An office must notify both the county auditor and the treasurer if any changes to an employee's status that would affect the pay. And if at any time the DA's forfeiture account balance is insufficient, the pay will cease immediately. There are four attorneys who are board certified in the office. I am trying to have every district court chief and any number two prosecutor to become eligible for promotion to have at least passed the board certification. So similar to law enforcement, certificate pay, we're asking at the prosecutors who have achieved the highest recognition in the state for criminal expertise that I be allowed to reward them with certificate pay. No. Then I wanted to provide you with an update from the Texas County and District Retirement System. They had on February 3rd a web seminar that I listened in on where they discussed the rate of return on their investments from the past year. They assume an 8% return on all of their investments every year and they did not meet that target this past year. They were 1.1% low. every year and they did not meet that target this past year. They were 1.1 percent low. They've also estimated that the majority of participants in the system will see an increase to their rate of a little bit less than half of a percent. I ask them if they could give us a firm projection at this time. They cannot. They won't have anything more firm for us until April, but if I use last year's anticipation, what we should expect with that 0.47 percent increase for the 13 budget is a rate of 11.61 percent. This year you adopted and elected, you elected for a higher rate than was required, you elected a 10.94 percent rate for the Texas County District retirement system. So this is almost 1% higher than you elected for the 12 budget. If they do have the rate what I estimated will be, it will cost the county approximate $600,000 more than it did last year. If everyone salary stays the same as the beginning of the budget. And that's something that would be addressed at budget. Sir. That's something that would be addressed at budget time. Yes, sir We will address that during the 13 budget hearings I just wanted to let you know as I knew what was going on with that Okay, are you just giving this information today period? I'm not asking you to take any action So there's no action at all required this will only impact your 13 budget going forward I just wanted to let you know, okay 13 budget going forward. I just wanted to let you know. Okay. Next. The next item I have does require some action that's been regards to the forensics department. I believe Dr. Vizio is here to help address any questions that you may have. It's come to our attention that there are a couple of things in the forensic department that couldn't be anticipated with the budget hearings. Because of the operation of forensic department that couldn't be anticipated with the budget hearings. Because of the operation of that department, there is frequently a need for overtime to be accrued. The staff that accrues that overtime doesn't qualify to be exempt personnel and so every single payday since the beginning of the year, they have been earning either overtime pay or comp time. What I'm recommending is that you pay off all of their comp time because there never appears to be a time that they could take it. So it will only ever grow and that you also institute a policy that this department not be allowed to take comp time and that they always use the overtime pay and that you also establish a budget for them to be able to pay that. We didn't anticipate this during the budget hearings as we brought them fully up to staff that just the timing of the work that they receive really dictates that they perform the work when it comes. Why is it all this overtime needed? Is it just more cases than anticipated? Dr. Veezy, I believe you could probably best address that. Just that forward doctor. We work every weekend. Every Saturday we go in so it's not the inconvenience families and so it's not to have an enormous number of cases on Monday. We come in every Saturday and we work. Additionally, ladies carry a phone in the evenings and sometimes they do not sleep very much because that phone is constantly ringing. For me to give cop time to them during the week just increases everybody else's workload. We don't have everybody up front to answer the phone and take care of the door and so consequently we're asking the the court to pay the pay the pay the overtime rather than the comp time. What's the estimated annual cost of the overtime? The annual cost of overtime estimated is $17,000. But because some comp time has already accrued, I'm asking you to approve $19,428.19 to pay off the comp time that already exists on the book. It's $17,000. It will be an annual amount you think. I believe so at this time commissioner. Which is of our over times impacted by the out of county contracts we're doing. We were doing an average over the last couple of months, a five cases from out of county a month. Most of those occurred during the week, but occasionally there is one that comes in on a weekend. Do we charge a different rate at weekend Saturday Sundays after hours? I guess we could. I think we'll look at that. We have interlocal contracts that are in agreement or interlocal agreements that are ineffective at this time with a specified amount of money based upon the complexity of the case and not when we do it. The service fee agreement that we have with all the other counties provides a fee per autopsy regardless of whenever it is. Well, I think we need to change that. Just to understand though, the bulk of your overtime is due to having to come in after hours and weekends for mostly weekends, not just workload is just the when you're right. I don't think that can ever be how you regulate that. That's true contingency. I don't know how you would ever regulate that or adjust it. We impact families when we don't come in on the weekend and can take care of you to get the body ready for release. I guess all I'm saying is I think you're exactly right doctor. All I'm saying is if it's an out of county Situation, I don't think we ought to be having to pay the overtime By the Montgomery County taxpayers. I like to have a different fee structure We can't attack spares. I like to have a different fee structure. Maybe when the contract's set for renewal with those other entities, if they request an autopsy to be done after hours or on weekends or holidays. Do our agreement allow for that, Phil? Is she think? Currently it does not. It has a set fee for the autopsy regardless of when it is. Those renewed on a yearly basis. It has a one year term automatically renewed, but we are able to come in there and ask for a fee adjustment. I agree with Judge. Is it feasible to stagger days of employees where you'd have one work Saturday would be the basically the we're busier the first part of the week than we are the rest of the rest of the week but giving somebody off you never know what's what's going to come in and to giving somebody off and promising them a time off on Friday we can be day-lows with cases and once again you know it impacts our ability to get the case done and perform in a professional way with somebody up there at the front, somebody able to answer the phones and that sort of thing. I'd like to add to we have three ladies that work there. The administrative person in the front and two lab techs, the administrative person is also trying to help in the lab techs. We have two doctors and one of the lab tech ladies has to assist each doctor and frequently they're doing autopsy at the same time and then they need the administrative lady to be in the front. I think they're pretty bare bones as it is. Yes sir. I don't think it's a right. in the front. I think they're pretty bare bones as it is. Yes sir. I don't think it's a right. And Commissioner, one of the things that Dr. Veezy mentioned in his discussion hasn't been brought to you yet, but will be on this item. And it's the fact that they carry a cell phone. Whenever they have that cell phone, they take turns carrying it. They carry it all the time, nice and weakens, and they do it a week at a time. Whenever they carry that call, they field phone calls from JPs that are requesting autopsies from an organization called LIFE to get LIFE gift to coordinate donations. And so far we haven't paid them for that, and we are required to pay them for that. So a proposal has been made that we give them an extra $100 per week as a stipend for when they carry the phone. So it would be $100 rotating from person to person. The estimated cost for that for the remainder of the year is just below $3800 annually. That's about $6,200. That's not included in the 70. That's correct. Do we need to add that amount to this? Yes, sir. You getting close to it. Greater returns better to hire another person and just fail that over time. I like if you look at that between now but I don't know if that would fix it though. I mean if it comes in in the middle of the night or on Saturday or Sunday. You're not going to get away. I think you're going to keep employees working six days a week. Unless you can get off. Obviously what's happening. Yeah, unless you can keep, like you say, stagger days off. They're going to consolidate personnel and engineering and administrative functions. The agreement provides for 100% of basement over 10 years for the period of January 113 through 2022. The current value of unimproved land is 2.2 million. We expect 28.7 million in improvements and 5,000 in personal property. The current annual tax for 2011 is $10,799. These are temporary employment contracts between the county and two employees that will be working with the Managed Assigned Council, Mental Health Department under Sarah Perlono. The court already approved creation of these positions in November 2011 and these are strictly temporary employment and they do not qualify for any benefits such as insurance retirement or medical benefits. This is an agreement with Brasus Valley Community Action Agency. I'm not familiar with Brise's County Action Committee. Or agency, whatever. EDPA is a 12-hundred-hundred-hundred organization that does a variety of programs, including weatherization and emergency assistance for utility assistance. and has been active in Montgomery County for a while doing weatherization programs. And prior to this emergency assistance had a utility assistance program and under the state CF program and BVCA did the weatherization component of that program. But recently emergency assistance, the state did some reorganization as my understanding and removed the emergency utility portion of that grant and gave it to BVCA to administer in Montgomery County. What we're doing is the county's going to be procuring the generators for them and have to go onto the property to make sure that it's installed properly. They have to monitor it.
