It took some three minutes for them all to fall down. The chain will move all the way through the school down the hallways to the cafeteria on and on and on and on and on. The kids were cheering. They were screaming. It was just amazing and all for great cause. So I'll be done. It is. What a memory. We had to speed it up to get it all up. But you get it. That's amazing. But now one of those kids not one of that shot me. You work together on that one. Yeah. You don't want to be the one kid that I have. Oh, no. That's that. So for that, I wanted to show the video because you kind of have to see it to believe it. But it's so exciting to have our famous Clemens resident here. I'm just going to run through a little bit of how this video has like blown up tremendously. And I'm probably not even going to get it all. And it's probably hit like at least like a half a million or more views today. But it has gone viral on TikTok, Reddit and Twitter. I know for sure there's been over 35 million views on TikTok alone. It's made the today show NBC Nightly News. She was interviewed by Lester Holt. WXII News, ABC 2, ABC 45 and the Clemens Courier. Of course, who hit it out of the park first. So I wanted to say that. This was a part of neighbors helping neighbors, and I just wanted to give credit. Farah Obern contacted Lynette, and they kind of talked through this. We were super excited to have Clemens Elementary participate in this monthly event that we do each year. Public hearing, minimum housing standards, abandoned and unsafe buildings, and amendments to title 15 land use, is adding a new chapter, 150 minimum housing and unsafe buildings, buildings to the code of ordinances of the village of Clemens. I show, is there any, I'm gonna open this public hearing and I understand there's no one signed up to their proponents and or opponents. So I show close to public hearing and turn it over to council for any comments or questions they may have. I did have one question and maybe I missed it reading in here but I'm sorry. Let me let attorney bench all way in if he has. I think we'd like to weigh in with prior to going for further forward. Thank you. I would, I prefer to answer questions since we've talked about this twice already at the retreat this year. And I think in August or September 2023 and I'll just say this is an option the town is not required to have minimum housing or unsafe building ordinances but if you ever do have a building that needs attention it's good to have these tools in your toolbox that they can be used. And I think Ms. Cameron had a question. I did have a question. And maybe I missed it in here. But in a couple of places it refers to public officer, shall mean officers or officers who are authorized by this ordinance, and on and on. Is there any place in this ordinance that talks about bringing in a deputy if necessary? Or is that doable? Is it something that needs to be spelled out or it's not doable? Or? The, some of the language is fairly antique because it comes from the general statutes and these are old general statutes. Public officer is usually read in the plural that it's officer or officers and it's really whomever the town manager appoints to fulfill that duty and that could change over time as the staff changes in your positions change. Well, I assume that but my I think my question is do they have the authority if whoever the public officer that that the manager has designated is having difficulty. Do does he have the authority to call in one of our deputies to Emilia rate the situation? The public officer would have the same Power to do that the same authority to do that is any is any staff member and That tends to shift over time and that tends to shift over time. So it's deliberately left open in some municipalities. The Code Enforcement Officer, the Public Officer, is a police officer and some it's a police department employee and others it's a planning department employee. Some very large cities have a code enforcement department. Sometimes they're sworn, sometimes they're not sworn, sometimes they have badges, sometimes they have uniforms. So that's all to be worked out as the village grows in the future. Well, I hope it doesn't come to that. I hope it doesn't come to that. I'm just seeing what the options are. Emily Harrison, if you would please come forward. Good evening, Mayor Council. I am before you tonight to discuss the cost share for 3604 for Scytheia Trail. Now this one's a little bit different from some of the other cost shares that we have done in the past that I'm presenting to you tonight. This is kind of a two-parter and so this is part one that we are bringing before you tonight. So for Cynthia Trail, as you can see here on the map, the area that it's located at, there is a public right of way drainage from the roadway that then turns into a private drainage way through the properties. And in 2019, there were actually two parcels there that got merged into one when they built the house there. So, as you can see on the map currently right now where that line is, there's two circles that are separated because there are sinkholes that was originally called in by the homeowners that is near their driveway, which is in line with the culvert pipe. So when we brought KRG utility out there to camera the line, we also showed that there was damage to the culvert pipe upstream of it. So the hole that we saw is the red circle, and the yellow circle is what the homeowner's had called in for the original concern. So here is the existing drainage area. Again, the picture on the left, that is the original site plan from, I believe, 2006. That showed the two parcels and it shows the private drainage easement that was on the plan. Pictures in the middle is showing the sinkholes that the homeowners had called in about by their driveway. And then the pictures on the right is showing the actual covert that has multiple fractures that are in it. And then trying, and then the one on the bottom, trying to go up from the downstream side because we couldn't get past that initial break in the line there. Trying to go up, somebody had extended the line so we couldn't get up to look further down the line, but that's just showing some of the things that we are seeing. So for the design aspect for this one, we need to redirect where the drainage line currently is, but still keeping it within the property and then bringing it back to that original drainage area because we don't want to change where it drains off to, we want to bring it back to there, but we need to move it away from where it currently is now because it is causing more problems. And so for this scope of work, preliminary cost estimate would be from a third party with LGB engineering. So this would include surveying the property, designing the new storm infrastructure plan, grading of the area to make sure that it has the positive flow that goes down it, and then creating the profile and the details for the construction for then hopefully part two. So tonight in front of you the estimate for this first part is $10,500 so that would be $5,250 cost share split. So both the homeowner and the village of Clemens would be paying that amount. And so then moving forward, just so you all know, we are, per our ordinances, able to match up to $10,000. So anything past this for construction and everything else, the village will only be able to add an additional $4,750 when we get to that point. But this is the scope of work for the design aspect tonight that we are bringing in front of you for our cost share to help this property. And I'll be happy to answer any questions that you may have. Any questions, Council? So does the homeowner know that for part two, that anything in addition to 4750, they're going to be responsible for because if we engage in part one, and then they're not agree able to part two. So yes, so we have been both myself and Mr. Gennel have been in contact with the homeowners to remind them that we are able to help with this first aspect but we are of how our ordinance is written we are capped at $10,000 so anything above a total of a $20,000 project will solely be on the homeowner. Would I be written into the contract with the homeowner? If we get to part two yes. Yes. I'll make sure. Is everybody's on the same page with this? Thank you. Thank you. Thank you. Thank you. Does the scope of work assessment, does it include an assessment of the impact on neighboring or other downstream properties for this new flow? So where it's going to go is pretty much... That is where the current drainage is and the thought. Yeah. So currently right now it drains this way and the thought right now, again this is still in the preliminary, is bringing it this way but then bringing it back to this area where it already in that same area and then there is a creek and then it goes directly because this is where that dam houses before it goes directly to Muddy Creek. So there really isn't any additional downstream impact because it goes directly to the creek of where it's at and then off to the Atkin. Yes, Atkin. Yes, Atkin. And I'm assuming that that requirement will be written into the contract and design, that there will be no impact on neighborhood properties or downstream. And I know I'm usually probably going to work, but we're not going to, we're not going to really alter this charge point. It's going to keep, basically keep the same. So, same, same water flow, same, you know where that is don't you right across from the lake yeah I'm assuming there's some contractual obligation that neighbor somewhere doesn't help you to work yeah we're not going to change at this torch point they're still going to go to the same same spot we're just looking at alternatives either way they're to fix try to fix the existing pipe or relocate and come back around. There really aren't any neighbors that to be impacted. And Mike, I think from my experience when there was a project on my court for a neighbor of mine, the village took into account the other neighboring properties and to the overall project. So they do a very good job at making a holistic approach to any of these projects to ensure that exactly what you said does not happen. And inadvertently have a negative impact on another homeowner. Council Mayor. I will be presenting the private property drainage cost share for 1512 Lakefield Drive. Let's see. Parton, I've never used this before. Okay. So the issue arose from a public ride away drainage from Medoglund Court that flows through the back of the property which has created a very erosive environment in their backyard. Oh, excuse me. With each rain event, the erosion has worsened. It has created a deeper channeling through the property, just enhancing the entirety of the problem area. So as you can see, starting on the left, there there are tree roots miscellaneous rip wrap, scattered trash and debris all throughout. So as I said before with each train event this is just worsening. Really the only thing that is keeping the existing dirt and rip wrap in place are the tree roots. So come time for the project to ensue. It will be very careful to avoid any damage to those tree roots. All right, so the scope of work will be to grade the downstream area to create a plunge pool. This will be at the edge of the property and a berm will be built to direct the water towards the plunge pool. This will be at the edge of the property and a berm will be built to direct the water towards the plunge pool and the erosion control fabric will be placed on the berm and in the plunge pool to stabilize the erosion along the channel. In addition to that, class 1 and class B rip wrap rock will be placed along the berm, channel and in the plunge pool to further stabilize and prevent erosion from occurring underneath. That will be approximately 40 feet long. Again, we want to stress that we really do not want to disturb the tree roots that are already in place. They are vital to the stabilization of that area. Following that, it will be a dress inseded to appease the disturbed area So everything will be aesthetically in place. It will look very nice and hopefully the homeowners will be very happy with it Between the three beds our CJ contracting did win with $7,650 That would lead into the homeowner in the village clements both being responsible for $3,825 each. I have a question. Is a plunge pool like a small stormwater device like like the ponds like the, is it just like a smaller version of that? Essentially, yes. So it's just a yes, it's a very small version. It's just helping kind of slow the storm water from when creating further channeling down the line because it is going into vacant lot so right now there has been issues with some flooding yeah slight erosion a little a little just excess water that shouldn't really be there so this is just gonna help slow all of that down it'll capture some and then when it comes out it will be a lot slower a lot less. Correct. Okay. Yes. Thank you. Can you go back to the mouth? Yes. Sorry. I know I've spent a little bit. So is it the view you showed us looking, I guess, left between the property, but you're going to put the pool in the red oval. Okay. I just wanted to make sure. Yes, yes, excuse me. Yes. And it really is just in that small area because everything after that is part of the vacant lot. Any other questions? If somebody was to develop a lot, you still got the discharge just going to come through. How they address it and how they routed around the house. Just depends. Okay, we don't know anybody knows. We looked at, we had a project several years recalls that we replaced box and down here like bill core we replaced the pipe underneath the cul-de-sat the head the box is upstream and did a lot of channel re-stabilization down with when it lots down to North Lake Shore. And I think, well well I can't speak for us also I'll speak for myself I find it extremely concerning that that no one is bothered to reach out to us when we are the representatives of the town to be most affected by this development this is how they have always operated clearly how they'll continue to operate. They continue to approve projects on our borders without any regard for our citizens, which are their citizens. These are Forsyth County residents being negatively impacted in climates by Forsyth County Commissioner decisions. So we don't know what's going on with that property. They just said that they're clearing it, but they just continue to spend taxpayer dollars on economic development. So I'd like to see the return on that investment at some point. Thank you very much.
