And I wouldn't be in the place we are only about 10 days after being sworn in. If it weren't for the help of a lot of fine people that help run Montgomery County on a daily basis. But I'd like to just, I'd like for if you're here when I call your name and if you'll just stand up just so I can give you a little bit of public praise. Mark Bosman with Infrastructure. Mark and his team of professionals have helped us from day one and making certain that we've had the tools and the resources that we need in South County to continue operations and his help has been invaluable and I believe Mark you're a true asset to Montgomery County and I thank you for your service. Next is Curtis and risk management. Curtis and the entire risk management team have been there to help early on. We went through and had a safety meeting a very first day identified some areas in which we could improve and become more efficient in our operations. And Curtis is a type of employee who was at our recycling facility at 9 o'clock on Saturday morning when I showed up just to make certain that we were following the rules and doing things right so I'd like to thank him in risk management. Next is Doty with HR. Come on, stand up, Doty. If you don't know Doty, you should. Doty is absolutely kind of the crown jewel of Montgomery County. She makes certain that our employees know what they're supposed to do from an HR perspective and she makes certain that we know the guidelines and that we continue to follow them. She was instrumental in helping me get my staff in place just in time to report the work on January 1st and she's been there to answer every question along the way. So people like you really make Montgomery County proud. Building management and Paul Case, those folks have gone above and beyond and making certain that some of the changes that we need to have had implemented right away, we're taking care of, you know, changing of locks, moving some things around him and his entire team have been there every step of the way, and I'm really happy for that. A few more people, Wayne McWin, Castodial, Wayne, you're awesome. You and your team really know how to take care of things. You've got our place cleaned up. It's looking great. And we certainly wouldn't be there without your help today. Marshall and IT, probably called that department more than anybody, just making me and my team knew how to get on the computers and take care of things and The folks that you had out there Tammer and Sean did a fantastic job and I think they're coming back today actually so thanks for all the help Phyllis Martin are a wonderful county auditor I know we've asked you a lot of questions and you've made certain that we're able to get into the finance system Pull the reports that we need to do and you've been just exceedingly helpful every step of the way. And Darloo with purchasing, I wouldn't have these pens if it weren't for you, so you're lucky to get those pens. But Darloo, George, the entire team purchased it has really been fantastic to work with and they've made our operations go smoothly so thanks for what you do. I don't believe he's here today but his name is John Bowman. John Bowman has 40 years experience with the Exxon Mobile Corporation in positions such as Finance Manager. He's been a CFO of several different organizations, Project Finance Manager. He has extensive knowledge in managing, structuring, negotiating, financing, M&A transactions, assets, sales, and turnarounds. Gentlemen is also an attorney here into JD at the University of Wisconsin-Madison. He is a graduate of the New York University School of Business, and he has a BBA from University of Wisconsin- Wisconsin Madison. I don't think we're going to find anybody with a more impeccable resume to help promote and make certain that we have and we are taking care of the serious needs of the water issues that we face in Montgomery County and with all due respect I'd like to have him considered to replace Mr. Tram as the next board member for Lonesaw Conservation District. I think what we did in our last meeting where we named two county buildings after retired judges after various things careers was very appropriate. But I'm not opposed to putting a five member committee together to look at that further. Judge and Commissioner, I too would support putting together a committee to make certain that when we name our facilities that's done so in a proper fashion. One of the things I'd like to give consideration to is making certain that we consider naming our buildings, parks, highways or roadways after veterans, war heroes, and our fallen brave who don't make it home. I know in the past we've named facilities after living members of the public. And being that I was living in Cinco Ranch when the Kenlay YMCA was in existence. And we had to go out there and peel Kenlay off the name of the sign. I would just caution us from naming facilities after the living. We just never know how that's going to end up turning out. But I don't know that there's a to end up turning out but I don't know that there's a better way to honor our veterans our police officers and our firemen it may die in the line of duty than by naming the public facility after them so I'd like to strongly consider that be the policy that's adopted from Montgomery County. One of the things I'd like to see is that the next Board of Judges meeting, the Board of Judges, starts to put together a plan for what they'd like to see as far as courtroom security and have the sheriff definitely as part of that so we can make certain that from a security and safety standpoint that our judges and personnel are and is a secure environment as they can be especially knowing some of the things that they're handling in these courts. I'll address the judges in reference to that so they can maybe present something to the courts or. Do we have an estimate on what the amount of the bailiffs? I don't have that information. Mark, wouldn't there actually be three bailiffs because they just approved another A.J. to begin January 1st? Who's that A.J.? Judge of the Donalds. No, she's out in Judge Atkins. She's, yeah, I'm already counting that one just had the two judges and need to be covered right now. McDonald is the one that she just appointed Amy and she's already started that's the one I'm counting that one in Gilbert's. And what about the AJ Jimmy go? But one of the things I'd like to address is I was in attendance during a budget hearings and I know that we were planning for these associate judges to be in place. And one of the things that I want everybody in Montgomery County to do going forward is to consider these types of requests as we're going through the budget process as to not lean on contingency unnecessarily. I think this should have been addressed during the budget hearings. And this would be for all department heads and all elected officials. I think we need to do a much better job in the planning process. And Miss Martin, one of the things I'd like your office to provide me is a breakdown since one or ten one of this 2012 until now. How many times have we gone to contingency by department and for how much funds? Because that'll help, that's a tool that I can use to better address budgeting and planning with department heads in like a phase. Or are these positions requested during budget hearing? Commissioner, I have a couple of questions just on the Montgomery County Mental Health Treatment Facility and forgive me I'm new I'm just learning the rules but I'm curious is to how the data is compiled and who generates this specific report. Linda, would you address that please? Can you step up to the microphone? The performance indicator report is the report that's put together monthly by the operator, GeoCare, and corporate itated, as part of their contract with Montgomery County. They are the ones who collect the data. They're the ones who analyze the data. They interpret the data. They present it in a written format each month to the Montgomery County Mental Health Treatment Facility Advisory Board. If the seven member board, that board goes through each one of the tabs are up to 48 different types in the report that measure different performance indicators. There are performance indicators that have state expectation levels with them and we meet our exceed each one of those when compared against the eight state-owned mental health hospitals. Very good, very good. Has the current county attorney or has the county attorney in the past had the ability or the have they reviewed the contract between Montgomery County and the Department of State Health Services and does this report comply with those terms? The contract, the contract compliance, the performance indicator report is part of what's required in that particular contract. And that contract has been reviewing county attorney's office. County attorney was instrumental in working with Andrew's card, which is the outside attorney selected by the Governor of County for that project. Okay, very good and JD if you could just When you have a moment if you will just re-review that contract and just make certainly you're comfortable with the content and Forceability the contract and if there are any changes that you'd recommend it'd be nice to hear them And then last thing is I'd just like to see a copy of this contract in my office as well. What was put together as far as how we would handle monitoring or screening and management of the Metaballoc syndrome and I was curious. One, do we have a dietician on site at the mental health. If you do, you have a registered dietician part of the required family level that is true about the pharmaceutical health service. Perfect. And then I was further reading on on page two when they discussed if a patient does present symptoms of this metabolic syndrome that it may be practice for them to switch medications. And I'm assuming that would be moving when you're talking about atypical antipsythiotics and weight gain that you would go from a higher, for example, Closopene has a higher characteristic for weight gain than the President and so they would try to move the patient from one of these drugs to another as part of that process. Dr. Barbara Moore as facility working with the data station as well as the head of the service. Very good. Now, the Dr. Moore put this together. I see that it was approved by Richard Kwam that has- The law is that the facility administrator is making a policy required as the facility administrator to approve anything that G.O.K. or Hopper's students. Dr. Moore would have worked with Kim and with Frank Lima, who is the Director of Food Service. Okay, perfect. And then the, so is this put together by the physician by Dr, I mean by Robert Plum, who put this report together for us? That hall of the is developed by G.O. Care and corporate, by multiple people on their management staff would have included Dr. Moore, Mr. Lane, Bob Huang, Denise Valentine, the performance improvement coordinator, Amrith Manager, Jeff Rose, who is the business facility administrator, as well as corporate individuals who have received their operation. Very good, obviously I'm not a physician, but I did spend a significant amount of time doing some research on this particular syndrome as well as how facilities typically manage this type of care. It seems, based on my cursory review, that most things have been addressed except the cessation of smoking. It's recommended by the Mayo Clinic as well as the American Journal of Managed Care. The patients are counseled and that they are given aid to stop smoking. That it is a significant portion of this treatment and it seems to be absent from this. Given the special means of population in the mental health treatment facility, that particular eye of the smothered is in there. There's times due to the recommendation of the medical inspector. Do they smoke in that facility? No. I mean can they smoke outside? If a patient's allowed to smoke in their diagnosed with this metabolic syndrome, I would be interested to see if that could be incorporated into this. We can take that just to back to the medical center. And then Mr. Lambrite, anytime that we we I see that there is a management plan that has been put into place regarding this facility and anytime we make changes to that plan I would like for your office to have the opportunity to review that and weigh in. We are currently charging the same amount as we are for black and white, but they cost us more. We also don't want to compete with, because it's really a convenience thing with our color. Judging on the court to consider an approved interlocal agreement with the city of Conroe. This is for the extension of the league line road The contract provides for a 50 50 split on cost of the project and After completion the city will maintain the entire road. Move. Second. The court authorized retention of this firm as outside counsel in 2011. And in the past, the court has paid these invoices from contingency. Mr. Lambrite I believe we paid somewhere around $300,000 so far to this firm for Texcom. Then he has prevented the firm out of all still and that are a big water and contracted with them. The next conversation, which I've told over about six years now, I have met with the attorney that Dan met back at our tender hearings and also a couple of months ago. And so just so we have an idea, we look at that just a little bit under 300,000. Everything I've seen, I think, is doing a very fine professional job. Is there something you look to continue? Yes, and how it is about, and David Walker is just letting the past, and I thought to leave this litigation, there was really no way to know how long it's going to be going on. A piece of it is tied up in the quarter of the field in Austin, and then they know that really is the fact that they have just a short amount of stuff. And this way, this is going to go over the years. If when you're preparing your 2014 fiscal year and budget if you could include a line item for costs such as this, it would move and have to go to contingency to pay for it. I won't name all of them, but virtually every person that James Novak recognized earlier around the county has done an exemplary job making the transition but from David Walker and I it's smooth as possible and I really recognize and applaud all the people for doing it throughout the county and all those departments. Secondly I also would like to recognize the employees in the county attorney's office. Everybody has chipped in. Some people are doing double duty because we're trying to train some people so we got backups in every area and we've had people jump in go to court and be a backup for somebody else and I really applaud the staff for their efforts in that regard. On the specific item on the agenda we're asking the court to consider and approve the following transfer of funds and these are associated with two new attorneys that are coming on board today. The first one is the in the amount of $3,289.53 removing that from position 7905-527905-2. And the second one in the amount of $9,079.96. That's also being moved from 7905-5 into 7904-2. This is just for restructuring in your office. These are just staff salaries that are being moved over to accommodate the two new people. She's a former associate judge in a family court in Harris County. She had several years in the county attorneys office for Harris County. Dealing a lot with CPS cases and other types of cases. She's also spent years in the District Attorney's Office in Harris County. And also, most notably, I think, are certainly notably five years in the Office of General Counsel for CPS. She lectures all over the state, legal seminars, and is a true expert in CPS matters, as well as many, many other matters. I think she's handled somewhere 100, 200 appeals herself. So we welcome her aboard today and she's essentially replacing Amy Atkinson who was promoted to Associate Judge but we will be expanding her duties as well to other arenas. Great welcome. And then we also I don't think they're in the court. Is it Stewart here this morning? Yeah one of these uplands for Stewart. He's Stewart is about a nine year lawyer that's coming on board in the county. Turn his office today. Gonna be a strong component of our litigation section, which we are committed to beefing up. Stewart is also highly regarded among the judges and the legal community here. He's in practice in Montgomery County. Also in Walker County, Stewart has an excess of 75 jury trials under his belt. That will be a strong addition to our litigation section. We also brought in, they're not here in the courtroom today, two very top notch parol leaders who between them have more than 40 years combined experience. They have both hit the ground running and just doing a tremendous job. I flat all the current staff in the county attorney's office and we welcome these new additions. Thank you very much. Consider discussing if appropriate, take action on a request at the county attorney's office review and recommend changes to the management advisory services contract that was approved in Commissioner's Court on December 3, 2012. Reference purchase order number twenty thirteen twelve nine vendor Linda Brazil. Commissioners and judge, I believe all contracts such as this should be reviewed by the county attorney's office. This original contract date is from 2007 when it was resubmitted December 12 or December 2012 terms and conditions were to remain the same. There are certain terms and conditions that I think need to be addressed. And number one, one of the very first things under services provided by Linda Brazil are assist county and completing the orderly transition between chief financial officers. At this time, I would expect that the transition has occurred and that is no longer needed in this contract. Number C, assist county and compliance regulations related to proper accounting for components of units of the county. I would think that our county auditor would be fully capable of taking on that responsibility herself. Number F, assist county and analyzing the expenditure of funds associated with general operations. Again, I think that's a function that the auditor can handle and should be removed from this contract. JD, obviously, when you're reviewing this, you'll be able to make those recommendations. There's just a couple of other things in here. I have no problem with Montgomery County entering into agreements with consultants to make certain that the needs of the county are taken care of. I just want to make certain that the contracts are, they stipulate the scope of work and services to be provided. I also have a couple of questions just about the blanket hold harmless agreement that seems to be in place JD if you could take a look at that when you review. I would also like to see a provision added to make certain that when consultants are doing business with Montgomery County that they have professional liability insurance to help protect the county. Don't believe that that is in place today, perhaps it is. And I think we should strongly consider a maximum number of hours per week and a total maximum compensation that would be paid on annual basis that way we can better budget for these types of things. Other than that, Mr. Brazil, thank you for the services that you provide to Montgomery County. I understand that you've been a real asset and look forward to working with you under a new contract. I think many time a county attorney wants to review a contract that certainly does not require court action. And there's a few things Commissioner has talked about. One thing, limiting hours, we never know from your Vermont. What's going to come up on this contract, contract spending for for what six years now. It's been reviewed. It's served obviously Linda provides a very important service that we've gone on that's connected to a huge investment. Her, her, the job that she does for us is certainly needed and required to take this project to some kind of exit strategy that we've got for a couple years, but her expertise is certainly needed to get us through this process. Obviously, J.D. can review any contract he wants to, but at this time I certainly wouldn't recommend he changes to it. Well, Mr. Metter, I'd read most of your statements, but the contract is outdated somewhat. It does refer to a lot of pure accounting auditor functions. Well, he can certainly review that, make recommendations and court revoke. That's what I'm saying. Let's let's have him review it and take those pure auditor or county functions out. We don't need those in there. That's going to be his his decision is what he recommends to the county if any changes to Mr. Brazil's contract. I don't think we should direct him what changes he needs to make. I think I need to be his I've had no problem with that. And I don't think he needs court action to review a contract. I understand Mr. Nox concerned about the way he has interpreted the items that appear in my contract as to what I'm supposed to do for Montgomery County. Those items that he has read, numbers one through four, all say that I will assist the county in accomplishing certain things. There was a transition period at last in about six to nine months. Once that transition period was over, I was in the middle of the Montgomery County, the Joe Corley detention facility development. That has nothing to do with accounting. That has nothing to do with county auditor's function. That was project development. Once that development was completed and we went into contract negotiation, that again not being any part of the county auditor's job. No, but I do think that for you to say that it has nothing to do with the county, it's the taxpayers that are on the hook for the go-forter. I'm a spoke if I'm sick of that. Okay, yes. That's one of the points out now. After that, we went on to page three under the item six, which is additional services, where you may ask me to perform additional services in addition to what's in paragraph one and I would then be appropriate to negotiate with you. I was approached by the commission's court specifically by Commissioner Metter and Commissioner Chance to ask me to work on the development of the mental health treatment facility. That's the primary thing I work on now. That again, development of a project, negotiation of contracts, and compliance with respect to oversight for purposes of regulatory items, whether it be federal state or now our local, those are outside the purview and the authority of the county auditor as the statute's declining. That's the work I do. So it might be helpful if I have a discussion with the county attorney so that he understands exactly what I do from a county. Absolutely. And then we can stipulate that in the contract. What's, ma'am, I'm still speaking to you. That way we can stipulate that in your contract. My name is Matt McCrary. I'm the State Director of Dixie Boys Baseball. And I'm on behalf of the very concerned citizens of the town of Spurendora. Let me just start out by thanking a couple of individuals, Mr. Red, Ryan Hart, the county attorneys office, Mr. JD Landbride and Ms. Lloyd Stafford with the Montgomery County Parks and Rex Department. For the past few months, their offices have been working long hours to resolve a concern of the citizens, us, one more, and the safety of our children. Unlike ALSA, Dixie, Little League, Pony, and most of your youth organization, USFA, the United States Fast Pets Association does not require their empires to submit to a criminal background check. USFA is a youth organization that's swimmed or allows to host tournaments at the county park that's swimmed or I realize that the county does not get involved in local league matters however. If you examine the documents that I've supplied you will see that this individual who has been the chosen empires and squendor for several years should not be allowed to be around our children. These documents alone should be reason enough of county commission's court to make it mandatory that all empires coaxes managers, their members dug out moms, volunteers or anyone in contact with our children submit to NCIC criminal background check. The county attorney has had to get involved in this matter to rewrite the entire lease agreement because the actions of this one individual. All the other local leagues in the Montgomery County have been forced to miss work and meet with the county attorney and the parking rights departments. They have a new lease agreements. They explain because of this one individual. Our courts said that the county attorney, the parking rights department, the citizens of Swimlor, and all the other local leagues would agree that this should be placed on the agenda as soon as possible. What have this individual had been a child molester? How do we know that USFA on-pire Swindleville was boarded directors a lot of unpower around our children or not, escape convicts, race mischild molesters or God knows what? Therefore I am the man he did this County Commission's Court placed a concerns on their agenda soon as possible. And as a concerned citizen, I would hope that this would pass unanimously. Okay, I've got a question. You know, where do you draw the line? Okay, I've got a question. You know, where do you draw the line? Understand if you're a child molester a sexual Deviant or whatever this person should not be around kids But what about a criminal that it has served his time that has unrelated defense? That's right. I bet the thing is is there's no criminal background check done whatsoever. They don't let overcromb her to submit to anything. They could be anything. They could be anything. Back I'm I've coached at Orwell for years and prior to that Katie American as well as YMCA and And where you're coming from I'm a little bit confused. I would I know at Orwell and Russ soccer. This is already in place Why is it in coming upon the court to mandate this why can you mandate this as a director of the league? Well, what did he as state director for Dixie it is mandated and Dixie but swim there as saltball so she is and does Well, Dixie has state director for Dixie. It is mandated. And Dixie. But Swendor is softball association. That's a play Dixie. They play USFA, which is like, it's like it's in an organization like Little League, Tony, ASA. In any time you, you, you do softball or baseball. All you do is change one rule or add a couple of things and you can come up with your own name. Dixie, ASA, Lilly, Pony, Connie, Mac, Utrep, anybody you name is mandated that you submit to a criminal history background check as far as Dixie goes. If there's a appeal process, you submit to it and as long as there's a appeal process you know you submit to it and uh... as long as nothing you know we served as time it's something that he did a long time ago it's not an issue but what if there then we know what's what's to face with because as big officials wind up in court a lot you know uh or having to go ahead. Is the Splendour a girl softball? Are they refusing to fight by this? I don't know. I've been to their board one time about a situation. It wasn't greeted very well. So I have spoken to their ex-president, which is now their vice president about this situation, about this individual many years ago. Face to face, I told him, you know, that there's not a good deal, that the guy, I mean, the guy's not a good guy. And you see in that letter, I stated the conversation I had with him. And, you know, I'm not here to judge anybody. I'm not, that's not my job. I mean, we're all seeing, we're all consulting glory guy. You know, my point is that there's nothing in place for any county part to say, okay, if they don't do it, we are going to mandate you that, now the coaches in Spendora, they have submitted to a background check. Because they were, they got a certification through ASA. And then they switched from ASA to USFA to host tournaments. And then this one is one of the problem arises when this individual refused to submit to an ASA criminal background check we asked him for two years he's never done it and when he didn't do it then I got curious and people started getting curious and asking me because I've been in the community doing this for about 23 years. And so I did it. I did a criminal background check on him. And this is what I found out. And I'm not saying that he shouldn't be unpired or whatever. All I'm saying is, how do we know that some other guys or ladies that are there aren't something wrong with him I've really, I mean they're not employees of the county though. They're representing the league or they're associated with your league and that's where that should fall. I agree. I mean I don't want it to ever have to get to this commissioners court to say this guy's not qualified because of this. Right. We're not set up to be that kind of a governing body. I know, yes sir. All I'm saying is that I believe that the county commissioners court does have the authority to say all your own powers and individuals will submit to a background check. That's all I'm asking. We can head that in our release agreement, mandate that in our release agreements. And who's going to review it? It's the question. Well, that's up to the lead. Back to the lead. Yeah, it's the lead issue. It's the lead issue. Yeah. It should never come to the commission. I feel I understand what you say. Believe me, I do. But, I mean, there are things we can't do. I feel like that's one of the things that we don't do. I can barely hear you. I had to take my hair and age off. My two-blow-on in there. What did you say? What did you say? I don't disagree with your issues. I mean, I certainly know there are some bad guys out there and it's hard to keep track of them, but some things we can do, some things we can't. And I think that's one thing that we can do. You can't put it in the lease agreement that to make it mandatory for background checks? I don't know that we're good. That's something our new county attorney could look at. In JD, if we did, I mean, we start to stipulate these types of provisions and then what you know it then is it on the county to have people we do that exactly the county's gonna have to start you know enforcing this and I'm not prepared to I mean I don't want bad guys up by our children don't get me wrong but I'm not sure that this is the right venue. Mayor Mayer may not be where we met on this just last week. I haven't been to this gym in the year, but I'm aware of your concerns. Daniel Jones, some of the judges staff, as well as a member from all the college, was office looking at this in even a broader sense as well, is some substantial amount of money as a big main private enterprise using county facilities. It's part of this whole thing we're trying to look at and do it and go and request a you to take a look at this whole whole habit and just go there. You all are in the process of reviewing all these questions, right? Yes, sir. Yes, yes, that is correct. And then what was he doing? Somebody doesn't sit here. Yeah, you got some high mobility. Exactly. And it looks like, well, all I was going to say is it had this been in place, this individual that I'm here today, this will never happen. And I just, you know, I had a lot of people ask me to come, because I got a lot of contacts, a lot of people call me. Well, let us add this to the list of the things that I can't eternity already doing, the connection with the baseball field leases, we're in the very middle of that right now. They had an hour and a half meeting last week. Right. Let us check into what it would take to add that to it. We just cannot be into an enforcement mode. This court cannot ever be in the enforcement mode on something like this. But who's authorized to do a background check? If they were county employees, if they were county employees, if they're not, they're not there associating with the lead. I thought that's against the law if you're done a background check. I don't know. I don't know. Brian you're here. No. There's a they sign a forum when they sign up for them every time I go criminal hangry background checks going to be done. It's just a simple form that you sign saying there's got in the in the swindler or football basketball baseball and outside anybody to even clean the gym in swindler does a criminal history background check okay all right thank you sir thank you all righty next we have mr. Jerry Hester Mr. Jerry Hester. Mr. Hester, thanks for coming before the court today. Mr. Hester to go ahead and come up to the court and explain his thoughts behind his letter. Thank you for coming. Thank you for your introduction. Before I get stored here I need to tell you and apologize to you. I'm coming in from a head cold in my old vocal cords kind of like the old gray marital not you what they used to be So if all of a sudden you see my lips move in and I'm not talking while you know why but anyway as James said here nor as I'm I'm the person who wrote you that letter about the concern about the increase in the you that letter about the concern about the increase in the border alarm annual fees. And I know probably some have asked, well, North flies all the bus over a few dollars. As he said, the mathematical fact of this is that it is a 400 percent increase at one time. And gentlemen, I would like to ask that you on this matter and any matter in the future that you remember that a few dollars for some is all they have and for others and they don't even have that. But the main reason my concern is the double taxation effect that this action does and also, in other words, why me as a being picked out as a ticker group, a person simply because I have an alarm in my home and I now want to have to pay for the abuses of others beyond what I already pay through the tax system. So that is the concern that I've got there and because to me, in order to law enforcement protection as funded through the county taxes is for everyone whether the call is made by a phone alarm system or whatever. As stated, in my letter, it appears that the cost of running false alarms is what the concern is about. I did receive from Mr. Moore some additional information that I did not receive in my original document that I got, showing how the calculations on our further calculations on the development this. But even that kind of raised more concern because I looked at it and I don't know whether it is correctly shown in the calculations that it takes 30 minutes to an hour to clear a false alarm call. There was once a person that all the rives there that it takes 30 minutes to an hour to clear that call. I guess, Sheriff, maybe can answer this for me, but unless procedures have changed since I was worked with the police, nor it's if a officer made the scene of a call and it was not valid, they cleared the call and found it and got into service immediately. So there was not any 30 minutes to an hour's time that was involved in these calculations here. But as to the cost coming back in when I was considering back into the double taxation so forth and what it's kind of appearing that the increase on the presentation of these is that it is an additional cost that needs to be funded. It's not an additional cost, gentlemen, in other words, you've got the law enforcement, and I'll just use law enforcement itself as far as the cost involved there, you've got the fixed and overhead cost for a lock and ulcerer on the street, what out there. His total cost, no matter what he's doing out there, is there. What I see is just a reallocation if there is of that cost. You've got the salary, you've got the vehicle, you've got the gas for him being on the streets for his entire working period. Now he included in that maybe running false alarms. That's just part of the cost factor in there. What I see happening here, Jim, is basically if you want to call it creative accounting, that you now come along and identify identified this particular cost segment in here because it comes back and say, well, why should everyone out here have to pay for running false of warms simply because they are responding to this type of a communication calling you for assistance help or whatever even though they may be false. To me, it's just like the phone call coming in from numerous people or whatever, calling in for suspicious persons or vehicles. The officer gets out there. It's a yard worker, a meter reader, whatever. Meaning that's taking up time for that officer from other duties. But what I see is for the creative kind of year, you come along and said, okay, for you people who now have an alarm in your home, no matter you have no problem, and probably the sheriff was put on my address, seven, see what my history is. But I think he can testify that I have not had an alarm at my home for nearly years. And the reason why my previous alarm was, Lord my house got struck by lightning and I had some faulty sensors. I had to get those replaced, but I was getting some alarms during that day period of time. And I can understand which requires you that everybody have to pay for these things. But as I stated in my letter, your alarm audience is set up for those who have numerous false alarms to then come along and penalize them. But what you're doing here, if you're not going to long on this segment of time here, you pull this out now, move it over, and put it in a revenue basis. There were now all of these false alarms I have to pay for, simply because I have a phone alarm in my house. That's not going to be revenue coming back into the court. That's not going to reduce your expenditures for that particular law enforcement segment. Mr. Hester, I, and Sheriff, you can correct me if I'm wrong, but I believe that there's a substantial portion of time just incurred with keeping up with who has an alarm and who doesn't. And some of this is administrative fees. I think how this was presented, perhaps, is somewhat confusing. I believe some of that increase is to help offset the additional costs. We have many more alarm permits coming in. I don't think that alarm permit fee had been raised in years. I mean, I don't recall the last time and salaries have increased. The number of permits have increased. I understand what you're saying as far as, well, why can't we penalize those who are violating this and that are raising the rate across the board? And that's the conversation I'm happy to have with Mr. Moore to kind of learn a little bit more about how he came up with this. But based on some preliminary conversations I've had, I do believe that part of that increase is just because it's been such a long time since we've increased the fee for the alarm permit in general, and that it is more in line with other municipalities and counties. I certainly want to be very conscious of any decisions that we make to increase taxes and off the cuff of 400 percent increase, obviously, sounds extraordinary. But I also know that the sheriff and his men and women are spending an inordinate amount of time chasing down alarms when they could be providing other services. And I'm happy to talk with J.R. more in the sheriff and see if you know how this came about and you know if there's a way to tweak it to make this program more effective. I don't think anybody's opposed to trying to make certain that we do the right thing and is efficiently and in a cost effective manner. Okay, let's move on gentlemen. We are running late today. All right, that's basically it other than the fact that I would go ahead and add this to the maybe the county's attorney's area to review, but coming back to the Texas law, concerning the alarm, ordinances, and fees and so forth. We're looking at the Texas law to be sure because under their mode as far as these fees, it states in the law that the annual fee is to be used for administrative fees. And as under J.R. Moore's phone numbers for the current fee, more than pays for those administrative charges under the budget. We will look at that. And also if you would, there's a provision in the law that they leave kind of big, they say if false norms are permitted, that gives the indication that maybe the law Will provide or allow you to charge immediately for false alarms And if you can do that anybody who has a false alarm charge them don't charge everybody who has an alarm in their house Bill Sullivan signed up. I talked about what's 23B2, which was the officials that have stepped stepping down on how you monitor the expenditures and the last period of the term. I thank you very much for that. I think that's very wise. The second thing was I was also up here to talk about Ms. Bajille's contract. I have a second part of that. Now when I've spoken here previously I was led to believe that she initially was working when she was the order this was a function of her job and then she left and she took out a consultancy. Now my question here is we're entering seventh year. Is there a plan for succession or you're just going to hire consultants to do this forever when it was a function within the orders of offices there? Shouldn't have a plan to repatriate it there? Sir, we're not in position today to talk about long-term planning in this part of the agenda. Okay. Just a thing that you should think about because this has been going on for a while, and it was something in the order of the department. The third thing I went down, so I'm in Zemartin, when we were talking about CO's Stifiquette's Obligation, and she showed me where in the detailed report they were listed. And I asked, and she pointed it out to me, and I asked her, which job is that? You know, which road building or whichever. And she said, well, we don't assign anything to that. So I have a question. Is this, isn't there an obligation if you, and I'm not talking about a moral obligation, I'm talking about a legal obligation, that if you have a road project for which you pass a certificate of obligation, you have, can you spend that money on anything? What Mr. Sullivan is referring to is in past certificates of obligation or road bonds even whenever you issue that road bond for road improvement projects in the county. You can use that for any road improvement project in the county. You don't have to necessarily say it's for exactly $1 million for League Line Road Commissioner Meta or exactly $600,000 for some of the connectors that are going on right now in precinct or or exactly how much money for the extension of Woodlands Parkway. Do I have that? Yeah, that's where I was getting it. And what one project runs under budget that difference can be used to fund a different project that might run over. But it still has to be spent on road projects. Road projects, right? You can. That's what we did that. Okay, and my concern is, can I get the burden to something else, other than an over-under? I understand something there, but if I come out and say I want to do a certain thing to this road, and that never happens, because I put it over here. Then your reason for borrowing, I mean I know the judge had one particular objection to one particular project and he recused himself but also aligned himself with a no. And I know a lot of the things about the rejection of the bond issue for the roads was the uncertainty of it all. It seemed to be like, quotes a slash fund. Now, that's a harsh word, but what I'm saying is that people don't mind spending money on things they know they need. And I have no objection to that. You delineate it. You dedicate it to that, and that's what it goes for. And if you want to do something with an over and under, I don't have a problem with that. But I think that if you have something you can't totally divert it from one project to another, particularly when we talk about you bond for specific purposes. So that's what I would like to say. But mainly I just came out today to thank each of you for what you do for our community, for what you do for the county. I just want to let you know a little bit about our organization. We're currently in the process of starting our 2013 Spring Softball season. We have registered about 230 girls this so far. We're going to register through the end of the week. When our organization started Commissioner Rindhart challenged us to make it affordable. And I'm here to tell you I'm proud of the fact that we provide softball for the girls in our area for cheaper. I think that anybody else in the county, probably anybody else in the state, can I ask what that rate is? I'm 60 dollars. No, that's great. So, and even if that, if they still can't afford that or if they still need something, we provide scholarships for anybody that comes forward. Any kid in our community that wants to place off all, we make it happen. And that takes a team effort. It takes a team effort on the many volunteers. You got coaches, team moms, countless hours given to these girls. It takes team effort by sponsors that step forward and promote and help us financially and it takes the county. If we didn't have a part to play in there's no way to place off law. So I just want to say thank you each of you for what you do for us to go in I guess to and now this is a little off-screen. But to address Mr. McCrary approaches us back in September, we have an annual board meeting every year. It's a board of volunteers. We are reelected every, well, we serve two year terms. So it's a public election at a public meeting that we post months ahead of time, but we do it September every year so everybody understands when it's going to happen. And he addressed his concerns to us and we went back and had a meeting and we said look we need to really look at what we're doing as far as our umpires. We've already had background checks and process for all of our volunteers, for our coaches, our team moms, anybody's on the field we already had that in place. We did overlook the umpires. They're in a different role because they're not alone with kids, everybody, their eyes are on them, but that being said, it still needs to happen. Does the umpire association have any? Yes, and basically we adopted a policy to say we will recognize any other umpire association because our concern was kind of like the same discussion you get into. Where do you draw the line? If somebody did something 40 years ago, do you still not let them? I mean, and obviously there's a clear, if it happened with the child, there's a clear distinction there. But you know, I mean, when people are young, they sometimes they do stupid things. And if they paid their debt to the society, how long do you hold them accountable to it? With that being said, what policy we adopted was there are several associations, and basically we said we will adopt or we will see proof that every umpire has an approved background check through and there's multiple Dixies one, ACEs, ASA certification, there's multiple Texas Association and SouthBall officiators. So basically we said we'll recognize any of those. Okay, we're not going to get into the to the nitty gritty of it. So that is our current policy. We've met with Daniel as far as the other concerns, and I'm sure we'll continue to meet with him as we work through it. And I'm just, if you have any concerns, I've been a resident of Montgomery County from my entire life. I was always involved as a kid, and I continue my involvement. I was recently elected to school board there at Splendora. My reputation I stand by. Our kids I've got one daughter that just moved out of league ball and I've got two others that won the start this year and one hasn't even began. So the reputation of our league means a lot to me. It's my kids out there. It's the other board members kids. They're safety obviously is our utmost importance So if there are any concerns We'll be happy to address them. So great. Each year we've, and sometimes we, I think we've had some off year. Sometimes we've kind of saved up our funds. Our most recent improvement, and we matched, we took what funds we have, and then we obtained the East Montgomery County Improvement District grant. We just built a $90,000 playground. It's 26-foot tall. I mean, the kids love it. The kids enjoy it. Prior to that, we built the pavilion. And prior to that, we've added some bad encages. And we want to continue to make those improvements. One of our goals is to kind of work with Commissioner Reinhardt and get us a long term as far as what we want to part to look like not next year but 10 years from now. And then break that down so we can actually so it's master plan to not just piecemeal plan. We want to work with you on that and that way we can apply our funds you know one small project at a time to obtain the greater project. Thank you, thank you, Commissioner. Thank you, sir. My name is John Merch, Montgomery County Tea Party. I think there are a couple of things that were addressed before in regards to citizens speaking before the agenda items are discussed. I'd like to make two requests. Yes sir. I believe there's a 72 hour requirement prior to the meeting to post the minute meetings which was done but it includes a weekend. I'd like to request that it exclude the weekend and it'd be 72 at a minimum 72 business hours before. So instead of posting Friday morning, maybe move it up to Wednesday morning. That would be very, very, that would be very difficult. So it would be very difficult. We have a, we deal with 52 different departments trying to get every agenda item tabulated put together with backup material Starting on Monday. That's when we start the agenda process and we have a hard time getting that even done by Friday It by Friday 9 30 It would be impossible to get that done on Wednesday. First, it will be impossible. And the second request is, instead of, and I think this was brought up to the commissioners court before in previous meeting and allowing citizens to speak before the agenda items are spoken to by the commissioners Court. I'd like to suggest that you have citizens address each item as they come up if they have something to talk about for that specific item. Well, for it's voted on. In general, I have no problem with that. But this is considered an open meeting not a public meeting I mean not a public meeting meeting this is not a workshop This is a meeting open to the public If you want to address something prior to a vote you're welcome to come ask any one of the commissioners on this bench to be sure and allow that. We will honor that request. Absolutely, John. If you have something that you want to discuss at the time, you know, before we take action, I think we can just move that up. Absolutely. At that time and take care of it. And we do, we have. Yeah. Because often, if you, you know, the time that this is posted, there's not much time to do research on it. And single-handedly, he did away with the red light cameras down there in Houston. I was against his position, but he's a great lawyer. Great guy. I want to just say something about Mr. Lambrite's travails, his problems. I want to just tell you. I don't know the full story of that, but this is a good man in my opinion. Noting for some time, as you know, I was for Phyllis Phyllis, but let me tell you, we've all been through these grievances and the hardest thing for a lawyer, a good lawyer with integrity to face. I've been through it and I just want to hear you out. I think we wish you well, Mr. Lambride, are you still here? Well, I know you told me you'd be here to hear my comments about you. That won't, but so let's wait on that. But this is hard, I know it's hard. When you're in the press and you've got people, so just, and I want to mention something about this little league or these children's sports and this business about child sex, I don't like to use the word perverts, the lesters or whatever. But I'm telling you, I've been a criminal defense lawyer and I'll tell you, and I admit I've got a bias. But for people that are accused like these people are, the stereotype against these people is really very pervasive and very unfortunate. I'm glad you all brought a little order to this thing. The discussion was less way here. We don't, but this hysteria that gets up when somebody like that is accused. And I don't like this. Stereo, I was on a grand jury last year in Houston. I'm on Montgomery County, and I may run for your position, Judge Sadler. But let me tell you, with that getting in particular, is on that grand jury. I'm telling you, the against these cases where it was just even come up that somebody had done something with the kid and jeez and one more thing about that I was in this little league and for 10 years I work with the guy we set up these leagues there. Well it was almost five or ten years. And I'll just call it Jerry. But Jerry and I were in this league together. We had no idea that he was involved with the kids, the boys. And my wife and I knew that something was wrong, but my wife always loved my strong with me, but she says something's wrong with Jerry. Well there was this pretty woman in a, I mean, just a voluptuous woman and she had this son and he was always, Jerry was always going over to her house and we thought he was going to see her. Well, it was, that he was going to see this boy Well, it was that he was going to see this boy and after a while, front page story came out that all these years he had been doing this. And the background checks would never have gotten him. Walter, Ms. Turner, are you a psychologist or psychiatrist? Because I'm questioning your prescription writing. This is absolutely unrelated. I'm really interested in that. No patient of yours. I started over to another psychologist, but she named Cheryl, but Cheryl's only got a master's. And she's a doctor. And as you view, and I'm from the libertarian wing of the Tea Party, not that God thing, that I don't have anything against God, but he, right?
