Cliffside sanitary district, as you know, is formed to provide sanitary sewer service and potable water service to portions of the Cliffside community in the southeastern section of Rutherford County. Comills, textile, company time on several mills in the community and provide the large volume of customers and users primarily for that sewer system. So, come mills, when they shut down the operations, which was serving churches, businesses, schools, residential units, continued to be served by the system. And so, the operation was handed over and a close-by-centred district was set up and authorized by the state and the free, which was basically a standalone authority that operated independently of the county. And at some point, I want to think it's been four years ago, five years ago. I think it's five years ago. The state ended up taking it over, running the operations, the local government commission, wanted to see the finances and the operations management system meet their standards so they basically took it over. And right now there are currently vacancies. Just to three member board and we have no one actively see any of those seats. State has finished the local government commission through the park treasury. They have finished their work on getting the budget. They're satisfied now that all the components of what they assumed responsibility the operations are managed for have been met. And finances are in good shape. They're ready to hand it back to the district. As I mentioned currently that we have no one in those seats. So by statute the county commissioners, even though the county has no governance, purview, or supervision management of close-side sanitary district, you do have the responsibility to appoint members to those seats when they are vacancies. Generally what would happen is the seats would be filled. And then at the next election, those individuals would run for election, because again, it a stand-alone authority which that means it was becoming up in November that names should be on about it. One of those out just in case there is interest in the public and serving on this board right now the commissioners were presenting to you at some point right now that you will not some point to now to go ahead and advertise for vacancies. In the submittal we get you'll consider and vote on those in August during the August commission meeting. Any individuals that at that point willing to serve, then they would need to file to run for those seats for the November upcoming general election. So that's what you have before you this afternoon, Richard Williams. kind of attorney did draft a resolution for your consideration for this afternoon. Actually, that's just apologize. That's the resolution the state passed in relations to this. All you need to do is just prove advertising vacacies for the Clipside relation to this. The county at one point had worked toward, this is for my time, I think former director, worked with the legislators to see about allowing others because there was some interest in the business sector or at least I know with Tom Sifson, classical academy about having to see at the table and legislators were looking at drafting some language to permit that and what they ended up coming up with the Richard I don't mean to step into the legal realm here, but the bill rotters came back and said that you could news Constitutional you had to live in that district and you had to be a customer Took the words out of my mouth sir It's a constitutional issue that's fine. I try I just want to make sure that you in case anybody had that question I've heard The general assembly the governor, no one has the authority to change that. Unfortunately. Very good. Thank you. Is it Section 5 for a sentence you have to be a 21 years old voter? I have no idea, sir. I am impressed by your superior knowledge in this regard. We were just discussing. Okay. It's only in. Is there any potential financial liability to the county here? We have no one there. Or is there a scenario with this district that could impact us financially. Not at the moment. The thing is uncertain is. What about, not at this moment, what are the worst case scenario? Yeah, well, you know, my crystal ball's pretty fuzzy when it comes to that, because there's not much in the way of predictability what state will or what they can even do. You know, it's come up in questions that we have as to whether or not they can require the county. Here's the worst case scenario. No one agrees to serve on the close-out sanitary district board then what. This board doesn't have, the county does not have the responsibility to maintain those operations going forward. If it be on the constitutional standing for the Board of Commissioners to be over there. There is none. Yeah. They, I think what the state would do is try to look around and see who would raise her hand. But from what I'm seeing, and again, I'm not an attorney that can interpret what that law means, it seems or it appears that the state couldn't just come in and acquire somebody to take it. Do you know what they can? State has all of us, whether you're a local government authority or a local government like we are, a local government. We're all just subdivisions of the state. State could, if they wanted to, they could pull the roadutherford County Charter and consolidate this with another county. They can do that with towns. They've had a history of that. The arties, it seems a little grier as to what they can do that. I think what they would generally do is look at us, look at broader water, one of the towns, and try to have that conversation with one of us to see would you take over the operations. The other option they have too is to go ahead and have a private company come and operate and manage that facility. So the question of whether or not they could make us take it, that's my assessment, my non-legal assessment is great. If they do, then at some point, it might require them to have to go back and revisit legislation that gives them more authority to require the county to take over the operation. If they do and that were to happen, then of course we would have to take a look to see what that means. There's not enough revenue generated by a close-up sanitary district because there's only 50, 60 homes on it. This is Thomas Jeff's classical academy, Cliffs Out Elementary, our library, our EMS base, a few industries were on it and several commercial retail and churches that are on that system, but it's a fairly small system, not enough revenue being generated to really go back and repair. The big thing that I was hoping would happen, which is not, is the state would go ahead and make the repairs necessary to get the infrastructure up to where it needs to be in 21st century standards. There's still a lot of terracotta lines that run all through those communities. A lot of manholes and a lot of pump stations that need fixing for lack of better ways of phrasing that. And then of course the plant itself was built and designed for a large industry. It doesn't have that kind of inflow coming in now. There's a lot of what they call eye-to-eye. Inflow and infiltration, it's having a large impact on how that system operates. Five years ago, we worked with WKDX and engineering firms and for that, with OTA engineer and WKDX to do an assessment of the system and inventory and find out what would be the cost to actually get this plant and infrastructure working to 21st century standards. At that time, it's $10 million, six for one part of it and four for the other, round numbers. If you know now the way inflation has been, that numbers multiplied, it'd be probably cost, it would cost $20 million or more to get where we need to be in five years ago. So that's the first thing we would look at as a county taking that over, is figuring out how are we gonna cover the cost for making repairs and revitalizing that system to where it'll operate more efficiently and properly. And that would be one large expense. And then of course the other challenge for us is that we don't have the engineering staff to operate or manage it or to maintain it. We don't have the trucks, the excavation equipment for maker repairs. So it would end up being that we would have to take a look at the county tax rate as it is right now to figure out what's the amount of supplemental funds needed to support not only the operations management of that current system, but to also figure out what it would cost to make emergency critical repairs and then ongoing repairs to get the system up and operating at a 21st century. I assume that if I'm a member of Broad River, I'm going to be very hesitant to take them on. I think whether the infrastructure as it is. Yeah. Anyone would. Yeah. The town state did take care of the infrastructure. That could possibly be someone that it might be financially feasible and profitable. That's correct. For them to do. Okay. I would acknowledge as well the LGC folks are having the conversation with broader water as well as the county. So many of us at the table to figure out what that next step looks like. Right now the most they can require the commissioners to do is attempt to refill those seats. I'll make a motion with past resolution. Second. Got a motion, second, any discussion? For clarification, the reason they want a citizen in the district to serve on the board is because that board actually sets the rates for the district. So you don't want somebody that lives there setting up the rates. That's correct. The opinion from on high is that it is a constitutional question because it is rate setting on behalf of citizens. And the citizens affected to be the ones to not just vote, but to govern. So no matter what happens, there will be a advantage to the cliff sides, the sanitation district citizens to step up, to settle this board. Even if it does transition, they did have a stake in the game of what those rates may be. Yes, sir. Have they? Any top of information been shared with those folks? I don't know. I'm eligible. Same as that would be an appropriate thing to do. You mean as far as from the state, the LGC and anything that's going on as far as those communications, either the state or us or somebody, it would just seem like I would venture to the guess. Director Rhodes apologizes for her absence afternoon. Just two items. One of them is for $22,500. This is for the county's contribution toward the school systems in North Carolina State University O Red Study. Dr. Sutton and I had a conversation last year after the presentation that Chairman King gave as to a possible route of having an independent firm come in that had some expertise in looking at school population growth and capacity and ORED was a group that was brought in based on a verbal that Dr. Sutton and I had is looking to the commissioners to see if you would be willing to cover that expense based on a request from the commissioners for the idea of a study to be done. No commitment, but at the same time we basically, Dr. Sutton and I had a handshake that we would come back to the commissioners if you would be willing to go ahead and cover the expense for that particular study for ORED as a result of that particular meeting and the request that came out from some of the conversation along that line. If it's so pleased as aboard, we have included that on here for your consideration. It's $22,500 for the ORED Integrated Planning Study. The other is Arbitras, I never can't say that word, correctly, Arbitras, yield reduction payment. So with the financing that we did for the RS Middle School project, I guess the good news is that the limited obligation bonds that we put out in 2019 actually perform better than we anticipated as far as interest is drawn, we exceeded the cap of what's for missable. So a portion of that would need to be sent back to RS, that's $8,158. So that's the budget amendments for this afternoon, gentlemen, glad to respond to any questions that you might have. Okay, for clarity, this $22,500, this is the third party assessment that the school board did after we made our presentation here to challenge them to get information, gather information to see what can be done with the disposition of the schools. The daily, what do you call daily average attendance? I know that's not the right acronym. A average daily membership. But more looking at the growth, you articulated that much better than I did. Thank you for sharing. Okay. Well, and so subsequent to our challenge to the school board to go ahead and engage these people. And we've gotten back a lot of very, very useful and actionable information. So we updated that, we did a new policy for black ice, and then we removed a couple policies that are no longer in place regarding some guideline memorandums, some duplication of driver training reporting to send, some other facets. And then I think that's all we had on here. And removed across the slow that we don't use anymore. We're getting ready for an audit by the state and the fall on this plan. I do receive an email right prior to our meeting that our DSS director Ms. Hunt is actually under the weather and it's unable to be here tonight to present this to us. However, I know we don't have a motion or second or action before us, but if the board will allow, I'm a little uneasy about this document. I believe it's written under the guys of a county managed DSS where our DSS is in is is a district line which means it's its own government entity because if you look on starting on page 8 it says the county hereby agrees it is responsible under the MOU for the following. It starts listing items that the county should adhere to mandated forms requirements. We don't do that now. That's the DSS director's responsibility. The county should apply the following administrative responsibilities. There's ABC and D with one, two, three for each one of those. Because this seems to be written in my opinion for a county government where a DSS is a department of the county under the purview of the county commissioners and their county manager. Where in our instance, our DSS is independent, actually, is a district where their own governing body, own governing board, their own chairman. And they're the ones responsible for the operation of the SS. I may have made a mistake because I'm not an attorney. The other Brian King is. But so I'm asking the board for any kind of discussion on this right now. I think it's sound reasoning and I like irrational on that. With all these considerations not being under our purview, I think it needs to be rewritten. And I think we should table it. And send it back to the state. I think I'll be on the table. It's showing a correlation between those other terms and the definition of what county is, and each one of those has to do with the SS. County Department of Social Services under one, County Director of Social Services, County Board of Social Services, Child Well for Social Services or Program. Social Services Programs or Social Services Program and other medical assistance. No way it isn't saying anything about County Manager, County Finance, Trib, County Commissioners. I think you make a good point. Glad to see you taking this action because it may be that maybe it's not necessary for anyone in the county that's left to sign. This is all a DSS theme because they all these are all the items that are asking for as far as maintaining governance within this OmoE between DSS and the state the HHS it's all referencing those things that the DSS director has control and management and operations and oversight of not the county manager nor the county commissioners exactly so in essence we you know why should we sign something that we have the governance over you know it's and the DHS is the only person who needs to be signing. It would make sense if we were a consolidated model, a DHHS model, but we're not. They still have a government board. There's still not a autonomy of how they operate under state personnel. This is a resolution acknowledging the Ruther County Board of Education declaring surplus certain real property like the recognized county manager, so you bear some of this. Thank you, sir. So the Ruther County Board of Education declared a certain portion of property of the old RS Medical Property at surplus. This is taken during their July or July meeting? Nope, June. That's their last June meeting. So now that's been kicked back to us. One of the North County General's statue requirements its commissioners. They send a request for once they do the big declaration of surplus property, then round of first refusal on New that pop-in center later. So that has to be submitted to the county next. A little different this time is that rather than the clienting where I'm making a recommendation to the commissioners this afternoon that you consider accepting that property. So once they've committed it to offering that to us, the county, we have expressed some interest in acquiring that property, a surplus property. So what we have attached, thank you, Attorney Richard Williams, a resolution presented for your consideration this afternoon and authorizing myself, County Manager, County Attorney and staffs, and the Gochette terms and conditions. I'm an agreement for the purchase of that particular property. And the NIST agreement would be brought back to you for a later-different consideration. So we're not asking you to give us permission to take next steps to acquire the property, just permission to start the due diligence.
