We ask all of you in your name. Amen. Amen. Amen. Congratulations to the flag of the United States of America. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize. I apologize Okay. Under J.R. Mor request, we need to do our public hearing gentlemen, ladies and gentlemen first, regarding the public, this is a public hearing on a tax increase. So let's call over that public hearing. And we need to allow citizens comment on the tax rate. Zero-inch step up. Jim and each plane in judge. Yeah, go ahead. What happens is this public hearing is for the citizens here to be able to discuss the impact of the tax rate increase that they are going to have Individually or under a business. This is not a hearing for your public budget. This is not a hearing for action by the court. It's only an advisory exchange between you and the citizens at the end of this meeting. You'll set the date and time for next Monday to be your second public hearing on this. There's any questions anybody has. I'll be glad to answer them. Okay, do we have any citizens comments today on the budget? That's assigned to the job, done a good job and the newspaper's done a good job. Now your next motion would be to set the next date, which is August the 19th at 930, to be the second public hearing at 930 on next Monday. I move we have next Monday, the second public hearing. Second. All of the favor see out. Motion passes. Yes, thank you, Judge. Will it join the public hearing and proceed to commissioners court. Okay, for the record, all members of the court are present. We need to motion on the agenda, please. So second. All of the favor say out. We have commissioners' several resolutions this morning. First is American payroll association payroll week I want to hear from that I move on payroll second all in favor say I second is National Health Center week do we have anyone to read their resolution? So all in favor say out motion passes Under Kenny Clark commissioners, we need to prove the minutes for July the 22nd and July the 29th. That'd be 8 a and b favor say I. I. Commissioner's I have no changes on the consent agenda. Food will go to the second. On a favor say I. I. Judge I did have a question on the consent agenda. I failed to bring that up before we moved on it, but there was a contract with the vendor that was being approved. Third co-services for traffic signal foundation services. We had terrible experience with this particular vendor in Precinct 3. And I would not recommend that we proceed with the contract with that organization. Yes. Okay, let's go back to consent. And now, Commissioner, what should make a second motion? I'd like to make a motion to approve the agenda the consent agenda with the change of moving or removing three a from consideration Do you have another vendor in place do we have? Okay. Do we have another vendor? We use wave media? There. there. Why don't we just remove that one from the this contract and have a second person next court. That's my motion is your second on the favor say aye That time of year when we nominate directors for the Montgomery County appraisal district Montgomery County appraisal district. In the past, we've had Commissioner chance, a Commissioner met her on this board. We need to see who has an interest in serving on this board. I'm glad to have the stage. Yeah. All right. Do we have any volunteers or recommendations for that second seat? You're good for you, Judge. You didn't enjoy that with you? Second bet. I'll make that as a motion. Second. Okay. Okay. I can't resist. All in favor, say aye. Motion passes. Okay, under 10b. Considered approval of the following. Estery committee members for the Kennedy Web Mobility Study. The reason number 10 is blank is there was some interest in text about Houston being a member of this committee, but I did not have final word on that yet, commissioners. Judge, why don't we go ahead and move on the rest of the list and we'll wait and see what text ought to work to do. We could always do a nine or we could, why don't you make a motion that we approve? The nine listed for that steering committee. Second, all in favor say out. Some passes. Just to the piece, precinct three. Consider an approval request to use $661.27 from the Justice Court Technology Fund to replace two laser printers. Phyllis, this was one of the things I think we talked about during the budget hearings was trying to move away from these type of printers and trying to go towards some sort of larger device for the entire office, right? We did address through IT the implementation of a contract that would be for printer maintenance. I don't know if that included printer purchases, Marshall. Maybe you can. I have a little bit of a specific look at that. I doubt it is just a little bit more good. Okay. Move. All in favor. See how? All right. Marcie Management. Morning, Judge. Commissioner. Morning, Nikki. We're likely to consider and prove 2011 grant adjustment. A UIC grant adjustment knows from farm and public safety and authorized justice center to accept the grant acceptance form. The only change is for a two-month extension on the grant. Move. Thank you. All in favor, sir. Aye. On some passes. Thank you. All on paper. Yeah. All right. What's the passes? Thank you. Morning, Sheriff. Morning, Judge. Commissioner. Here, how are you? Fine. On 13A, you asked you considering to prove transfer of funds between the following positions. The transfer pertains to civilian positions and does not increase the current salary structure in their six of them. Move. Today is on February 5th. On 13b as you consider and accept supplemental funds in the amount of $5,000 from the OCDF strategic initiative SWTXS-0843 ranch hand agreement between the MCSO and DEA. All in papers? On 13C as you consider, except funding in the amount of $5,000 for the OSDF strategic initiative SWTXS-0915H. the MTSO and D.A. All of favor say out. Team D, as you consider, now the MTSO will arm detailed division, $3,000 in postage from the postage account for nine. What's it? My favorite sale. On the EAS considering to prove the following changes in transfer of salaries due to re-evaluation of the position, the changes did not increase the current salary structure. Close position, $56.011, dash $4,125, dash $1, and $56.011, dash $4,125, dash age 41, 25, age 1, and 56 over 11, age 41, 25, age 2, collection specialist, and open position 56 over 11, age 39, 40, age 1, and 56 over 11, age 39, 40, age 2. Move. Second. All of the beverage say, uh, and on 13 a.m. asked that we discuss and take action there for appropriate on jail expansion. Okay, uh, first, tell us what we have left the steady, less the commission wrote money from the job quality center and dollars. Certainly judge if you'd like to turn the page on item 17a. I'm sorry. It's 17 B. Item 17 B was a list of items that have already been approved or discussed by this commissioners court with regards to the proceeds of the sale of the Joe Corlea utility. The net proceeds of that sale were $22.493 million. Y'all have already committed to using $500,000 for your HGAC study. I'm sorry, $100,000 for your HGAC study. $500,000 for the toll road transportation study. A little bit in excess of $1.5 million for some one-time purchases that were discussed during the budget process. A million dollars for one-time funding for the Texas County District Retirement System. And $6 million was allocated to Rodinbridge uses. That leaves a remaining uncommitted amount of $13,311,631. That's a city is going to pick up half of that. Thank you. They are. They are. Leaves how much? They have $50,000 back in that. Yeah. If the city picks up half of that that leaves $13,361,631. We need to of that. The jail. Absolutely. You know, every time, every forever, the only way, the only time we've ever added onto the jail or did anything was with COS. I'd like to see the Court consider doing COS for this project and keep this money as a rainy day fund if you want to call it that, but I hate to see a spend all this money at one time, but we've always used COs to enlarge the jail population facilities. I don't know, Commissioner. I don't know what you're saying, but our debt level is getting on up there. We do have this money and I can't think of a better reason to use it for a new jail expansion. I like the idea of airmarking these dollars for future jail needs. I just am concerned about the piecemeal approach of just continuing to add on to this jail that we have. We've talked briefly last court about trying to look at some sort of a fee schedule for municipalities to help make them more cognizantly aware of housing prisoners in the jail and I think we need to look at some alternative measures things that we can do to try to draw down that that jail population and then take a more holistic approach of what are our county needs going to be further down the road, not just a year or two years, but what type of gel are we going to need five years, 10 years down the road and start to prepare for that? Because as I understand it, Sheriff, if we were to add on to this gel today, that's about as much as we can do. We don't have any more land available around there for the future. And so I've talked with you briefly about the idea of looking at, you know, is our current county jail marketable? If so, maybe we try to market that jail and build a new Sheriff's Administration building and jail complex somewhere else, looking further to the future with the possibility of tying a courthouse into it on down the road. And yes, sir, all that'd be great is just you know we can make it to see you know which which way we're gonna go because we're at that point now where we've got to do something. Sure if cities can they have their own jail or do they have to go through years? No they can have their own jail they fall under the Texas jail commission just like we do and that's the reason a lot of the cities have given up their jail. They don't spend all that money on the jail. I think it's a big help. I think it's a big help. If they won't, sure. Sure. You've got some options out there that you've looked at. We look at some plans of the day. Can you kind of run through that? Sure. We look at some plans of the day. Can you kind of run through that? It kind of gives us an idea of how long that may carry us out if we were to do any one of those options. Let's say we do three floors. Is that 168 people per floor? Yeah. That's over 500 beds. And the 40% increase in the jail size. Yes, sir. And our population increase since I've been in the office in the eight years, 60%. And we've had, just in the past year though, we've gone from 923 to 1180 judge at 257 beds. I mean you're talking about potentially building a facility that may only last three, four years. And in the additional cost is it, is it any more costly from running a jail, managing a jail if it's multi stories versus just a large one floor complex that has no no. I think I've got the one to 48 ratio, you know, with your employees to to the thanes and I mean, whether it's round level or multi stories that that office is saying. But if we looked at some sort of a fee schedule for municipalities, that could help. You talked about running two jail buckets daily, trying to get people out of the jail. Have we started that or is that gone anywhere? We need to talk to the Office of Court Administration about doing two probable cause here is a day. And that'll make a little difference judge. It's not going to make you right. That's not the answer. Well, yes, and not just one staff in correct. Right. Yes, right. We're not close to me. We're not close to being able to make a decision of what we're going to do here. I think there's more work that we need to do. And some things that we need to explore before we take action of what we're going to do. What do you need to do, Commissioner? What do you need me to do? I mean, you've done a lot. I mean, it's just we just got options here that we don't need to just jump off. Oh, I mean, you've done a lot. I mean, we've just got options here that we don't need to just jump off. I mean, we've got, we're looking at 168 beds and maybe a mixture of no eggs. And I don't know how you do it. You know, when we built the Joe Carly in a way or whatever it was, in two years we were going to need it. Things happened beyond our control or we didn't need it. Just now it's starting to come back. Yes. For the growth. Of course, where the growth comes crooks. We know that. So, and I don't know how you would say the first one floor is 168 beds. Is that right? Yes. Each floor is 168 is what we're looking at. How far would that carry? If what were two stories do I? I don't know how you do that because you don't know what the county's gonna do And sure if it's the need just for jail beds. I mean are you are you do you have adequate space for all your your personnel? As far as administration. I know we just did a big renovation of the kitchen. Yes I'm one and that's still under construction and but when it's completed, it would be able to service. If we did four floors, would that kitchen still accommodate? Yes. And I'd like to see, and I know we talked about it, but I think we've ever seen thing for, is what the operation cost is going to be. And I guess we could do it per prisoner or per 100 prisoners, whatever. I think in there it is. If you could work something up, fill us for that. We've got it in there. I mean, I mean, it's super badgers. And you have that. What's that amount? It's on the very first page. There's just a hundred six D.A.s that's down there on the bottom. Sowering benefits, one point three, nine. And that's the only expense we have of them. That would be per floor if we did most of them Yes, that would be for floor. And they would have uniforms or would not have any of that stuff. No. See, Commissioner, that's where the CDs come in. If we build a shell, I think we'll have a CD participate and their prisoners, once we build a shell, if in fact we build it. Do you have an idea of, sure municipal prisoners are from different cities around the county? I'll say that again. Yeah, you have an idea. How many chief the number of prisoners are from the cities? Yes, sir. We've got that we've got that number. Of course we put the most in there and We put the most in there and you should have that. I think you estimated in 2012 if we had received revenue from municipalities, it had been in excess of $4.6 million. I mean, I think that's something we have to do. That's not a question of. We put the most. We have an OPD comes in second. And maybe by DS third and then the constables all together. Maybe by doing it we'd encourage City of Conroad to build a jail or four point four point six million bet that why would it depends on how much we charge but I would like I do think we should move on setting aside the 13 million 361 thousand six hundred and thirty one dollars for future jail needs. I do too the joke for the event built to accommodate additional prisoners. We had a windfall from that project and I think we should maintain those dollars for that reason. So what can we do about getting some type of committee together and set down and let's we can make a decision on what we need to do because we're getting in a bind. Well, for one thing, we need to have our Mark Bosma here, our infrastructure director, to help leave that committee sheriff. I would say we should have a committee of you, Mark Bosma, Philus. And maybe one of you commissioners on that committee and Let's do a hard look at whether we do three fours four floors We had to do CO's we commission if we did four floors The balance CO's the balance CEOs. We need to do something about the cities. I agree. I agree. What if that's something that the committee can explore? The committee should go talk to the city. I don't have any people on that. It's not everybody that they bring to that jail house. We go to some of them or county warks and things like like that. I mean there's all kind of thing to consider. Well you all know how it works and we know so you know come up with some number. I mean I don't know I don't know how you do it. I don't know whether it be a percentage of operations. They don't history with just a few. Did you you came up with 26 or did you put this together chief you came up you said 26% of Operation cost for the jail in 2012 were attributable to municipalities, right? The average Number of prisoners that were wrote in by all municipalities which was 26% in 2012 and divided that into our jail budget of 2012 That's where you get your 4.6 million if they were paying their 26% would it be okay it would be and then you know obviously agencies some rest more than others and we just got this obviously now, but Do you have a there a per head fee? I mean, do we is there a daily fee per prisoner or something that Off per daily cost per and in made it $51.67 And then what is the is any if we started to look at fill us with municipalities pay you know in Harris County for example or other counties with the daily fees I've seen 25 but I don't know if that's a we can we can certainly explore that commissioner if we form that committee y'all were discussing we can explore who else charges municipalities in their county and how they calculate that rate, how they come to that rate. Okay, I think to conclude this, I'll make the motion that we form the committee of Mark Bosma, the sheriff, James Novak and Phyllis Martin, the former committee to come up with a recommendation to this commission's court for the future jail expansion. And to hold the balance of that money in escrow or in trust for use for whatever we decided to. Okay. Second that. All in favor, see you. Thank you, Chair. Yes, sir. CDBG. Good morning. Good morning. Please consider and approve upgrading my case manager position from part time to full time effective September 28 This was actually in my budget that you approved during the budget hearings I failed to mention it at the microphone that we were upgrading this position from part time to full time It was listed in the budget documents that you had absolutely no impact on the county. Move. All of the everybody out. Thank you. Much in pass. Thank you, Cesar. Mr. Judge, this here is for the person that does my deliveries every day to my offices in New Cane, the woodlands, and also in Magnolyum. I don't need a salary change on this because a person takes three weeks vacation a year and that's covered by the staff, so it's absorbed into it. This is gonna equate to about $1,300 and is paycheck every two weeks is right at 1,500. So just for clarity, this is actually not a staff member. This is a contractor that delivers for the county. He doesn't receive a paycheck. He is paid through accounts payable because he works at his own discretion. So there's just a little bit of misfin terminology there, but it is under contract. No benefits or anything. So correct. A lot of money by eliminating a full time position going with a contract employee. Start that years ago when John Revis was retiring and then he couldn't see it night as he got older so this person replaced him. You can move to all the ERSA. But most of the past, thank you. Questions? Morning. Good morning. Please consider and approve the early voting locations and times for the November 5, 2013 election. Move. Exactly. All the favor, see out. Also, please consider and if appropriate, take action on consolidating the voting precincts for the November 5 election. Move. That's it. All the favor, see out. Hi. Thank you. for the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the first time in the this legislative session authorize an increase for district court judges. There is a separate statute that says that you have to pay your county court judges within a thousand dollars of which your district court judges make. For the one month of September when that goes into effect the impact to the county is $2,192.54. This includes benefits and I'm asking you to name contingency as a funding source for that. Who? Second. All in favor, Seattle. The next item is the report that we discussed earlier. You did say earlier that you wanted to commit those remaining $13 million, $13.3 million for future jail needs. If y'all would just memorialize that now with motion, I'd appreciate it. So all in favor, Seattle. if y'all would just memorialize that now with motion, I'd appreciate it. So, I'll have a favor to see out. All right. The next item is in regards to some cleanup work with what was done during the budget area. There was approximately 1.6 million, it was actually 1,582, 129. It was approved for some one-time purchases for various departments. What we would like to do is give the departments the authority to spend that money now. We would automatically carry that over into their fiscal 14 budget knowing that most of them won't have time to complete their projects before the end of this fiscal year. If those projects aren't completed by the end of fiscal 14, they would need to come to you to ask for permission to carry it to 15. Move. I fairs here. All right. The last item is in regards to the one-time contribution that you discussed during the budget hearings to the Texas County and District Retirement System. I'm asking you to authorize that in the amount of $1 million. Move, I think this is. And this is 13 million already has that million taken out? Yes, sir. This is already considered in this. I move second. I'm in favor of see-all right. All right. Thank you. You're welcome. Purchasing. Morning, Judge. Commissioner. Good morning. 18A, I would like to present recommendation Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you Second. All in favor, see how? Item number B. Consider and approve the leasing of a mail processing software and equipment and the purchase of a project management training and related miscellaneous items from Pitney Boas through the interlocal agreement with by-board contract in the amount of $84,340. The tax office. Move, say it. All in favor, see how. $84,340 the tax office. Move, say it. Favorite say aye. Okay. Thank you. Yeah, it's going back to that general review for me. I'd like to be on that committee too, as well, if that would be appropriate. Okay. Let's go back to that line item. And I will amend my motion to add Commissioner D'Orl to that jail committee. Second. All my favor, see out. Okay. Motion passes. Tell you attorney. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry, Commissioner, I was just going through five because six is different. Okay, I move one through five. All in favor, sir. In 1986, we're asking the court to approve an assignment of lease with amendment from Greatland Holdings to Northern Aviation Construction. These are both entities that are essentially held by Steve Ratcliffe and the amendment provides for five-year options if he constructs additional hangars at the airport. Move. Thanks. All of a favor, Seattle. 19B is a contract amendment with TCEQ related to the Lyrat program. This will extend the term through 2015 and TCEQ will grant an additional $354,954 to the county. These funds essentially pass through to HGAC who administer as a contract on our behalf. We also need authorization for the judge to sign the agreement and the letter to disperse funds. Move. Second. All in favor. See. I 19 see is a second amendment to the management and operations agreement between the county and geocar. This does two things is knowledge. It acknowledges the change in the entity name from geocar ink to geocar LLC and also includes some minor changes in the insurance provisions due to that transfer. Move. Second. All of the vera say, item 19D is a, we're seeking approval of a temporary employment contract for Michael Huddle. He's one of the part-time temporary contract, I'm sorry, grant employees that work since CDBG. This is a standard template we've used in the past with the exception that increases his pay by 5% at the start of the next fiscal year. Move. So again, all the favors, yeah. In item 19E, we're asking the Court to approve appointment of the airport advisory board members. The resolution is before the court will Essentially reappoint everyone that's on that For now with the exception of the precinct three appointee that will remain vacant until the commissioner can come up with a name for his appointment Daniel are all those positions appointed at the same time well they They've expired so we're reappointing with a stagger on their terms. I move. Second. Commissioners, when do you want to have someone be think? Hopefully by next court. OK, there's motion. Second, all in favor, say aye. All in favor, Sia? Yes. I don't mind. Item 19 F is going to be deferred. Item 19 E, where I send the court to approve transfers of funds and closing a position and opening a position. The transfer will not increase the salary structure. Move. There. salary structure. Move. Second. All the favor say I about that 19 beat. How many people do we help with that low income on vehicle? And by no left? Or do we even do it? HJC administers it. Huh? HJC administers it. Huh? HJC administers it for us Daniel. Do you know how many people I don't know? I believe HAC kind of pulls the money together and then helps people in the region that need the funds. We've talked with them in the past about restricting the funds to apply to Montgomery County citizens first and then if we don't utilize all the funds were granted they could use it in other but we don't know what we have anybody in Montgomery County. I mean I assume we can get reporting from HGAC but I don't I don't have that information. Greg? You know I don't. I don't. I don't know if you all talked about that. I said nothing. Not yet. But I can... The Otters Office has indicated they can get a list and forward it. We could forward to the commissioners in the judge. It's wonderful. An item 19a, right in the court to approve an exception to the park rules, as well as the waiver of the youth fees. So for a benefit fundraiser in Magnolia Park this is for softball tournament that will take place in August. Certainly that's one that the softball association supports through the one of the members. I would move. Second. All in favor, sir. Item 20a1, arresting the court to authorize acceptance of a donation deed. This is for public road in pre-saint 1. Additionally, requesting the court to appoint Mike Meadows, a special commissioner to sign the acceptance of the deed. Move. Second. I'm a favor, sir. Move. Second. All the favour, sayah? Aye. In item 20B1, write in the court to approve a contract for sale of land in pre-saint 2 for $515,000 and appoint BD Griffin as a special commission to accept and sign the documents on behalf of the county. Move. I'll favour, sayah. And in item 20B2, write in the court to approve an interlocal agreement with TC, I'm sorry with a sentence in the river authority regarding a route along Mikaela Brode fish peak thoroughfare and down to Honea, Egypt road. All in favor say aye. Okay, under commissioners, precinct three. Consider and approve the following close 614-8504-1 and open 614-8550-1 and then 2 all in one motion. Consider and approve the transfer of the following amounts 31,847-11 from 614-8504-1 to 614-850-1 and 18,152-89 from 614-4213-501 to 614-850-1. I move. Second. All in favor say aye. Motion passes. Okay, under Article 551.071 and .072, the local government code, let's reset this court for executive session. Do we have any citizens who would like to address commission's court today. Good morning, Judge commissioners. I'm John Baume, Vice President of the Texas Patriots PAC. I was up here last session and last meeting and I talked a little bit about the Joe Corlej jail. I just want to go back and read something that appeared in the 2007 Montgomery County Annual Financial Report under a section titled Long-Term Financing Financial Planning. In court stated the following, quote, recognizing the immediate as well as future need for more bed space in the county jail, commissioners court created the jail financing corporation to raise the funds necessary to construct an 1100 bed detention facility adjacent to these existing jail. The corporation issued $45 million in lease revenue bonds in 2007 and construction is currently underway. Upon completion, the facility will be leased to the county by the corporation to initially house federal inmates under the terms of an intergovernmental agreement with the federal government. Revenues received from housing the federal inmates will in turn be used to retire the outstanding bonds. The county anticipates opening up an estimated 250 beds in existing jail by transferring current federal inmates to the new facility. The point I'd like to make is that the money that was spent by the county, taxpayer money, for this financing was for the jail. Any profit, any money that came back to the county should go to the jail. Now, according to what has been submitted to the court today, the county made $22 million on the sale of the jail, which is great. It could have easily lost money, as fortunately we raised the money. But that money should be set aside entirely for the purpose that it was created. If the money was created by an investment in a jail, it should be set aside to build additional jail space instead of being used for other purposes. Thank you. Thank you, sir. Do we have the citizens that would like to address commissioners court today? Alrighty. Give me resources. Good morning.
