We were able to get Verizon to add to the agreement a paragraph indicating that in the event the FCC regulations would allow for additional fees than the agreement would be amended during the term to reflect that change. So even though the agreement, the term of the agreement was 15 years, in the event five years from now, the FCC changes the amount that we can receive, then the agreement can be amended to assert that. Number eight is an informational update and proposed change or changes. Annual routine bridge inspection on Milk Street Bridge over the Delaware, Lacanwine Railroad and Roaring Brook. Mr. Chairman, on the question, we have an annual inspection on the Milk Street Bridge. It's been as people are aware, it's been deteriorating over time. The current posting is a bridge weight limit of 13 ton with an exception, with an accept combinations of 21 ton. What Penn dot through their third party wants to ask us to do is decrease the tonnage to five ton and put up water barriers, 402 feet on the right side of the bridge, which would be the pedestrian cross rock, with blocking that off on both ends. The reason being is they don't want any potential vehicles going up over sidewalk, because they're nervous that the weight or the structure won't hold it. To give everybody some kind of idea, five-tun is only an average passenger vehicle or an average residential truck. So possibly some smaller ambulances would be able to go over as well, but a UPS vehicle, school bus, fire truck, garbage truck, a plow truck, etc. would not be able to go over that bridge, because they deemed it unsafe for that weight capacity. So, council, we're waiting on the final from PennDOT to say that that's what they want to do with the five ton but council would have to make a decision one to either put those water barriers up which would cost us in the excess of about $22,000 and have a five ton weight limit which is that vehicle or a residential truck, or they can choose another option of the clothes that bridge and detour all traffic. Don't have to make a decision on that tonight, Vito, for the final wear from PennDoc. No, PennDoc had 30 days to get us their final approval of what they want done, but the five ton in the water barriers, it's that option or to close and bridge is the other option. And just to give you as a little more information on this, we tried and I've had meetings setting up, I want to say if I'm not mistaken, maybe three to four year, five years ago, to enter into a program with PennDOT, where we would pay 5% turn everything over to PennDOT. I don't even know if that program still exists anymore. They would take over everything from engineering to building and then eventually turn the bridge back over to Burrow. The problem with bridges, obviously it's deteriorating, but there's three independent structures on that bridge. If you ever look underneath, that's just not one bridge as anybody that's passing over, it thinks there's a railroad bridge there, and it has two separate structures for the bridge that goes over Roaring Brook. So I think at the time we might have been quoted, I'm just guesstimating 12 million or something like that to replace that whole structure, which wouldn't cost us 5% at the time. Now you're talking, obviously, things increased. I don't think we could ever take on a whole bridge with the placement as the borough ourselves. but it's something that has to be done. I mean, the safety of the citizens that live there, fire, ambulance response. We're going to wait on the pen-dot report and see what happens there, but that's more or less. We've looked into it. We're trying. I don't know if that's we've been in water as to say, but it's maybe something we could still talk to Penn out about and see if that program will. I think that had something to be weren't eligible for. They did a study on how much the income of the people that live and add a immediate area and I don't know if it qualified. I don't think it qualified, but we got to look at something else maybe gets help from the state legislators or something but I don't think we could ever take on the burden of who plays an effort ourselves. Vito did you and I not talk about the state recommends it closes or it gets repaired and since we can't repair it, it should be posed as being regarded. What I omitted was I asked when when those water barriers are about 1,350 tons. So the way the weight distribution is calculated that it's 300 pounds per linear foot is what those weight those weighted those water barriers are going to be which that bridge in capacity will hold that. They can suggest that so I asked them with the longevity of that being you know that fix for because my concern was everything is going to go to the left and compromise the other side. Opposite the passenger are the pedestrian crosses. They gave me an estimate of about two to five years we would probably have to decrease the bridge to one lane. To give everybody just some information on the bridge, the railroad company built that bridge in 1915. So when they built it, it was in an agreement in November of 19, in September of 1915, that they turned it over to the borough and the borough would maintain it there on. So there was a lot of lore that we did on the bridge, we didn't on the bridge. I have the document from Penn dot that the bridge is the burrows. So it would be our decision on what to do for that bridge. I think obviously we're not going to do anything tonight with motions or anything, but just information and we pass it long and let's see what pendats final word is which obviously it's not going to be good. What are water barriers? What? They like those big Jersey barriers, you know the big concrete barriers that you see in the middle like the highway dividers. Oh yeah. But you fill them with water. Oh, what's the purpose of that in case someone hits them? Yes. It's safer. Yes. What are they made of? The man who's standing pen that likes to use that a lot, the water barriers. But if it didn't decrease to a single lane, we would probably have to look at some signaling on both ends of the bridge as well, on whether it's two stop signs or whether it's traffic lights. So if we go to this situation, then are you saying fire trucks won't be able to go over the bridge? No, man, they're... Well, how will the fire trucks get there in the event of a fire? The deep tour would have to go down wheel or avenue to where hiles used to be. Take a left down to the bottom of the hill and they can't go straight because that that by-dock is only 10 feet they would have to go right at the little lake left at the new bridge they just put in two blocks up and take another left it's a bunker hill. Well the response time would be horrible. Vito, one other thing, when we, when I talked about this, the two year, the cost is the first thing I'd like you to address. And the second thing is, you mentioned to me also, I think that you applied to the state to put this grant or this bridge on the list to be repaired by the state. Am I correct there? Yes, that's what Mr. Halen was just saying three, four years ago, there was a program that they had. We sent the letter. They said the wait period could possibly be anywhere from eight to ten years to either to even get on the list for that approval. What it was is Councilman Hallen and said is that we would turn the bridge over to them. They would repair it. We would be we would be responsible for 5% of the total cost. Penn Dodd to give us an estimate that I would be at that time $10 million. Then once that was completed, it would be turned back over to the borough and maintained by the borough. The cost, I think, are you asking about the water barriers or the cost of the bridge? The cost, we talked a few things. We talked the cost of obviously replacing the bridge, the water barriers, and there was a third one we talked about, third option. Well, before you go there, are we on that waiting list for the state or are we, what are we doing with that? We're not on the waiting list. No, because at the time the money became dry to do that program. To build the bridge. Okay. to do that program. To build the bridge okay. We're going to try to reestablish it. I was in touch with Senator Blake's offices and at the time I don't remember who our state rep was. It might have been representative Haggardy. Right. I'm to try to get any help we could because the prognosis of this structure isn't very good. So, eventually, this gradually close down sooner or later. If we were down to one lane, would the fire trucks be able to get over there then? No. Regardless of what we want to do, the capacity has to be decreased to five ton because the steel girders, they feel are that compromised. And Vito, how much of the water barriers again? Well, there are different prices. I looked on co-stars pricing. There are about 275 to 300 dollars per barrier. We have to cover $402 fee. So we might be able to vary safely 70 barriers, probably we're on $21,000. But maybe I'm just saying, let's, we could weigh more when Matt's gonna give us a final thing and then thank you also set up a safe way to pass over that bridge and maybe we won't meet that many barriers because maybe they'll use what's called the Jersey barrier, the concrete barrier, and then use the water barriers to protect on the edge of it. Because that's what more or less they're looking for is a head on a crash into the barriers. So they'll surround the Jersey barrier on the foreside with with water barriers and then put it down to Malay and then we'll probably need signals to only have Malay of traffic all through each side. But again, that will probably in a amount of there a few years, but they'll come through with some suggestions if we ask and the bear to assist us with anything And I know they're always good to help and not the boroughs. So I agree. We could hand with anything to you here. So should we get in touch with our state rep? Absolutely. We could send. You know, I'm sure we tried this. They know about they're going to get the inspect and L, even when they come with the inspect and if, again, I'm just taking them out of there a few years. They might even say, hey, listen, this program's available. That program's available. This is what you need to do to help you, you know, because it's rehabilitate the bridge, is in my opinion, isn't going to happen. They're going to have to build a new bridge. So I would like, again, I would like the wheels to turn there, at least now we could get over with this bridge and put another bridge alongside of it, that the permanent structure, I don't know where the best entrance exit would be, but remember to knock the bridge out and it would take five to seven years to build a bridge, easy, at the time they go through everything. And that's in kind. The problem is you're dealing with the waterways that you need to permit and you're dealing with the railroad that you need to permit. So anything done is governed by the PUC that PennDOT has to do. So they bought, they have to get approval from both the railroad and because it's still an active railroad and the waterways because the rowing broke that runs underneath it. You know, could you arrange a meeting just for the PUC or I'm sorry they pinned out to come in to one of our exact sessions and explain all this to us? Especially with the time limit and the time urgency of the time I'd like to really stay on top of this and keep it in the forefront at least to know what's coming sooner obviously than later. We, what I just told you is what I'll get Penn not there, but they're going to say the same thing. And the time frame is we have to wait the 30 days for Penn to respond to us. So once Penn dot gets that final approval, what their recommendations are, they're gonna say yes, this is what you need to do. Now you can do a ladder of the two, which is closing, but that's what their recommendation is, there's a report, I believe I sent to everybody that Penn dot furnished. But Tom, Tom Hell and I just talked about, maybe there are some programs that we can avail ourselves of maybe thinking we can talk about that. And we probably could talk to Senator Blake and also Representative Mullin about that. Yeah. After even County could probably can also and they can help us do with anything. So it's in the process at this point. Well, we did get some pushback. Can you explain that situation? Well, Keystone does not want us to send, does not want the bureau council to send the letter. So we've been discussing that issue with them with potential litigation threatened by them if we did some the letter based on the prior landfill agreement so that's where we are at this point and no decision has been made with regard to what is going to occur. As I said, we do have the draft letter and we have until June 30th, descendant. So it's up to council. Well, council already voted to send it, Mickey. I mean, we voted on that. Mickey, we, a council already voted on to send it. Yeah, that, yeah. So, I mean, I think that's a move point. We, you know, we were 7-0 on that. So we just needed some timing. And in your opinion, do you think that litigation would be successful? If we could. No, I think the agreement, the 2014 agreement, I believe, permits us to make any type of comment we want. Well, that is the council permits the council to make any type of comment they want with regard to the landfill and any expansion of it. So I think they would be successful. Thank you. We never had an FTE budget, a full-time equivalent budget. We have a new, I wanted to introduce our new treasure. His name is Mark Burton. He comes with many, many years of experience in government and we're very pleased to have him and he's really finding his way. So as Tom said, and again, this is something that I have to rely on, the people who came before me to say is that we have, we had it budgeted $57,000 for that new treasure. And he has been hired and he's doing a good job because really this is a very large hole for him to climb out of. This is the May January through May budget and again, not budget financials that to make it a realistic budget for 2021. And in the meantime, I wanted to give folks at least an idea of where we are with respect to last year. So if everyone can see my screen, can you guys see my screen now? The budget? Or no, they have. You know, some of these line items are a little bit hard to understand or they're misleading because, for instance, this line item, the tax anticipation note last year, we took out a million dollars. And this year, we were only had to take out 575, 479 of that was for a missed pension payment for 2018. So we had to pay that in 2019 or 2020 after the state came in and ordered our books. So anyway, so it looks like we're down $425,000 there, but really, it's alone. The tax anticipation note is alone. So yes, we didn't get that for $25, but that's a good thing because we don't want to be that much more in debt for 2020. So if you go down a little bit further, some of these things I had questions on and Mark was able to get the answers for me. And this is just a quick everyone knows is the salaries. I mean, I don't want to miss any ones of profit and loss. The biggest line items are wages. So here's police salaries. They're $83,000 for the first five months of the year. They're $83,000 more than they were in 2019. The fire salaries are 41,000 more. Code enforcement, 6000. And solid waste, almost $60,000 more than they were for the first five months of 2019. Now one of the questions I had was this right here. What the heck was that for $1.15 million under solid waste? It doesn't make sense to me. It turns out that this is mostly Schultz stadium. This is what Mark, Mark discovered. So you know that is a capital purchase but it's certainly not a capital purchase under solid waste. Mark and I have an appointment with Mike Doherty. He is our outside auditor for Dunmore. He audits our books every year. So these are some, and we have an appointment with him on June 24th. Mark and I are going to go up to his office and try and figure out, you know, you know, Mike Doherty may have already discovered that this is misposted. And he, that may be already corrected, but we have to deal with what we have now. We don't have the financial statements yet. So these are just some of the questions I had for Mark. And Mark was able to answer most of them. He's very familiar with our profit and loss statement and again, we're going to start working on on the budget for next year to make it more realistic. Here's something too that is concerning for me and for everyone in the borough I would say, it is the loan. See how much they're up just this one line item, $258,000, $261,000. And I don't know what this pension bond was last year. That's another question I'm going to ask my my my priority. So we so we can get a little bit of a better handle on our what's real and this in this thing and what isn't so net income for the first five months, we, you know, the time when we get our tax revenue. So to everyone's concern is like, as Mr. Johnson said, it's later in the year that we need to be really, really worried about. And also, as not to interrupt, I'm sorry, Janet, are you finished there? I'm sorry. And we still have that 425 that if, you know, with the tax and tax, yeah, tax and participation, no, it doesn't get touched, that helps us. So my concern and in 3 million of that came in December, there must have been a huge cash crunch last December to take $3 million out of the sewer authority account for operations. So again, my concern is not so much, you know, the first five months, but you know, what's going to happen later in the year? So Mark and I would like to get like a hint. And as you say, salaries are salaries are salaries. I agree with that, but I think it's worth pointing out so the people have done more know what the situation is with the salaries. This letter is being sent to you to make you aware once again of the situation you are all too familiar with T legal use and abuse of ATV vehicles riding on streets of the Dumber community I will only address my neighborhood which is very dangerous Every single day of the week begins being the most dangerous and unsafe for anyone to walk the streets let alone come out of their house We are met with quads and dirt bikes driving an extremely high rates of speed driving down the public railroad in front of my home. If that is not enough, most times one of the ATV drivers will find enjoyment by veering off the public road and onto my personal property and decide to spin out while doing on to my personal property and decided to spin out while doing so with the tires of the ATV will kick debris which they know fly up in the air and land who knows where. I have cameras installed on my personal property and have numerous clips of erratic and dangerous actions of certain ATV drivers. I can share those with you if you'd like. I would also add there are some ATB drivers who respectfully drive high-slow and do not speed on the public road but it is disrespectful but is the disrespectful drivers who also outweigh that. These actions from these ATB drivers will begin approximately about 11 a.m. and will continue until about 3 a.m. in the next morning. All day long quads and dirt bikes drive up and down, driving irresponsibly, dangerously, and erratically. Yet you choose to do nothing as council to rectify this dangerous situation. I have also bought brought to your attention that with this behavior gunshots were being fired hours on then and who knows which direction and when was being a. This happens more at night so add the darkness to the aim of the shooter. If you ask me that person should be mentally evaluated. For years this was brought to your attention and nothing was done on make my neighborhood safe. I ask you why. What is going to take, what is it going to take for you as a member of council come up with a solution to make my street safe? Is it going to take someone getting hurt or a loss of life for that to happen? Are you prepared to take that responsibility, the legal responsibility, the personal responsibility, and the emotional responsibility if someone gets hurt. At NOAA we'll get you the most and we'll never, that will get you the most and it will never go away. Again, I ask you why do you choose to protect the legal use of AKBs on public roads? Whatever your reason is it worth it? Last week, two signs of NOAAKD riders were posted on my street. on public roads, whatever your reason is it worth it. I reached out to Mayor Timberk, we took this first step to help with the situation but the signs have done absolutely nothing because they are not being enforced which is the most critical part. A cop car makes an occasional pass through the street which will not fix the problem either. Enforcing the laws, the only answer. I have to file the law of legal and illegal, and maybe if I became an ATV owner, I wouldn't have to. I wouldn't have to do that. I can easily make complaints to the number of police every single time I hear an ATV going down the road. But I do not have to respect for the number of police that are busy with other issues. And if the driver is respectfully going on the road. But when I have to call for safety concerns, I am met with disrespect and ignored. And again, nothing being done. Why and who gets to decide that? As members of Congress who are willingly choosing to protect ATV riders over safety, you are not protecting the ATV drivers either. I suggest finding a safe solution for everyone if this is what you want for our town. Find an entrance to the wood for free access for the ATVs and make sure that the road is safe for the drivers, their trucks and trailers until they reach the point of unloading off a public treat. So with protecting the APTV driver, it also comes with responsibility of seeing it through. ATV owners also need to see their responsibility through of buying a trailer to haul their ATO off to a public road and unload. However, they feel the entitlement of how having to do so because some are allowed to wreak havoc on the most public roads and instill fear to the community that someday someone will get hurt. Nothing is being done. Again, I ask why. I believe there could be a safe solution for both sides. But what is happening now is not the answer. Thank you, Leanne Perry. Could we just cite people from them? Again, they're illegal. There's no license plates on them. So how do you figure out who's driving that vehicle? Well, you'd have to be able to take a vehicle. Yeah, you'd have to be able to identify the driver of the ATV or get the license plate if it had a license plate. And then you could, you could cite film that she has and see if there's anything identifiable on it, you know, well, you think you could definitely cite them if you could prove who it was. Yeah, oh, that's good. I didn't know that. I didn't know if like a private security at someone's house can be used for that purpose. Yeah, well, they do it with cameras on the on the traffic lights. They try and get her. Yeah, traffic lights. They try to get her there's something to your earlier today. I think there used to be a attorney parent. Yeah. I can put the video on the Facebook page. Actually any homeowner can put the video on a Facebook page from their personal home. And I think they can put it on their Facebook page to identify the individuals riding the quads. Well, you'd have to provide it to the police department first and foremost, and they could then follow up on it. Mr. Perry, do you think it would be feasible to have a meeting with all parties involved in the neighbors and try and come up with some kind of solution up there with the police chief yourself mayor? I'd be happy to be happy to do it. Everyone knows this is a major problem in all municipalities all over. It's illegal to ride these things on the roads, but the police are not allowed to chase people riding them. Many times they don't have license plates, so you can't identify who it is. So it's similar in every burrow. I've talked to the solicitor of the music burrow. They passed an ordinance, but it's basically unenforceable, and they have the same problem we do. Thank you.
