We have two proclamations this morning that we're going to address and first we'd like to introduce some guests that we have with us. We have Scott Perry with City of Conroe and he's the director at Osfer Johnson Junior Community Center. We have Mayor Webb Melder from City of Conroe here with us. We have Dayton Rogers who he works with the City of Conroe as well at Oscar Johnson. Elizabeth Anderson, she's also a City of Conroe. We have Diane Featherstone, she's the executive director of the dispute resolution center. And as you can see we're all from different groups. We all have different programs, but we have some key factors that tie us together and that's youth and serving communities. And so we'd like to present this proclamation today to take a stand against bullying in our county, October's National Bullying Prevention Month, whereas bullying is physical, verbal, sexual, or emotional harm or intimidation, intentionally directed at a person or group of people, and whereas bullying occurs in neighborhoods, playgrounds, schools, and three technology, such as the Internet and cell phones, whereas various research has concluded that bullying is the most common form of violence affecting millions of American children and adolescents each year. Whereas targets of bullying are more likely to acquire physical, emotional, and learning problems and students who are repeatedly bullied often fear such activities as riding on the school bus, going to school, and attending community activities. And whereas children who bully are at a greater risk of engaging in more serious violent behaviors, and children who witness bullying often feel less secure, more fearful, and intimidated. And whereas Texas A&M Agro-Lys Extension Service, the Montgomery County 4-H and Youth Development Program, Conroe High School, Wilkinson Elementary, local school districts, and new service providers, including City of Conroe, are committed to take a stand against bullying by supporting educators and the important responsibility to engage our schools and communities in bullying prevention and awareness programs. Whereas Texas A&M AgriLife Extension Service, the Montgomery County Forage and Youth Development Program, has provided leadership in training school faculty, community programs, and youth service providers to deliver the take-a-stand bullying prevention and conflict resolution program, developed by Texas A&M AgriLife Extension and the Texas Rural Mediation Services. Therefore be it resolved that the Montgomery County Commissioners Court proclaimed this month of October as Bullying Prevention Month in Montgomery County and be it further resolved that Montgomery County schools, students, parents, recreation programs, religious institutions and community organizations being encouraged to engage in a variety of awareness and prevention activities, designed to make our community safer for all children and adolescents every month of the year. I would like to add Darren Bailey to come and read the winning nomination letter. Good morning. What makes a good boss? One that dictates who, what, where, when, and how something will be done? Although I find those things important in a boss, what I find more important is one that will listen. One that values their employees, their employees knowledge, their experiences, and their ideas. It's even more refreshing when that boss looks outside of their own office to gain knowledge and information from others. This letter is probably a little different than most of the letters that you received because I don't actually work for Judge Patrice McDonald. I am employed by the Montgomery County Clerk's office. In my duties as Chief Deputy and Court Administrator, I have the privilege of working alongside Judge McDonald. Even though I don't answer to her on a daily basis, the County clerk and his deputies serve as the clerk for the County Court's law. So in a roundabout way, I do work for her in my capacity as a deputy clerk. I'm pleased to nominate Judge Patrice McDonald for both of the year. I met Judge McDonald during her campaign. Shortly after becoming the judge-elect, she came to our office and asked if we would teach her the Clarks job. And you need to know that that was before she took office. In that first meeting, she made it clear that she felt like there was more to being a judge than just sitting on the bench. By learning what each stakeholder in the court process did, she would understand better how the process worked. She sat with our clerks and learned our job, asked questions, took notes, and asked more questions. I have found in my 25 years and as an employee of the court system that you walk a very fine line when working with the judges. It has been my experience that they don't really care what you know or what you think. In this arena, they are the ultimate authority but that's not the case with Judge McDonald. She listens to what she has what you have to say. Your experiences are important to her. Your knowledge does not intimidate her. On more than one occasion I've walked into our office and said without hesitation what are you doing or why did you do that or I don't think you can do that, to which she responds, why not? And then she listens while I make my case. I would venture to say that most bosses would not be so gracious when an employee questions what they are doing. And for a judge to take the position of, you might be right, or I might actually learn something from you is truly amazing. I'm so happy to nominate my friend Judge Patrice McDonald for this honor. I have learned so much from her and I know that she has learned from me as well. It is difficult to communicate in these few short paragraphs the impact that she has made on me since taking office. She's giving me a new perspective on what to look for in a judicial candidate. I appreciate the fact that she considers the process as a whole, not just her position and role as the judge. She excelled in both positions and in March 2012, Michelle was promoted to Civil Visor and the records weren't management bureau. She supervises 24 clerks and has done an extraordinary job of providing the leadership and direction the bureau needed. I can't tell you how happy I am to have Michelle working for me. She's helped me so much over the years, and she's a terrific employee and very deserving of this award. You know, we're saying for all those people, you know, when you have to make a decision about a supervisor and all of a facelift, like, launching records and the important division in that chair, obviously. And she accepts the job, she gets over there and she doesn't have to stay in the job. And you can walk in that division anytime. And I think when you're at FO boy's brag about their boss, and I'll, you know, she's doing a good job. Under item 10A, County Judge, considering to approve the wording of the placement of historical markers on the courthouse square by the Montgomery County Assort Commission, one marker to be located at the front entrance of the Courthouse on Thompson Street and the second marker to North East County's Courthouse at Davis and Maine. These markers will give narratives of the history when Montgomery County's two courthouses in the downtown Condo Fire February 21st, 1911. The funding for this was provided by the Historic Commission and the Commission's Court. Second, marker funded by the City of Condo. Motion on that motion I'm sorry very important I'll make it very brief last summer I'm standing here in behalf of the historical commission as a chairman of the historical commission from Montgomery County and Ron Sikowski who is the president president of the Conroe live organization is here. We've got two markers. The process involves getting the historical commission to review and approve the narrative or the background to support two historical markers. And then from there it goes to the Texas Historical Commission where they do the final review and approval. However, both of these markers would be located here on the courthouse square. The first is the Montgomery County courthouse marker that would designate at least the somewhat of the history of the five courthouses we've had in Montgomery County. Three in the town of Montgomery actually in a temporary one located, which is there's already historical marker in front of Isaac Conrose House on Avenue A, the other side of the tracks. And then the two courthouses we've had here in Conroe, the one that was built in 1891, completed in 1891, and then the present courthouse that was constructed and completed in 1936. The historical marker, that marker would be situated wherever the county judge wanted but somewhere on the front entrance to the courthouse. And then the second marker would be located on the northeast corner of the court house that the corner of main and davis street that would designate the fire of nineteen leaven that totally impacted the downtown area revitalized if you will the downtown area from wooden structures to brick structures that we now have many of which are over a hundred years old today the the funding for both uh... the commissioners court back in the summer had approved as part of the historical commission's funding the approval for the marker that would designate the history of the county courthouses in Montgomery County. The funding for the second marker, the Conroe Fire of 1911, I believe will be funded through the Conroe Live organization with the support of the city of Conno, and that's already been tentatively approved. So what we're asking today is simply for your approval of having two markers on the courthouse square so that we can present that to the Texas Historical Commission as part of our package. Great. David. Commissioner's good morning. I'll just take a moment of your time. It's the intent of the County Attorney's Office. In a few days ahead to take another look at the access management procedures that we adopted and that you all passed earlier this year. If you recall that process has been assumed by Montgomery County from TexDot. We think that there's a feature or two in those procedures that we can tighten up. This has come to light recently as you may know when a driveway permit was issued earlier this year for three and a half acres that's on 3083 in the vicinity of Albert Morehead Road and it is not an accident that the three and a half acres back up to the Texcom site that is the city of mitigation that the county is involved in along with the City of Conroe, where we're opposing the granting of permits for wastewater injection wells. We believe, and I think it's appropriate for the record to state this morning, that we think that that three and a half acres was purchased by friends of the Texcom effort. And we're justly concerned about that. We have taken steps just in the last few days to ensure that the owner of the site, the site was sold and purchased by this individual back in April. We've taken steps this past week to correspond by certified mail with that owner and to put him on notice that the driveway permit that has been presently issued is for private use as stated in the permit and that the approved use for the property has been designated as undeveloped land. And we are putting him on notice that that is exactly what the permit has been issued for and nothing else and certainly not to allow access by commercial truck traffic to service a wastewater injection well adjacent to or behind this particular site. We provided that notice to Mr. Poe, the owner of property and also to Blile and Associates, the engineering firm that has been contracted with to install the new driveway that are along at 3083. With respect to any amendment or changes in the access management processes, we will take a look at that and we'll come back at a future court date and perhaps suggest one or two changes for your consideration. It's my privilege this morning to introduce the candidate for the County Extension Agent Family and Consumer Sciences position. This is the position that was formerly held by Linda Moak, who retired in May of this year. But I'd like to introduce to you all this morning Amy Ressler as our candidate for this position. Amy holds a Bachelor of Science degree in human development and family studies from Texas Tech University, and also a Master's degree in interdisciplinary studies from Texas A&M at Texas Arcana. For the past six years, Amy has been the county extension agent for family consumer sciences in Burleson County, and she served as the program coordinator and managed an extensive educational program in that particular county. Some of the key programs that she did conduct with nutrition education, diabetes education, child care provider education, food protection management and community development. She also worked with the 4-H program in Burleson County and they have nearly 300 club members in 4-H and she conducted a lot of different workshops and clinics for those young people with their 4-H projects. Prior to that time Amy served as the Director for the AgriLife Extension's Better Living for Texans program which is a nutrition educational program targeting food stamp recipients and low income families and then that director role she compiled many of the reports and summaries and programs she interpreted those programs and she also supervised the support staff and program assistance across the state. Prior to that role, Amy has served as a county extension agent in Buie County for three years in Stevens County for two years and she started her extension career in Hale County. And she conducted a lot of different educational programs related to family consumer sciences and also for H&U development. She has won numerous awards for her accomplishments. She received the Vice Chancellor's Award in Excellence for Diversity Programming. She has received the Mid-Career and Early Career Awards for Epsilon Sigma Phi. She has also received the Community Development Award, the Educational Package Award, the Diversity Award, and the Consumer Media Award from the Texas Association of Family and Consumer Sciences. And she also received the Communications Package Award in the Educational Peace Award with the Texas Association of Extension 4-H Agents. I think you can see she has a lot of experiences and comes with many programs that she has conducted and I think she will do an excellent job for you all here in Montgomery County. As we know, there's some issues with the driveway and so on and so forth that David Walker brought to your attention. I do request or ask that you all, I don't know how y'all do it, but maybe have a meeting and look at some discrepancies that are in, that we feel are in the application in the permit. Also, I would like to bring your attention to the company who did do the driveway is Biome Associates. Usually residential driveways are not done by Biome Associates. I just spoke to the gentleman who approved this permit or was the signature on the application. And he confirmed that residential driveways are not usually done by an engineer. I do believe that's one red flag that should have been looked at. And I would ask that you all double check that. Also, I want to bring to your attention that it's a 45 foot driveway. That is not normal for a private driveway. I know mine's not 45 foot, so I would like you all to consider that as well. I think that there was a lot of red looking at these things, it's more immediate than not. Progression is not always on your side. And I do believe that this is progressing more quickly than it should. And I do believe there's a lot of red flags that this is not for private use. And if that is what the permit shows, that it's for private use, that Montgomery County does have the authority, they should, to be able to see if an assistant driver block it at this point, because that's not what's being constructed. The rebarb, the thickness of the concrete, it's very, very obvious. It's a commercial driveway. And as we've been told that if it doesn't, isn't the same as the permit that actually will be taken and I'm just asking that y'all get together and look at all those things sooner than later because it just doesn't quite add up. With over 900,000 Texans unemployed and over 15,000 Montgomery County residents unemployed. This project is certainly good news. On September 27th, Ms. Lorde and I spoke before the Texas Transportation Commission, wherein a $1 billion project, roadway project, was announced and awarded to Zachary Odenbrecht. We ask their assistance as we are asking you to hear today, gentlemen, to urge Zachary Odenbrecht, TechS. and the TechS. Compensation Commission to hire veterans, Texans, and those who are legally authorized to work and hold these positions in these thousands of jobs that will be created and those are the TTC's own words. I'd also like to read a resolution here that you also have before you. Resolution of Commissioner's Court of Montgomery County, Texas authorizing support for the hiring of Montgomery County Texas citizens, other Texans, Texans, and United States citizens from across our great land to fill a job to be created by the work associated with the execution of TechSot project. Whereas on September 27, 2012, the Texas Transportation Commission made a conditional award for the Grand Parkway Section's F1, F2, G to Sagri Odenbite contractors and whereas Grand Parkway section G is predominantly located in Montgomery County Texas and whereas the Texas Transportation Commission stated on September 27, 2012 that the Grand Parkway sections, sections F1, F2 and G will create thousands of jobs and where as final award is to be made on or about December 15, 2012 with construction expected to begin in January 2013 and whereas according to the U.S. Bureau of Labor Statistics in August 2012 there are over 15,000 unemployed workers in Montgomery County, not including the underutilized workforce and those who have given up looking for an employment. And whereas the June 2012 statewide Texas unemployment was reported by the US Bureau of Labor Statistics to be over 964,000 workers, not including the underutilized and those who have given up looking for an employment. And whereas according to the US Bureau of Labor Statistics in June 2012, over 806,000 US veterans were out of work nationwide. And whereas the US U6 United States unemployed, worker number is an excess of 23 million. Whereas this County Commissioners Court unequivocally states that there is no shortage of Texas or U.S. citizens ready willing and able to work, and whereas there should be a shortage of a U.S. citizen workforce and prior to allowing the employment of any foreign nationals, Texas.Clearly state, it's commitment to the enforcement of the U.S. Department of Homeland Security's e-Verification system, we're all for a national seeking employment. Veterans have a, the US government has spent millions of dollars on training veterans and they come back with a wealth of knowledge and a wealth of leadership that can be put to use right here. I moved here from Hawaii after living there 18 years, served in Iraq, know what it's like to be out of work there, lost my home there, and moved to Texas where I began a fresh start. But I wanted to say on behalf of Phyllis Reini, I've been employed. I'm an attorney too. I've been employed. I'm an attorney too. And she is employing me. She's, she's authorized me for a very limited purpose. And she's sitting here. I was a sport of sure, but I want to say that but I Think that's come up and I noticed the the publicity about mr. Noak who I really like Of course, I'm a tea party Democrat and I get a big big laugh out of that and yeah But I do know what I'm doing being a Tea Party Democrat. It comes against the social issues that Tea Party has. But far the economics and the libertarian aspect. But I wanted to say this, that I've been to some Democratic functions in Houston and they've got bond issues. It's funny. All the Democrats, they don't, we really don't, they just go for any spending and then the Tea Party's come back, no spending, no taxes. And I think the answer to it is that everybody who's coming with these broad-based positions should study the specific issue that's involved in any spending or taxing issue. And this came up at the Tea Party event when the mayor of what's that place anyway. He said, you really need to study unless you're in on the planning, you see what's going on. You shouldn't really take to strong positions. So that's my position. I'm against the Democrats on the issue, I'm against the Tea Party on the issue, study the issue and then come to the conclusion that you find from the facts, isn't that right?
