This year one of the things the committee decided they wanted to do was to do a traveling trophy so that there was competitions between the different departments of similar sizes. Good morning, commissioners. For the ones that may not know, I'm Claudette Evans, chairman of the employees committee. I'm sorry. Microphone's not on. Good morning commissioners. For the ones that may not know me, I'm Claudette Evans chairman for the police committee. Mrs. Linda Ricketts are a treasure and this is a care and lighting men are 2011. I just wanted to tell you a little bit about the employees committee. Each year we have fundraisers throughout the year like the bake sale, chili day, garage sale. The money raised through the garage sale goes towards our scholarship fund and all the other money raised goes toward the purchase of gift cards and plaques to the recognizing employee of the month, employee of the year, boss of the year, and department of the year, and our annual Christmas luncheon. Just the Christmas Luncheon alone cost over $3,000. It is important to have good participation in our fundraisers so we can have funds for this event. And now Linda Rickett would like to say a few things. It's important, as a lot of it says, that we have representation on the committee and our committee has, as a lot of committees, has wane to about 10 people in the committee and you know how many departments we have in the county. So this morning we are presenting a resolution of support of the Montgomery County Employees Committee. Whereas the Montgomery County Employee Committee was established in 1987 and comprised of Montgomery County employees and whereas the general purpose of the committee is to act as a liaison between the commissioners court and the employees of Montgomery County to inform the employees of Montgomery County of relevant issues within the county to inform commissioners court of issues of need of employees to promote the relationship between employees and elected and appointed officials to institute with approval of the court various programs which will benefit employees enhance work performance and strive to improve the efficiency of government as a whole. And whereas Montgomery County Employees Committee meets the third-thirsty of each month to plan events to accomplish the goals to set forth in the statement above. And whereas each department should be represented on the committee. Now therefore, be it resolved that Montgomery County Commissioner's Court does hereby support and encourage all county departments to appoint an employee as representative of your department who will attend the meetings and participate in the events for which the committee is responsible. And he's one of our investigators that we know that, regardless of what the situation is, if it's a special task that we have, we always know we can call on Joe, and he's more than willing to provide whatever assistance and knowledge that he has to assist in that, getting everything done. He was willing to come on board immediately within a couple of days of being offered the position and told us at that time that he had a long planned family vacation for the week after Thanksgiving. We of course are not asking that he received paid vacation, but because his vacation was stacked next to the Thanksgiving holiday, the policy is he would not get paid for the Thanksgiving holiday. And we would like a waiver of that so he could be paid for the two days of the Thanksgiving holiday. And did was he set up to come after Thanksgiving as though it was? No he was, he came on board right before Thanksgiving the beginning of November and worked for those few weeks and but because he had this long standing vacation planned, it made him eligible to get paid for Wednesday, I'm thirsty and Friday if Thanksgiving. Well, how does policy range you have to work the day before, the day after the holiday, where you get paid for it. And you work the whole week before the holiday. I'm going to first of all, I would like to recognize our staff. We have a number of y'all. We'll stand for this. I want to thank them for coming to join us over here today. And then this is Miss Linda Moke and my supervisor from our supervisor of College Station, Dr. Dale Fritz. We want to come in today and thank you all for your continued support of the Texas AgriLife Extension program here in Montgomery County. And I wanted to give you a little bit of highlights of some of the things that have been happening in Montgomery County as a result of the work being done by the staff of the Texas that have been happening in Montgomery County as a result of the work being done by the staff of Texas AgriLife Extension. In October, 370 agricultural workers and landscape industry professionals received their required certificates, certification CEU units in order to maintain their pesticide application licenses through the Southeast Texas Ground Maintenance Conference. The Montgomery County Master Gardeners have been very active this year. We have over 350 volunteers in that program and they donated over 32,000 hours of volunteer service to the residents of Montgomery County with an estimated value of over $600,000. Through the Family and Consumer Science Department, they have trained over 30 adult seniors in the area of a Master of Memory through the Lone Star College Academy of Life-Long Learning. They have a very active volunteer program through the Extension Education Group that has donated over 25,000 hours of volunteer service with an estimated value of over half a million dollars. Of course, a lot of you are very familiar with the 4-H and Youth Program here in Montgomery County where we have over 1100 4-H and Youth Members in 21 4-H clubs. And they're very actively participating in leadership, and record bookkeeping, food show, food challenge, and taking national trips, and that sort of thing. The Junior Master Gardener Program is a horticultural program through 4-H, and we've become a leader in the Junior Master Gardener Program across the state, where we trained over 20 teachers, extension volunteers, and other youth service professionals from five counties across the district. The Montgomery County Extension staff has also been involved with the Magnoia Economic Development Board and providing information in the planning process of the expanded equine facility over in McNoah. And 4H has also been involved in a one-day community service program called 1-day 4H where over 1200 pounds of food was contributed and collected and over a thousand dollars was contributed towards the Montgomery County Food Bank. So you can see that the Montgomery County Food Bank. So you can see that the Montgomery County Extension is very involved in a variety of services around the county and we once again want to thank all of you for your continued support of the program. I also would like to personally invite each of you to come to the Montgomery County Master Gardener's Christmas Awards luncheon which will be held next Monday at the Lone Star Convention Center at 11.30. So any of you all that can make it we would love to have you there. I'm going to turn it over to Miss Moke for just a moment. Thank you commissioners. And I know that the volunteers that I work with in family and consumer sciences are most appreciative of the work that you do in their particular precincts. We are still in the process of making a major revamp of the regulations because the statutes change. But the tow truck companies need to file their rates with the state by January 31 and they cannot change the rates and refile them. So we felt like we needed to go ahead and do this rate increase now. What the amendments include are we've got a distinction between light duty, medium duty, and heavy duty tote trucks. The rates would be 200 maximum allowable, 200 for a light duty, 250 for medium duty, 400 for heavy duty, and they get an additional $50 if there is some kind of accident damage that complicate it. Also, we're going to be dispatching particularly for medium or heavy duty trucks when it appears on the scene that we have to have one of those in that a light duty will not do. So we will be eliminating part of the trucks going out there. If the load is more than 15,000 pounds, they do get a sense per pound maximum rate. We also have a $75 maximum allowable for a backup truck. Sometimes the vehicles and the trailers will be in pieces. They have to have more than one backup. They could have two backup, but we have no more than three vehicles. And the amendment does say that all of the pieces of the vehicle have to be delivered to the same place, either to a storage facility or to a facility for repair as designated by the owner. There are specialized pieces of equipment that have to be installed, and the contractor has to buy this equipment from third parties and he has to pay for all of it up front so we did not think it would be appropriate to withhold money when he's having to buy this specialized equipment. We have two citizens I think would like to address court this morning. You're up. Commissioner chance, Commissioner Doyle, Commissioner Metter, Commissioner Reinhardt. My name is Patrick Jindron and I want to talk real briefly on agenda item 17 A3. That was on the agenda. The juvenile board after three meetings and much discussion has forwarded to the purchasing department a proposal by a group of lawyers to contract with the county to provide legal representation to indigent juveniles. There were two competing proposals and the main difference in the proposals was that my group of attorneys was willing to provide the same services for 17.5% less cost but was not chosen. My team of Richard Conless, Brian Burns, the Stewart-U's and myself are willing to negotiate with the county to possibly provide even greater cost savings to the county by lowering our bid amount. The difference in the two contract prices could almost pay the entire salary and benefits of an extra patrol deputy with the Sheriff's Department. The difference could easily pay to hire an additional juvenile probation officer to work with the Lincoln Youth in Montgomery County. The other lawyers made the point to indicate that the difference in price is not all that much. Well, the average or not the average tax-paying citizen or in a position where they have to worry about the county's budget. At that same philosophy where to be translated budget-wide, we would be talking millions of dollars, I'm sure. At subcommittee that the full juvenile board relied upon, recognized our team as equally qualified as the other team because they offered both groups an opportunity to share the contract. Both groups decline. The other team states that one of the main reasons to choose them is that they regularly hunt and fish with members of the prosecutor's office. So what that other group is saying is that personal relationships play a role in the administration of justice in Montgomery County's juvenile proceedings. That's not good for the community that prosecutor decisions are being made based on personal relationships and not what is in the best interest of the citizens of the county. Justice should be blind and someone should not get a break or their case dismissed simply because the juvenile prosecutor and the defense attorney are fishing buddies. The safety of the community is at state 2 when you have a group of three recent juvenile prosecutors now dealing with cases against the reigning juvenile prosecutor that was a subordinate of one of the members of the now defense team if they're essentially eventually chosen. Those close partial relationships cloud what should be an adversarial system. Some time was addressed by the other team of lawyers of them being board certified in juvenile law. However juvenile law is not all that difficult to practice. It's duty law. When where crunch time comes, commissioners is in the jury trial setting where one of our team members has more experience and is a lawyer who is board certified in criminal law. It is much more difficult to get certification in criminal law than juvenile law. And most of the contestant matters in juvenile law, 95% of it deals with criminal law matters. If the other team of lawyers has chosen they follow the ethical requirements to inform their clients that they have the choice to have another attorney appointed, if they do not want someone to fitting them that previously prosecuted them, that will add tens of thousands of dollars of cost to the county. Additionally the county attorney will have to waive the conflict and that will be additional time and energy on the county attorney's office reviewing those cases because a new defense attorney is now privy to insider prosecutor information. The prosecutor would then be now at this advantage in a majority of cases. Another difference in two competing proposals, commissioners is that we have a passion for defending poor children. We bring 10 years of experience from a defense perspective of handling a heavy defense case load. The other team primarily has prosecution experience and are an improvement commodity in this field. As a commissioners court, you have to decide if that is the type of system you want for citizens of Montgomery County. Additionally, we are prepared to provide the same or similar services for much less cost of the county, a savings of more than $50,000. The difference can be explained in a simple analogy. You're going to provide milk for inmates in the county jail. Does it matter if they get Morton's milk or Walmart brand milk that's 25% less?
