Let's get my eyes on. Whereas Montgomery County is one of the fastest growing counties in Texas, is rapidly losing its natural character environmental quality. And whereas there are unique and quality natural habitats adjacent to current and planned developments along the Lake Creek and other flood plains in Montgomery County that have high value for preserving water quality, mitigating flooding, and offering recreational opportunities. And whereas the loss of forests, for perian buffers, and other critical green space in highly developed areas to the south, that resulted in loss of water quality in chameleon recreational areas and increased flooding. And whereas recreational opportunities near residences are more likely to be used than those requiring long distance motor transport transport Now therefore be it resolved that the commissioners quarter Montgomery County, Texas Supports the development of a green belt along Lake Creek and associated production plan for Lake Creek watershed and Lake Creek and Associated Production Plan for Lake Creek Watershed and will work with lead entities such as the Houston Galveston Area Council by whose land conservancy East 1488, 88 Community Association, Keith Montgomery County Beautiful and or other appropriate organizations in applying for funding to develop a watershed plan, and we're appropriate to secure land and other and or conservation easements, and we'll support the project through in-kind services such as preparing grant applications, park development, et cetera, conditional on the availability of staff and equipment. It's been about a year since I spoke the last time. You folks do some really important work. And as you start the new year, you're dealing with reading the papers with budget issues and all the other issues. And people do appreciate the work that you do and the debate that goes into it. Well, you know, getting everybody to agree on something pretty tough, but you guys navigate through the waters and pretty well do the right thing consistently. Sometimes a citizen comes to your agree with citizens with the life quality issue. Something that's important to their community. We had a chance a while back. We had quite an issue out there. What I'm referring to is remember the dump truck issues and call your cemetery road by a year ago. We came to commissioners court and I know emotions were high shall we say say, and I mean, and meaning. And it was interesting because from our community, it was just ad hoc. It was just a couple people on the phone, hey, here's what's going down. It got pretty contentionous on no commission dolls. And people came at you pretty hard in that issue. But you stuck by your guns. You guys navigated your way, and you write what I feel is the right thing to do and you voted to make our roadways out there no trucks over two no-through trucks over two axles which was kind of a first for the county. I want to tell you thank you thank you very much it really had a positive impact on our community. You don't hear the steady drone, the drone to dump trucks going up down the street, and I actually have grass growing all the way back to the street again. Of course, that means more grass to cut, that's okay. But so as you work through, the issues that will come through you this fine new year and everything, just remember there's a lot of people out there, we don't come back like we shouldn't say thank you. And I appreciate the opportunity to come back and say thank you to each and every one of you for what you did. And for what you do every day when you're sitting those chairs in this courtroom, it is appreciated. Other than that, wish you safety and Godspeed. Thank you, Judge. Thank you, Harsners. The government law enforcement association fully understands the stress and the current economy on the county budget while we normally apply the conservative approach this court takes to ensure the county's financial health we have significant concerns regarding information provided by you and the Conroe Courier on the Sunday's edition. Specifically any mention of reducing the county's retirement contribution for county employees in which we represent. In short we ask you not to balance the budget on the backs of your current employees the current benefits package for county employees is as lean and as cost effective as any in the state. Your employees bear at times some numerous portions of their health care cost. Souries while sufficient continue to lag behind the salaries of other localities and urban centers to our south. The sheriff's Office, for example, continuously loses qualified candidates to other agencies and municipalities that offer better benefits and higher pay. And this has been a continuation that we have seen in the past and it continues to happen today. With the budget of $236.26 million, there's room for improvement without taking away from our families and our long-term financial help. Judge Sadler served. You're quoting saying that a reduction in the county's contribution system, two and a half times the employee's contribution at two times, would be a cost of savings of $2 million per year. Surely you can cut the county's budget less than 1% in infrastructure, services or physical assets without taking away from personnel. Our constituents that we serve and protect, I mean, we serve and protect the citizens of this county and keep them safe. I mean, are you really going to deprive them of due compensation or retirement benefits when they already sacrifice so much for everybody here and for the citizens of this county? I'd like to take this opportunity to address county employees in other areas of employment within this county. Take a good hard look at the proposal in which the effects of your long-term financial health, look at how it makes, thin the years you must work before you can afford to retire from the county and ensure the needs for you to continue to work and other employment after retirement. We ask you to join with Montgomery County Law Enforcement Association. We also have members from the fraternal order of police. We ask that you join all of us together and send a strong message to this court that if cuts are needed, they must be found elsewhere. Again, our back should not bear this thing of benefit cutting when we already have to bear significant burden. Gentlemen, I respect the court and the job that you all have done, that you do every day, and that you're elected to do. I understand that hard decisions must be made. Cunning the county's retirement contribution must not be one of them. Must not be one of them. Your employee supports you, and they serve you. Everything that you've done. Don't let them down by turning your backs on them during this process. Thank you, gentlemen. So before you leave, I'm not sure how much investigation you've done on this subject matter. Yes. Montgomery County is probably the highest contributor to pension retirement plan of anybody in state of Texas. All the counties surrounding the Montgomery County are substantially lower. Do you not recognize that? I've actually looked at TC. It was the Texas County retirement system and also we're in the middle of doing studies right now along with budgetary studies and seeing where the money could actually come from with cutting some infrastructure and then physical physical um... monies to make up for this going from two and a half to one down to two to one and say actually been quoted by you that tune out or two from two and a half to two may not be enough and there's a chance that it could go lower and the employee retention rate we we feel the employee retention rate, if the retirement is affected with the contribution from the county, the employee retention rate is going to drop tremendously. Well, I disagree with you totally. We still have, we still will have probably the best employee benefit plan, even after we're through with this committee process if anybody in Montgomery County I think the retirement plan will have to be cut We don't need to get into a debate here today the committee hasn't even met yet correct, but And by the way we will be looking at the very infrastructure issues you're talking about Yes, sir everything you've mentioned we will be looking at absolutely. We're going to have to take a broad look at all of county government not just part. No I agree. I agree 110% on that. Thank you for coming today. Thank you sir. Appreciate it. Moore as Chair of the Budget Reduction Committee for 2011 and to discuss the Committee Appointment Share. This morning I came here early and passed out a copy of a letter that I've sent to Judge Saber in Commissioner Chants, along with the immediate action required on a budget questionnaire on the Senate Department. I don't know if you had a chance to read it yet, but I would like to go ahead and introduce to you the committee that I've selected for this. The actual committee membership will be composed of four people, myself, Phyllis Martin, County Auditor, Mark Mooney, County Engineer, and Daniel Jones Assistant County Attorney. I will have advisors to that committee. There's three of those advisors, Dennis McMahon for Risk Management, Marshall Shirley with IT Director, and Dodie Shaw with HR Director. My assistants will be the people that work for me, and that's my executive, administrative assistant, Carolyn Ethridge, and Shannon Ligon, who has been my My assistance will be the people that work for me and that's my executive administrative assistant, Carolyn Etheridge and Shannon Ligon who has been my special project supervisor. If you look at the goals and objectives that are there, if you want me to go through those judge, I will. If you want to wait and schedule this for another time that's fine too. But the goal is if you want me to do. Of course pleasure. Do I? Whatever the course pleasure. I do whatever the course pleasure Jimmy goes to him and takes the equations the thrill all right those objectives number one is review all county departments Cost of operations to determine justification of the department and their expenditures Number two review all benefits relating to mandated requirements involved with outside funding to determine if cost justifies continuation and whether it is in the best use of the tax fairs money. Number three, review possible consolidations of department services or privatization of small departments. Number four, review TCDRS and the cost of employee benefits. Number five, review options for sale are least purchase of fixed assets. Number six, review cost of carl ounces versus mildies reimbursement versus county owned vehicle assignments. Number seven, review alternatives, eliminations for voicemail costs on county phone systems. Number eight, review necessity of county cell phones and cost savings per same with eliminating all but department heads in one assistant. Number nine, review cost of phone system at the county jail. Number 10, review vacant positions and continued funding for them. Basically, we're going to do this in two parts. The first part will be to look at all non-elected official departments. There's 40 of those departments that will review. It's our plan to give you a report on April 11 of our findings and basically give you options, not recommendations, but options based on those findings so that you'll make the final decision on what to do. After that then we'll go for the elected officials. We're aware that elected officials and their employees are not subject to changes until the regular budget process. However, if we discover some changes during the non-department budgets that will affect those departments then we'll probably go ahead and talk with them first and there will be some of the first people we talk to once we start the second phase. Along with that I have a questionnaire that's attached there that pretty much outlines 12 questions that I'm going to be asking each of them on the department heads. I welcome the court to give me any additional questions that I'd like for us to look at. However, I'd like to caution you to one of the reasons I took this position was the fact that it would not be micromanaged. That I wouldn't have people telling me what to do and what not to do. I wouldn't have people saying they wouldn't meet with me without some kind of repercussions. With that in mind, I'll be glad to answer any of the questions the court might have. Is Judge Edwards here? Judge, once you step forward, repeat the conversation we had last week. Also, my days you have? Well, it really started with a conversation with JR last week. The courts are all independent departments and are treated as such by the commissioners. So I think that it would be helpful if I, the senior judge, for now, been on the bench learning, anyone else would be the advisory to JR in about what we have needs or what we can cut in operational expenses. Part of the another thing is it's not even a department is the cost that we're spending on in the sense. Right now all the money you're spending on the 12 operations of the courts does not meet or exceed because of actually paying indigent defense. I'm a year at 4.5 to 5 million dollars and the operation of courts aren't that much. And what you've got is 100 subcontractors of this county who are unsupervised in a very limited capacity. So I would like to be an advisory to JR about options that this court can implement, not the judge, but what this court can implement in order to address, we cut those calls. I think that it's, when I first started practicing law, the representation of the poor and the people charged with crimes was considered pro bono. Lawyers did this as a learning opportunity at a law school. They were mentored by more seasoned lawyers to help them along so that justice could be done. Now, it's for money. We have created in this county, a cottage industry of lawyers who think that they are entitled to this money, and entitled to those appointments. I want to put it into it. I've been on the bench a long time. I'm really not afraid of anybody or the defense board, anyone else, and I think that I can make a difference. I think I can can make a difference. I think I can work for the commission on the indigent fence. It's set up in the state for various options. We're spending too much money for too low and I think it's time to end. So if you're looking for the cut cost, I think in the operation of the budgets of the courts, I think we're pretty we're pretty lean. We can improve and sharing. We don't share courtrooms. We don't share pretty lean. We can't improve in sharing. We don't share courtrooms. We don't share jury rooms. We don't share kitchens or rec rooms. We don't share reception areas. We don't share copy machines. We don't share employees, even though we're all on the same floor together. And that should be looked at. So with your permission, I'd like to help out what I can with JRR and give this court some options about it. Let me add to this. With the conversation I had with Judge Edwards, it started when he came over to get his license plates. I welcomed that input. I just did not feel like that the judge could be an advisor. But we did discuss a couple of things there that I was pleasantly surprised with these comments about the necessity of this versus the necessity of that. And I welcome that opportunity to court so please. I think it's a great idea. But it is that we've talked about for years, more years than I can count. If you can come back with some great recommendations, Judge Edwards, I welcome that. So I would, I think you ought to be a advisory member to J.R.s committee. I appreciate that. I would agree too. Thank you to J.R You know I'd like to know Before we start trying to scare the people of Montgomery County and saying we're, I know we need to cut back, but what the revenue was, say, you've got it in here, 0809 compared to what it is, you know, for say, 010 N you know because I can get that information for you sir I've got it over there in the tax side but if you want the total revenue you'll have to get that from the office. Yeah compared to what it was oh wait oh nine you know to see what but I don't want to people in Montgomery County to think that we're broke, you know. Well, I'm the same way. My actual feeling on that is the last thing we want to do is look at people costing jobs. I think we have a responsibility though if that department is no longer needed, we don't need to have two managers. If we're going to consolidate departments and if we don't lose the job, we're going to lose the position because we don't need two managers if it's all put under one department. And those again will be recommendations that y'all make. I will give it to you as options. I will show you what's there and what the savings are by doing it one, two, or three different ways are doing nothing. That'll be your last final decision. I will investigate and find out what's there and what is costing you and not to stand in the way of correcting the judge, but he's missing about two million on his forecast. If you go from $2.50 to $2.25, when I looked at it last week and talked to him, it's $2 million. It's $2.00, it's four million. So, I think we need to look at it. And I think now it's his Ford and Montgomery County. We're financially sounding in way better shaped and most other areas. I fund balances are great. Second day are things are way better off in most other areas of the country. But we've got to see the Houston 20-mile south of this is going through some major cuts now in adjustment with whatever the state comes up with in the way of 20 million this morning they were somewhat one of the reporters estimate 20 to 30 million dollars in shortfall if they have to cut their budget 20 million dollars in order to it's going to impact Montgomery County's going to impact fall to 244 counties exactly what it could be or not be we don't know yet but we need to make whatever preparations are available to us today to meet our situation in 2012 and 2013 and we're a long way from hurting today but we need to be sure that we don't get in the same position in the city of Yusunwanda with the new mayor who went in furlough and people just to make their budget demands. I hope so we'll wind up for something like that in Montana. their budget demands. I hope there would wind up for something like that in Montgomery Canada. We will. We think we'll take a break. I see the image with this committee. That's why I'm not going to let anybody know what's going on till we put it all together and bring you one report and then each one of you commissioner will receive that advance. But I don't believe that we do anything. It calls gossip and in you windows that are simply not truth or it's interpretation by making this public information to all departments. So our committee will be mum about this so we finish that first step and we'll bring it to you in advance if y'all take an action on it. Are we talking about when you're talking about cutting the benefits from 250 to 225 is that was a present employees or a new employees. Commissioner, all of those things are going to be reviewed. I'm not talking about anything yet. I'm talking about everything. That's just one part of, if you look at the 10 items that I gave you there, you know, that's just one of them. Again, when you get those options, those options will show you what action will, with each action, what the benefit will be and what the downside is to that. So again, you will be making that decision not to committee. wasn't going to cut present employees. We can't change the rate to spend contributed or the dollar amount has been contributed up to the day we make the change. If you were on the 250 or 100 for the last 20 years, your retirement would still be paid at that 250 or 100 up to that change. But any thing contributed after, say January 1st 2012 that rate changes two and a quarter and you'd be paid on your retirement based on two and a quarter from that date forward. You have to be simply thinking. That's correct. Yeah, what I think the mission chance to say is you still get the benefit of the 250 contribution all the prior years. Yeah that doesn't change. I'd ask you to consider and approve the grant amendment number one for the CDBG Home and ESG grants and funding approvals for CDBG Form HUD 7082 and Home Form HUD 4000 and 93. 4,093. What happened on this was we received a letter from HUD on December 28th from Edward Pringle of the Houston Field Office. He is the director of the Houston Field Office letting us know that the Houston Field Office made an error in the original grant agreement that they sent to us for execution. They neglected to incorporate some of the required grant award terms. The terms that they neglected to require of us in that grant award were some new conditions from the new Federal Funding Accountability and Transparency Act under the Obama Administration. I have researched the federal regulations associated with that and determined that as a county we are already doing all of the things that are required in that act. They've just moved it and codified it into regulation. The requirements were that the county register in the CCR system, while Nita takes care of that for us as a county annually already, and that we make sure that our subrecipients also register annually, and I had already been making sure that they were doing that annually for all of our grants already. We have run into some situations where people own their mobile homes, but they're renting in mobile home parks and obviously we can't drop a slab and put a modular home in those situations and so we have expanded our rules going forward so that in those very restricted situations we can go ahead and replace a mobile home and that is the primary change in the program. It also authorizes us under very restrictive situations when people have no family to stay with during the week or two that we need to replace their home that we can place them someplace temporarily and the grant funds pay for that. The second one has to do with the opposite end of what we're going to talk about. Number one, consider and approve the risk management department as the record retention department for insurance certificates and other and the contact department aimed on insurance secrets on all contracts with county and for authorize all county departments deliver a management department a copy of the existing contracts with the county with a contact name telephone number and a copy of the existing insurance certificates and further authorize the risk management department to manage the insurance certificate process on all existing contracts, including any new and real contracts. All insurance certificates should read as follows. If the county is listed as certificate holder, additional name insured or both. And that's Montgomery County, Texas, Attention Risk Management Department and the address. Let me explain to you this process. This is a kind of a long process. This will take quite a while to do. There's multiple departments involved. This is not something where someone has to deliver in the case of the auditor has quite a few contracts. The purchasing department has quite a few contracts. The county attorney's office has quite a few contracts. This will take a while. But we've had a request back in October to do this by insurance company. So that was the request I made. But this will take a while. We'll have to get with all the departments involved to see how to do that would be the most effective way to do that without interfering some of the workflow right now. In this item we asked you to approve a resolution that would allow the county through Phillip Barton to file for an auxiliary mortgage lender license. We had it in consent because we thought we were going to get out of this, but we received comments from the state licensing bureau and the Texas Department of Saving and Mortgage Blending, that we would not be exempt. What we have is what they call the Safe Act, which is the Texas Secure and Fair Enforcement for Mortgage Licensing Act, was passed by the Texas legislature in 2009 in response to a federal act. And this requires that anyone who, for compensation or game, takes a resident to a mortgage application or offers or negotiate his terms of resident to a mortgage loan would have to have a license. But they do recognize that political subdivisions are a little bit different than companies who are in the business of doing this. And they set up an auxiliary license for the county. It's necessary for us to get this license because of some of the CDBG activities where they're providing a down payment assistance and some of the housing assistance because when we do the rehab for providing homes, we have to get a data trust and a promissory note. And even though it's interest fee and interest free, and most of it is going to be forgiven, these statues require us to get this license. It also requires Joanne to show them to get a license in order to talk directly to these people, and we have to get a license to sponsor her to accomplish this. The county's license fee would be approximately $100. We're not asking for any funding because we believe that this would be funded through some CDBG admin money. It's all related to replacement housing from Hurricane I storms, all right? Also, the down payment assistance for normal programs that CDBG does with herd money, in addition to the Ike money, it's not just Ike. Do I hear a motion? Or the resolution? That's something we absolutely have to have at last. In order to do these programs, they are saying that we do have to have it. They just issued a written opinion setting that no snowy vision exists for nonprofits with political subdivisions conducting housing assistance programs with 0% in just one. We're hoping they're going to change this in the future, recognizing that our state consultation doesn't allow a political subdivision to be a lender, but we're really not lending money. Some of you may recall on June 14, 2010, Mark Ellis is the chairman of the board for this district addressed the court, but there was no action taken at time because we had some commissioners out. The members of this district are Harris County City of Houston, Fort Bend County, Waller County and Galveston County. They are at the district is asking that Montgomery County hold one position out of 14 positions on this board. The county's representative would be appointed by the county judge and would be reappointed or a new one appointed every two years. There is no action that can be taken by this board with respect to the location of new rail lines or modification of rail lines within Montgomery County unless we are a member of the board. So they will not take action unless we are a member of the board. So they will not take action unless we're in there, but we can, of course, also do work on our own behalf through HDAC or whatever agency, and it's not an exclusive action on rail lines. This district has the powers of a freight rail district. They would have authority to enter into agreements with TechSUD or for any other agency to accomplish their goals. We're not asking for funding today, but as Mark Ellis asked you and Dean, they are asking that we provide $5,000 to be a member. That's the same amount of money that Galveston and Wallert County provide to this association and they will be invoicing us for that. Where is that money used for? And in this request, we're just asking you to allow us to make a redistribution of available salary funds between the two prosecutors that will be handling our juvenile prosecution. The Woodlands would also pay up to $1,22,000 for us to purchase up to 21 patrol vehicles and one motorcycle. The township would also fund up to $428,250 in fuel costs for the vehicles. It would be 17,000 for a part-time clerical worker or office furnishings and 110,000 toward salary and benefits toward a full-time warrant officer. In JP 3 they're providing $50,700 toward one full-time clerical assistant. This isn't the total money for these positions, but they have a cap on what they'll use. Just briefly, if you recall the Texcom litigation this Thursday, the Railroad Commission will be taking up the actual commission taking up the recommendation of their hearing examiners that the letter that was issued back in 2005 in the TCEQ application by Texcom that letter of no impact on all-en-gas interest has been recommended to be rescinded. In the Commission this Thursday Railroad Commission will take up that recommendation for final decision. If that letter is in fact rescinded by the Commission, I believe that is fatal to Texcom's application. In addition to that, on the 26th of this month, the Texas Commission on Environmental Quality will be taking up the recommendation of the two administrative law judges that the applications be denied. Will be going, I'll be going, and I think our legislative contingent will probably be there. I'm pretty sure the Crow Group will send several buses on the 26th. And it's interesting to me, I don't know what this means, but it's interesting to me that these two commission hearings are being conducted so soon, especially the TCEQ hearing.
