I think that, uh, Phyllis Martin and David Walker are still, uh, have not reached an agreement related to, simply to JPE's that are from Montgomery County. Well, I would like to approve this today, but set this to re-review after their final resolution. Okay. After they're going, Joe. Okay, there's a discrepancy between David Walker and Phyllis on the salary to understand them. And I'm just saying I would like to re-review this if possible after their resolution. I'm not sure what is your opinion. I feel that the local government code. This is for. Oh. Frankly, and you fill us both. It's actually for Martin. Okay. Fill us Martin. Well, the local government code specifically states that you have to publish the salary of any elected official in a county and we have published these salaries at a rate that we're paying them exclusive of these contracts. Then doing additional work doesn't allow for us to pay them extra. But what David says specifically removes the JP. I mean obviously something's happened here before that allows this to happen for JP, it wet sounds. Because that's the only office they preclude from that. Is that correct, David? Well, it's my opinion, Commissioner, that the requirements published in elected official salaries specifically just as the piece is not a prohibition to paying them under this particular statute, the provisions of Section 27.055 of the government code. I mean, it's true what Ms. Martin says that we're required to publish salaries at the beginning of the budget year. That in my opinion does not prohibit application of this statute, which is an ascent and emergency when you have a justice of peace that's become ill. And what Mr. Better was talking about is the new office holding prohibitions in the Texas Constitution specifically do not apply to justice of the peace. It's my opinion that you read that along with 27.055, that's the only opportunity we have to find a justice of the peace is those that are presently sitting unless there's some fund of retired or former justices we don't have them in Montgomery County and I expect there aren't any around the state of Texas. So what you're seeing David is the JP's are excluded from the statute of Phyllis is referring to. No sir I think her statute but the one she's talking about that requires notice of the salary. I mean that's true but that's not a limitation on the application of 27055. I don't think that you read the two statutes that they require that they be fit together. What she's talking about, the notice of a salary is to provide the essentially, to provide the elected official an opportunity to grieve and to notify the public of what you're paying elected officials. Well, this action today by doing it publicly is advising the public that these elected JPs, if they perform this service, will be paid an additional amount based on the contracts that are approved and the rate that is required under the statute. That's notice of additional compensation and it's my opinion that you find gentlemen can grant additional compensation if you choose to throughout the budget year to individuals that work for the county. I don't see a prohibition. Would that apply to any office for just the JPs? Well if there was an argument of dual office holding if that somehow was was the argument then it might be a prohibition for those positions that are listed under that prohibition in the Constitution. But JPE's are specifically excluded in that section of the Constitution to do an office only. That's the only office that is removed. Well there's one or two others in that section of the Constitution but they don't apply to local government. It's the only local government office that's specifically excluded from the office. It may be understated to fill us in there. But they're treated differently than a court at law judge or a district judge. Well with respect to dual office hold in there are yes. And I'm not certain why I can only assume that historically in rural counties it's difficult perhaps to find people to fill in for JPs. Now in the 2705 which is the temporary appointment statute requires that you find a qualified person. That qualified person is defined as a person that has served at least four and a half years as just as the piece. It doesn't say a former JP or a retired JP, it says a person that has served for four and a half years. I don't know where you find that type of individual unless you have, for instance, somebody like Judge Carol in the Cox. Well, she's the only one that we've had around here. Well, Judge Cynthia Mcmillan, I think as well, but there just aren't that many. And we're very fortunate to have the neighboring counties that can help us with this and 27055 specifically makes reference to using JPR persons qualified persons, which is a JP From a neighboring county or from a county outside of this county You think that's because those quarters specifically directed to their free sinks or a I think that's because those courts are specifically directed to their free sinks or a court or a district court Countywide commissioner. I didn't I didn't review the legislative history of the statute, but I can tell you that You just about would not be able to find qualified persons unless you used JPs that were potentially currently serving Okay, this contract takes us to September of 13, is that correct? I'm here today as President of the Houston Eagle Forum Group. And as you might know, the Eagle Forum is an Eagle Forum works toward and supports causes that help our families. And jobs are key for the survival and the well-being of our families. In that light, today I am submitting for the record and for your consideration in signing a resolution with which I will go ahead and read. It's only one paid not too long and you should have it there in front of you as well. Resolution of Commissioner's Court of Montgomery County Texas authorizing support for the hiring of Montgomery County Texas citizens. Other Texas citizens and United States citizens from across our great land, to fill the jobs to be created by the work associated with the execution of the text.contract for the design build operation and maintenance of segments F1, F2, and G of the Grand Parkway. And where I was on September 27, 2012, the Texas Transportation Commission approved a conditional award for the Grand Parkway segments, F1, F2NG to Zachary Odebreg contractors. And whereas Grand Parkway segment G is predominantly located in Montgomery County, Texas. And whereas final award to Zachary Odebrecht is to be made on our about December 15, 2012. And whereas the Texas Transportation Commission stated on September 27, 2012 that the Grand Parkway segments F1, F2, and G will create thousands of jobs. And whereas Grand Parkway construction of F1, F2, and G is expected to begin in January 2013. And whereas according to the US Bureau of Labor Statistics in August 2012, there are over 15,000 unemployed workers in Montgomery County, not including the underutilized workforce and those who have given up looking for employment. And whereas on this June 2012 statewide, Texas unemployment was reported by the US Bureau of Labor Statistics to be over 964,000 workers, not including the underutilized and those who have given that looking for employment. And whereas according to the US Bureau of Labor Statistics in June 2012, over 806,000 U.S. veterans nationwide, thousands of whom have fought bravely in Iraq and Afghanistan wars were unemployed. And whereas the U6 United States' unemployment number is an excess of 23 million, and whereas the Montgomery County Commissioners Court unequivocally states that there is no evidence of shortage of Texas or U.S. citizens, ready willing and able to perform this work, this work. And whereas the county commission hereby commits to promote citizen workforce training through Houston, Galveston, Area Council, workforce solutions, Inc. the Texas Workforce Commission, and any other state, county, or charitable agency or organization that it deems Qualified to adequately train Montgomery County and or US citizen workforce And be it resolved at the Montgomery County Commissioners Court hereby offers this resolution as Demonstrated by our official signatures below and support of a higher U.S. citizen workforce clause in the final agreement with Zachary Odebrecht, covering employment practices of Zachary Boat Odebrecht and that every consultant and subcontractor and all lower tier subcontractors, which will include rigid text-out enforcement and severe financial penalties for violation. Again, for your consideration and signing on approving this and promise that you will help Texans get back to work. I think it's a great resolution. It's not on the agenda today, unfortunately. This is going to be you, the taxpayer that pays this money back. What do we do as a commissioners court? Or the state of Texas or state legislature? Do you see the box group put in? No, sir, I don't. I would say this to start off with. It's very important that we not allow Communists trying to enter into doing business as we have so many other organizations, companies, and family owned why not support our own families. This is what I'm talking about. Well, I'm using China as an example. It could be anybody. Well, you presented it at hypothetical, sir. I did. I did. Let's just say it's whatever North Korea. South Korea. Don't take up the Korean. I know South Korea. Taiwan, Mexico. Mexico. I believe the state of the economy right now and how much our families are suffering. It probably makes more sense to hire local people, even though the contract is signed by foreign firms. I've lived in Montgomery County since 1972 and I'm here with a lot of concerned citizens about the commissioners expressing an intent to hire an attorney for the Sheriff's Department and a few months ago the voters went out and they voted for an accounting attorney and next year he'll take those duties on and I think it would be beneficial if we would allow him to do that because traditionally he cares for the council and he cares for all of the County officers and so we would like to you know allow him to do that and and take care of what we voted him to do Also, we're concerned about our taxes being increased to create a paid position. And that would also duplicate the attorney's duties. I mean, it would be a county attorney and another attorney maybe duplicating the same duties. And so we have seniors, we know that the economy is kind of at a slowdown right now. And so we're concerned about our taxes. There's going to be a presidential election coming up. And so it just kind of worries us about when we're on fixed income if we could afford another tax paid position and so instead of creating higher taxes we could allow our representative that we voted to be the county attorney to carry out all of his duties. Well and you know he's you know we need to support him and him staff coming in and then if that doesn't work and really truly we need to have another one then you know Mr. Lambrite and she could work together on that. I think he's a great guy. I don't take a position on whether to share, whether she should be heard by the sheriff. And in that, that's not my position. But I just think, I think Miss Rainey is just really, really, I supported her. I thought she was a better candidate. But I'll tell you, Mr. Lambeight, have no complaints against him.
