There was a mistake made in original allocation and that money should have gone to Fort Bend County Structural Collapse Program. The 400,000 will come from 9-9-4-06613-75708 and the 12,371 will come from 9-9-4-066613741 and 1.13. You're not already obligating any of those monies for anything. No. Move. Second. Thank you. In the past, the East Montgomery County Chamber of Commerce has asked to use a portion of the Tullis Library parking lot in conjunction with the Solmeal Festival. We understand there will be constables there to make sure that library patrons will be able to use the library during the time that it is open, that ask you to consider and if appropriate to approve. Oh, thank you. All pay for the seat. Hi. Thank you. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right I received a petition for the local option election for the City of Magnoia, and I submitted a certification that there were insufficient qualified signatures for this court to order that election. Carol, did I understand that they didn't have enough copies of the petitions to get signed? Is that what happened? Yes, that's correct. What happened? There were data births with left blank or incomplete on some signatures. The dates that they signed were with left blank on some signatures. Some voters weren't registered or weren't registered in the city of Magnolia. There was a page 17 that they duplicated and they have to use our original certified sealed pages. They had 25 pages, they returned 17. They were also voters who probably signed for family members, but we didn't even get that far into checking signatures. Okay, is there another option or an opportunity to try to submit these petitions at a later date for another election. I think it's a minute for November election. November OK. Thank you. Thank you. Thank you. I guess we need a motion and a second on 15 Blue. All of every see that? 16 environmental services. Morning. These are the properties that we have blist for demolition or requests funded by CDBG. Six houses and structures at this time, one in precinct one, one in precinct two and four, in precinct four. Move. Second. All the favor? Yes. Collections. This is to move $1,535 from one position to another. You know what this is about? I'm going to do it. I'll put it for it. $18 a agricultural life extension. The extension services in the process of identifying program areas for 2012 through 2016, and this has always been fundamental to our program development. You know we use volunteers to help us determine program topics, program areas and areas of focus for our extension agents to work with their volunteer committees. While long term strategic visioning is the core responsibility of our leadership advisory board which is made up of about 15 community leaders from across each of the pre-sinks. We also like to involve others in identifying issues. And one of the new program development models is to use an online survey process for getting county residents to reply to those issues. And so I'm here today to ask your approval in being able to send this survey out to all of our county employees to give them an opportunity to reply to relevant issues that they see as being critical in their parts of the county. So the process would be that I would send the email with a cover letter to the judge's office and then if they would send it out through our CIS department to all county employees I think that would be an appropriate procedure. So I ask your approval for that. Move. All favor see out. Thank you then county employees. It's only like one question maybe like two minutes. I mean it's got some demographics. And then residents are asked to identify at least one critical issue that they see facing the residents of Montgomery County in the next five years. And that's basically it. And then in the next few months, by May 16, we'll be pulling those surveys together. And they're all being tabulated at Texas A&M and then we'll be able to see what's most critical in our county. So we'll be getting back with you on the results of that. Right. Thank you. So very much. Auditor. I'd have to get a consider and approve for separate requests from the 418 district court that total $7,670 and.97 for use of the court reporter service fund. Second. Number C.I. Thank you. Part two. Good morning. I would like to present the recommendation and contract for approval for the following. Award items 6, 7 and 10. Reject and re-arrived item number 8. And to defer our other items, not mentioned under this section, all in one motion. Move. Sorry. All motion. Move. Second. All favor, say aye. Item B, acknowledge and accept the request from the Sheriff's Office to purchase five vehicles through the interlocal agreement with HGAC and Dallas Dodge in the amount of $101,366. Move. Second. All favor,. Move. Thank you. All the papers here? Thank you. I'm just curious. I'm just sharing vehicles. I close the local guys to the Dallas Dodge. You know, Sherry? I know that the Crown Vicks don't make it anymore. And we're what I know to share the Prime Minister want to use this vehicle to do a test for durability. What vehicle is it? The Dutch Charger, Police Package. What was the local bids versus the Dallas Dodge? We have an individual sound. The HAC by board. The HAC, contract. The HAC is the one that bid it. The worst. We have a choice to go to the HAC by board or bid amount. Yes sir. Which do we do normally? We bid amount if there's enough time or less there. Sure, the prime minister is in the rush to have them quicker. Use the little bit of HAC because of the volume to get a better pricing. Well, I recommend if we could bid those out locally, we do. We have a lot of local dealers, as you all know, the support community. I think we ought to do that. If there's enough time sheriff. And I know you probably didn't even get involved with this. Well, and I read we go before the eight years before, so we get to be in the office. And yeah, I mean, we do that. We haven't had much luck in the past, okay. Okay. Thank you. Thank you. How many dealers it takes, you know, 12, 16 weeks or maybe longer to even think about getting them. You know, they know. Life they get, they get their journey. Okay, we got to an answer now. Well, that's the way it is. Is that an hour out, Chair? Yes, sir. We don't have the guard, they'll hear you say this morning. Two to three months, you know. Okay, county attorney. In 21A, at the request of Barbara Damott, we sent a notice of lease termination to the Clayton Theatre Foundation. We had been using the Theatre for jury assembly purposes 2003 2003 but we no longer need that space. The letter went out from the county attorney's office and we asked you to approve a resolution in order ratifying the county attorney's 30 day notice letter to terminate the Criot and use effective March 31st. Where are they going to have? At the old commissioners court building they built out out a new, serious, in the room. How many were let hold? Yeah, actually it was the auditor's office. The auditor's office. Yeah. They're big enough? Thank you, sir. Move. Sorry to go. Home service, yeah? In 21b, we ask you to approve an occupancy agreement with the Conlow's 7th day Adventist Church. Volunteers from this church are acting in concert with the local child protective services to assemble tear packages for children in Montgomery County. The name of the program is known as the Bag of Love. They're going to use this space strictly to collect items and assemble the bags. The lease provides for one office space in the Oak Commissioners Court building to be used by them for that sole purpose. The rent is the dollar a year and the agreement is for one year. And we ask you to authorize the judge to sign on the court to behalf and also they are providing liability insurance certificate. Move. Thank you. All third. I want to see how. In 21C we're redressing something that we talked about the last time where we had a letter of intent and a memorandum of understanding to participate in grant funding to provide financial support for access bill's children in conjunction with Montgomery County Women's Center to provide supervised visitation and safe exchange of children when ordered by the local court. The grant agreement that comes from the Department of Justice requires that a governmental entity be the grantee, and we have agreed to file for that. We file for it twice in prior years and not receive a grant, but we're hoping they will get it this time. Under the grant, there's no county money to be spent. The only thing the county would do is provide some financial administration that would come through the county auditor's office and perhaps Juanita in the grants area would assist them and we would be receiving an administrative budget through the grant money to cover it approximately $416 a month. It would be a 36 month grant period. The grant could be up to $400,000. We ask you to approve and execute our application for that grant. That's great. I move. Second. I'll turn this yeah. 21D is deferred. 21E is we have to to approve an amendment to the tax abatement agreement in place with low note Houston LLC. There's only two things really in this amendment. One is to reduce the total tactable value that must be maintained from 26 million to 20 million and to update the contact and address information because they did change the address on the property identification. Move. Second. All up favor, please. I. In 21F, we ask you to acknowledge the receipt of a letter from ESD number eight, notifying the court that its Board of Directors met and called for an election to be held March May the 14th of 2011 to vote on a proposition to impose a sales and use tax of 1% to provide necessary revenue to build or renovate fire stations in the district, provide training, acquire new equipment and possibly reduce their property tax. We're required to acknowledge the letter. Under the statute they have to advise you and you have to acknowledge the receipt of their letter. What am I going to do? Not approval of what they're doing. What am I going to do? If you don't acknowledge your receipt. Well, I suppose it would fail under this statute, but we have received the letter. I'm just asking. Stay in there. Where is my district? I mean, it'scer Service District number eight South County. I guess what I'm reading between the lines is they don't need the money. I move to consider an acknowledged receipt of the letter. I'm moved to consider an honest least, to receive to the letter. Okay. Second. All right. Yeah. Okay. In 21G, we ask you to approve a resolution that would designate a change in the location to hold the tax sales, indeed, of trust sales. That would go from the steps of the courthouse to 301 North Thompson Room 208. And that would be effective on the 91st day after this resolution is recorded in the county property records and we're asking the county clerk to record that document after your problem. Is that the jury assembly room? No sir, this is where the environmental permits office is. I move. Second. I'll permissue. In 22A, you can do an agreement for law enforcement services to be provided by the possible precinct force office to the Riverwalk subdivision property owners association. This agreement is virtually the same as the other law enforcement service agreements that we've entered into. The property owners' association would fully reverse the county for all of the salaries, benefits. It would include a 5% administrative fee and the association would also provide funding to equip the patrol cards that would be used. And the agreement would last until the end of this year. Move. Second. All in favor, see how? All right. Item B is we have to prove the professional services agreement with Dr. D. Sack for relief vet services. It is one of three that we used out there. We've gone from hourly basis to half a day fee. And under this agreement, as the same as the other two vet, they all have to work at least one day a week and be constable who is overseeing the animal shelter does a schedule for that. The terms are consistent with other formats. The fee is soon $50 for four hours worth, $500 for eight hours, and $750 if they work 12 hours. And this is less than what we had previously done on a month and month basis. On Fabercia. And last, 22C. We asked you to approve a contract with the second administrative judicial region. We've had this contract in place for several years and this is very similar to what we've done in the past. The only thing different is that it provides for the presiding judge to also be and county employee, the same as his staff. They're already county employees. It would provide for the judge to be a county employee effective 841 of 2011. Under this agreement, he has the ability to participate in the T-SRS retirement plan, like all other county employees. And we've been told by that agency that he is able to buy into the retirement plan retroactively, perhaps even back as far as 1996. And what I do wanna point out is, any cost or expenses here are gonna be reimbursed by the region. So if there are any matching funds for him to participate in that retirement plan backwards, the region, which has made up of about 30 counties, would reimburse the county for all of those costs and all of the cost of him being in the ploy. He, I believe, has waived the medical benefit, so we would not have any additional benefits when he retired. And this is, I don't guess I understand what this judge will, is it a visiting judge? This is Judge Underwood, Judge Olin Underwood, who is the presiding judge, and the 30 counties that are participating in that region that he oversees, participate in these costs. They haven't a fee assessment of these every year for this budget and the county participate by the number of courts that we have. I mean, we would pay a portion of that just like every other county. Move. All in favor, staff. Okay, we have a public hearing, public hearings, and precinct two, let's recess the court and convene those public hearings. The partial replat of lots 32 33 and 34 block one of the hilltop ranch section one to be known as hilltop ranch partial replat number one. Anyone here to discuss that? Step forward. Okay. And Tamara, have we reviewed that? Okay. There's no objection from the Homeowners Association or anything. Well, this man wanted to speak right now. Okay. No objection from the homeowner's association or anything. Well, this man wanted to speak right here. Do you want to speak, sir? Step forward. I'm the property owner of that property and I've just here to see if it gets approved. Okay. We've heard no objection from the POA or anything. Second item is considering the previous establishing a speed limit of 35 miles per hour throughout the Glenwood subdivision. Anyone here to discuss that? Nine judge. Okay, let's reconvene commissioners quarter during the public hearings. I would move on a one and two. Second on favor. Yeah. I. Hey under commissioners precinct one. Consider further requests by city of Montgomery from Montgomery County precinct one commissioner to assist with project on old planners. Punters they'll road inside the city limits of Montgomery per and local agreement. I move. Second. All favor. the federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal federal under local government code 262.024A4Move. On paper see I. Okay, under article 551.071 of the government code, let's recess for executive session. Okay, let's bring the court back to order 551.071 of the government code. Let's recess for executive session. Okay, let's bring the court back to order. Please there's no action necessary from executive session. We have any citizens that would like to comment today to commission's court. You may resources. Good morning. I'd like to pull number six from the court packet. And after that, just consider and approve the payroll change of quest forms as presented. Move. Second. On paper. See I. Thank you. Did you say we're pulling six? Okay, I think. Okay, Commissioner's anything else? Move with your second. Second. On paper. See I.
