All members of the court are present with the exception of Commissioner Metter. Commissioner's we need a motion on the agenda. Move. Second. All in favor? Say, ah, ah. Second, all in favor, say hi. Commissioners, we have two proclamations this morning. One is motorcycle safety awareness. Good morning. Good morning. I'm a lasting pig pin. This is hungry. And this is schnauzer. We're with the Confederation of Clubs and Independence. We appreciate your time letting us read this proclamation. The proclamation is for motorcycle safety and awareness. May is nationally recognized as motorcycle safety and awareness. Whereas today's society is finding more citizens involved in motorcycle on the roads of our country. And whereas motorcycles are roughly unprotected and therefore more prone to injury or death and a crash than other vehicle drivers. Whereas campaigns have helped inform riders and motorists alike on motorcycle safety issues to reduce motorcycle related risks, injuries and most of all fatalities through a comprehensive approach to motorcycle safety. And whereas it is the responsibility of all who put themselves behind the wheel to become aware of motorcycles regarding them with the same respect as any other vehicle traveling the highways of this country. And it is the responsibility of riders and motorists alike to obey all traffic laws and safety rules. And whereas urging all citizens of our community to become aware of the inherent danger involved in operating a motorcycle. as urging all citizens of our community to become aware of the inherent danger involved in operating a motorcycle and for riders and motorists alike to give each other the mutual respect they deserve. Now therefore be it proclaimed that the Commissioner's Court of Montgomery County, Texas does hereby proclaim the month of May 2012 as motorcycle safety and awareness month and further urges all residents to do their part to increase safety and awareness in our community. I move. All the papers. Yeah. Look at our bikes. Y'all right. I'm just curious. Harley Davidson. Harley. Yes, sir. Spider. He's got a spider. Well, my wife has a spider. I like that. What kind of a holly deal have? I have a sports shirt. Sports shirt. Like that? How about you? I was off to. Thanks. They're real slow, aren't they? Yes, sir. Yes, sir. Thank you. We make them slow. OK. I know. So I see a lot of signs going up now. Yes, sir. Yeah. We're working on this one. I like to be your time. I'm going to sign the percentile. Thank you sir. Thank you. Thank you. Next we have a seven B older Americans month. Yes sir. I think any one of us up here probably will qualify for that. That's more. Good morning. Good morning. My name is Weedy Burns and I'm a supervisor with adult protective services here in Montgomery County and I'm going to read the proclamation for the Older Americans month. Whereas every year thousands of elderly and disabled citizens are victims of abuse, neglect and exploitation and denied many of their rights because elder abuse knows no boundaries as it affects all racial, cultural, religious, and socioeconomic groups. And because in 2011, more than 87,741 in-home intakes were investigated, and 58,068 cases were confirmed with victims of abuse, neglect, or exploitation in the state of Texas, and whereas the health and well-being of elderly and disabled people in Texas and Montgomery County should be one of our highest priorities and of concern to all Texans. And because no aspect of our society, culture, technology, agriculture, science, sports, or education will enjoy its current prominence without the contribution from those who are elderly or have disabilities. And whereas we recognize the benefits of wisdom, strength, courage, and knowledge of the elderly and disabled, and because the experience of their generation and contributions can only aid our great state of Texas in meeting the challenges of its future and because many people, because people who are elderly or have disabilities are among the most important resources of this great state and because it is fitting that we as a community recognize the need to protect their health, safety and rights. Now therefore be it proclaimed that the Commission of Court of Montgomery County Texas does hereby proclaim the month of May 2012 as older Americans month in Montgomery County and all and urge all citizens to work together in the years to come to help reduce abuse neglect and exploitation of people who are elderly and disabled and support this year's theme in powering communities to provide services in a new age focus on vulnerable adults financial legal mental social and health care perspective thank you thank you for coming all the papers yeah okay commissioners let's move up if you if you all don't mind let's go to the regular agenda on 10 a b and c I hate to keep Gertie here through all our business. We have Gertie Spencer here, commissioners. And she is going to resign as the chairman of the board of the Montgomery County Historical Commission. However, she has agreed to stay on as a board member. So Gertie, if you would step forward and we're going to roast you. Oh, no. I'm just kidding. Be careful, so it gets you back. Greg, we want to thank you so much for the multitude of issues that you have tackled from the museum over there at Candy Kane Park and so many things you have done for the Historical Commission over the last 25 years. But for you, I don't think we would be here even talking about this issue like we are right now. and I think we have some other people maybe possibly an audience that would like to make a few comments. And they have supported the museum and the historical commission and the rest of the preservation efforts in our county. Is there any comments from the public regarding you're not going to roast me? Yes Well, I was echo what you just said It's but for dirty. I don't think that we On the board of the heritage Would be able to speak in that place doing what little we do Except for the efforts of her so much of her handjanks over the years. We just really appreciate it. Thank you. I want to thank the commissioners court for the support over the years that I've been involved in the historical commission. And I want to thank Patty and Sylvia who has kept me legal, halfway legal anyway, and all the things. Go to the state, appreciate your support, and it was my privilege to chair this for that many years. Thank you. Thank you. Thank you. Next, an exciting note on the same issue. Larry Forster has agreed to take over this chairmanship of this council. And if you would step forward, Larry. Good morning. Good morning. Thank you for agreeing to take over this chairmanship. We know your interest in history of Montgomery County. That has been evident over the years. Your knowledge, I think maybe possibly shorter Robin Montgomery is up to a very, very high on the history of this county. And now you can take this forward like it needs to be done. And we appreciate that service. My pleasure. Thank you very much for the honor. service. My pleasure. Thank you very much for the honor. The commissioners I move on to an A B and C. They call a favor say I. I can't. Can a clerk need to prove the minutes for April 23rd? Move. Second. All favor. Yeah. Commissioners, I have no changes on consent. Move. Yes. Thank you. I'll take this. Ah. Okay, and with the sheriff we need to have a public hearing, let's resist this court and convene public hearing and a connection with the sheriff's department. Judges hearing is part of the grant requirements for the burn grants and we ask that we have a conductive Or to conduct a public hearing on filing the application for the Edward burn memorial justice assistance grant program for 2012 local jurisdiction through the US Department of Justice pursuant to public hearing notice published May 2nd of 2012 The grant is titled Jag FY 2012 new New and Replacement Body Armor Project in the amount of $66,541 and no matching funds are required. Do we have any public comment? You can actually with this grant that the chief just talked about. There being none, let's, as you know, the Public Hearing Recommendations Court. Move. Second. All in favor say aye. That was only being seen, so you do it. All right. And for item 11c, we ask that you consider and approve the acceptance of supplemental funds for the HIDA Year three grant in the amount of $7,560 All in favor say ah Thank you District attorney How are you? Good morning. We came to this court in October 2011 and you have given us a position in our budget. And then we have some extensive costs coming up with this smart and new litigation. And we agreed to hold that position open for 13 weeks in order to help fund that litigation. We have received the grant, I guess the last bill for the experts on that particular matter. We are short in our budget in that line item that you transfer those funds into about $19,297. Speaking with the auditor, we are able, we have not filled that position until today. If you have two more additional papers, you can sweep out of that particular position. So all we're asking this court to do is give us $9,747. In that line, I'm not a contingency in order to completely pay off this one-engine litigation. We have to add more than that out of our asset, for which we're upon. fund and obviously let that position open. So we'd have to fund the additional 9, 9, 747, $23,000 out of the container. Move. Second. On favor of Cia? Oh, yes. Thank you. Thank you. By the way, what's the status of that Swayne's in deal without? Judge Edwards has set to make some rulings on that. Finding the fact that the inclusion of law one fact done, once that's done, it'll be boarded to the court of appeals. And we'll go from there. OK. Thank you. Thanks, Bill. County Clerk. Can they clerk? Good morning gentlemen. I started wearing my collections hat this morning. I had sent a lot of packet I think outlining what we were attempting to do in terms of moving some money from a restricted line item to a non-restricted line item. In talking to the auditor about it Friday, she sort of indicated that some of the items paying for the global connect outbound dieter calls really wasn't necessarily such a proper restricted line item to begin with. But anyway, we're asking you to see if we can move some things around a little bit to see if we can drop in a piece of software that will, I think, enhance our ability to make calls and do some collecting for the candidates. I move. That's all I'm going to do. I'm going to put it over to you. I'm going to send passies. Thank you, Martin. You can use the elevator. Okay. Constable, proceed for. More on Judge Commissioners? Morning. I consider it appropriate approval of two additional new deputy constables for Precinct IV. These positions be funded by Commissioner Precinct IV for the remainder of 2012 year. I move. Second. All in favor, see I? I think a reason I in favor, C.I. I think a reason I find positions is you'd have to be in pre-sync 4 to see what goes on. I think the DA can vouch for that. These boys work 24 hours a day, seven days a week, and I'm glad to find those two positions ready. You can take it out of my car. Thank you, Commissioner. Okay, library. Good morning, gentlemen. We're asking that some funds be transferred within the salary budget $176.80 so that we can start an employee at a rate appropriate with their experience. Mr. Doyle has several times indicated that he'd like us to begin people appropriately. Funds were available in this position. They were swept at the end of last year because we had started someone at a lower rate. We'd like to reinstate those funds in the position. Move. Okay. On the favor, say aye. Thank you. Thank you. Purchase. Good morning. Good morning. I have 16. I'd like to present the recommendations for approval and our I have 16. I would like to present the recommendations for approval and or contracts for the filing items all in one motion. Item number three, the RFPQ for architectural services precinct to MCCD, approve the contract for Edwards Associates, PLLC, for a fee of 8.25% of the estimated construction costs of 650,000. Item number 5. What building is that? That's for innovation on the old hospital and JP building for the clinic that the CDBG is doing over there. Okay. Item number 5, RFPQ, Energy Efficiency and Conservation Block Grant Program Phase 10, Energy Savings and Lighting Retrofits, Department of Infrastructure. There were five respondents. Award to Sylvania Light Services in the amount of $110,690 and 34 cents from Houston, Texas. The second low was A&H Electric from Conroad, Texas in the amount of $125,985. Okay, if you don't mind repeating the first, what was the first bit? For Svang is what we're awarding to, $110,690 and 34 cents. The second was $124. $125, $990 and 34 cents. The second was $124. $125. $985. Great. Thank you. That was A&H. I move on. $125. Second. All in favor, say hi. Thank you. Thank you. the queue. County Attorney here. You got to speak up. I'm a document and and and and and I'm going to turn to the terms of the time. I'm going to favor. I'm going to favor. the is that additional insurance or is that covered under the policies that we have in place now. I move. On favor, yeah. The first phase was estimated to be $30,600 initially. Next to that, we have to make some passes. That happened in just the beginning and the reconciliation. That's the remaining of the first phase. The doctors have really worked today to get through that. Can you all hear what you saying? If you're not a microphone over there. I can't. I'm having a hard time hearing you from here. Yeah, you don't mind. Give me the repeat 17c. Please. Okay. That's approval of the settlement documents related to the next sale reconciliation for Phase 1. That first phase was estimated to be $33,600. Initially, the next sale paid a half of that. And after the negotiation or reconciliation, they're going to pay the remainder of those Phase 1 costs. And so the documents before the court today are just merely too except and approve that settlement for phase one. I move. Second. All my favor, see ya. All right. And item 18A is a resolution in order that authorizes the execution of an agreement with our lady of the Lake University. This is for a performance of psychological clinic services. And this is for the Manage Design Council Mental Health Program. Under the agreement, the county will pay $17,520. I'll provide 12 hours of services a week for one year. The contract is also contingent upon the county receiving grant funds for the program. And as part of this, we need the court to authorize a professional services exemption per 262-024A4, the Texas local government code. Second. All in favor say, we're surpassing. Thank you. And pre-stay two, we have a public hearing let's recess the court convene that public hearing senator prune raising speed limit the forty miles per hour on some runway between fourteen eight in their large roads is anyone here to discuss that us that. Okay, let's turn the public hearing recommending commission's courts move. All in favor see out. Already under Article 551.071 of the government code, let's recess this court for executive session. Okay, let's bring the court back to order, please. Commissioners, we need a motion on 20 B to incur expenses on behalf of county in connection with the Jenny Roberts versus deputy sheriff, biford night and others. Move. Second. All in favor say aye. Second. Do we have any citizens who would like to address commissioners court today? Can you make resources? Good morning. Please consider and approve the payroll change request forms. Move. Second. All in favor, see how? Thank you. Thank you. Mr. Smith, anything else? By the way, Mr. Meathers, Father's Fiddle, I believe, is Wednesday. Is that correct? Today, I'm Wednesday at St. M. Fiernan-Holland-Willow. The funeral is back. What's the service? Oh, okay. The station is. The night. And the same. St. M. Okay. Five to seven. Great. Thank you. Is your motion to adjourn? Move. All in favor. See I will. Why are you back? Is your motion to adjourn? Move. I'll take a seat. Wait a minute. Hurry up, adjourned. Stand far.
