Let's bring the court to order, please. Let's stand for the opening prayer and the pleasure of allegiance to the church. David Walker, you have a letter from the prayer sometime. Thank you, Larry. I don't have a prayer. I have a file that we have that before this morning in the form of a letter to give us from the praise and thanks be to you. I have a letter that you give us from the time we've been playing it. us, let us all of those present. Ask us which you, questions to this community. Go on to the country. I call this morning that you'll be with our young men and women's decisions around the world. Check out our freedoms, serve our armed forces. Ask us to give us success and ambitions that they'll return home safely to their country. Ask probably this morning that you guys are on the court I pledge allegiance to the flag of the United States of America, and to be republic for which it stands, one nation under our indivisible, with liberty and justice strong. I would like to take a pledge to lead the Indian Texas, one state under one flag, one indivisible. Thank you. I'm going to write one in the middle. Already for the record, all members of the court are present with the exception of Commissioner Metter. You need to most of the agenda, please. Move. I'll see you. I'll see you. The mission is we have two resolutions this morning. First is middle health awareness month. We have anyone here to read that. All right. I do. I guess I'm saying that's the reason you're on board. We're as Middle Health is critical for our well-being and vitality, as well as that of our families, communities and businesses, and where as the President's new Freedom Commission declared that mental disorders and mental health problems affect people of all backgrounds and all stages of life, and to no one is immune, and where as the World Health Organization found in mental illnesses ranked first in terms of causing disability in the United States, and collectively are the most prevalent health problems in America today, more common than cancer and lung and heart disease combined. And whereas one in 10 children has a diagnosable, mental, emotional, or behavioral disorder, one in 10 is from a serious emotional disturbance, TDHS, and whereas mental health disorders such as schizophrenia, depression and anxiety disorders are real common and treatable illnesses. And whereas one in four adults is affected by mental disorder in any given year and only 16 percent seek treatment. And whereas the US Surgeon General has found that a range of mental health treatments of documented efficacy exists for most mental disorders. And whereas the National Mental Health Association, the National Council, or Community Behavioral Healthcare, and their national partners observe mental health month each May to raise awareness and understanding of mental health and illness. Whereas we call upon all Montgomery County citizens, government agencies, public and private institutions, businesses and schools to recommit our community to increasing awareness and understanding of mental illness in the need for appropriate and accessible services for all people with mental health. Now therefore, be it resolved that the Commissioners Court of Montgomery County is pleased to recognize the month of May 2010 as mental health awareness month signed and entered this 24th day of May 2010. I move. I'll have to am. Thank you. Next, older Americans month. We acquired a few that are qualified to read this. Look at the Americans like me. You can never read a motion or anything. Well, I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. We're asked for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We're asking for a chance. We economic groups and because in 2009 more than 89,489 in-home intakes were received, 72,265 investigations were completed and 50,936 cases were confirmed with victims of abuse, neglect or exploitation in the state of Texas. And whereas the health and well-being of elderly and disabled people in Texas and Montgomery County should be one of our highest priorities and of concern to all Texas. And because no aspect of our society, cultural and technology, our agricultural science sports, our education would enjoy its current prominence without the contribution from those who are elderly or have disabilities. And whereas we recognize the benefits of wisdom, strength, courage, and knowledge of the elderly and disabled and because the experience of their generation and contributions can only aid our great state of Texas in meeting the challenges of its future. And because people who are elderly or have disabilities are among the most important resources of the great state and because it is fitting that we as community recognize it need to protect their health safety and rights. Now therefore be it for claims that the Commission of School of Montgomery County Texas does hereby proclaim the month of May 2010 as older Americans month and Montgomery I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with the government for the past 20 years. I've been working with please. Thank you for coming today. Thank you. All in favor. Yeah. Motion passes. Under the county clerk, we need to prove the minutes for May 10th. Move. Second. All in favor. Yeah. I wish the Sanctuary have one item on under the treasure page four. items 9B1 and 9B2 to be removed. That's all I have. Move on consent. Second. All in favor, sir? No. This is we need to prove that Pady Warner in my office, the authorized signature on tax refunds. Move. Just this number four. Missioners. First thing that we'd like to ask the committee to approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the approve the integrated filing system, help with our records management and also some office furniture. Move. All of the oversea. Motion passes. Second thing that we would ask is that you allow the purchase of some technology equipment to computer systems, a mobile printer for the judge, and some laser printers to upgrade our receding process. Those funds being made available through the technology fund. Move, second. All in favor, please. Yeah. Thank you, gentlemen. Thank you. Texas S.S.R. Yes, Your Judge. I'd like you to the court to know that I received some additional information that makes me want to revise my request today. I'll find out that there's over one third of our employees to make in less than the 95% of midway point. So I'd like to withdraw that request and ask it instead. Did you put that request in? Is consideration for my budget that I'm submitting for July discussion purposes? The funds are already there. Those are other funds that are coming in restricted use, but I don't feel it's appropriate that my employees be treated differently when we got one-third of them out there not being paid that same amount. So with that in mind, what I'm asking to do if you've got that recap with you is take item A and B and improve that, approve that and that's a total savings of 34,833 with the reorganization. Move. Second. All the papers here. All right. That's all, and I shall have got some other questions. Thank you for taking that off the agenda. All right. Thank you. Appreciate that. All right, thank you. Appreciate that. All right, juvenile probation. Morning, I have two items before you this morning. The first is to consider consent and approve appointment of Robert Rosenquist as a juvenile court magistrate. The funds do exist for this. He would be used sparingly, primarily be used only on Mondays and Tuesdays for our detention hearings. His power is a real limited as a juvenile magistrate, but it would be much more cost effective of using him than having a busing judge come in. And this would be done only in absent, if our juvenile judge was absent that day. So that's good to you. The juvenile board did approve this on May 7th, but it does require your consent. Some here today requesting your consent. Is that different than the problem with calls hearings? It's different, right. These are just attention hearings, right? I'll move. Okay. I'll have to see on that. Okay. Motion passes. Second item is to consider and approve allocating the $25,539 reimbursement from HGAC. For expenses incurred for housing juveniles from the Coastal Detention Center during Hurricane Ike. The money has been received. Would like to use those funds to do some needed repairs on the building. An example of some of the repairs are needed, is we need to repair a walk-in freezer. We need to update our ancill fire suppression system in our kitchen. We need to purchase a walk-through metal detector for detention. We're currently using a loner from one of the school districts and it's my additional updating of painting and so forth in the facility. Move. Thank you. On paper. See you. Thank you. Can I ask if you need to vote on that? You know about the salary being included. Does it affect me? I'll put the salary part of the motion. That that was really be that money will be put into a suspended count basically. My understanding from everything JR said was he'd like to order a proof items a NB which are a total cost savings to his budget but what he wants is for y'all to address the increase of the entire county's population who's paid below 95% of the mid-wondering budget. No, no, no. So my daughter and my daughter just have been living in a little bit of a new city and try to sound as if we were there through my... Okay. And that's a whole budget. But just tell her how it's not being lived out. Okay. Okay. Where are we? Let's see. Sheriff. Good morning. Good morning. Item A considering a proof purchase of one refrigerator for Walden detectives not to exceed $500. This appliance is needed to store evidence and other items requiring a refrigeration. Move. Okay. We'll see. Yeah. In B, consider and approve the following transfers of budgeted salary and associated longevity, certification, and or other associated pay with the following position change. These transfers do not increase the approved salary structure. There are two. Move. Second. All in favor, sir? In C, we ask you to consider and approve the deobligation of the balance of grant funds for unused travel and training in the amount of $339.78 from fiscal year 0-9 for the CGAD HGAC grant contract number 189-2502 for specialized investigator for sexual assault program. Move. All the papers here? Indeed. Considering approved the de-obligation of the balance of of CJD grant funds in the amount of $434.30 from FY09 grant contract number 214-4001 for NCARD Video Cameras program. In E we ask you to discuss an approve of the acceptance of funding from the high intensity drug trafficking areas program in grant number G09HKN0017A awarded in the amount of $24,460 in authorized county judge Allen B. Sather to execute both the grant agreement and the grant conditions on behalf of Montgomery County Sheriff's Office. Move. Second. All the papers are out. Thank you. Thank you. I rely for the station. Good morning. Morning. I'd like to ask that you all consider and approve a request to move funds in the 2010 budget from payroll account to a holding account 999-999. Very good. Cheers. Second. All of the papers here. All right. What's your pass? Thank you, gentlemen. the building maintenance considered to prove the transfer of position 510 6906101 need equipment to infrastructure position 407 6906-1. This position will not be replaced and building maintenance. Move. I'll never see out of that. Question commissioners, is this intended to go into our energy grant, which is under the infrastructure department, or is this intended to be an infrastructure itself? The infrastructure itself is not for that. Morning, Joe. more than Joe's. Consider and discuss entering into at least agreement with Conroe Symphony Orchestra for approximately 4400 square feet of space located 1500 North Frasier property. We're not doing anything with that space right now. No, sorry. No point. No, and so we're not going to go in there. But if you all approve this, we'll go. We have a broken window. We need to replace. And then another window that's out will take care of those. We have Dr. Alien Arnold here in the next pipe. Terry, all this morning. I understand your board has already approved this. What term leads to we talk about in my office? We talked about five years of one year at a time option to root for a four-dition one-year periods. Does that be a sufficient for y'all? Which was the way I look at this is that textuary is not being used. This might really help paper air conditioning over there. I think it's a win-win situation. Is there any discussion on the agenda here? I think it's good. I'll look at it with you. So all in favor, see you. I'll get with Gary in Terry's office on the paperwork. Great. Thank you, Mark. Congratulations. Good morning. Good morning. I had spoken with Commissioner Metta about both of these proposals. The first is to authorize a transfer in the budget. When we submitted information for the budget last spring, CIS, which is now IT, information for the budget last spring. CIS, which is now IT. If they change their name one more time, we're just gonna have to get a generic care. But the recommendation had been for three servers and three uninterrupted power supply units. Another direction is being sought and we believe it'll be more cost effective. At this time, those units do not have to be purchased. However, we are at a crisis crossroads with regard to replacement computers. We've had several go down at our circulation desk and so I'm asking that $11,247 be taken from capital outlay equipment and be put into the supply other account so that we might buy replacement computers. My second author is to authorize funding for the position that you had previously approved. This would be the new children's librarian. Our 20-year employee retires at the end of the month, basically the end of this week, and we have secured an individual that we believe will be able to pick up and run with this Activity has some prior experience and therefore we'd like to make these changes as Listed to fund the position and then the remaining funds From the earlier library assistant position would be moved into this area as well so that the total budget would be for the entire position. All the favourites here, Anna. Thank you very much. Auditor. I have a request from the county about the audit firm of Herphered lynch sellers in Kirkham to engage with the county for services for the audit of the fiscal pin report. Tom sellers is here with herphered lynch to address any issues or questions you may have. Move. All on papers here. No, no. I'll go ahead and consider and accept the county's compliance report for the year and to September 30 2009. This is in regards to single audit work, which is required of anyone receiving an excess of $500,000 of federal governmental grant. Move. All in favor, T.I. What's in pass? I have request from county court at law number two to use $295 from the court reporter service fund. Move. Second. All the papers. Yeah. Okay. I have another request from county court at law number three to use $623.63 from that same fund. Move. All the papers. Yeah. And finally I have a request from the 9th district court to use $295 from the court of quarter-students. Move. All fairs here. All fairs here. Thanks. Thanks. Thanks. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. I would like to defer items 1 to 7, 9, 14 and 15 and 18. I would like to take the following recommendations for the Commission's Court in one motion for items 8, 10, 11, 12, 13, 16 and 17. Move. Second. I'll pay with the item. Thank you. 10, 11, 12, 13, 16, and 17. Move. Second. I'll pay for CIO. Thank you. County Attorney. 21A is deferred. 21B. We are asking you to approve and order to pay $1729.32 in accordance with a settlement agreement that was previously reached in the litigation with Katie Allison. This additional settlement amount is for co-brecverage that we had agreed to pay and we would need a funding source for that. The rest of the settlement agreement was paid from contingency. Move. The funding source comes from the same imbalance of it. Second. All in favor, sir? Aye. Thank you. And 22A is also deferred. Okay, we have a public hearing. You're precinct three. Let's reset the court. You could be in that public hearing. We have two items on the public hearing. Considered in placement. Always stop at the intersection of Lake Robins. And what are we having to? Anyone here would like to address it. Second items. Considered in placement. Have always stopped sending the intersection of branch crossing at Caramont Anyone who likes to dress it It's not yet Alrighty, let's adjourn the public hearings or recommend commissioners court. I move Well, if they're see us Oh some passes Okay, you know commissioners precinct three consider an approval agreement between the Grimmick County and the commission is precinct three. Consider an approval agreement between Montgomery County and the Texas Department of State Health Services for the operation of the mental treatment of the facility and authorized emergency chance to sign and required contract documents. Linda's here and she spent the majority of that time putting that contract together if you'll have any questions, she'd be more happy to address it. You know this well. If this has been about 18 month project at this contract ultimately done in saying that move for approval. All paper see aye. Motion passes. Make sure I'm is considered to approve a tentative schedule of dancing connections with the issues of wine for the purpose of constructing this mental health treatment facility. Mr. Chancellor, Judge? Hello, Ron. Ron, a hair with RBC cap for markets. I did pass out a brief presentation regarding the financing for the mental health treatment facility. Tentatively looking at about 33 million and certificates of obligation. Page one and two give you an overview of the current state of the bond market. The bond market, bond buyer index is highlighted in more detail on page two. We actually had a very stable interest rate market. The bond buyer index for general obligation bonds is that blue line on the graph there. We're currently at a 4.27. We anticipate pretty stable interest rate environment through this sale. Page three is simply an overview of the schedule that we're trying to adhere to. After today's meeting we're going to begin working on the necessary documents with the attorneys, primarily the familiar official statement. We will come back to you on Monday June the 14th for your approval for a notice of intent to issue certificates of obligation so we can meet our publishing requirements under the law. And then we will proceed along the calendar and come back with the bond sale on Monday, July 26th and looking for funding closing on Thursday, August 26th. Between now and then we're going to be working on structuring the bond issue. We've tentatively run preliminary numbers again. We're at 33 million tentatively but we'll hone that down for our next meeting. I thought the amount of my nature was 31.8 million. We've got some capitalized interest that we're going to put into the program as well as a reserve fund. I do have the numbers here. We've got 31.8 as a deposit to construction fund. We do, and preliminary numbers, I do have about $200,000 in it for bond insurance. Currently, we don't think we're going to need that number, so I'm kind of hedging with you a little bit. They probably be lower than that. And all the debt service on those back by the contract with the state. That's what we anticipate. We sign weird response today in this initial contract, which has renewable provisions and the way that we now cost this with negotiation on the city operator. We should be able to cover both the operations and the entire debt service out of the appropriation from the state. I'm sorry. I moved. Thank you. All the folks here. Thank you. Thank you. Thank you, Brian. Consider an approval electronic explanation of the HAC, Solid Wage Grant application from the Grimm and County precinct three, CIS and drop off recycling facility. I moved. Highway 242 at FM 1314 per application on file. I think Mark has you got any comments on that Mark. Commissioner, this is this ramp pass through financing that the state is offering. We have one project that we have submitted. We've actually submitted the application. This is kind of an accident. We had a deadline to be. We. We've actually submitted the application. This is going to act in fact. We had a deadline to be, we wanted to bring it to the court for your approval. I move. Thank you. I'll take a seat on. Motion passed. We'll be under order 55107.
