Four and 18th Judicial Court, considering discussion approved, appropriate authorization of employment of an associate judge for a four-eighteenth district court. We judge Gilbert's here to address that this morning. Good morning. I'm going to try and be as brief as possible. I'm essentially asking for three different things that are on the agenda this morning. I'd like to talk about the first two together if I could, which are requesting the authorization for the employment of an associate judge and another court reporter for the 418th District Court. Y'all will probably remember many years ago other people were in front of you proposing the creation of three new courts which of course was done effective before 2008. This court is the family court which its primary focus is to relieve the pressure of family loads on all of the other courts, which I believe we are greatly doing, greatly exceeding. I've given you a packet to look at, we'll quick the top one. The first part is chapter 201 of the family code that shows you that y'all are authorized in this circumstance to create and allow us to get an associate judge. The purpose of the associate judge in this case is, essentially, we're drowning. If further on in this packet, I've given you the numbers that show you the number of cases that come into my court each month and in the number of cases that are disposed of each month. In bottom line, the cases that come in always exceed the cases that are disposed of, which is creating a backlog. We're currently handling 100% of all family law, pro-say litigation, people without lawyers. We're doing it well. We have a great system. The problem is, there's just so many of them, and these aren't cases that we can dispose of without being there, taking the time to talk to the individuals. It's just a slow churning process. We're also handling seven-twelfths of all of the non-family law cases, new cases that are filed in this county. If we don't do something to address this problem, what's going to happen is we're going to have a backlog of thousands of cases. We're already closing in on a backlog of 2,000 cases in my court in less than two years. If you flip a couple pages, I copied for you the local rules which come from a Supreme Court mandate which require us as judges to move family law cases, primarily divorce cases within six months of the date they're filed or the respondent answer. So essentially about eight months from the time the case is filed, someone should be able to have their trial for divorce and get finalized as opposed to living apart under temporary orders which usually are a financial catastrophe for families. If you turn the page, you can see an example of a scheduling order that just went out this month in November from my court. The cause number which starts 10-08 shows you the month that this lawsuit was filed. 2010-08 is August. That lawsuit was filed in August of 2010. It's been given a trial date of September 2011 and that's not because we don't have anything happening between now and then that's how full and backed up we are. We're already so back-logged that we cannot keep up with the local rules and the Supreme Court mandate of the timely disposal of files. On the next page is an example of my court, the cases in and the cases out, and I went around the state and compared it to other family specialty courts, probably the best county to compare ourselves to as Fort Bend County. They have the same demographics, same population. The significance difference is one, they have two family district courts where we only have one and each of their family district courts has an associate judge. So they have four judges, all of you. If you look at their disposal rates which are in here you can see that they are disposing of as many if not more cases that come in each month which is the goal. They waited right behind that is a letter from one of the judges staff there that not only shows you how it was created they started with the family court in the 80s with an associate judge, but they created a second and 99. They didn't get an associate judge until 2003. They waited four years. I'm here asking you in two years to avoid what happened in Fort Bend County. They had a backlog of over 5,000 cases by the time they got an associate judge and they're still trying to dig out of the whole seven years later. Their associate judge is making $105,000 annually, which is somewhat consistent across the state. What I'm asking for is I think it's time. I think that we have a wonderful system set up where an associate judge essentially you can have two courts running for about the cost of one. We don't need any additional staff. If you look at the last page, I've copied you a floor plan. That's my courtroom in the main courthouse. I've already taken Mark Bosma up there and showed him the pink circled area is what is currently room 2 to 2. Sometimes use is the ninth ancillary. Judge Edwards has graciously said that if an associate judge is granted, that we can use that as the associate judge's courtroom, all we have to do is pop a door hole in one of our walls. And I don't need any build out. I don't need any staff. I don't need anything but a warm body that's an associate judge and a court reporter. What I'm asking or proposing is that you approve an associate judge with an annual salary of $100,000 and a court reporter. I also have for you the current court reporters of the counties with an annual salary of $60,000. That would make this person the lowest paid court reporter in the county. Approximately after talking with HR, my understanding is those two salaries combined with benefits would be around $200,000 annual fiscal budget. What I'm proposing is that we start this on January 1, which would be three-fourths of the remaining fiscal year, so I'm essentially asking you to consider spending about $150,000. The benefit is simple. If we don't attack the problem now, it's going to be something we have to attack later. And I'm trying to propose that we do it before the whole is too big. And it takes us four bend-weighted four years. And they're still trying to dig out of the whole seven years later. I want to be able to comply with the Supreme Court mandates for timely filing of cases. Some of you are probably curious as to where the money would come from or how we generate money. Family courts don't really generate money such as criminal courts do, but I would ask you to consider two things. Number one, we're relieving the load on many of the criminal courts, enabling them to move their cases faster and likely generate more money for the county by handling their family law cases. And two, something that I didn't realize was happening or not happening before I took the benches, were very strict about ensuring that people who claim indigency and try to avoid paying filing fees in family cases truly qualify as indigent. No one gets a divorce in front of me that hasn't paid a filing fee without having strict evidence and testimony about their financial status. Conveniently enough they're also in front of me with a divorce decree so I have the ability to look and see that Bubba is asking to waive a $200 filing fee while giving himself the Mercedes and the BMW. Usually Bubba won't get a divorce until he pays his $200 filing fee. But I don't know how we quantitative it. I know for a fact that it's making a difference in the district clerk's office because about three or four months after I took the bench, Barbara Damit came up and gave me a hug and told me about this. I wasn't aware that that wasn't happening before. I believe that the auditor can confirm that there is some real money, not some contingent money that may be available to fund what I'm requesting. And if I'm not mistaken, perhaps from the district clerk's office, I'm not sure which may be a direct relation to the funds that we're helping bring in. So that's the information I'd like to present to you on the first two agenda items. I don't know if you'd like me to talk about the third or if you have questions on the first two, they kind of go together. Is C, I think you tell me that that part-time reference attorney is going to be a bring-on agenda? that part-time reference attorney is going to be paid for in the agenda. That's the third thing I'm asking for. I'm hoping might be a little bit easier so I'm asking you to approve something that will cost you nothing. Again, what it will do is enable the pro-se litigants to move through the system easier and faster, which alleviates us. It helps us move other files. There are many counties across the state. When I got, I'm not the smartest with in the shed, but I can learn kind of quick. And I learned quickly that hazing's alive and well in Montgomery County, when at the first judges meeting, they graciously gave me 100% of the pro-sale litigation. It's been an experience, but it's actually turned into a positive one. We have a separate docket. It's slow, it's painstaking. We have to look at every piece of paper and every file. When I say we, I mean I right now. There's no one else that can do it. An associate judge can help me do it, but it's what bugs us down. And we have all of them for the entire county. And there's easily thousands and thousands a year, okay? Other counties are trying to streamline the process. And one of the things that they're doing is they have attorneys. They call them reference attorneys or self-help desks, funded through their law library. What this person is is an attorney who's there to assist the pro-say litigants in filling out their papers and telling them how to get through the process. I've had Ms. Carr come watch one of our pro-say days and it's just a cattle herd. And the sad thing is, is there'll be 50 files there. Maybe 25 will get approved that day. The other 25, their paperwork isn't right. They've made technical errors. I want to prove of what they're trying to do, whatever it may be. And what we've got to do is try and tell them what the problems are without giving them legal advice and expect them to go fix it. It's a lot of them don't. A lot of them come back three, four, five times try. It's a lot of them don't. A lot of them come back three, four, five times try. It's a frustrating process. And really, if they don't come back and fix it, we're forcing people to continue to live separate while being married, perhaps not taking care of child support obligations or other things that need to be taken care of. But at best, I have a 500 batting average with these people right now. But you have petitioned by about library and a bar association and I have agreed to pay this reference. I went to the Law Library Board and what I'm proposing is that out of the Law Library Fund which has the money to pay for this, that they hire a part-time attorney to be a reference attorney to help the pro-say litigants. Travis County, Smith County, Harris County, other counties have things like this. And in Travis County, not one Procei litigant goes in front of the judge until they've sat with a reference attorney. Of course, they have three now. But that judge I went and spoke to him, watched them do their whole process for a day. He's got about a 98% batting average. It's amazing. But the Law Library Board and the Bar Association has approved this. If you approve it, essentially we would be able to hire or the Law Library would be able to hire a reference attorney to work part time. So there's no extra benefits or anything like that. What I'm proposing is that it'd be a $30,000 position for 20 hours a week and talking with Doty that turns out to be about 35,000 after the FICA and the other numbers that will be added to that. All of that would come out of the law library fund. It wouldn't cost the county anything. The money's there. There were some liability concerns or questions that were raised as I was talking to the bar and to the county attorney's office. One of, on that second clip that you've got, if you look at that second page and I put pink by it, there's all types of language where this is not an attorney-client relationship being created. This is a library reference attorney and a library patron. There's no legal advice being given. They sign something that basically states that the county attorney has asked or Dennis from risk management has asked that there be a couple other sentences added to that to give it some more teeth. But in short, Travis County has been doing it for nine years, has not had one lawsuit, has not had one grievance filed, and they moved their pro-say dockets along much more efficiently than we do. So I'm hoping you'd consider that item also. I think it's something I think the judge is trying to be very pro-checked here and do something ahead of the curve. Obviously, as numbers speak for themselves, I would make a motion that we'll prove A, B, and C. Whatever money we can, you can come up with fine, what we can't, what I would recommend we pay far to contingency. I don't believe there would be a need to do it out of contingency with continuously updating numbers. It appears that we will have enough revenue that hasn't yet been projected in district clerk fees to be able to recognize more revenue for that. I agree when visiting with Judge Gilbert last week regorists program I think it will be a real asset to the county and certainly an opportunity to avoid adding another full district court any time in the near future. Would you go here to operate the new forensic mental facility that the county's under construction with? Joe may or may not remember this was funded with the help of Senator Williams for $7.5 million with a writer 97 appropriation bill out of the 81st legislature. This is a first for the state of Texas to have a forensic facility that's operated by another local government agency for the purpose of treatment for folks with mental problems prior to going to trial. This is a 100 bed facility located here in Conroe. It was built at a cost of slightly over $31 million, which includes a million half in furniture fixtures and equipment. Today's contract with GL will provide for a cost of about $124,000 per bed to operate that. That's somewhere in the neighborhood 11,000 below the state's annual cost operation beds that I remember correctly. We will serve both male and female patients. All of these patients will be placed here by the Texas Mental Health Services. What's the correct name? It takes the human health service. Which we anticipate will control or help us control our costs of transporting mental patients back and forth to rush to wherever they have to go outside the county as well as accepting clients from throughout the state of Texas. This is great. 175 full time jobs. Adding a $9 million annual payroll to Montgomery County's payroll cost. And average salary of $51,600. It's quite an asset we've believed in Montgomery County. And we're certainly proud of it. I want to thank Linda Bersillo for the time and effort that she put in to get this contract put together. We started on this project somewhere neighborhood three and a half years ago. It's been a long time in coming. We're scheduled to open March 1st of 2011 which we will meet that deadline. Our first reimbursement from the state comes into the government county on December the 1st and it will be funded throughout the balance of that year. When anticipated, we refunded to another appropriation in this coming session.
