Good evening everyone. Welcome to the first December 11th regular schedule meeting of Esper City Council. We welcome you all here. If you will, first of all, stand and join me in a moment of silent prayer and ask that you, if you choose to pray in your prayers, remember the significance of the day that we're in today, not 11, and all the families in the victims, not 11. For our first item of business tonight, I'm gonna call on the City Manager, John Auger, to highlight an award for proclamation. And he'll be can tell you about that. And I'd like to thank John for you all to come up. Recently, personally, in August, the city hosted the eights and pounds, which is the Margie Goodhall and the criterion for migration. And at least that lasted. The other front quarries, the official orders by and the criterion for migration, which we've done that to the Federal Practical Police, sign an official order making it official, North Carolina, Kansas City, and Martin East Society Championship for the State. So this caught by the winner of our Feeds and Fells event to be a massive event like the Jack Daniels, and his work in Tennessee, and the Memphis in May, and Memphis County City Tennessee and of course, can't sit itself for the tribute. For sure, Pete Cooper at Barley D Specialist, he had given the needed energy man with the death of Dr. Trot, and he said, what if I drop in and hear his old pain that folks were able to put up, recreation services in front of him, and fantastic job getting all together, is it on the road prep that the guy knew he was supposed to like me? The most important thing to know is that this was our first attempt at a major competition like that. It came out really well and was a big boost for tourism tourism and ask for a roundup down here. We had a great effort on behalf of the city by all the city employees that were participating and our police were a big part of that. As you notice, we have quite a few officers here tonight. So thank you for your hard work on that event. I'll call on the Chief Norton to come forward. Thank you. Thank you. Thank you. was retiring to that effect at September 1, with 30 years, possibly 30 years, total service with the C.M. Asheville World as well as the State of North Carolina. Stop now going back a long ways, I think since it's not first grade. We were in first grade together, stopped post-hospitalial then. We grew up together, ran so over, first grade, middle school play, little league baseball and same team, and all the way through last middle of the day. Our first real full time job was with the State BLT, being with us there about the same time and being found our way here to our final home, which is after the City of Asheville. I can't just move it before it is. So it's gotten around a long time. He's always been a great guy. In fact, when the man in the brother worked with a seed, he didn't know the great guy. But we're very fortunate to have had him for the last 24 years here at the City of Asheville Police Department. I always liked him. When Scott was a reserve, he would come to ride with me a lot at night. We had some good adventures and a great time then. And it's an opening came open and Scott came on to the farm full time. That was why we had a long time. It's a great kid. He's probably on morale. I think I'll be coming. Yeah. Great family. You can't beat those people that work here for the city. And the city were very fortunate. And actually, most of the rest of the world. And a lot of other city employees that had fortunate to work here for the city and the city were very fortunate, National Specialization work and a lot of those people always had been fortunate to work here and through Spouts for Rear, it's an incidental control like all police officers did, it's an incidental control, by some attitude it has to look in it, I've been invited to sergeant before that, it's an incidental control, it's a sergeant work that has SRO Supervisor, the corporate major, and so we had a very broad experience and a lot of different duties and certain law capacities. It was always a great service and a problem. Anybody that does 24 years long tour, makes a lot of sacrifices, a lot of sacrifices, family time. You can't do that without writing school from this family. A lot of years, parents, so that would like to congratulate you on the Cup of Ireland, maybe in the third year or so time. Congratulations. I'm going to just make real quick, I've enjoyed my career for 24 years in the city. I came in very young, I shared her child, I learned a lot. The city's been great in taking me. And I watched the city grow on the crossburn, and I watched the police fall on the crossburn. I think it's, you know, great place, great place to be, great place to raise your family. And again, I just like to say like thank you and I hope not to be a stranger and come around so you're sorry. Thank you. I need to make a couple of remarks here and I will say for the record, you know, we will miss you. You've been a great officer. I'm looking at the two of you and finding out that you started school together and all, thinking, what happened around? He didn't look. He didn't look so over there. But actually for the record, I would like to mention that there are quite a few police officers here in attendance tonight for your retirement and that's a testament to your friendship with these guys and the work you did for the city and we wish you the best of luck. Before I begin, for those who are planning to speak this evening on an agenda item, we're in public comment period. Please help see 35 clearly right under name of the I am here speaking once we can get your name spelled right for the record. This is a request. I'm Mr. Platt of Pals to resume. I'll be waiting at 9.50 Martin Luther King Jr. Drive. The existing zoning on the front of the U.S. R725 is maintained residential. and a small portion of B1, which is neighborhood commercial. The request is to design an entire property of the two general commercial. One test, R1 will number included in the request over all the properties just under two acres in some. There's just a maintenance on the property currently under the development of the preaches, so there was a structure that most recently used as a church which had to renew for the next year's natural and fishing. I'll note the applicants reason to stay in on the application for the resounding, which is to do a community center. The applicant has been used as a church in the factory, resounding all the agency community tremendously and raised the property up to date. As you all know, this is a straight B2 general commercial zone, the plus they should consider all the potential uses that could be developed on the property in that zoning district. But the applicant has provided very, very important at this time. Take a look at the zoning records included in your packet and above the screen. So the property is outlined in red here. There's almost outside the of the warmness of the Union and the drive. A few properties to the west of the Bayou-Aid road, at the Spring Street, and just east of the intersection of the warmness of the C.A. and the C.R. Falls Road. As you may know, those with a closed search can get my idea. The ground is on, it was also based on the floor turn on the later slide. But you can get a problem on in red. Person in crime is the current zoning of the majority of the property, and that zoning continues to the east. This small portion of the property is on these ones, it's never in commercial, and it is included in a relatively large area of existing commercials on the farm park in the area. To the south, you have an existing D2 General Business District that fronts on the Salisbury Street, as well as residential zoning to the south of the property in the area you can see is rolling as you do sound with from the frontage and one with the king, cheater drive, but the front half of the portion of the area. Please focus on the property. If you have an IDF, you develop the patterns. I think you mentioned the east of the area. The existing being one commercial, being two, general business and south, and the residential sub-election two, the Southwest. Including some photos of property, looking east. This is looking west away from the subdued property at the intersection of spring streets. The submachine looking south down spring street, just near the subdued property, business substation is properly actually getting before it gets to the surface. Including the typical analysis in our report, I'll note that the property is inside the city limits. All city services are available. Martin Luther King in your drive is taking and taking part in their affair south-street street street in local street that city may things. You look at the intent of the request of being to commercial district. It is intended to serve the convenience goods, shelter's units retail and service needs and other public, both local and transient. This district's all we look at is access to major honor third player and never with access to major on their fair and then never with access to the mixed local streets. Hey, 3,000 square foot structure. All is pretty soon on the site. So when you've been there earlier this year, available information that we could locate indicates that the structure has been back in the news as well as on residential uses as early as 1960 and there's non-residential uses that we could both illustrate on institutional type uses. The structure and its parking were located on the portion of the property that currently is zone 7.5 so it had been a non-conforming non-essential land use. In turn, the city's comprehensive plan for some guidance on the value of the request. This is the primary growth strategy area for the city and city service are available. And we can promote development in those areas first. It's very close land use map. The western portion of the property is right in the developed commercial. The S2Vs and the majority of the property, the L-D-T, reflects the existing zoning laws on the ground, which is the same thing as the mentioned one, makes that the recommendation for continued playbues. Overall, in addition to the most advanced staff felt that there were nine goals policies that were generally supported with the request, two attendance to speak natively towards the re- regional and request. Overall, staff does recommend a firm rule of the request. And the final board did also review this request that it's being last month and recommended it for you as well. And one day I would portion the properties already zone being on neighborhood commercial. And although the occupants of the planning for purposes is a neighborhood residential that uses on the property that is currently on residential, that the history indicates the property has been used for non-residential purposes and can't be discontinuous to existing future versions of into the South. We will play organization regional and division of transportation projects receiving local input points in conjunction with the NCDOT strategic transportation investment. is the resolution about the athletic official to comprise all four counties, the region's technical advisory committee, which I'll point out is chaired by Councilman Baker, as well as the committee in the packet, our region's final project priority lists for both regional and individual level project needs, or submitted to the ATH as part of the SDI law. You may remember in June of this year, I breathe the council on process after June the head of the leads, the technical scores, of the LARSA-VITED projects. And at that time, we had several projects at its core, Barry Webb, they securely owned the technical standards of their projects. So this year was pretty good for you and let us believe that we had a decent chance to get to some of the projects on the new design. And for you this, thankfully it was like we still do that big chance to see that funding. Since my last update, the staff has been participating at regional meeting to all council members and they've been working with the visionate staff to determine what projects should be designated as priorities in light of the number of factors. But primarily in light of mean, the technical merit that the DOT has placed on the project, and ultimately, the likelihood of thisOT has placed on the project. And ultimately, the life they had of this project is received from them. And on August 29th, that effort completed with the adoption of the project list that are included in your package. I just don't know what package it is. I don't need to do more of this. It's only a lectern. They'll call the email. They came by of email, but I'm not sure. I did a reading of what you know about me. You knew you were on the screen. But I do. I've been putting the best of that most. I can't read. It is online, probably. Yes, it is. So let me summarize what's online. You don't see it. There are seven aspects of related projects that made the list for final consideration. And those seven appear to have a reasonable chance of being funded. Again, when you see in fact lists, those are the projects that have a green shade. And what I've done on this screen is pulled out of those, essentially there's roughly 30 projects that the Fort County region had wanted to be included for consideration. I pulled out the ones that are built into Asheville and have a decent shot of getting funded. At least that's our best guess at this point. We'll now more in December when the draft the FESR released and what my idea, what projects may be constructed with that metronome funding began in 2016. This round we're planning for begins in 2016. But I do want to recognize Councilman Baker for his leadership on that committee. This is the first time anyone of us elected officials or war staff throughout the state has had to go through this new process. And it wasn't easy. He did a good job of getting everybody involved in doing what they had to do. It caught in that process process and unfortunately for us we bear the amount of well we could under this process. So I would be happy to get the materials printed for you. They are online but just know that we have a good chance of seeing some substantial agreements over the next six years. Are those in order, Trevor? They're not really in any particular order per se. I will say the ones, maybe the ones towards the top of those columns probably have a better chance of remaining funded than the ones towards by the... We've been cheaper. Yeah. It's going to be interesting. A lot of this in the panel, but the other divisions submitted in front of the CD. Come on, let's see how you can figure it out. Mr. Mayor, I'd like to say that I really appreciate having clever and this committee. I think he probably understood the process as well as anybody in the whole thing, and he was a very valuable member in making these seasons. And we had to do those horse trading. We not only represent Redmouth County, we represent Caswell Rock and Am, and Montgomery County. So we had to look at the total picture. Unfortunately, Caswell County just didn't rank to, but we were able, hopefully, to get at least one project for them. But we were given certain numbers and don't ask me how they come up with those numbers but if we got to a certain level the prospect is or long that this project will most likely be approved. But when they put it all together those numbers are going to change. So we've faired real well in this process. Yeah. I think it's safe to say that it pays to be one of the larger cities and division eight. And it wasn't our process in putting this together, but this will be asked to work with. I told the vision engineer that he won your ass role in planning based on the new process, but there are certainly some rural've got a direct real impact and have always seen this and that's worked that way. The caveat to it all is you've got to watch the state level funding, of course they have a 10% variance in that and you've got to, you know, they're selling it but a dollar. You know, if the state level funding increases by 10% is coming from someone, but you do have, this is the best process that we've seen the most firefuls. The ol' equity thing just ended up, pieces of road scattered all over Illinois. One item I'm not mentioning is that we are paired with Region 10, which is Mecklenburg, which ain't good. Which ain't good. Which ain't good. But I think we're both there all right. It is, I think we're too high to, but take some howling when you like pack me. I mean it's, thank you, Chair. Well we're telling that road projects, let me just let the council know for a point of information that while we were expecting the Mac Road stop-like project interchange improvement project to go to Bids in August that did not happen. It's been postponed to October because of right away acquisition difficulties and could possibly be moved out again. If they can't get together with the property owners on a couple of pieces of the right away then it could be moved on out again but we're anxious to get that that interchange and improve the stop light there and at 64 at the bottom of the hill. We'll greatly improve the access on Macro 49 64. How was that that way today? And was it that activity from the north side of 49 directly opposite where Macro comes in 2, look at the power of those leading programs. Well, and they may be, they could be doing that bit. It is some significant impact on the whole of the program. A lot of businesses in the small, for a small area. You know, so it's, but it's, so. So they're still negotiating and it's been moved out to October and possibly will be moved again Just point of reference because people ask Ask us those questions about when they're gonna do the stoplight It's been in the paper that that was going to beds in August and just for a point of information that's been moved I'm sorry. They're not going to cancel meeting in order to receive evidence of a potential public health nuisance to a replacement under section 168-193 of North Carolina General Statutes. Thank you Mayor. In August, staff received a letter from the Randolph County Health Department indicating that an abandoned pool locator on property in the 901 Marlboro Road, posed a public health nuisance due to its current condition. Preliminary investigation by city staff revealed that conditions likely did exist on the property relative to the pool, warranting action by the city to evade the nuisance. This evening staff requests a council of co-op public hearing to be held at your regular meeting next month October 9th. To review any evidence related to whether that nuisance abatement operation should be undertaken. Adoption of the resolution this evening will direct the staff to gather all of the evidence to be presented after the hearing. And also calls notice to be made, which includes publication as well, so I'm going to show the property. Just to let everybody know that the property we're talking about and needs to the specific issue relates to this, abandoned something cool, so that more road. And she's drawn on it. The first issue of me is that I feel like I need to take action on it. The pool we're doing this evening that to ask you to schedule that here and to proceed evidence. Okay. I do the question. This is speaking to the microphone and first introduce yourself. My name is Mike Overley. Thank you, Mr. O'Reilly. Go right here. First, I just wanted to ask a question. What I'm going to say if it's not actually part of the agenda, is that okay? Like, this is just any comments about anything. There's no way you can address a council tonight at this point, a point in time on anything that concerns you about the city of Ashburton. Okay. Thank you. This is the first time I've attended a council meeting, Sam. Not always sure what we're talking about. The protocol. Whenever a council meeting does. Sam, I don't like to know how you can see people coming. So I just have some questions for you guys and it's referring to the residential garbage can and recycling can fees that were just introduced. I was just wondering how you decided to come about charging the amounts that you're charging and why you chose to do that. Thank you for coming by the night and you're doing fine. We've had a lot of practice this year first time. Over the past years since essentially 1992, the city up until 1992, when the city dumped a garbage in the landfill, it was no charge to the city. So from 1992 to 20 beginning July 2014, we were able to consume that, use that funds out of our property tax revenue. Now this is it's when the council has to make decisions about the budget they have to look at the city at the whole so me and you as individuals might might not create garbage but the city creates 20,000 tons a year which which translated to about $800,000. So in the revaluation year that the county just had on our property tax, the actual total value of the city went down. So the $800,000 is what the six dollars adds up to pay our fees. So there was just no where the council also raised taxes in this fiscal year too. So the council was hit with like triple when fuel prices lower values overall and then increased sanitation fees because the landfill we go to is in Troy and it continues to rise too. So that's how the council came up with the price that washed itself out. So is this going to be an ongoing charge that's going to go on forever and ever? Or is this a temporary thing to- No, it changes. It's an ongoing charge. But the council, if you may have seen in the paper, the local news, a lot of our calls are born by shipping back and forth to Troy. If there is a landfill in Randolph County reopened, and if it's cheaper, and if the council can get a good deal on our rate, it may translate to lower rates there, but in the long run run that's probably a pretty accurate fee. Now up until this year the Council never chose to do that. Our sister cities, Sanford, Salisbury, Thomas Field, Archdale, Randerman, they already had the fee for years and like Thomas Field and Sanford and Salisbury are like 13 dollars so we're about half. So the council is trying to cover as much of your garbage fees into your property tax as possible. So did you ever discuss the possibility of... I know that this isn't very efficient but did you ever discuss the possibilities of basing it off of say for example you live you're just an individual that owns a house you don't produce as much garbage as say a large family and if you don't put your hands out as much because you don't have that much trash did you ever think about basing it off of come you know how much trash each and the residents actually put out for pickup? Yeah, like a like a pay as you throw program kind For the or something along. Yeah, but for the council's perspective though The truck has to run the route all the time. We don't go point to point so Tomorrow's Friday it'll be west of North Fet North West of fabula's great all that section of town will go will ride by about a 4,500 stops tomorrow and we don't know who puts their can out or now not without having a point to point service which would probably be a lot more expensive if you were to hire that fee if you were to hire a product holder to come to your house and pick your garbage up twice a week, because we come by your house twice a week, you're probably looking at 50 bucks a month. I understand that. I guess like for the recycling part of it, we've got sites that we can take our recycling to, but yet you're still picking up recycling at the home. So couldn't people just say, you know what, I don't want to pay your dollar because I can just go run it down and drop it off at the recycling site. Except the truck still comes by your house. That's the dilemma that council faced because your neighbors might not choose the same option. That's the dilemma the council faces when they're setting the sanitation fees and schedule. I mean, and we've really worked to really make it as efficient as possible. You know, we have one driver per truck. It's completely automated so we don't have the old way of three or four people in a vehicle. Our transfer station is one person. It's, you know, the scales are automated, the equipment's automated. The council bids out the fees, where we go to the landfills, tries to get the cheapest rate possible every year. And we're trying to, and actually that recycling rate is a lot cheaper on your piece than trying to encourage people to recycle. Actually it's a price per ton for recycling is a lot cheaper than our price per ton for garbage. Because one reason it stays here in Ashboro, it just goes to Ashboro recycling and they process it, which keeps us from having to Erie we Let Kim Markman asperer recycling do their thing in the private sector go out and convert it to now does the seal to make any money off of the recycling We do if we sell the cardboard, but our materials It would take a lot more tonnage than us to make any money In other words, it doesn't even have it It's more time than us to make any money. In other words, it doesn't even have a lot of money. It's cheaper. It don't make any money, but it's not paying the regular garbage price. It's 10 dollars a ton cheaper than the waste. Yeah, it's 10 dollars a ton cheaper. And if you were to take your can away, if you were to say, have the option and say, you know, I'll check mine downtown, you might. You probably would, because you're concerned about it. Many people, if we took their great can away, they just thought the garbage and our tonnage would go up and then it consequently our cost to dispose of the garbage or total cost would go up. So every pound that we put in recycling can saves us $10 a ton. The ton each. The more ton each we recycle the less we're paying the dispose of the garbage. So, yeah, and they're getting that stays local, we don't have to truck that to Troy and we pay the company to take it, paying him cheaper and there's very little market for the glass. A little bit of marketing. Yeah, yeah. So, one of the most, one of the things that the citizens have shared with us over the years since we started the curbside. We used to have the three drop offsights and expect people to sort and carry it down. And when we started the curbside, we phased that in over a period of three years. But we planned to place it in for five, but there was such demand. Yeah, we did it for fourrants and we would buy enough cans to do one quadrants. The next budget year we purchased the cans for the next quadrant and everybody that had not gotten them was anxious to get them and everybody that had gotten them said it was the greatest thing we would do. Our difficulty is, as John's been trying to explain, is that our costs keep going up. And our taxes this year had to go up. And that $7 that we're talking about on the garbage week. A lot of people are selling it. That's all right. Go ahead. Go ahead. That's what you're saying. All right. That's what I said. You said so good. But the fee could have just had All right. That's what I said. You said so. Okay. But the fee could have just had easily been put in your taxes. I mean, and that's the dilemma the council always faces. Do we? Everybody charges fees and fees at the bank or fees at the city or wherever our story get out of hand, but we have to decide whether it's better as a tax, property tax or a fee, and spreading the fees out to all of our water customers. And that's where the bill shows up on your water bill is more fair to the property tax payers, because not everybody is a property tax payer. So we we elected at this point to share that spread that out and put it on every water bill and not just the tax bill. And the other thing we originally had three drop sites were down to two when the senior adults moves out of the way and moves across the street will probably take that recycling out. We've kept the drop sites cause apartment dwellers don't have anywhere to because they have dumpster pickup. But probably over time will actually phase the drop sites out as we work out a recycling program for apartment dwellers. And I guess my other question is, does every, I mean, this is just residential, do businesses, do they pay, it's something similar? Do they pay a lot more? No, businesses have had a can fee for a long time. If you have a dumpster, it's a collection fee. If you rent a dump to firmness, a soft sort of fee for that. And a big industry like Klossner or Energizer, they have big, big roll offs. We don't serve a stem at all, actually. The private companies do the large industries with the roll offs. And a lot of our, they pay a lot more. And they pay a lot more. And a lot of our, they pay a lot more. And a lot of our, a lot of our smaller industries, uh, choose to use a dumpster, a private dumpster service and not the CES dumpster service. Yeah. So I was, cause I was going to see if they use those like you mean, even with a lot of the businesses along 64, you're not able to compensate for that and that was some of the calculus development they have a real high level of a lot of property tax and they're not serviced by our sanitation. Basically the concern with McCree Ball Park, if you've been out there lately, it was originally constructed in 1947. The concrete decking is cracked, there's a lot of steel that's rusted and it's just kind of a safe to concern as well as just honest. But the proposal is for the final major. Let's emphasize here that it was a serious safety concern. It was built in 47. 47. The understructure was all rusted and fallen off. Yes sir. It's a lot of the pans that go under the existing structure that hold the concrete or no longer structurally sound according to the engineer they're resting completely through as well as the bracing as well. Basically what we're looking at doing for the project is removal of all the concrete decking and keeping the remaining superstructure and the building of the Grand Standard Clinton, the roof, with the exception of what is going or what is currently the press box that is going to stay in place with extra bracing to support the concrete. And there'll be running some extra supports along this area. And it's going from 200 and 90 scenes to 321 scenes and we're also able to incorporate a ramp for handicapped access with handicapped scene. handicapped scene is required for the number of scenes that we're having come out to six handicapped scenes And there has not been handicapped seating in this grandstand. That's correct But because of the Brains handicapped was Required and it came up to six wheelchair access ramps. Basically what we're looking at doing is removal of the concrete decking and replacement with aluminum decking. Aluminum decking of being kind of around the beam in steps. And the seats will be mounted on, and you'll have a set of steps on the side for access. There's also executive seating here, and you'll have this existing stairs. The seating is going to look like this. It's basically a traditional type of color of the legend. It's going to be green unless otherwise I'll tell it otherwise but right now we're going to be choosing green and this is a shop from the rear. We're looking at proposed bid date of September 16th with anticipated project length of 120 days. We had six contractors interested in three from what and come from around the state and one from out of state. The flooring part will be solid. It's going to have a texture to it. So that took that way less than half of the original seating there. So by reconfiguring, you make a smaller deck and putting seats on each deck works out better.
