you want to see exactly what's going in there, you can see what the developer has put. In other places, they name these same models that are on the planet in front of you. The last matter is that the location and character they use if developed according to the plan has submitted and approved with all the conditions. Is in harmony with the area in which it's to be located and in general conforming with the plan of development of Ashboro and its environments. All surrounding properties either low density residential or is vacant, this will be medium density residential. It is the growth strategy map has it for long-range growth which calls for medium or low density residential, which this fits into. Probably most important is to have fits in terms of after a steam of development is you're going to be in exactly the same zone. We're not asking you to change the zone you've just had. We don't have the same condition of youth program. We have to say number of units. So, really, we are refining what's already out there, but it's a very minor change in what is zone four already, what's already been approved, and what's called for the land development plan, which is why the last one was approved. That, I think, covers all four of these tests. I think it's very clear that the applicant meets all of them with regard to the variance from sub-nebigial ordinance. Obviously, we're talking about it very strong. Not the zoning force, which is a pretty high-perture and means that the sub-nebigial force is. And that's necessitated by some physical problems here with regard to our steep ring and the re-clutter. You know, it's never been building when the flood area. And there has to be a way to deal with a fairly steep rise from one end of the property to the other, I think. Mr. Somi says it's 125 foot, wise from western part of the site to the Eastern site, Eastern site of the site, believe that those variances were also all approved on the last commissioners' program. We're simply asking you to re-issue those approvals for the same reasons that were put forward before you in the past. In fact, some of the roadways that you saw, the Picked You, Mr. Evans and slides, already incorporate those variances, because they were approved last time. And those roadways matched those variances. Think it would be somewhat of a hard tip to require this new after-pick you go back and change what was there. What's over been put down and tear them up. I don't think anybody knew what would be happy about it. But with regard to that final issue about turn around, I have to say when you took them off it brought that up. It had not crossed my mind that we could be looking 10 years or 20 years from now if the city lies larger garbage trucks or larger fire engines and being required to go back in and re-engineer this subdivision, how do they can put in any other subdivisions we would expect to. That's not how I read this. I understand why Mr. Mopped asked that question. I think it's appropriate for the burden of the only applicant to me, all the existing conditions, when this is put in, but to ask an applicant any place to redesign and repay the whole subdivision, when changes take place 10, 15 years from now, if they ever do, I think might be a good example. I'm not sure why, because I prefer prefer to counsel for the city. I'm not sure if that's the intent of the ordinance law or conditions. He seems to be shaking, but it's not. So I don't think we need to worry about it. He's not swarming with an eliton. I'm not swarming, I'll listen to you. I think that covers all of the points. This is the, I will open a public hearing on the proposed budget for fiscal year 2012, 2013, and invite anyone in the audience that would like to address the council regarding the budget. Mayor, I may, a misreasual run that for me when John gets running. I'll make some open and comments. Just mayor, this is required by General Statutes. This is duly advertised. We have just some quick comments. General fund mayors balanced at $24,566,939 dollars and includes no property tax increase. The remade to remain the same, the 55 cents per 100 dollar value. The Warren sewer fund is $14,690,000 and25,000, remember that's an enterprise bond made off our water and sewer revenues. General bond budget highlights quickly. Again, we covered all this in great detail last time and it's been in the paper. General government can see how those departments break down the marine government body right down to human resources. You can see the big piece of that of one and a half million of that 3.3 million total is a big nightmare. It's a human resources. You have plenty of zoning in there. That's 2.3 million of it. 2.3 million of it. 3.3 million. Round numbers. Public safety is the majority of what the expense is. It's almost 50 percent. It includes police fire building inspections and fire inspections Transportation is operating streets the city engineers office and the airport authority 3.4 minute again, just obviously would jump right at you 100 miles right? We discussed last time. Environmental protection is 2.6 million for environmental services and the recycling transfer station is 194,000 for total of 2.8. Then culture and recreation, which includes the golf course, the library and facilities maintenance is 3.5 million facilities maintenance again is separated out and maintains all of our facilities including some in the water and sewer fund which is a transferred back okay in the water and sewer fund mayor quickly we do recommend a rate increase the minimum bill which includes 150 cubic feet, goes from $261 to $3.61 to $27.61. I'm sorry, to $30.61. We tried to stay at the maximum rate of a dollar a day for a minimum user. Consumption for over 100 cubic feet after the first 100 cubic feet goes from 2.51 to 2.63. We base that on a family of fours about 800 cubic feet and it's right goes from $60 and 24 cents to 6480. That's inside the sewer. As for both services at 2.13 two dollars and 13 cents a day, it's kind of drugless backwards from trying to keep those two numbers. So there's the outside the city, we step to the two and a half times the inside rate. And then again, you'll see that in the Water and Sewer Fund, our departments are building in collections. It's 476,000 water meter operations, 747 water maintenance and water uh, wastewater maintenance, 1.1 and 1.4 million each. So I remember 400 miles apart. Then of course our big expense is for water treatment plant, wastewater treatment plant. You'll notice that the water treatment is half the wastewater treatment. You see where all our expenses is right there. Technical services, that's pre-treatment program, grease and fats, fat cells and grease systems, maintenance that includes maintenance on our pumps, hydraulics, all that. And our water quality, that's our lab is a 14.69, 14,000, and 690,000 to $25. Now which will be driving this budget mayor and this not initially driven budgets in year past, this plan equipment replacement. Now we talked about that at the workshop. We've talked about that over time. Traditionally at this point in our history, we would be going to the public for a bond campaign and this stuff would be barring and paying for over time. Over 20 years, in fact, when I came here and the town was on the board when I was hired in 01 and the mayor was, we were talking about expanding the water and wastewater plant. You remember since then the economy changed, not with with just 2008 but we've lost a lot of usage with textiles and it's time to replace this equipment that includes the digest recover at the wastewater treatment plant. We had a complete Michael's been here a couple of times to talk to you guys about and we talked about the need for it with the Maldon Mill project. The filters at the south water treatment plant, remember we have, they're on the same lot, but there's a North and a south side, that's 500, 7,000. Our filters right now are barely working, we have to backwash them all the time, we're just at their life cycle. Just like your car or the filters on your furnace at home, they have to be changed, it's no different. Then the nitrification diffusers at the wastewater treatment plant, that's an EPA requirement. Then we have the standard maintenance and repair of our four water tanks. We have an annual cost of that. That takes about that much a year. And that includes the cathodics, they don't rust, cathodic protection, painting. 75,000, the two big main vials that come out of the water plant over on West Street both have to be repaired. If you remember, they've broken a timer too and we've been out there for a week on end trying to fix them. You said we repaired it, we talked about replacement already. Yeah, they're going to replace them. We've repaired them all we can. 10,000 per flow meters for our list stations. Again, we have to monitor our own eye. And then it's along with the upgrades of the plant. We have to upgrade our lab equipment. So that's really driving the water fun this year. Normally that'd be spread out, you know, but just the way it. Our traditional, you know, 1952, 1972, 1992, 2012, our every 20-year cycle, where we replaced this, we're not doing it in the bond campaign, we just have to, you know, borrow it and raise the rates to pay for it. Also this year we had a lot of deferred items. We had to stick in the general fund. Got $509,000, $250 per 20 police cars. Captain Williams here, he can answer about the status of our police cars. I think we have about 30 over 100,000 miles. This gets rid of all the blue and white cars. Fire truck 260,000. That's for this traditional pumper. Not an aerial, which was Chief Smith-Thasper, when we got to figure out how to get one of those, too. Remember, aerial trucks in 1966. We have seven firefighting trucks. or 20 years or older our fifth ones 19 years and ones seven or eight and ones you know two or three. So NFPA is putting in a new standard where trucks are 20 years or less so we're right up against that and we need to expand on our third fire station just to keep up with our demand on the east side. Garbage trucks were a placement. We need equipment for facilities maintenance that includes moan equipment, mainly traffic division needs a new service truck and the land all trailer to transport equipment. That's a pretty big expense item but right now we drive all of our equipment around town. You'll see us driving. That's a traffic hazard and it puts our employees at risk and you would think traffic gives way for equipment but it actually does not so that's a real safety issue for our employees. We're responsible for too and from the site we can move our big equipment easier that way. Thank you. As usual it's we talked about getting the holding equipment and doing the multi-mill project you know the multiple we get to sugar water and convert it to energy and beginning to move our own home here to the landfill. In Montgomery County I do think Randolph's moving as quick as possible to build a landfill or reopen the landfill over there in the central falls area. I do think at that point we'll still use this equipment to haul from our transfer station there. We'll stay out of traffic. We can maintain our routes and matter serve our citizens. Water maintenance needs to service truck and a waste water maintenance department and then our back truck needs to remain this and repair. It's a pretty big item. Now we get all the police cars in the fire truck. We have to put them equipment in them. We're doing e-ticket and e-sitation now. So we have to be hooked to the internet and the court system. Judge Hill will be up in a minute, but I didn't see the saw on that chronic now. The OSHA is now requiring communications gear and fire trucks, so the driver and the captain and the fire fighters aren't young and each other, also it's very loud in there with the alarms going, so they give them ear protection as well as communications. And the communications equipment for the public works department, as you know, we're getting ready to change over and the public safety Frequencies are going to public works and they'll be going to the 800 megahertz system which will be more More expense for us. We'll hope we can share it with the county. There's we're still pursuing those grants as usual we continue to those grants. As usual we continue to give to the Boys and Girls Club which is a councillors committed to the Arts Guild, the Mall playground which we have done about 10 years now. We are half and half with the CBNL and the little Mall playground in the Senior Adults Association. About half that 42,000 I think of that 94 is the senior adults. Jonathan Sirugam might ask Kim Merri about the demand for kayaks and canoes into the picnic shelters. Also in there we have the grandstand seats we talked about last time at my career part. We have the big 2013 and 2014. We have the South Eastern Regional, American Asian Tournaments, those grandstand seats we got or indoor seats we got from Greensboro Colosseum when they did the recolosseum and they're just worn out and pool needs is always, we have to buy chemicals for our pools. And then 117,000 for the book's periodicals and supplies. Just remind, remember the council that we provide book's periodicals and supplies here. The other branches provide labor at their site. But with us is the headquarters branch. It's hard to tell who is a's a county employee who's a city employee Also, we had the library before the county was unified. So I mean this goes all the way back to What the the 30s this time John So from here mayor This is a public hearing the adoption date is scheduled for June 28th, 2012 to 1230. That's about as far as we can stretch it out this month. June 30th is a Saturday and we dobs to know when to meet on a Friday in case we don't have a call on it. Something will happen. And that gives time for the General Assembly to adopt their 12-13 budget for at least send us in the general direction. You gotta remember there's a lot that we receive that's by General Assembly that they could change or amend that includes beer and wine revenue, utilities franchise tax, The POW Bill appropriation for streets and roads, the hold harmless. Just for mind you, this is the last year of the hold harmless. It's we're up for 200,000 and I think we're 202, 204 this year. 202, 202. 202,000 this year. That actually expires this year. So we've been lobbying to keep that in so This gives us some little bit of time to see what happens I don't Know right now as of the House and Senator Miles apart on their different budget ideas and their proposals, so Could be a long long could be a long June for those guys, the budget writers and both the House and the Senate. Step up and introduce yourself for the audio record and tell us what you think. I'm Linda Lancaster. I've been a resident of Ashworth for 15 years. I've always considered myself an informed citizen, and I do spend a lot of time reading a paper, and there's probably not. I have dozen meetings I have read about. In the 15 years I've been here. In those 15 years, I have seen a steady erosion of services that offered for my tax dollar. What we're once covered by my taxes are now fees as we impose those as we go forward in. I'm convinced in some of the spending that the council offers, you stray far and wide from what your charter speaks of my with something your basic services. Every year, John makes a presentation on the budget. We'll tell how tight it is. It will pass. And then you'll find another half million to three quarters of million to spend during a year. We spend more and more money with nonprofits over which you and through you, nor I, exercising the control over those people. Probably the most egregious is the mercy clinic, who blew through $1.25 million in stimulus money. Remember those shovel-ready jobs? Well, there was a lot of shoveling going on at mercy, but I don't think any of it had anything to do with job creation. You gave them $40,000 of my money. They don't have the track record. They advertise over six or seven counties, and those are not the people to insurance who will come here. And I have to say, if you personally, since all seven, have been voted for it, if you don't have the courage of your convictions to have fired your doctor and fired your dentist and gone there, then it's just at the end of the day, fair amount of hot air. This year's budget represents a 66% increase in water and sewer over the O4 budget. And I gotta ask, I don't use any more water and when you look at a 66% increase from O4 to O12 that's a lot. When you look at all of them it's a 48% increase but all of them added together and I have to ask what am I getting for my tax dollar? Okay. I see more taxes, I see fewer services, and I see higher tax rates. I understand about replacing stuff, but our water budget in 0.04 was 8.8 million. And by the way, these are your numbers not bad. They come from the budget ordinance. This year is 14.69. So I have to ask, 66% increase. Are we delivering service and value for the citizens of Ashburg? What are we getting for a 66% increase? I've shared this with David before. You guys outspend the rate of inflation to 1.5 times on average every year. That's in real spending when you take out inflation. So what are we getting? If we can't do this efficiently and effectively in a period that while it may not technically be a recession as our federal government defines a recession, We all know what the unemployment rate is in this county We all know how many unemployed Neighbors we have This is a stretch But if we can't do this as a city government Looking at your charter for some mission guidance and maybe it's time we started privatizing some of these Cities are doing this and they're saving money. Again, an aging system for the law system, an aging system, a system built for industrial consumption. Because our industrial consumption goes down. The rate payer, the homeowner has to make it up. And with just as I just demonstrated that aging system, I mean, we've got pipes out here, right out here on the church street, they're put in a World War I, you know? So I mean, it's just, I mean, I wish we had the eight, or eight and a half million gallons a day we projected for 2012, but on a really hot day in July and August, we might run 4.6 or 4.7 million gallons now. I mean, we just don't have the same we need and we're desperately trying to figure out how to sell the RAM sewer, how to sell the Franklinville. I know I've been to Teddy Talk with this. How to sell the big users, but just our demand continues to shrink and his business is getting more efficient efficient they just use less. And we have not recovered from 2004 when we lost champagne dye in serially in eight months at a million gallons a day of production. And that includes, as Mike Hunter always says, one of our biggest customers is the city of Randall. And if they figure out how to get us completely off their system, we'll pick up, yeah, we pick up another 150,000 gallons a day of usage in our plant. But we have nobody to sell it to. It's kind of like the hospital. They need people in their beds. It doesn't really have much. I mean, beds they have. They need them to fill it up all the time. It's a Mr. Lancaster's right. I mean, but I think the council is trying hard to be it. And I know that staff is trying hard to be as efficient as possible, but those changing demographics and that demand is just hard to deal with. And we tried to work, I said we tried to work backwards and keep it at a dollar a day for the minimum customer. Thank you, Charlie. It's worth noting though that for many years, he's been interested in subsidizing the small day-to-day users, the small single payment house, all the way to the house. He had been interested in not subsidizing anymore, so he's got to come back to somebody and that's his thing. And I just remind the council, we have, like Lucas, because Mr. McCrary sold the property to the city for a dollar. I mean, he talked about an act of civic mindedness and the checks to elaborate on my queries never been cast. The dollar of the city wrote for him. Now, likewise, when we built like Greece would pay to sell, still do more. Not to be honest, cereal, Mr. Lane Gaster, but what less services are you getting if you don't mind asking that, please? Well, I first came here. White goods and trash was free. You now charge $10 a pop for computers. The city or the county, and I understand about the recycle thing. You've changed fees on everything dealing with direct services. You now for the first time this year are charging, intend to charge if this passes. Registration fees for all of the athletic sports events, which were free once upon a time. The list starts adding and that's just off the top of my head without any notes in front. But if you look back to 2001, 2000, of if I use the city services like I do, I would probably add another 15 to 20% to my taxpayer through fee use. add another 15 to 20% to my tax bill through fee use. The golf course has gone up three or four times in the last decade. I don't golf anymore, but that's kind of huge. And we understand pay as you go. Gee, 66% on water, 48% on the general fund. I mean, what do the citizens get for value at the end of the day? 66% on water, 48% on the general fund. I mean, what do the citizens get for value at the end of the day? That is the bottom line. And I'm sure the city numbers people could right could tell you how much have you collected in fees that used to not exist 15 years ago? And they could do that every year. We do expect, in the next year's budget, to just to stay revenue neutral to have a tax increase. Having said that, we have no idea at this point exactly where we're going to end up, but you're right. Okay, go ahead. All right, now what I'm looking at is water raking increase. And I know on the maintenance council meeting, I was told that the rates were not increased if the city granted free water to that nonprofit agency, William C.I. and then on May 24th, I heard, well, the water bill's going up. So let me finish. It was just a natural fall. It went through my hand. Well, my water bill went up, and I gave him $30,000. I gave it, as I never heard the final resolution. The thing. The final resolution of that? You have no name, one. No. But and then before you adopt the final budget, if you do give it, then it will be adjusted to reflect this decrease in revenue. I don't expect we'll know what the final outcome is before we adopt the budget. Okay. Because we're the Mr. Ward and Mr. Sermon are still going back and forth with the people at the Y. Now just one statement I wanted to make. We are looking at hearing from Randolph County, St. Illinois Carolina and the federal government taxes increase. And I'm also hearing that pretty soon we're going to be the people that are supported in some way shaped form by the gum That's going to at least equal our outnumber those of us that are paying to support it So sooner or later the money's going to run out and I would like to see Everybody tight in the belt like I'm gonna have to and I'm doing that's just my one statement So the 1314 budget I would like to see some type of Not revenue neutral stay in the same but cutting back on some expenses some way shape Perform because the federal government's going bankrupt states states are going bankrupt, and I'm saying Wisconsin and Ohio, they cut that, and they're doing pretty good. California's bankrupt San Diego did that, and they said they're cutting. So, sooner or later it's coming. We're going to have to. And when this real bag of Washington comes in, I think Montgomery County had a problem with others, and I think it was a city manager or the tax manager said, he's questioning his because it increased instead of decrease and I know there was chicken farmers, they said they went, they came millionaires over not. She had to percent increases in a lot of cases and value not. So I don't even presume to know what y'all have to go through to run the city. I don't even presume that it's like I'll have to go through it to run the city. I don't have a clue. I'll have to plan it about that. I'm just saying from my point of view. I know my bail. It's going to have to be tight. You're exactly right. And I will tell you that by being here at this budget presentation two weeks ago, you know more than every citizen about what we have to go through. And I understand your concern. And the same cost every business has the cities and they're different. When we burn 575 gallons of fuel a day, even though we don't pay the motor fuels tax like you do at the pump, so you might pay $350, we might pay $3. It's proportionally the same for us. Now we just heard Mr. Lancaster, he's very articulate. A numbers guy, he's living the same street, the mayor and I did, he lives beside him. Smart as a whip, but the same. I don't think he stood up and said he wanted us to come by his house and pick his garbage up just once a month because fuel went up. So the same, the same. So the same, so the same. I'm in the city because I like the service. I know what I'm not. I've lived in the county and I don't want to call many. I think I get a bargain. My point is going to 13 and 14. Go have to do something. And it will be a big. It needs to scale. Absolutely. Absolutely. And it's, and we're fortunate that way, as I said, You're absolutely right. And we're fortunate that we, as I said, the other day that we did get maltermy all. I'm also employed here in Ashburth under Davidson Vastments. I'm an NJ convenience store, or owner, Cox, 64. And I want to come to this City Council meeting tonight and ask the question. It's a question that people has even asked me and have been brought to my attention. Is there anything that a city, any city, not just ours, but any city, can do unordinance in a dress code. I mean it's uh I'm just asking the question that we have people that are allowed to run around in the city of Ashboro really sitting in the United States with their their pants pulled down below their waist and their junk hanging out and holding the mubber one hand so they can wall. I know this council has more important things than this city and I understand that but I've been told by somebody that somebody doesn't, I don't know if anybody has ever come to y'all with this and presented this and said, is there anything that any kind of city ordinance? OK. I have the same concerns. It really distresses me to see some of the people that Captain Williams and back there has to deal with Williams. And our 80 police officers have to deal with out on the street, the people that come in your place of business inappropriately dressed and with inappropriate actions and demeanor. Are you familiar with any city in the United States that has legislated dress code? I mean, just off top of your head, have you heard of anybody that has? Not yet. Okay. Now, I'm going to defer, you know, it's a legitimate question. It is a concern of yours and many other people. Mr. Sugg, would you like to weigh in, please? I can offer this being as a practical answer to the answer to the city's non-position to regulate risk for it. So you're for anything who walk into the other areas of the street. So I have a problem with this, but you can get any product properly or you can control their business. As far as the city adopting as a matter of any order, the city adopts as enforceables by law or criminal law. I was not able to say that because one, any effort to try to regulate someone's address is going to infringe over from the freedom of expression to the city to have to draft extremely carefully, not constitutional violation, and they're government about public resources and the day they able to put other resources that we use about the services we pulled over to fighting litigation which the city would probably lose if we were very careful how it was drafted and by the time the city was very careful in how the language was drafted it would be ineffectual. The other thing is a practical matter is given the constitutional concerns, it is near about impossible to articulate the address code that the enforcers of the law and the people who are having to comply with the law would understand and read upon as being the same thing and how to apply it even in all situations? And if it's not applied, so even if you survive the way it's drafted as applied to individuals, the city's enforcement officers would be subject to litigation over there as well. That's a long range of stuff. I'm back with Bob Lyman, who is just right. Bob Lyman, who's a pro-business owner, and controlled their friends. Okay. Address to council. I'm sorry. Speak to us. I understand what you're saying. And an incident happened in a business where a gentleman started to walk in. We have a sign with the work. Certains used required. He had no shirt on. Pants down. We don't have to serve him. And he pumped gas at that point. He already had it. He wasn't getting gas in his company. He was getting gas in his company. Okay. So, quite frankly, I just refused to serve him. And thanks a lot, we're doing it. It didn't buy gas. Yes, did it throw the oil off? I'm not being smart here. I'm saying you have just exactly what Mr. Sussex said. You have the right to refuse service. You have a sign that says, search, choose, whatever. He wasn't willing to abide by that. I'd run him off and say don't come back. It's a customer you don't need. I mean this day and time, I was too very good to win because of one that come in like that and they told me they wouldn't be coming back because these incidents going around town, these things happening in the city of Ashboro. I don't see how we could stop it but you as a property owner and the business, you can attempt to stop it. It comes to down to, it really comes down in my mind is how bad you want him as a customer and what you want him to say and call the police. You ask him to leave, call the police. When you made the statement that John hanging out, was there John hanging out that was visible? Not closed, but that's all that is here. Here's a hatch for blowers. This buttocks. As part of their expanding opportunities for active living camp or campaign, the Senior Adults Association has requested that the city apply for a rural hope grant from the North Carolina Rural Center on their behalf. Applicants for this type of grant must be local governments who are applying on behalf of one or more private, sorry, one or more private or nonprofit healthcare entities committed to constructing a new facility or renovating existing or vacant buildings and creating new jobs. As you know the proposed new senior center will have programs aimed at increasing senior wellness. The grant allows a request $8,000 per job created. They do anticipate creating five jobs so we will be requesting $40,000. The senior dose association has completed a pre-application process with the rural center. They intend to have their application in by the June 29th application deadline awards will be made August 22nd. We have your resolution on this matter tonight and support the committee for the grant application and ask for your adoption of this by reference. As you're all aware, we do require to receive the same residence and bond residence to reserve pick and shoppers in our parks. As you're all aware, we do require to keep the seat residents and non-residents to reserve picnic shoppers in our parks. And for that fee, the public expects to certain amount of service in return. And unfortunately, it's becoming a growing concerned where a third party group will get through shelter before the group is actually built up to make work a pay-to-feed. And we'll leave when the renting group arrives. I'm afraid the days are gone when a six foot three, three hundred and fifty pound recreation employee walks up and says, I'm sorry, I need leave. I don't leave anymore. And unfortunately, as it stands right now, the police have a hard time helping us with that as well, because there's nothing that gives them the authority to do that. And that's what we're asking for tonight is the authority to have some assistance to where we can actually get people to leave the shelter and then someone is properly not really properly receiving from that shelter. Do we have any mechanism for letting people know that it's available for reservation or when they come up? I mean, it's a show for us. There's a lot of jumpers. There's a lot of jumpers. There's a park at the end of the year. There will be a few deep ducts on this passage. You know, right now it's going to be really Saturday at two. What will happen is a group will go and set up a camp that they'd off, take the shelter, and then a group that comes in at 10 when they're disposed to, ask to have their shelter. The ones that just crashed on the shelter, they say, won't leave. And then the people that paid for the shelter are not able to use it. And we actually had an instance just for Kiwisio, which is what really got this started, is the police actually went out, it was on a weekend, records staff wasn't available. So now one loan is called, the police officer went out, and then it actually broke in agreement to where they would share the shelter. And everything was finally made until the police officer left, and then the party that was there, the non-renting party, decided they were gonna turn their music up and infringe on other people's party and they just went downhill from there. But there was no way to actually get that. Non-renting party to leave. And you think that you have a solution here? We hope so. And you think that you have a solution here. We hope so.
