I pledge allegiance to the flag of the United States of America, to the Republic for which it stands, law and nation, under God, individual, liberty and justice for all of us. Our own country is wide, our families lead to the effect of one state under God, one individual. The record on members of the court are present. We need a motion on the agenda, please. All the favor say aye. We have a resolution proclamation today for one of our value consultants, The Good morning. Good morning. Proclamation is as follows. Whereas tennis be McMahon is served Montgomery County commission's court. It's employees, retirees, and taxpayers for over 30 years. And whereas during the ensuing years, the district manager uses his depth of knowledge, vast experience and the management of risk to assist Montgomery County Commission's Court in managing the risk associated with operations of a rapidly expanding and progressive county. And whereas in providing his expertise to commission's court, McMahon has enabled commission's court to provide cost savings for taxpayers that can be independently measured in the millions of dollars. Whereas in 2002, McManagree to increase his duties and assume the position of director of risk management on a temporary basis, Auditor Care Athe request of Commissioner's Court to establish and operate an independent Department of Risk Management, which is charged with administration of employee benefits for out employees, dependents and retirees, workers comp for employees, safety programs for employees, and facilitating risk assessment and the management of laws prevention programs for avoidance of property casualty and liability events in whole areas of county government. Whereas through his leadership, the employees of the risk management department have expanded their professional knowledge to better serve commission court employees and taxpayers of Montgomery County. And whereas McMahon has expressed his desire to resume his original role as advisor to commission court and the risk management department, whereas it is with great reluctance the Commission's Court understands and accept McMandre's request to resume his original role as advisor. Now therefore, bit resolved, we, the members of Commission's Court of Montgomery County, Texas, who hereby proclaim both our recognition of and gratitude to Dennis McMandre for a job that has reached above and beyond any of our expectations and anticipate a continued successful collaboration. Sounds pretty good, McLean. You write that? I don't think there's a member up here or an employee that will argue with this right here. Dennis says, that amazing things with our risk management department and, and in it absolutely has saved us millions of dollars. The clinic that I would love you and joy is the brain child of Dennis McMahon. It's done great things from Montgomery County. I've been extremely helpful in the business that we're in and we're gonna miss him but he's got some good folks that he's trained that's gonna carry right on. So Dennis congratulations and joy. Yourself. I'll lose, good. Second. If you've ever been on your own business and look for good any work, when it comes back, that's unheard of. You know, I think all of us have seen that up here, but Dennis has brought us a lot of money back from work when it comes. And that's just unreal. Yeah, and before we vote, I wanted to make a few comments. Dennis, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no that we're discussing this resolution and we appreciate all your work. And there's a motion to second. Any more comments before you vote? Excellent job, Dennis. We have used your department no savings to balance our budget on more than one occasion. It has meant a great deal to the county and savings and the ability to do what we've done with our own insurance program. I don't think I've been through the budget yet that you didn't bring money back to us at the end of the year. I hope you still have those suggestions for us. Thank you, Dennis. All in favor say aye. Or some passes. Under Kenny Clark, we need to prove the admonitions for May 23rd. Move. Second. All third. See I. No, no. Missors, I have no change for consent. Move. Second. All favor, see I? Aye, aye. All done. 10 a. We need to defer the item on the Grand Parkway. We're still working on some conditions. If we do in fact give this back to the state of Texas, we are working on some conditions still, and we're not really quite ready to vote on this. I don't think commissioners, if you all agree. Judge, before we further that, I think Bobby Adams and John Holtworth have been working on this deal. But y'all like to throw a little something in on this deal what we can be looking for to do. He's back out behind you. That ain't a good deal. I have to be guiding in negotiating power and well I certainly think there's value on the Grand Parkways from this turn and I think Jason you go ahead we were talking about it this morning. Well this is a very important card art for the region in particularly Montgomery County because next basically loop road around Houston, the belt aid is to go down it is totally congested now. But right now what's happening in the state legislature just passed a major legislation that was crucial to text off for them to continue or be able to develop it. I haven't seen the final version of that thing, but they're right to be able to sex dot right to be able to develop the project with some private money expired all the 31st of this year. Supposedly the new legislation allows them to be able to continue on to look at various options through public private partnerships and other things to be able to develop. Anybody, any government, ladies and and the prompt this time. So if that did indeed has, it gives a text dot, this continued ability to develop projects in this way. It's my understanding that text dot is still has not received their final traffic and revenue study from their consultants to determine how much total revenue this thing will generate until they have those numbers. They don't know exactly or will not be at a very good position to negotiate with a private concern to help them design, build, and finance this thing. So I think you guys in the county would be well served to wait at least until you get these numbers in. The tech stocks will have and see how lucrative this might be. Then that puts you in a good position as a help in your negotiation with textiles to get, you, if you're right now, and so let, you need to just determine, which is the best opportunities, and the best way, both the expedient way to get it built. And if that's to give it back to TexDot Fine. But we need to have our input into it. And the county gets the best deal that they can out of it. When is that traffic of revenue study going to be completed? Well, it will be the end of this month or first of July. Right. It could be as much as on into July before they get the numbers. That's when World're supposed to do. Yes. And so once you get those numbers, we'll see how lucrative the thing is and help you guys and be able to make a decision on whether you want to pursue it yourself or let them pursue it. If they're going to pursue it, obviously, you all have expressed the concerns that you want to know. When they're going to do it, when they're going to do it, when they're going to deliver it to you, and what are the kinds of connections and our value that you can get from it now or in the future. The Highway Commission at their last meeting authorized TechSdot to go out from RFP and always to this year for segments B,1 and F2 I believe we think we're running any risk of delay in segment G by the current this or to making different I don't think it makes any difference I think it's a good decision with the furthest commissioners the too many unanswered questions at this point. But thank you all for your input. We're going to set up a group of someone's in the go-shake with tech. Once we do get those numbers, you think that'd be a good idea at this point. We'll talk about it. Okay, Kenny, courtle Law Number 2. Good morning. I have an employee who's a, she's a part-time employee. She's going to be leaving for maternity leave here very shortly and since she's not going to be paid while she's on maternity leave, the funds are there from her position to fund a temporary to perform her function while she's gone and I'm asking the court to approve that move. That all in favor. See out. Motion passed. Thank you. Chair. I want to judge commissioner on on 12 a asked you to defer that on 12 b asked you consider to prove the following transfer to buddy the Saudi associated longevity certification in our other associated pay with the following position changes these transfers do not increase the approved service structure in there's one move on paper. Yeah. I asked you consider and set grant fund from the NRA Foundation incorporated in the amount of a thousand nine hundred twenty one dollar and forty four cents. The application for the grant was approved in commission school on nowhere on 22nd 2010 under motion 15. Move. All favor. Yeah. Some passes. FOFD, as you discuss and approve of appropriate the acceptance of funding from the high-intensity drug-trapting areas, HIDA, program and grant number, G11, HN 0017 a Warding amount of $16,460 an authorized county judge Allen be sidelined to execute both the grant agreement and the grant conditions on behalf of the Montgomery County Sheriff's Office One paper say I Thank you, sir. Farm marshals. One of the judges risk. The first item that we have on the agenda is the adoption of an order under local government code 352. We'll be adding skyrockets with stick and missiles with fins to the list of restricted fireworks that cannot be sold or used in Montgomery County. That is normally put into place anytime we have a dry index over 575. Our reading as of yesterday was 718 in the county. We did have some rainfall but we expected to stay at least in the 700 range for some time. So it's appropriate to go ahead and put that on now. We have a June 15 deadline. The quicker we do it, the more notice we give to the fireworks industry so that they can properly order their products for the season. So it asks that you go ahead and approve that order at this time. Move. Move. Second. On favor? See how? Motion passes. Second item is just a brief update on where we are in the drought conditions in our current status in Montgomery County. We had some sporadic rainfall yesterday, mostly in South Montgomery County, the Woodlands area. That really was beneficial because that's been the driest area by far in the county. It's just been bone dried down there. So that's helped us kind of even things out. The North half of the county got no rain. We expect when the numbers come out today, we'll still be in the range of 700 on the drought index. And that's really unprecedented for this time of year. We never see those numbers until later on July, August, during the summer fire season. So with that, there's some obvious concerns going forward. One of those is the July 4th holiday. We started meeting with the fireworks industry. We have some representatives of the fireworks industry here today. We started meeting with them last week. Harris County started meeting with their folks and we're developing a set of recommendations. We have some recommendations now. We're working to reconcile those for our area, so it's not just Montgomery County, the idea is to be uniform throughout the Houston area. So we're gonna come back with those recommendations, probably somewhere along the line of the next week or so to your judge and give you some information. And then we're gonna have a recommendation that the fireworks industry can support, that the fire service can support, how to move forward, should these drought conditions continue through July 4th. So we would do that under a disaster declaration. So there's some time limits that we have to work with, but we believe somewhere around the 15th would be an appropriate time to come back. That would give us time to decide if we want to do a disaster declaration, ask the governor for the extension and then bring it back to the court to further extend it, you know, to follow all of the steps that we need to do to make that declaration legal. So, look for that probably on the next court session will have that for you and my goal is to have something that's not just from the Fire Marshal's office, but it's something that the industry can support as well. Good job. Appreciate your job, Jimmy. Okay. Thank you. Any questions? Okay, we're at the management. Morning. Please consider and approve the following changes. Open position 402, 95261. Close position 402, 8327-1, and transfer budgeted salary to position 402-9526-1. What is that? That is the open position is the Director of Risk Management. The closed position is the Wellness Center Ops, a risk administrator. Okay. I'm going to take it. All in favor. See you. I'll move some passes. Thank you. Thank you, Judge. Auditor. I think you can consider and approve some changes related to reorganization of the alarms division. You have a alarms division in the collections department and I believe the function of that is being transferred to environmental health. So going through all of these, it's asking you to create the department titled Environmental Health Alarm Division and transferring the staffed positions from the collections department for the alarm division to that environmental health alarm division, transfer the equipment associated with those staff members and transfer the remainder of the operating budget for that function all to the new environmental health alarms division. Move. Thank you. All the fairers, yeah. I'm going to put some passes. The next item I'm asking you to consider and approve an optional contribution to the county's account with TCDRS. Several court dates ago, you approved the buy-in from one of the local judges into our retirement system. There was a funding source isolated for that. It was the second region. We've received the funds from that. And so we need your authorization to put those funds into the TCDRS plan. That was from Judge Underwood in the second region. Move. Second. All third. Yeah. Next I would ask you to consider and approve the counties 2012 TCDRS plan provisions and authorize the county judge to sign. Being requested this year is to not adopt a cost of living increase for retirees and to keep the elected rate of 10.94%. That's the rate you've elected for the previous two years. No move. Say it again. All fair, we see out. Uh-uh. And finally ask you to consider and accept the compliance report for the fiscal year ended September 32, 2010 as prepared by Herford Lynch-Cellars and Kirkham. This report does include the schedule of federal financial assistance as required by the single audit act. Move. Say it again. All of every seeah? Thank you. Purchasing. Morning. Morning, Judge. Commissioners. Item 1A. I would like to present the recommendations and contracts from Proofle for the following award items 4 and 6 all in one motion. All in favor, sir? Item D, acknowledging to accept the contract with consolidated traffic controls, Inc., for traffic control, enforcement and single reemption equipment through interlocal agreement with HEC for various precincts. Move. There we go. All the verifications? Uh-uh. See, consider and approve the discretionary exemption. Text the local government code, and it takes section 262.024A4 for the police explosive technicians course in radiography training from the Canadian Police College. The total cost of training is $81,326.40. Funds to be taken out of the 2009 UASI grant emergency management. Move. Second. Well, if ever see, I. Thank you. Thank you. Thank you. How the attorney? In item 17 A we're asking the court to consent to an assignment of a land lease at Limstein Executive Airport. Are these assignments from Charles Ballard to Douglas Mab? For a hanger number six, 1677 square feet of land. And following the assignment, all the terms and conditions will remain unchanged. I move. Second. All favor? Yes. I. The team V were asking that the Corps acknowledge and accept the amended motor vehicle title services rules and regulations. This is amendment two to the rules and regulations that were adopted by the tax assessor under chapter 520, the transportation code. The amendments include a provision that would prohibit the title service companies from submitting their documents online. There's also a provision that requires them to retain certain records and allow for the inspection of those records by a peace officer. And that record requirement is already contained in the statute which is one to include those intellectual rules as well. And finally there's a provision that allows the tax system to cancel or suspend those licenses for failure to maintain those required records. A move. A little bit worse, yeah. All veris here. The item 18A, wrestling the court to approve an agreement between Montgomery County and Sam Houston State University. Sam Houston is going to provide psychological services to the Montgomery County Sheriff's Office for 20 hours a week. The services will include psychological assessment, counseling, and screening of the new inmate. The services are going to be provided by doctoral students at the University under the direct supervision of the director of clinical training at the university. The term of the agreement is for one year in the cost of the county's $11,000. I believe the sheriff will be able to absorb those costs in his current budget. Move. Move. On favor. See I. Okay. Under commissioners precinct one concern approval resolution to wave the local cash match for a bridge. To be replaced under the federal off system bridge replacement program by committing to making improvements to other county road crossing drainage structures location is take a chance and road it like Creek CSA project number 0 912, one, I move. Second. All in favor, staff. All right. Alrighty, precinct three. Sitting through the following replacement on the citizen advisory committee for redistricting. Gural learners, one night able to serve on that. And he's being replaced by Jim Simon, who is the newly elected city councilman in the city of Oak Ridge and Orange. I move. Second. All in favor, All in favor? Yes. All right. Motion passes. Okay, under article 551-071.072 and 0.074, let's recess for executive session. Okay, let's reconvene the court with quite a bit of action necessary for my executive session. First, we need to approve the settlement with Decker-Oaks, investment corps and develop maturity in DIMT Company. All fair for sale? Yes. Okay. Number two, they discuss, and if appropriate, approve the settlement of McGermy County versus Stone Ranch Development, and developer security surety and adept to company. Say it. All in favor, say it. All right. Okay, on 21D, we need to authorize filing litigation against Kenya crossing LLC and The surety company developer surety and in dem to company move off every side E We need to discuss this appropriate authorize filing of litigation against here at this point development and First and then with the insurgency company All favor say I Continent see Okay, do we need action on the Black Forest Finchers Leaf today or not? Not okay, we don't. Okay. And finally, we need to approve disciplinary action against Nadine Jenkins and John West Which would be suspension with pay until further notice All of every see-out All right, did we have any citizens who would like to address commissioners courts today? Court today. Anything else to mistress? Oh, human resources. I didn't see Doty. Good morning. We're considering the proof that payroll change requests for all of the favor. Anything else, commissaries? Good, we're adjourned. Second. All the favourable. See ya.
