We ask in the name of the Father, amen. Amen. I pledge allegiance to the flag of the United States of America and to the Republic for which stands one nation under God in the visible with liberty and justice for all. Okay, for the record, our members of the court are present. We need commissioners, a motion on the agenda, please. Move. commissioners emotion on the agenda please move thank you for your see I by the way we need to move I'll get there a minute pro. Proclamation, resolutions, walk the walk. Is there anyone here to read walk the walk? Chief, good morning. We got a copy right here chief. Okay. Basically this is a proclamation I understand for the beginning of the National Hunger and Homeless Awareness which our county has has quite a few and I'm very proud to say the county is doing a lot of efforts to help with that problem. So I want to thank you all for this proclamation. Proclamation is walk the walk on Saturday, November 10, 2020, 2012, as the beginning of the National Hunger and Homeless Awareness. We're asked for the past several years, the National Coalition for the Homeless and National Student Campaign Against Hunger and Homelessness, have sponsored National Hunger and Homeless Awareness Week. And we're asked purpose of this proclamation is to educate the public about many reasons people are hungry and homeless including the shortage of affordable housing in Montgomery County for very low income residents and to encourage support for the homeless assistance, service providers as well as the community service opportunities for students and school service organizations. And whereas there are many organizations committed to sheltering, providing supportive services, as well as meals and foods plastered homeless, including ID services, housing and employment, training and transportation. And whereas the county commissioners recognize the hunger and homeless continues to be a serious problem for many individuals and families in Montgomery County. And whereas the intent of the walk, the walk is consistent with activities of the Montgomery County homeless coalition. Now therefore, be it proclaimed that the commission is called a Montgomery County Texas, does hereby proclaim the November 10th walk, the walk as the beginning of national hunger and homeless awareness in Montgomery County. We have further resolved that the County Commissioners encourage all citizens to recognize that many people do not have housing and need support from citizens and private and public nonprofit service entities. Good. Great. Thank you for coming today. Thank you. Judge, if we could, just want to remind everybody that the homeless walk is Saturday morning. We're meeting at the Salvation Army just to do a walk for awareness of the homeless here in Montgomery County. Great. Thank you, Chief. Thank you, sir. Thank you. I'm going to move. I'm on my favor. See you. All right. Most of the passes. Commission's next is a proclamation submitted by the Eagle Forum to this Commission's Court. Who is that forward? You can tell us in short and you can read the resolution whichever you would like to do. I prefer in short. Good morning. Thank you again gentlemen. Yes, this resolution is about jobs. Jobs for Montgomery County residents, jobs for Texans, jobs for Americans and those legally authorized to work in the United States of America. And before I get your answer on the resolution to see if you will support it, I wanted to, you know, in lieu of what was just announced the proclamation for the walk of the homeless. And this is exactly what the Eagle Forum is championing our families. And the resolution I understand that it is something that we all believe that our municipalities, our public servants and our leaders all agree with. However, what the resolution will do is to show your further support and your commitment publicly that you will do all you can in working with text. Working with your community to ensure that these jobs mainly funded by the citizens here, text dollars, that they go back into that same purse and allow for our citizens to support themselves and their families. So this and the walk for the homeless, how many veterans might be there in that situation? And this is what we're asking here. And there are some previous proclamations that this commission has supported. There is a fair housing proclamation. There is intellectual disabilities, telecommunications week. United Way Volunteer Appreciation Month. Our families would, our community we volunteer, we put back, we are just asking for that little bit back that is do us. We're here, we're citizens we've put in so I appreciate you taking into consideration some of these other proclamation scholar athlete day. You know, all these other proclamations that seem they're all very important. However, if we do not support the core of the community, how can we survive as a nation? So I do ask for your response to the resolution and help and support of making sure that tech.it is a good steward of the citizens dollars. Okay. Comments, there's any questions or any further discussion? The resolution is in support of hiring veterans. Veterans Texans. Yes. If you recall, I was joined with Texas Workers' Workforce Veterans Resource Coordinator, Denise Lord, at the first meeting that we attended probably last month. We were also joined with Betty Anderson, President of Montgomery County Eagle Forum. Miss Lorde's job is to put these veterans back to work. And that is what we are advocating as well. Jobs for veterans, Texans, Americans, there are thousands and thousands of other Americans who have moved to Texas and continue to move and relocate to Texas looking for jobs. So we do not have any room to hire and give these jobs away to people who should not be who are not legally authorized to work in the United States of America. That is the law. Okay. Any further discussion, commissioners? Well, I think in principle it's it's a great idea Whether it can actually happen by Otobrek and the actual contractor is another thing But I would I would move that we pass this resolution suck of that. Thank you All in favor say aye Motion passes. Thank you so much gentlemen. Thank you All in favor say aye motion passes. Thank you so much gentlemen. We're asking you to consider the raise of rate from the current $0.12 per square foot annually to $0.15 per square foot annually. Last adjustment on the rates of the report to your 2000 and 2001. Believe the adopted rate is just in a reasonable rate based on fair market value survey. The average lease rate of like properties of comparable airports in Houston, metropolitan area. And we have attached to resolution for you a copy of that survey. Also I have met with the majority of the airport tenants in advance of your consideration of this item and we have sent letters out to all those that are affected by this lease rate. There are just a handful of leases, 13 out of 81 that would not be affected at this time because there are some conflicting terms in those leases and their rates are either higher than the rate that you would establish today or there are some five-year protection periods in those leases that will expire eventually. Well, before we vote on that, I totally support Commissioner Fundin that he can, I'm developing partnership. What I have a problem with is the five-year contract and the nature of the five-year contract. It's one year with three renewables, I believe. It can be canceled. I thought it was written as a five-year contract. It's one year with three renewables, I believe. It can be canceled. I thought it was written as a five-year contract. Phyllis, David, if you all judge it, it actually has a termination clause or it can be terminated at any time without cause with 180 days notice. So it could potentially go to five years, but it could be terminated earlier than that. Got termination causes. Oh okay. You never had an interest in that in the last ten years I'm a little surprised. Well I have an interest in it today. That's wonderful. Anyway if you did it the second? All in favor, see I? Aye. Aye. Motion passes. Okay, under oracles. Five, five, one. We're good. What? Get precinct four. Precinct four. Where's that? Right under the precinct. No, that's all consent. That's on consent. I'm sorry. Yeah, I'll let you buy that. Yeah, I'll buy that, Jay. No problem. Under Article 551.071, the government code, let's recess for executive session. Hey, let's bring the court back to order, please. There are two items that require action from the court from executive session. First one we need a motion and connection with the Southwestern Bell telephone company versus Montgomery County case. Claim number B100089. case claim number B100089 to encourage expenses to hire an expert witness. All in favor see I. Oh, some passes. The second item is a. Plain number a 11 0 0 9 5 style to want a redo, fill us redo, frittini redo, frittin redo versus Montgomery County. And this is to what exactly Daniel here proves a settlement to prove a settlement in that case. All the favor say aye. Motion passes. All righty, do we have any citizens that would like to address commissioners court? I think one person signed up under the witness form. Bill Sullivan. Bill? I'm Bill Sullivan from the willow's. I come here to address as I normally do. I see out in the whole way several buildings have names on several people here and I'm here to talk about leaving a legacy other than buildings but better law. I always talk about the typical obligations. I don't have an objection to specific obligations. I think they should be done in an emergency. I fully understand that, but I just ask for the reason of this of having an emergency defined. And that's just that an ordinance or a law or whatever you have to pass to define an emergency for us to be able to obligation be passed. Recently, in one of the meetings I'm with the Tea Party, met with JR Moore, who's now speaking to us. And we talked about that a bit. And Mayor Kirkindol was there as well, and he came up to me and he explained about a problem that they had with the deterioration of their sewer and their water system, which created a health hazard. I said, do you want me to speak for that? I'll speak for that. I'll support that as a certificate of obligation because I think that's an emergency because there's a health reason. So I would like to see something like that in this county as a control on the use of certificate of obligations which even the judge was against one of the ones which was reasonably passed because it was not an emergency. The second thing I'd like to speak about, we just went through a process here where there was something passed regarding the Chamber of Commerce and it was something which was brought up four meetings ago, about four meetings ago. It had to do with the lame back session of the sitting commissioner. Now, two or three of you thought that it was already the rule in the county, but it turned out not to be. And Mr. Chance took some offense at it, because he thought it was directed at him. Well, if it's done elsewhere and it makes good law, then it makes good sense. And why don't you pass it to the effect of so it comes after Mr. Chance? So that it becomes because it's a good idea and it's something that you just did. As the way I read it, it was a long-term obligation, which was going to precinct three in a lame duck session. And you all voted on it. So why don't you just make it a provision which, like I said, two or three you thought it was already. And the final thing, next Saturday is Marine Corps birthday, 237 years. We normally have our birthday party at In the Willowons of Town Green Park where we give our cake, et cetera, and we celebrate the birthday at the Texas Marine Medal of Honor Memorial. This year it's going to be the eighth. Tom Arrelli, I'm sure you all know, is heavily involved in that as a MI. And we're going to have it on the eighth because Tom has to sit on the board for the Naval Academy or the Academy's for Congress. So, like to let all you guys know and you're always welcome. Thank you. Thank you Bill. OK. I'd like to address something you just got to say. And you put it on your deal, the lame ducks, and you throw one of them remarks at me. Why don't you come to East County and see what a lame duck commissioner does? No, sir. I was just talking about the law. I was talking about the law. But you said lame duck on your day all right. Yeah, what I was referring to was the expired term of a person who has either been defeated in election or is not seeking election in regards to the controlling of the budget. I think that came up four meetings ago. It has nothing to do with any aspersions or anything like that. What I'm saying is, and I think Commissioner Chance brought it up that the idea of that is somebody who got defeated in a primary rather than somebody who had stepped down. That's not correct, I didn't bring it up. Well, it was brought up in the meeting. Okay. It was brought up that the intent of that was somebody who was defeated and had revenge in mind rather than anything else. And I'm not saying anybody has any of that. I'm just saying it's a provision that exists and that it makes good sense. And so nobody gets offended. Have it come into effect after the exploration? In this case, it was at the meeting, it was because you were the only one that had a who was sitting in such a session. And I said, well, make it after you step down. But it just makes good sense, and a lot of counties do it. So that's what I'm talking about, sir. David, did we ever find out whether we do in fact have that in place or not? We go back far enough to see if it is. So I'm saying you thought you did it and just correct that that's all. I don't know if I took office in 99. Excuse me? I said I took office in 99 and I were told that there's a real that time that the commissioner before me could not spend more than 20% of his budget. Okay. Before you took office? Yes sir. Was was that the law? Cardinal what I was told it was. Okay, but what are we just here? We just heard it wasn't. And I'm saying that's that's fine. You agree that that's fine. 20% is a good rule. Let's do something to do. Don't elect crooks. That's nice to do. Don't elect crooks in the first place. Mr. Tans has agreed not to spend over 20% I've been here Issue in January I wouldn't mind addressing this and passing it I have no problem with that I've been there 20 years out and never been an issue bill. I mean, I don't I don't know why all of a sudden it's an issue It's never nobody's ever done that So we're all professional. We work for the county. We work for Montgomery County. We do what's good. We're not out there to screw our residents. What do you think? I'm not talking about you. I'm not talking about you. I'm talking about you. I'm talking about you. I've never been an issue. I'm talking about good law. I think it makes good law because you thought you passed it already. And have it here to it for the last 25 years. Sure. But it's not a law. Why is it so important? I don't understand why it's so important. I don't know why it's so important that you're resisting it. I'm not resisting it. I'm just saying it's never happened. OK. Laws are there to protect the people? That's our job. I'm sorry sir. You have a function in it. Yep Alrighty, you know, Bill. Thank you. Do we have you as a sit-in under lame? Yes, ma'am good morning I'm Nancyoring and I came a couple of weeks ago and my favorite support of our county attorney that was elected. And you also, you're going to have a meeting afterwards with Ms. Phyllis and Mr. Lambert. And we just were wondering what was the outcome. The outcome was basically, why don't you get with Phyllis and David after the meeting. It's too long for me to go into right now here on the bench. I'm sure they'd be glad to share with you the outcome of the meeting. You can get with Phyllis or David either one and I'm sure they will tell you exactly what happened. Thank you. Do we have any more citizens of a light to address commissioners court today? Walter. Good morning, Judge Sadler and commissioners. Good morning. I wish I could attract the same kind of attention that you give to Bill Sullivan. Because I've been trying to agitate you all every time to assembly. And I, oh my goodness. Maybe I should just take questions. I want to say, Mr. Sullivan, oh, there's Mr. Noak, and I want to tell you, the biggest she down to early voting at last is whether Mr. Noak is going to get over 80% of the vote. And that there were, that's being placed on that. But if he was a Democrat, we want him to get over 100% of the vote. But anyway, that's the big issue. But I want a great guy you are, and Cambridge is going to kill me for saying that. But anyway, I want to just address this saying of, because Mr. Sullivan just got me all around. She can blame him because I'm up here today. But naming these buildings, but I do want to tell you, we are working on naming a building, as you know, after my friend, Adrian Heath, who was a flawed individual. I will admit, but he is my friend. And we are definitely going to name that motel after him. One way or another. OK, so, good job, Sadler. And we are definitely going to name that motel after him. One way or another. Okay. So, Dr. Zadler, when I came down here looking for, and I invited you all after the last election to please learn Australian language, and I don't think any of you have done it yet. But anyway, I'm glad to see you again, and I again ask you, are you going to run again? That's just still the same, I'm decided. Okay. Well, as far as the meeting with Lambride, Bill, listen, I talked to Mr. Lambride after the meeting and honest to goodness, he was crying so bad that I didn't know he needed my psychologist, Dr. Julie Turner, because he was very... He talked to him, they'll tell you a little bit about it, but I'm not comfortable with any confidence, Mr. Lambrite. But the other thing is, I wanted to just ask you, you know, I go to these tea parties too. I'm still a Democrat. I get out of the party, but where could you have more fun than you do at a Democratic meeting and argue with these darn stupid liberals? But you can't do it. But the Tea Party is wonderful. And I agree. He eats there every time. Mr. No, I call Mr. Doris. You come sometimes just to see what's going on. But I think I really, really support him. But they do get, in my opinion, and I've told him. They don't study the issues enough. And the mayor from over there, what's his name the mayor from Kirk and doll made that point get over here and get into the nitty gritty of it before you come in and just want to blanket lead don't spend any more money man the Democratic Party every time it comes up to support any bond issue anything they want to spend everything they They don't care. And the tea party wants to spend nothing. Our tax nothing. You got to get into it, Commissioner. I think you might, that suggestion a little bit of a minute, go get into it, get involved. And until you get these blanket statements, and no spending or all, all spending. One other thing, the JP Judge Moriarty is that his name? Yes, sir. Well, how's he doing? I? Have not seen him he's Walter. He's trying to get better Yeah, he's on a medical leave and we're hoping it's better. He's still working quite a bit Well, I sure hope he does because I've been through these class see misdemeanors And I think they ought to be filed on these kids and I think Michael Barry what he did and attacked and judged Moriarty the way he did over that case was raw. I think he did the right thing. I'm sorry somebody gets put in jail for a day. I've been in jail for three days for contempt. I mean, good Lord, it's good for the soul, for Bill's character. And I'll tell you that. he just wished him my best. I wish I'd gotten, I've seen one of the JP got into trouble on it. And, but I really support this business to send in these kids. I've been in these schools. I see the teachers can't do anything. Maybe it's over done, but get them into these JP courts. They do a good job of helping the families. I think to straighten their kids out in my opinion. That's my opinion. Mr. Rayoff, right? You agree? Anyway, always asking for a backup. Thank you very much. I really appreciate it. Thank you, Walter. You wanna think if I don't run, you may have four lame ducks up here. Lamb ducks. Well, it's worth becoming more interesting. I'll be speaking for you south about that. I'm going to do my job. Okay. Anything else commissioners before we adjourn? Thank you. That's right. Human resources. Please consider and improve the pay well change request for arms. Move. Second. All the favor say out. Anything else commissioners? Move adjourned. Thank you. All the favor say out. Anything else commissions? Move adjourned. Thank you. All the favor say out.
