But this is a dual rezoning conditional use permit request that has been filed by the property owner Ken Galamore for property located at 1431 East Salisbury Street. Again, it's to take the property from the residential low density district, which is R 40. That says conditional use B2. It's actually conditional use I2, so you need to note that on the screen there. But it says a request to go to an industrial, general industrial district, with the permit for those previously indicated uses. There's one parcel number involved with this request. The size of the parcel is 2.67 acres. Formerly, we had a rental sales of heavy equipment prior to the city's acquisition of the property a few years ago. Look at an overview map of the vicinity, the subject properties outlined in red on your screen. It is at the intersection of Morton Luther King, Jr. Drive, and East Salisbury Street. It's across from the rear entrance to Randolph Mall. We zoom in and look at the zoning in the area. Again, the existing zoning on the properties. B2, it's a request to go to conditional use I2. I'll note that we have large expanses of general business, commercial, including Randolph Mall into the east, immediately to the west of the property. You see that white area that is zoned, I believe that's R10 on the screen. That area in white and any area in white is actually not within the city limits, but it is within our extra-characterial zoning jurisdiction so the property to the west does border some residential properties. Included topographic map of the area also gives you an idea of where city utilities are proximity to the subject parcel. There's no worthy environmental considerations that affect this property. proximity to the subject parcel. So no, no, no of a mixture of land uses and commercial and even one conditional use eye to district a few parcels to the west as you move east it's primarily commercial me to district. Now several photos showing the subject property this is a scene from East Salisbury Street. This is a view from Martin Luther King Jr. Drive. We're going back towards East Salisbury Street. We have a shot because the it does have frontage on Martin Luther King Jr. We are looking east along Martin Luther King Jr. drive there and that photo and then west in this next photo. I do have large versions of this plan if anybody would like to see it but as is required with the condition of use permit request the applicant has filed a Sip plan that has been reviewed by staff Found to be general conformity with the zoning ordinance Some highlights of this plan it does show an addition to the existing principal structure Thousand square feet in that areas is hatched on that existing building that's towards the center of the site plan. There is a new, I think it's 7200 square foot, a new paint shop that's proposed behind the existing structure and that building's crosshatch as well. So any new buildings are essentially crosshatch on this plan or reshaded. There is a potential for the existing accessory building which fronts along Martin Luther King's eunuchado to either be enclosed or demolished and rebuilt to the cities in conformity with the city's zoning center. So they do have plans to either reuse the existing structure or demo and rebuild consistent with the city's requirements. So that is also noted on the plan. The plan also shows improvements to access drives as well as new parking areas all which will be paved and there is landscaping shown as required by the ordinance along both streak frontages as well as a buffer screen along the what is the Western portion of the property adjacent to those neighboring residential land uses and residential zoning. APCAN also gave us elevations of both the rehab of the existing building as well as an idea of what the new construction will look like. I have included those in your packets. Just looking real briefly at some analysis for the rezoning aspect of this request, both the Salisbury Street and Martin Luther King are maintained by the state, or designated minor thoroughfares in the city's comprehensive transportation plan. This property was brought into the city limits in June of 2013, but it is not currently served by city water or sewer. As I said, property was previously used for rental sales heavy equipment, which in fact was a legal non-conforming use under the current B2 district, because that also under today's rules would be a use that would require an industrial zoning district. That structure, the principal structure on the on the property of peers, corner tax records was built around 1964. If you look at the land development plan for some guidance on the rezoning aspect of this, the map does identify as commercial consistent with its existing zoning. It is now in the city limits and as such was noted as a primary growth during our most recent update of the plan. Previous to that, this was within an economic development area of the city. Look at specific goals of policies within the land development plan. We believe there's five that generally tend to support the request. Two that tend to be negative towards the request. Overall when it comes to the zoning aspect of this, staff does recommend approval of this, citing, you know, it's commercial designation within the land development plan, the fact that the East Small Area plan recognizes a need to accommodate industrial use and expansion of industrial uses within the Eastern portion of the city. Again, it's in a primary growth strategy area. There's no environmental factors that limit the development for this property. And again, it does have additional course on additional use permit that is with the request that we think can help mitigate negative, any negative impacts on the joining uses. If we look specifically at the conditional use permit in the specific development plan for the project again, we have some building additions that are shown as well as a new new construction, totaling 7200 square feet. Again, potential for inclusion for the existing accessory building. The plan does show the required landscaping along the street frontages as well as along the western property boundary. I'll note that there is no provision or notation related to open storage of materials on this property which would have to be screened if that were to be proposed. Therefore, that is not something that this approval tonight would allow in terms of open storage of materials. We do have some suggested conditions. Should you find fit to approve the request for the permit? Number one is just to ensure that that Western screen or buffer meet or exceed the requirements of our landscaping requirements. There is some existing vegetation that as always we hope can be retained and used to meet some of those standards but there is also some open areas along that boundary where some supplemental vegetation will have to be planted. So we want to note that at the end of the day, we have a buffer screen that meets or exceeds the requirements. Likewise, Martin Luther King Jr. Drive has some pretty substantial trees that probably can meet the front-yard landscape requirement along that front edge. If we find that during construction or development, some of that changes, we do want a condition that ensures that that requirement is met. The last substantial one is really related to a decision of the North Carolina Department of Transportation and that is pertaining to the easternmost driveway that's shown on the site plan. We have received some comments from DOT that they would like that second driveway either closed or relocated to be further away from the intersection for safety purposes. This condition only says if that, you know, whatever DOT ultimately determines and conjunction with the applicant for that driveway that those revisions can be made without having come back to council for re-review. And lastly, our standard condition pertaining to the reordation of the memorandum of land use restrictions to put the public on notice of this permit. As I said the planning board and staff both give this request to you with the favorable recommendation. Findings of fact are up on the screen now. This is the responsibility of the applicant to present testimony related to these findings. Mr. Mayor, I will close my remarks and we have to answer any questions or turn it over to the applicant. I want to thank the city and the council for their consideration on this don't change here and I want to refer all the questions over to my relative and to the site plan manager. Okay. Okay. Thanks. I think the sector has many of these type operations. There's already a couple of body shops. The Mall across the street has a car-related service at Sears. NAPA's right down the street. Now at the very opening of Thal's Berry at the 64 entrance we have two, actually three new car dealerships. One of those has a body shop currently. And speaking to the four way test and he's asked me to do that if I could. Again, this business is usual. There's been a lot of work done on the site plan to make sure it meets most of the conditions. And there's been much conversation with DOT and that will be resolved on any drive cuts that they might require to be changed. If that's the case, then it's a be it that will be done. So I think that we've done most everything necessary to see that it certainly does not endanger the public or their safety and it is, I think it is consistent with the growth plan and the map plan of the city. On the second issue, the USMEs all required conditions, the specifications of ash verisoting, zoning ordinance. I hope so after the time and efforts we've spent in drawing up the plan, we've made a lot of efforts to make or can has along with the engineering firm to make sure that that was taken care of. Item three that the use when I was substantially injured the value or joining or budding properties or that the use is a public necessity. Well, auto repairs always a necessity, but speaking to property values, I think in looking at the property today in this current condition and looking at the site plan and the proposed improvements, I think, and looking at the property today in his current condition and looking at the site plan and the proposed improvements, I think we all will agree that would should improve the aesthetics in the sector. And I would hope that it would help the joining property owners value. Item four, the location and character of the use if developed according to plan that's submitted and approved will be in harmony with the area in which it will located and in general conformity with the plan of development of Ashburn is in Byron's. Okay, whatever that means. And babies you want to tell us what that means? Anyway, I think it is certainly consistent with the sector. That's a growth area and there's lots of lots of development that's already taken place. And I suspect a good bit more that will take place in the future. The engineering firm is here. Can you tell me the public hearing of the question of mending the boundaries of the primary fire limits? Thank you, Mayor. Last month I discussed staff's intention to take a look at the boundaries of our primary fire limits to see if any changes might be warranted Since those limits were last reviewed If you recall and I put these same slide up from last month But it but a city is required to define our primary fire limits The purpose of the law is intended protect urban areas that maybe if vulnerable to fire due to building construction type, age of construction, proximity of similarly built, an aged construction. And under the statute, no wooden or frame, wooden building or frame structure, maybe erected, altered, repaired, moved either into the limits from another location or from within the limits itself without the approval of number one, your building inspector, but more importantly, the Commissioner of Insurance or Designee. Again, this is another slide from last month, but it does show you the boundaries of our current primary limits, which as I told you last month, extend all the way from presinol to kivit north to south and church street to the west and offset off a north fable street of a couple hundred feet to the east. Fire department as well as community development staff including our building inspections and fire inspection staff have done that analysis. We looked at year-build for all buildings within the current limits as well as an evaluation of building area densities by block and that's important because that's mentioned within the building code in terms of how we are supposed to set the boundaries of this district. We also looked at occupancy types, access to fire hydrant, proximity to fire station, all those things were part of the analysis that we performed. We also talked about changes to the building code that have been added to the code since the last review, which I think was in 1983 of this boundary. We also talked about investments that have been made in the public safety emergency service arenas since that time. What we find is that the greatest concentration of structures, whose construction predates modern, what we consider modern building code requirements, was really contained within the blocks bounded by West Hallsbury Street, to the North, North Avel Street, to the East, Academy Street, to the South, and South Church Street, to the north, north-fable street to the east, academy street to the south, and south church street to the west. And those areas are already within the current limits. This map on the screen gives you an idea by color coding, the age of the structures within our district. And we also did a buffer around our current limits to get an idea of age of construction, beyond immediately adjacent to our district, green being the newest construction, yellow being older than that, and red being the oldest construction that we have here within the downtown area. Structures that are located beyond those blocks I just mentioned tend to be of newer construction tend to be more frequently set back or detached from one another and set back from property lines and we believe that they are this entire area including areas beyond those blocks, are within an adequate distance of fire station number one to ensure timely fire protection services. This is a map that gives you an idea of how densely built upon our blocks are. Any area that's in red means that more than 50% of those areas are built upon with structure square footage. Yellow is a little less dense than the red areas, but the vast majority of our existing limits are noted in blue on their meaning that they are less than 45% built upon or dense by block. So as I said, you know, areas outside of the Salisbury Street, Bayville Street, Academy Street, Church Street, boundary are tend to be newer, set back, detached, have adequate access to the fire protection services, in light of those findings, a staff recommendation that the council set a public hearing for October 6, 2016, on the question of whether an amendment to these limits should be made. In the past, we have approved various economic incentive agreements with some of the industries in town and some things have changed in those industries operations which are not allowing them to meet the criteria that was originally agreed upon. So way back when, when we approved all all these we set up a budget to provide for all these economic incentives since it does not appear based on feedback from these companies that we will be they will be asking for these incentives then I'm just cleaning up the records by eliminating them as proposed expenditures over the next few years. It will just make our final clean up our financials a little bit. The other thing is setting up allocations for various economic development agencies that we provide some support to during the year and for pigs and petals. And cleaning up another cleanup for the economic development and tourism development fund was a project that we cleanup for the economic development and tourism development fund was a project that we had for the radio reading of replacements that have been concluded and just cleaning up that budget. The ordinance to amend the general fund is to take care of two primary goals. One is we did receive a grant for $65,000 for Peninsula Park, for Lake Lucas we received that on August 10th. Therefore I'd like to set up the budget to allow us to proceed with that project. The second item or goal of this amendment is to allocate the proceeds from the sale of the property that we were just recently talking about that the sale went to Mr. Gallemore. For various uses throughout the city, some of the money will go to the consultant fee that you agree to. $40 plus thousand will go for sidewalk improvements. $100 thousand for construction purchase of and construction improvements for 134 West Wamen Avenue, which is the where our current recycling center is. It's a cost for more of the old senior adult center was setting up $55,000 in the airport budget for the Franklin partnership contract that we would like to enter into to try and assist us in negotiating some additional funding for the airport project, the airport expansion that Mr. Leonard is going to be talking about. $5,000 for a pilot project, for a wireless environment downtown and making some changes to reallocate resources in the original adopted budget to account for some change in staffing through a movement Reed, leave the lead. And we'll be votes. First, she got the GFOA award. She was forced to not receive the $206,000. She also received $5,000. I'm going to take it a little bit further back before we ride it about the time we implemented the tether. Me and Ryan were sent off to a nice training. It was a four day training. We got both certified on animal cruelty investigator and body conditions scoring on animals through ACES, which stands for the American Animal Cruelty Investigation School. And they're out of Pensacola, Florida. And it was a great training. I guess it's been days talking about it. They gave us two three ring, two two inch three ring binders Full of information during that four day period and then We'll carry over to the tether light So far everything's going real smooth between me and Ryan we average about 30 to 40 What we call just welfare checks, calls a month. If we get out there and they're involving tether issues, we'll address that and let the owner of the animal know the upcoming new ordinance that's going to go and affect January 1st. We also get about, that's how many we averaged last month. We averaged about 15 to 20 calls for responsible dog owners. They'll call us and ask us, how is this the log going to affect us? See, we haven't even passed out flyers these people. The word is getting around that the new law is going to come us. See we don't even, we haven't even passed out flyers these people. The word is getting around that the new law is going to come in effect. And we'll just answer their questions on a case by case basis. Usually after I go out to a welfare check and I'll address the tether, I'll just drive by the neighborhood a week or two to see if anything has changed. And usually for, I would say about 75% of the people I've spoke to about the law have already changed it in that two weeks. So they're not waiting till the 1st of January. They're going ahead in approving or in approving their dogs or their animals current situation before the new law even kicks in. I did get a call from a lady. She was a reasonable or responsible pet owner and she had asked, hey, I put my dog out on a tether, probably two hours a day for an hour each period, but I said on the porch with my dog. She's like, am I gonna get a ticket for this? And I was like, no, if every pet owner would actually stay out there with their pet, I wouldn't have a job. You were running in our own business on the team, right? Yes, yes. I did let her know. was like you don't have to stay out there. I mean we have a reasonable period of time for your dog to use the restroom and or exercise and she's like well I just wanted to make sure I wasn't going to be getting in trouble for the new law and I was like no ma'am, you have no problems. But so far, the... nobody's really had issues with the new tethered law. I mean, everybody we've explained it to says this is more beneficial for the animals. It's beneficial for the people because if they're in a pin, they don't have to worry about other dogs, straight dogs, whatever coming on the property, and hurting their animal, or the animal hurting itself, why tethered out, or chained up, or whatever the case may be. But that's about all I have to offer, or speak about that. Is there any questions? A month a month that that's as far as just the citizens calling us What will average about between 30 to 40 calls a month? Not all of them involved tethering but most of them do because they're tethered out with no shelter or or Just they're complaining about neighbors. Yes, yes They're my associate doll and then and then we'd get like maybe 15 to 20 calls from people that just want to know how the law is going to affect them per month So I mean we're getting quite a few calls already that like I've stated the last time when I wanted the tether ordinance approved, it gets us on the property before there's any injury to the animal itself. And just 30 to 40, and then you add in the people that are just calling us. I mean, that's a lot of animals. That's anywhere from 45 to 60 calls a month. I get just on tethering alone. And that will eliminate a whole lot of animal cruelty investigations due to getting tangled and injured and it cutting into them or worse. After going to the school and thank you Supervisor G. Command Stamp, maybe I can put them in a picture out there to enforce these and then find a cool to him and use situations when he can give you a better training. After going to the school. I know you learned a lot now. You could fit like that with certainly what it worked. It was time and effort. Yes sir. And better prepared you to do jobs. One thing that has come up recently. You have Yes, sir I do you read that for the council please hold on just it has it has And our definition of shelter is a little weak. The palace is not about that. Yeah, and the dirt, the, the, the, the, the, the, the, you know, got hole under storage building, uh, actually, uh, meets our definition of shelter. And that's probably not what we had in town. Uh, in town, when we did this, and I would ask, um, staff to, uh, to maybe come up, look to what other people are doing and define as proper shelter for these animals to be. What I'd like to do tonight is not prepared to talk about shelter tonight for us to do any kind of action, but I want you to hear our definition of shelter and maybe next month we can come back with a recommendation about twig art ordinance to make it a little bit more intense with adequate shelter that something you guys can work with better. You go out, you do actually go out and see things where dogs are living under buildings and under a piece of plywood or a Piece of plywood leaning up against the side of a building. That gets them out of the weather. I ordered this far a little short and allowed you to do much about that. Yeah, it, uh, what is our definition of shelter? Our definition states as adequate shelter. Means and enclosures sufficient to provide shelter from extremes of weather in a means to remain cool, dry and comfortable. That's it. And that sounds pretty good if you'd like to see. And it can be, you know, a gas place under a storage building. A building on a little place of dry, a weed and a cake. And generally, I'm done with. Well, the shelter is not dry. In the winter or the storm. So anyway, I would just personally, I would like for you and your supervisors to research a little bit, find out what a more reasonable definition of a shelter would be, a handy meeting between what you're about to share with you. I won't share the whole thing. He picked up a definition of shelter from the school, the animation, the school, David, which is really extreme and I'm pretty sure I wouldn't have been comfortable adopting that. But somewhere between where he's getting ready to reach and what he has already reached, we need to tweak our limits a little bit, because what we do is ask for a minute or so. For the animal cruelty class that we attended, our instructors, like I stated, were at a Pins and Hole Florida. They're where there's a little bit warmer than ours, but not by a whole lot. We got a vision. Ha ha ha. They've got a whole paragraph for their animal shelter definition alone. And if you would like me to read it, I will. Well, it's rather extreme in my opinion, and certainly I want everybody to understand it's not something that I want us to live for. But somewhere in the medium, in there somewhere, they go ahead and read the show of the hatching information. Shelter means provision of an unlimited access to a three-dimensional structure having a roof, walls, and a floor, which is dry, sanitary, clean, and waterproof, and made of durable material at a minimum the structure must be. Suffice and size to allow the animal to stand up, turn around, lie down and stretch comfortably. Designed to protect the animal from the adverse effects of the elements and provide access to shade from direct sunlight and re-grace from exposure to inclement weather conditions. free of standing water, accumulated waste and debris, provide adequate ventilation and provide a solid surface flooring area resting platform, pad mat or similar provision of adequate size for the animal to lie upon in a comfortable manner. We're going to find a happy median between ours and that one. My experience is classic. Keep fighting, it shows up in the shoe box. Six months later you know, taking up half the living room, we don't want to do anything about it to a tree. You know that house about a foot space. Yeah. Looked around it, but I don't know that I find that spirit of that definition is too extreme. To extreme perkside, I mean, you know, of course, I'm sure, because if you're in bed on your self, you're in visualizing, you know, of course, I'm sure, if you're in pain on yourself, you're in visualizing, you know, hardboard side, concrete floor, you know, shade tree, you know, but, you know, it wouldn't doghouse some shingles on it, that sort of thing. I think the size is gonna be the hatch tree, you know that. Let me, you know. I'm telling how big the center is gonna be. Let me, uh, let me read one more definition. Let me read one more definition. And this might be that happy median. This is Randolph County's definition of structure. A structure with a minimum of three sides, a roof, and a bottom used to house an animal and protect it from the weather. It kind of defines, you need a dog house, not a building to just chain your dog up to and with input from the U.S. and pride to come up and make a proposal there and make a meeting of something that we can use. It gives you a little more authority and control over how these animals are maintained. You are better preparing now to identify abuse and neglect that you were four or five months ago. They're going to that school was important and I appreciate you doing it. Well, the best part about it was networking through that training and just being able to touch base with a lot of different animal control organizations, not just within North Carolina, but outside just to see how they operate and how they define what they do. And we have a resource now that you can follow back on with questions and sharing certain There's always a... You know, if the Greystone Town was there, the Greystone... There was watches that were lit up the airways with the emailing. The watches are becoming more issued in the city and unfortunately there's not much we can do. The rich have been there and the watches are the five-hats. and they would do a rich headman over in Washington. Yeah, I know. And if they're not going to do anything about Foxes, why don't they give us a tax, so we met in our bag yard. I'm glad you're on Fox. Fox has fallen while I've gone on while I've reached for some time. But you can tell us a little bit. Foxes fall under, well, North Carolina wildlife resources, right? Yes, sir. Okay. Tell us what you do about Foxes and the control of Foxes this point. The Wildlife Resource Commission, when it comes in regards to wildlife officers, issues, us a depredation permit. Well, we go on their website and we can get one. And that gives us the authority to handle wildlife animals without legal repercussion. But that depredation permit is limited to strictly sick, injured, or rabid animals. If they're just acting natural and being naturally wild animals, we need to put a... I try to educate when I get to that situation on how to co-enhabitate with them. Because Aschro City's population is so dense compared to anything surrounding in the county, you're more likely going to run into one. There's a lot more wildlife inside of Ashrow City because one, the gun laws. I mean, in county they're out there just popping them off in their backyard. But, and then you don't have the large breed predators. You don't have the coyotes, you don't have the bobcats, you don't have stuff like that inside the city. So your possums, your deer, your foxes and your raccoons are co-mingling in these same areas, but they have such a large area they cover to find food and water, and they're used to humans because there's a lot more of us living in the city than that live on the county. I mean we're more likely to come across them more often than if you live five miles outside of the city. And the issue is, it's just the, on my end, it's just educating the public on, you've took their property from them originally. Now they're coming back to find a home, we just gotta live with them. And I tried to educate on what sick injured or rabid looks like. But the last case is I just tell them, if you don't know, just call me. There might not be a whole lot I can do. And I come out and assess the situation. Why do I pre-sort the will not allow us to relocate? Traffic relocate. If my depredation permits that if it is not sick, injured, or appears to be rabid inside of that cat trap that I have set, I am to release on site. I can't do a thing, he's in my life. Or I get fined by the Wildlife Resource Commission from the Wildlife Officer. For one of our exacerbating issues, one thing that enhances this problem is, if people that feed their domestic pets outside, walk out this full handful of food in the bowl of wheat, they have that big aluminum turkey tray. Not only do they have raccoons and possums and boxes, they have rats. And boxes are coming after the grants. So, you know, it's a perpetuating situation. We need to educate people that they can't just go to the blue down the ground and develop a lot or in the backyard there to feed their adults. Exactly. Raise your hands and everything else, but. Yes, my. I would like to ask if you would give a wind and see what he's going to have his next community watch in the rice dome area and the bridge at the new area. And I think it would be a good idea for you to be there because that's where a lot of comments are coming from. That way you can address a larger group of people instead of just one or more.
