We got McKenney-Hunger and homeless awareness week. Is anyone here to read that? Okay. We don't have a copy of the confirmation judge. We have submitted it. Yeah, one. OK. Morning. Good morning. How are y'all? Morning. Whereas for the past several years, the National Coalition for the Homeless and National Student Campaign against Hunger and hunger and homelessness has sponsored national hunger and homelessness awareness week. And whereas the purpose of the proclamation is to educate the public about the many reasons people are hungry and homeless, including the shortage of affordable housing in Montgomery County for a very low income residence and to encourage support for homeless assistance service providers as well as community service opportunities for students and school service organizations and whereas there are many organizations committed to sheltering providing supporting services as well as meals and food supplies to the homeless including ID services, housing, employment, training, transportation, for and whereas the Montgomery County Commissioners Court recognizes that hunger and homelessness continues to be a serious problem for many individuals and families in Montgomery County. And whereas the intent of this week is consistent with the activities of the Montgomery County homeless coalition. Now therefore be it resolved that the commissioners court of Montgomery County, Texas hereby proclaims the week of November 15th through the 21st as the Montgomery County Hunger and Homelessness Awareness Week. Be it further resolved that the Commissioner's Court of Montgomery County, Texas, hereby encourages all citizens to recognize that many people do not have housing and need support from citizens and private and public nonprofit service entities. No, this was the sweet 2013 salary suite. Yes sir. I just wanted it to be a little bit more public that we were going to be performing the 2013 salary sweep to this year's contingency balance and we'd be moving 2,400. What is it? 2,400.10. 2,410,475,000 to contingency. And that would be more than enough sheriff to fund your needed task force And Bill is the sum of that can be used for the step plan is that for some of that funding's coming from No, so whenever we did intend to budget the step plan We said that that would come from the sheriff's Money. And this week doesn't include any funds from the Sheriff's Department as we hit this bus. This other department. I would just just to sweep is something that occurred in fiscal 13. It's not something you could anticipate repeating every single year while we do this week every year. Balleries are certainly something that you need to budget for every year. So this would have an impact on your next year's budget All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. All right. Judge, are we giving you an credit for the housing and the space that we allow? No. Okay. I move, earth. Do you move? I did not. Did you move? I move on it. I'm in favor say aye. Uh-uh. Sheriff. Oh, Judge, Commissioner. Morning.m. A.S. You consider to prove the following changes in positions and Associated salaries and new positions are required by the Texas Commission on Jail Standards. The operation of the jail kitchen, the changes do not affect the current salary structure. Close 5121 days, 4601 days, seven medic. Open 5121, 58, over 355 detention to deputy. Close 5121, 4601, 10 medic. Open 5121, 58, over 356 detention deputy. Mondays, presencing at 42,500 and allocate the remaining 2,193,64 in position funds to the jail funding line 5121,99999999. Move. Mr. Chairman. Before you move on this, if you'll recall back in May, the sheriff came to you and asked to abolish the medic positions to privatize that operation and we do contract that out now. These positions were abolished. The fact that they were funded in the position schedules, but not the actual budget. Is an oversight on the part of the auditor's office? These funds are not there. You would have to take these funds from contingency. This money was approved in our budget, those positions, and we're fixing to open the jail kitchen, and I'll just be two of those positions. We're going to have to hire two more workers when that kitchen opens up. It's going to take a while to hire them anyway. Can't we keep some of that money that we're sweeping to fund these? Sir, I'm not sure if we can do that. I'm not disputing at all that the sheriff need these positions is the funding that he's wanting to use. Yeah, I remember we did privatize and I moved that we used the funding source for this will be part of the suite that we're going to make. All the papers say aye. Motion passes. 11V considered to prove the FYI 2013 equipers. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The FI. The contract the position to effective immediately and will include two trolled deputies one motorcycle deputy the three positions will be funded by the township at 4,200 each with a salary stipend of $3,000 for the motorcycle deputy position move all favor see out I'm sure you're deferring item C the request for the task force at this time. Yes. So you still, is there still something that the Sheriff's Department needs? Absolutely. Yes sir. Okay. I kind of feel like we are acting like France did in 1939 when the troops were line enough on the border there. So I brought the tank with me to just hope we're not sticking our head in the sand and waiting for a 1940, summer 1940 come along when the German tanks roll through the streets of Paris. That's when the French finally decided to take action. So hope we just don't wait too long, Sheriff. Thanks, Sheriff. I know you've got some guys that you put together on the task force that are doing some of that work now I think if we can look at some of those results and maybe next year in our budget we can we can plan for that certainly we support your efforts and appreciate all We're moving on to do that on D. Yeah. Okay. Hospital pre-state to morning, George, more commissioner. Great point. This is just an acceptance and consider the regional DWI grant that we applied for in the HGAC in the amount of $10,183 for the HGAC in the amount of $10,183 with a match of $4,431.16 from the constable's budget too which has already been approved in is in my budget. All in favor say aye. I appreciate it. Thank you. All right. Constable precinct 4. Morning Judge, Richard. Morning, sir. Consider and approve the purchase of two new fully equipped patrol vehicles to be assigned to personnel who opted to give their vehicle stipend and accordance with the newly approved law enforcement's debt pay plan, please name the fund source. I assume that for pre-sync 3. In pre-sync 3 came in October, we anticipated that these people would be giving up a portion of their, well they would be giving up all of their vehicles stipend, and while it wouldn't be sufficient to cover in fiscal in the current fiscal year Future years would eventually catch up with it. So which I'll name this contingency for the difference Knowing that in future years there would be a cost savings to the county and what you budgeted at that time was $44,000 to purchase and equip each vehicle We do the same thing and is all the equipment that are currently in those vehicles belongs to the county being transferred to new vehicles? A portion of it will be Okay, how much actual new money are you asking for in this request? You would need about $43,000 judge. OK, how did this happen? I'm not exactly following. Because the cost savings that we anticipate receiving from these deputies giving up their vehicles stipend is about $45,000 per year. The vehicles themselves are $44,000 each. So we'll take the cost savings to purchase and equip one of those vehicles, but we'll need to fund the other out of contingency knowing that next year, we'll save that money because these vehicles will already be purchased. Is that talked about in budget hearings? We've already done this. We've already done this. We're going to come. And it's a good deal. We've all been fair enough to give up that vehicle. I'm I'm I'm I'm I'm I'm I'm those are the stockings won't be necessary next year in those vehicles the last room. Several five. Oh yeah. It's your motion motion. Second. All in favor of see out. Motion passes. Okay. Be considering to prove the additional funds for fuel and maintenance on two newly purchased county vehicles. Please name a fund in source. How much that'll be? Could be up just 6,000 years of just for fuel. In Precinct 3, we funded half of that out of I think out of contingency and the other half out of me. I'll do that. And then I think the service was under warranty or by precinct 3 barn. I move. I'll never see eye with that funny source as I'm eyes. Hi. Okay. Okay. Next. See, consider the proof of quest to close position 5541-5910-4 and open position 5541-7802-2 and transfer all funds to newly open position additional funds in the amount of $6,568.22 and associate benefits to be funded by Commissioner Persing for. I move. All in favor of the CAI? Hi. And last, the considering approved the increase of $4,170 and associated benefits for position 5541-7815-1 to be funded by Commissioner Prissy-4. Move. Thanks. So all in favor of the CAI? Aye. All right. Motion move. Thank you. So all in favor. Yeah, motion passed. Thank you. Elections. Good morning. Morning. Please consider and approve and order canvassing the returns and declaring the results of the November 25th 2013 constitutional amendment election. All in favor, Seattle? Thank you. Passes, thank you. Morning. Morning, Wayne. Please consider an approved of the following carryover funds from FY 2013 to current budget year to be placed in capital outlay line item to purchase two vehicles. Friday we learned from purchasing that the pricing on those vehicles is coming back a little higher so instead of 30,000 I'd like to request 34,000 and we have the funds available. This was a result of a cost savings that we anticipated some programs that we implemented the budget review committee commissioner Doyle and commissioner no act were aware that we would have excess funds and Also recommended that we consider that first is put in in the new budget year Yeah, you got some of the the ladies that work for you over there knows vehicles with 200,000 miles on them late at night That's not a good thing. All right. I think the the lowest miles on the one and we're going to get rid of is 210,000 miles Second, well favor see I Thank you juvenile probation Good morning, judge good morning commissioners morning I'm asking this morning that you consider and approve de-opligating I'm asking this woman that you consider and approve de-obligating $3,867.51 from the FY 13 family reunification grant. This amount includes a refund in the amount of $254.1. I'm also asking that you consider and approve de-obligating $2,891.54 from the FY 13 Power Recovery Grant. I'm sorry. Thank you, gentlemen. Thank you. Auditor. The first item before you is a request to approve contingency as a funding source to pay 213 separate tax statements that we received from the tax office. New software that was implemented last year has allowed him to look up past history for the past 20 years of when the county has closed on different properties for right of way or perhaps conservation easements. These have been reviewed by the County Attorney's Office and the Auditor's Office. They total $13,968.54. The county will receive a portion of that back because the county is one of the tax receivers in those statements, but past history tells us that it is much simpler for accounting purposes to pay the full amount and then receive the county's allocation. Hey, second. All the pay were see-on. the county's allocation. Thank you. Second. All the payers see you. Thank you. Thank you. The next item before you is a request to file into the record. Reports received from various law enforcement officers for Chapter 59 audits as performed by the Auditor's Office and request to pass this court. Move. Thank you. All the payers see you. I'll favor see you. All right. Thank you. Thank you. I'll be right back. I'll be right back. Thank you. Thank you. I'm Judge. Morning, darling. 18A. I would like to present the recommendation and contracts for item number three, RFCQ, probation, tracking system software, two corrections, software solution for adult probation. Lou, second. All in favor, see how? I'm good. Item number five, material handling equipment to crown, lift trucks in the amount of 122,000 with Montgomery County Food Bank and CCD. Lou, second. All in favor, see how? out of 122,000 with the Montgomery County Food Bank MCCD. Really? Second. All in favor, see how? I. B, considering to approve the purchase of a caller generator from Lofton Equipment Company through the interlocal agreement with HEC and the amount of $57,629, precinct three. Move. Second. All in favor favourites here? Okay. Consider and approve the purchase of one boom-mower from Brookside Equipment through the Interlocal Agreement with Byboard in the amount of $73,544. Precinct 2. Move. Thank you. All of the favourites here. All right. I'd indeed consider and approve the purchase of one John Deere cab tractor from John Deere Company through the interlocal agreement with Byboard in the amount of 73,000, $31.34, pre-sync 2. Move. Second. All on paper, see ya. Thank you. Kenny attorney. Thank you. Kenny attorney In item 19 a. Raskin the court to approve a revised professional services agreement with Carolyn Cox for her temporary justice of the peace services The statute requires that we pay her the same rate as the elected JPs and so the purpose of this revision is just to reflect the increase in pay for the 13-14 fiscal year. And this is for any JP court she can work or is it? It's the same contract she had before it's only for JP1. Or it's the difference. I don't remember what the minimal it's the 5%. Judge didn't my time you this was only going to be a six month Contract and it's going to be reviewed I remember that being I'm not sure what in the six month they would be at this point Isn't that why it came is it's about six months the way that it's written I believe right now is it's in effect for the duration of six minutes. The way that it's written I believe right now is it's in effect for the duration of the current JP's absence. So it could potentially be as long as necessary. It can also be terminated by the court if they wish to do so with 14 days notice. And motion is second. Two seconds. I think we're all in favor. I think we're all in favor. Yeah. No. Motion passes three to one with one no vote from Commissioner Watt. In item 19 be arrest in the court to approve the public services contract for funding to the Heritage Museum. The amount of this contract is $15,000. This was allocated in the 2013-2014 budget. Blue. Second. All the favors, yeah? All right. The post. Passes three to one with the Shanoah, voting against. And I'd like to take items 19, C and D together as one motion. These are agreements with two entities, one is Society of St. Vincent de Paul, the other entity is the Society of Samaritan's Inc. These are contracts for Community Development Block Grant funding to those entities for crisis intervention services that can include assistance with Brent, mortgage payments, prescriptions, that sort of thing. The contracts are both for $55,000 and one, the Society of St. Vincent de Paul intends to help $1,280 individuals and Society of Samaritan intends to help $1,400 and nine individuals and these are for low, very low and extremely low income persons. And it's 100% grant funded? Yes, it's funded through commute development. I move. All in favor, see out. In item 20A1, arresting the court to approve an assignment of a land lease at the Lone Star Executive Airport, the assignment is from Patrick, I can send to Sky Candy LLC. Move. All in favor. See. Okay. Commissioners. Precinct four. Transfer of funds from 6157340255417102 for the following positions. We've already discussed that. That's the position of the actual. I move. Okay. All in favor? Say aye. All right. You're under Article 551.071 and 0.072. Let's recess this court for executive session. Okay. Let's bring the court back to order, please. In executive session, we did a motion to set a minimum bid on a building in the woodlands. Move, set the minimum bid at six million. There's a second. All the favor say aye. Aye. Motion passes. We have one citizen who has signed up. Ken Smith. You're up, sir. I don't see a line item or I don't see a line item on the agenda for my subject but for the future. I'm Ken Smith with Shatwood Utility District and we with a lack of an HOA we enforce the deed restrictions and we also attempt to enforce the original plat of our property and the purpose, residential purpose of those. And in the, we have people that come to us and they want to make three lots into five lots. They want to split their lots. Some residents in the past have took their homes and built over two lots and then they want to partial out the second lot and we oppose these things especially if there's utility buildings, large buildings on the other lot. And so that's our attorney says that the people that can override us as the commissioners court that you have the authority to change plants and and the use of plants. And so our attorney is Larry Forster you may know him. Been around a while. So anyway, I'm just here representing a district opposing any splitting of our our our lots are repurposing them. That's all I've got. Right. Thank you sir. Thank you. Thank you. Do we have any other citizens coming today? Bill? I was asked to provide a definition of emergency for certificate of publication. I presented that a few months ago and I was curious if any progress was made that these are items of concern. Second thing, previously when we were meeting on the budget, I suggested at the time that there will be a line item called contingency and that contingency will be funded on the basis of past historical dipping in contingency. Now, I don't think that that has happened and now I see this sweeping and this unsweetening and all the rest. I mean, I've been coming here for quite a while and it seems like, well, how are we going to fund it? We'll take it out of contingency. And it seems to be a regular obligation. Well, it's a regular obligation. You're going to have to do it all the time. Just put it in the budget. You fund it for the first time and then send the budget and it goes for the next time. And then when you need it during the year, you have it and you don't have to depend on one of the things that will lack of overtime to the sheriff's office, which has been historical in the past. Third thing on the situation with the sheriff's office and the gang activity. I understand the need for it. I understand gangs are a separate entity and how it has to be. I wish when it were presented to the people because they haven't seen stories in the paper about it. What is the backup that this is gang activity? And what it would affect what we can do here, as opposed to if the gangs are sourced in Harris County, wouldn't they have to do the gang activity? And we have to have some sort of an intergovernmental relationship or something like that. The next thing was the jail proceeds. I have no idea where that is. I don't know where that committee and when that's due to report, because I see things that are going on about the expansion of the jail. And I hear significance of obligation coming up again and again that's more debt and we had all those proceeds from the jail and as far as the chance building is concerned I would appreciate that Plan B which is how are we going to replace this building? Be fully disclosed because we're going to need the space. It's prime space in the woodlands. I don't know how it's going to be replaced. It may be a landswab but maybe something. But that before the scroll the scrolls before there is any sale of that building. And that's basically it. Thanks Bill. Thank you. Thank you. Sure. Do we have any other citizens comments today? If not, give me resources. Please consider and approve the payroll change request for move. Second all my favor say most of the passes anything else commissioners. Thanks.
