Okay, let's bring the court order, please. Let's stand for the opening prayer and the pledge of allegiance. We need to follow the here for the prayer this morning. Sure, Judge. I'm most grateful to have followed. We're thankful for this beautiful day. We're thankful for all the blessings that you have bestowed upon each one of us. We asked that you bless this country. We asked that you watch over our troops. People say, bring them home. We asked that you be with this court and they make decisions for this county. That the decision they make be pleasing to you. Most of all, we ask that you forgive us for versing at all these things we ask in Jesus name. Amen. Amen. I pledge allegiance to the United States of America and to the Republic for which it stands one nation under garlic, indivisible, with liberty and justice for all. for the record all members of the court are present. We need a motion. We need to begin the police. Second. All my favor? See? Uh-huh. We have several resolutions. We're going to the County Employees Committee. Good morning, Judge. Commissioners. Good morning, Judge, commissioners. Morning. Morning. I'm here to request a two-hour lunch for our Christmas luncheon as we normally do. And that'll be Tuesday, December 9th. And so we're asking that you allow us to attend the county Christmas luncheon, as well as our convention center. I move. Second. Panel favor, see you. I'll push some passes. Thank you. I also am here to recognize the employee of a month and I'd like for JD to come up here. Certainly that's not you would like to. Patty that's not the employee of the month. And certainly that's not you would like to. Patty, that's not the employee of the mind. No, no, no, no. Somebody far, far more deserving than this. And to get this person here today, I literally thought I was going to have to bring their desk and their computer up here, because that's just how diligent, how dedicated this young lady is. I'd like to die on a graph. Would you do on me, Diana? I hope I didn't just give Diana a heart attack here. Oh, oh. Thank you. Yeah, Diana, I have worked with Diana for about, I think, about eight years now. And I'd just like to read the letter. We had a number of letters from my department submitted, not just from people that work with Diana, but others in our department because she just sent me to stand out employee. But I said, I want to nominate Diana McGrath as employee of the month. Having observed Diana's work as a paralegal for the past eight years or so, I can say without question, she is one of the finest employees anyone could ever hope to have. Many people work hard, but Diana also works very, very smart. She always has a bright, cheerful attitude, no matter how much work comes her way, and believe me, and I think her group would test about this, an awful lot of work comes Diana's way in our CPS section. Diana is one of those individuals that makes the entire team better. We've all heard the old saying, if you want something done, give it to a busy person. Diana is just that person. She is always busy first in the office and just knows of the grindstone. And Diana is some 20 years of experience as a paralegal shines through every day from the moment she arrives at the office, and there is no task that it beyond her skill level. If she doesn't already know the answer, she will quickly do the research and find the answer. The amount of work she completes each day is truly incredible. It's always done in meticulous fashion. And before joining the county attorney's office, Diana was apparently go for like 18 years in private practice. So Diana's also highly regarded within the family law community throughout our county. One downside of this was that over the years, Diana had worked for me. Lawyers from around the county would call her at my office and offer her a job. Unfortunately for me and now fortunately for McGermy County, Diana always declined those offers and I can think of no more deserving person to be employed than my wife and Diana McGraph. Okay. Now it's time to recognize the boss of the year and fortunately Montgomery County has many great bosses and we had at least 17 nominated. It goes to a committee that's a recognition coordinator of PEC and they have nothing to do with Montgomery County so we try to be as neutral as possible. So I understand several of you are here because you have written a letter for your boss and we applaud you all but we don't have time to read them all so I would like for Amy to come up for a few minutes. for a few minutes. Well, obviously, Dady, you then awarded boss of the year from Montgomery County. Thank you. Good morning, everybody. I was a fan of you. You have a fan of you. You have seen it with me. So when asked to give a few words about JD, I thought I would steal the words of others. Unfortunately, we had quite a few to choose from. So rather than read all of the letters, I thought I would pick out a few of those which represent kind of a common theme throughout the letters. Perhaps the most importantly for me as an employee, JD has a great demeanor and philosophy as a boss. He takes an active interest in what is going on in each division, yet he does so without micromanaging our work. We all appreciate that JD is approachable and eager to help us succeed at our respective jobs. And if you respect our ability to do those jobs, he also puts a strong emphasis on teamwork, encouraging people in different divisions to assist one another. This helps foster sense of camaraderie among employees so who might not otherwise interact. JD and Natalie have encouraged teamwork throughout the office. Another thing that I really appreciate about JD is that he quietly leads by example. Anyone who comes in early or stays late knows that JD is regularly in the office. For more than a full day, and it's not unusual to find him in the office on a weekend, his obvious dedication to the job does not go unnoticed. Certainly has a positive impact on the state of mind of any employee finds himself or herself putting in those long hours. Another letter, Sadie is meticulous about everything. He takes his time making decisions and is not afraid to express his own true opinion. He wants those things done right consistently with efficiency. There's nothing he asks his employees to do that he himself will not do. Inside the end with this office, I've seen him help his employees install their printers, fit together new office chair, help clean out the kitchen, assemble store yourselves and work been just for our coffee room. JD took a highly active role in making sure that everything was perfect. The night before we officially moved, JD was up there till 4 a.m. assembling our break room table and chairs, work stations for coffee rooms, and moving office appliances for operation. The man literally never stops, again, dedication with a capital of e. JD has also fostered a cooperative team environment among the entire office. Many people in the office regularly receive accolades for their work or win an important case. When this happens, the entire office receives notice that we can cheer on our office mates and learn from them about how they achieved success. JD never mentions a word about his own efforts. The camaraderie created makes it so much easier to reach across section lines when help is needed. JD leads by example. He's the first one in the office and the last one to go home. He's in the office on weekends working on little things that make the office run smoother. He usually stays so busy during the day that he skips lunch, yet he's always in a good mood. His non-stop energetic work ethic is contagious to his staff. For all these reasons and too many more to list, we nominate JD Lambrite for last week. Well, I didn't notice until I stand up here now that such a large part of the county attorney's office is over here. I am truly honored and humbled and shocked by this, but it really is a testament to all these fine people we've assembled for the last 19 or 20 months now in the office. In the teamwork, the dedication, we just have a group of about 30 people that are putting forth a phenomenal effort on behalf of our clients. And we hear that all the time and it's still this doing this not me. I just try to stay out of the way and let them do what they can do best. Thank you very much. This is an incredible and surprised honor. Alrighty, and the county clerk, commissioners, we need to prove the minutes for October 20th. All in favor say aye. All in consent. On page 9 under infrastructure we need to add the word partial certificate of substantial completion. The word partial needs to be added. Which one is it? Pays 9 under infrastructure. Yep. H1. Yeah. H1 should be approved the parcel certificate of substantial completion. And we need to remove on P three nine eight five through twelve. That's covered in number 15. It's just a duplicate. So I move on consent. I'll be able to see. Auditor. I'll look at the address. Oh, okay, excuse me. I can't ever find that page. Here we go. Consider to approve the change of the name of the Tri-County Mental Health Military Tournamentation Services to Tri-County Behavioral Health Care has approved by their Board of Trustees on July 12th. All in favor say. Justice number three. Consider an approved view of $1,600 and $46 from the JP Technology Fund. Move. All in favor say aye. All right. Emergency management. I want to judge commissioners. Morning. I'd like to ask Court to consider discussing and approve the proposed grant projects for the 2015 UIC grant program. I believe I've provided a list of the projects that we have. It comes to total, it comes to about 1.2 million. I think, how long do you anticipate we'll still get those grant dollars. The UIC grant looks like it's pretty firm. The amount has remained steady for us last couple of years, at about 25 million for the UIC region. There's some discussion. The top 25 UICs the funding has been pretty solid. There's some of the smaller UICs that are coming back to legislature asking that they've received more funding, that the focus has mostly been with sustaining the projects that we had with the earlier grant fund. So that's more than the focus has been. Are we on a cash basis with this? Nicky, we're not financing anything. We pay for everything. It's a reimbursement, and then we get reimbursed. We have the projects approved in the grant system, then we buy the equipment or whatever, and then we reimburse, every three months we go in and do a reimbursement request for a lot of things we've already purchased. So that's all 100% grant fund. I move. All the papers see you. Thanks. I have to consider improving air local agreement with San just in a river authority for the sharing of fuel supplies during the disaster. They had a little, they came to me several months ago and had a little concern that they might have problems getting fuel during the disaster and we normally have sufficient contracts and our state resources and they just want to make sure that they're able to get some of those fuel resources too. We're just going to reimbursate like the other. What? The English. Yeah. Whether we, if we get fuel from them, it allows for us to reimburse them and vice versa. Okay. So. Move. Second. On the paper say. Thank you. Sheriff. Morning, Judge. Commissioner. Morning, Sheriff. On 13 a. As you consider, except 17,3007,425 cents in support of the joint terrorism task force between the FBI and Montgomery County Sheriff's Office for physical year 2015. Fund should be allocated to Department 56.01514 with benefits funded from the Department 56.01. Blue. Okay. All they ever say? Uh-uh. 13.B. as you consider to prove the acceptance of the physical year 2014 state criminal alien assistance program award in the amount of $96,202 and authorize lieutenant Jeremiah consider to prove the NRA Foundation General Grant Application for the FY 15 NRA Foundation training equipment project and authorized Lieutenant Brady Fitzgerald of the Sheriff's Office to submit the grant proposal electronically on behalf of the county. The grant is for $4,559.95 with no matching funds required. Move. All in favor, see on? They asked you considering a proof allowing the FYI 14 balance in accounts 5601 and 7390 and 5121, 7351 be carried forward into the FY 15 budget. The funds in the Sheriff's budget are needed to purchase 26 computers for the new deputies. Funds in the jail budget will be used to replace two inmate transport plans with high mileage. We're asking to do this because it was we're not able to get this in our twenty fifteen bucks Yeah, chief was telling me earlier that those bands don't just go back and forth from here to the tail they Go around the I guess around the state moving prison. Yes, it didn't take long wear my I move second all they were see up That's the sister. Good morning, judging commissioners. We're asking you to consider a proof and name funding source for the purchase and installation of new carpeting and flooring for phase one of the tax office remodel. The total amount needed for the proposals is $11,916.84. For us do we have any money from CEOs that could fund this? Judd you'd have to check with Mark Bosman that I believe that all outstanding CEO balances are currently under direction from his office. I'm really fond of that contingency. You'll be probably talking to a lot of work over there. I'm going to be amazed at this. I'm including windows, the sudden changes of the food group. We'll attack the office. We're actually probably going to talk in the neighborhood of 65,000 or 100,000. We'll get that in the beginning. That's not food. Food and life. I was not sure about the windows or the air conditioning. I guess my question is, did we have CEOs unallocated? the big use for this. During the budget year all designated where we were putting all the funds this year. We don't have that. Any of this project on the CEO's during the budget. Okay, I mean I understand new floors and some new paint on the walls of the place could use. Some aesthetically pleasing type work, but as far as the long term, I think this is Courtney to have a discussion on what the future of that tax office is before we start buying windows and air conditioning. And without the windows and the air conditioning, I think Paul is estimating around and he doesn't have a final estimate, but he's supposed to have that sometime this week. In the neighborhood of 40,000 without the windows in their conditioning. It needs it. Yeah. I move this to be funded out of contingency. The 11,900 that she's asking for. Well, the rest of it would come up. Yeah, I'll say. All the favor, sir? No. All right. Oh, she'll pass this. Thank you, Tammy. Tammy, if you would, in the meantime, I think we need to be looking at what is the long term prognosis for this building. Is it imminent or is it not? We're very interested in our public health care on that. We're very interested in our public health care on that. We're very interested in our public health care on that. I don't know. One time J.R. talked about building an entirely new building that's something we may want to think about. Yeah, we need to look at it at the real model and pieces of this and see if it's worth the money into it. It may be something that we need to do. Like Craig said is looking at a new building somewhere. I think it's that building it's pretty old. Very old. It was very many places where it was built. It was a time to move, try to get out with minimal changes and that was the $40,000. That was just maybe a few walls in the morning. Okay. Mark. I'm going to point you back off to several other pages. Did you share that building that and rebuild that location? It's a long, long system. Yeah, we certainly need to take a long term look at this. And that building, I mean, in each a lot of work. Once you put a group together to study this, it'd come back with a recommendation for the court. Judge, I think we had, at one time, put together a building committee that we talked about in this court last year. We did. And as they've ever met. We may be time to. We may need to take a look at that. You. Who is all that committee to fill us you know? Come on fill us I Recall at the time that Mark discussed it talking about him in Paul case as well as Scott Smith Marshall Shirley Wayne Mac was our custodial director at the time and I believe he was on it I Believe that Scott Hazelwood from Environmental Health was also on it. We could certainly go review the tape. Well we ought to, whatever that committee was, we ought to have one floating position for whoever the building is going to be for. Absolutely. Whatever department, whether it be the Sheriff's Department, I know y'all got a new building coming up. The tax office or wherever that building is going to service. Now I nominate the judge elect to be on that committee. And apparently I've already misspoke any weather. I don't know if you can get a second of that. And gentlemen, apparently I've already misspoke and it wasn't Scott Hazelwood. It was a different Scott. So we'd have to look it up to know for sure. Whoever that committee is plus one floating position, whatever departments let us know. Yeah. OK. Airport. Well, it's got here today. Because Sarah Scuss approved the development site plan for aircraft hangers 17 E and F. My great land holding zinc. Some of the work in Steve Rack just doing out there. I move second. All in favor see out. All right. Most our conventions are. Good morning, judges commissioners. I'd like for you to consider and approve moving the following salary position funds $327.68 from position 513 57 25-3 to position 513 57 25-4 327 68 from position 513 5 725 3 to position 513 50 725-1 and 327.68 from position 513, 5725-1, and $327.68 from position 513, 5725-3 to position 513, 3420-1. The transfer of these salary funds were not increasing the overall department budget. What is that? What it is, we had an employee leave and he was making around $983 more and we took that money and transported it into three different positions. Commissioner, I have three. Not doing that, sir. We talked about not taking those dollars and just spreading them through the department. Was this something that Doty did you look at it? No, we did not go through Dodie on this. We had checked with the doctor's office and so that's what we did. We had moved the money. We contacted them to ask them about it and how to do it. We did not go through HR. I agree, Commissioner. We talked about not just allocated new, unused dollars at salary increases mid-year. Great. Thank you. unused dollars and salary increases mid-year. Right, thank you. Mm-hmm. Uh, on forensic services, commissioners, I'm ready to move forward on this new position for Dr. VT. He is ill today. You could not be here. We can defer this. Let's defer it to him. Okay. Mr. Forest 17a, 18 DWI court. Morning. I have to need a please consider and approve the deobligation of $22,360.65 due back to the criminal justice division from the DWI court program. What is this deobligation? What are we doing here? We didn't spend all of the grant funds that were awarded to the DBI court. It has to go back. Yes, sir. All in favor, Cia? We put a lot of money in this DBI court in the drug court out of county. How much? Is this money that we could not spend? this BWI cork and the drug court out of county, copper. Is this money that we could not spend? We did not spend it, no, I'm saying was it regulated to where we could not spend it? We could have spent it the money. There were, the funds weren't expended like through drug testing, treatment, that type of thing. And so it's specifically for drug testing. And for treatment, yes, sir. Okay. So the budget for the DWI court this year is $376,377,000. But this money here is earmarked strictly for drug testing treatment. I believe the way the grant's written can have a net has to be used for specific items. Yes, sir. I'm Okay, all in favor. See you Just all your services Good morning judging commission morning Please consider and transfer the salary stipend which was once an out allowance in the amount of $1,182 with 22 cents from position 509 303-8 to position 509 303-2. What are we doing here? This this person is in charge of picking up the trash in the downtown buildings with his own vehicle. Due to health issues, he's no longer able to take that responsibility. So I'm trying to move it to another person that volunteered to take over that responsibility. Okay. Those that are having a dumpster in every building, they just got you in a month. Second. All in favor, say aye. Don't throw in every building. They just got you in a month. Second all the favor say I Up is the court administration Judged missioners morning. I'd ask that you in 20 a consider and approve Transfer of funds of $402 from the county and district court Technology Fund to the 284th District Court for supplementing purchase of a case management computer. I move. Second. All in favor, see-on. And in 20B, I ask that you consider an improvement of the travel requisition to Giuliano de Apar, for conducting county business in Brasers County due to a transfer of venue August 24th to 25th. The requisition was submitted to the auditor past the 30 days. The reason for this was purely, it wasn't on that part of Julianna. It was on the part of getting a signature from the district clerk or supervisor. She doesn't work in the 359th which held court in Brasers County but but she worked for the District Clerk's Office. And the person processing the paperwork in the 2509 was sick for a few days during the month. And so due to professional development on the District Clerk's side, due to sickness on the 2509 side, it just fell out of side that 30 day time limit. Nothing from her that was hurtful. I move. Second. On my paper, Cia. Thank you very much. I move. Second. On my favor, Sia. Thank you very much. Thank you. County auditor. Before you is a list of seven projects that were discussed during the budget hearings, they totaled $3.51 million. They are where we anticipate issuing certificates of obligation to perform those projects. If you'll recall, one of them is what was discussed at the last court whenever we needed to hire an architect for the sheriff's substation in South County and so that would be included in this list as well. I think that the list it looks good I would have just Craig I think maybe if we add $500,000 should the district two patrol office 2 Patrol Office just in case. And we don't have to issue all of that just to cover, because there's some concern that we may not be able to get the full footprint that they need and share it. If y'all had some input on that building, what you need down there? I'm getting one yes and one, though. We're having a grand early on. They've been working on looking for footprint the start of building it in the layout. Well, think on all these buildings as we do, we need to get that building committee together and certainly get all case involved and custodial involved. So as we go forward, we're making sure we've got materials in those buildings that are efficient, but they make sense for maintenance. And Sheriff, as we go, I'd like to sit in on these meetings for that substation over there. So the mud is in contact with our office fairly often about this. I know they're anxious, and we just put in a request to close book, Chase, so we can get this going quickly. OK. Yes, sir. All right. And I agree that Bill and committee needs to be assembled Immediately, I got someone on looking at the column that fill us sure judge Yeah, just to make sure we know we run into cases where we bought equipment The meets bids meet spec but they're they're an obsolete piece of equipment that's going out of service and we get stuck with something We can't get parts for and I don't want to make sure that Paul's looking at that and we have everybody looking at this going to be maintaining those buildings in the future. Absolutely. All righty, next. Do we need a motion on that? Yeah, just to so I moved that we set up a capital project fund for zero zero one seven in the amount of four million ten thousand dollars second All in favor say hi. Hi most passes The next item before use in regards to the animal shelter building fund On a previous court date there was a request to accept a check for three thousand dollars for the purpose of the animal shelter building fund And then the request to use it for space and neuters. I'm sorry for vaccinations. It couldn't be used for that. The donor requested their check back. They wanted to donate it directly to those services not for purposes of improving the animal shelter building. Subsequent to that, I received another request from a different donor to receive their two separate $2000 donations back because they too had had specific purposes in mind for those donations that didn't include the animal shelter building. So this request is to allow us to return that one check that hadn't been cashed for $3,000 and refund to the donor the two separate $2,000 donations for a total of $7,000. So who over see who runs this building shelter fund? Who? There's a committee. It's the animal shelter committee, I believe, is the name of it. They come through infrastructure. I believe that there's a committee that oversees it. For sure, the instructions for the animal shelter building fund say that those funds can't be spent without the committee approving the expenditure. So if they approve it for a spareter purposes is that not? The rule also say that it has to be spent on improving the the building. Can that be modified to allow for both? I mean... That would make more sense than right- Yeah, then right- Yeah, I think it loses money. This is... Amy? Yeah, then right. Yeah, he likes to lose his money. This is Amy her mark Don't need the money in and then the board and the board is the committee And we should have said more than just a building fund, but this came up to do this and they want to use this money for that. So when the came up before to use the money, we couldn't do this because that's why they came back. I think it's going to take the money and use the pay, the benefit of it there. So that's why they're asking for the fund back. Okay Amy, can we just make it, can they come back to us with a change or no? It's a donor who came back to us with a change. They could come back with a change and then we could apply. But they're asking for their money back right now. So they can go pay those doctors. We should return the money because we don't have an intent on using money for the return. So we're still through the back door getting the benefit. Yeah. So I move. Second. All in favor, see how? All right. All right. The next item before you is a request to reallocate $239,840 to the J.P. technology fund. If you'll recall for the last several years I've come to you with this request and it's to allocate a portion of the salaries from the IT department to maintaining the technology improvements in the different justice courts. It's done based on a percentage of employees for which they provide those services in the justice courts as compared to the entire county. Move. Second. I'll remember, Seattle. D is. The last item is a duplicate, yes sir. Remove because it's covered under consent. Purchasing. covered under consent purchasing. Good morning, Durham. Good morning, Commissioner. Good morning, Durham. Item 22, A, no action. Item B, considering to approve the utilization of a contract with Mustang Cats and the purchase of one excavator and a catchment in the amount of $212,391.76 in one pneumatic compactor in the amount of $83,501.08 through the interlocal agreement with buy board precinct 4. I move Darloom can we take that money out of the resolution we got down later on here today? Yes. Okay. If I have a line item for it. Sure we can. Right. Second. All in favor, see how? I- Thank you. Before we recess, can we go back to the building committee? Philist, or Judge, do we need to- do, do we need to add people to that committee? I don't think we need to be that. I'd like to add Charlie Raleigh to that committee as well. We'll put it on the agenda and bring it back through next time to add into that. Okay. Good. Alrighty. Let's recess this court. It could be in public hearings for the Montgomery County to a road authority. We did. What we're asking you to approve today is to Montgomery County, tell the authority, it's a consulting contract, to Mike Stone and associates, for consulting work on both the flyover and 240-n. This is a gentleman that came in from Fort Wayne County. That's a good job for them. And really, what do you need to, what do you need to, what do you need to, what do you need to, what do you need to, what. We need to, uh, yeah, we did it in action during the, during the, yeah. You could probably name revenue. Sure. Second. Yeah. All in favor, say, uh, what is it? Well, the motion is going to need a funding source. And you could probably name revenues from the tolls. What's the, is there an estimate of the future toll revenues? What was the estimated cost of this again? It is an hourly, it is a cost. There's a schedule with the guard to people doing so. It just depends on the activity that they do with the guard to that. I don't recall a firm estimate. We can name future toll revenues as that funding source. I'd judge if you would. It would be an effective loan from the county until the revenues came out. Okay, the the amended motion was to add toe revenues as a funding source. If it borrow from the general fund in the meantime, so be it. Second, all the favor say. We need to adjourn the meeting and the government of the federal authority, the rate of income commissioners court, county attorney. We're going to defer item 24 a. Why? Because because we believe that we have an alternate way. The original. A little perfect. I was just curious because I was a guy called and asking about how we're going to clean this up. It looks like the company who's employed dumped the thing for going to pay the other company directly. So in case the courts wondering what happened was there was evidently some sort of a crime scene. Clean up in Harris County. they got dumped in Montgomery County. When I say dumped, they just dropped the chair that the guy had shot himself in and all the towels and blood and everything on the side of the road and we had to clean it up. So, good thing they're coming after to take care of it. If they don't pay, we'll bring it back. They don't play, sheriff can go get them. And item B we'd ask you to consider an approve of resolution order authorizing precinct for commissioner Reinhart to extend between and including October 1st and December 31st to exceed the 25% of the amount budget in the fiscal year 2015 for precinct four by the amount not to exceed 350,000. This arises out of a 25% cap that the court passed back in January of 2013. And Commissioner Reinhardt has undertaken some bigger projects which is going to exceed the 25% cap in this first quarter of this year. And we're asking for approval to exceed that cap by no more than $350,000. We and Jim have agreed on that. It's like 1.7 million carry over and Jim agreed on to purchase this two pieces equipment that's very much needed in these county right now. So emotional that I move second all in favor say I. An item C we're asking to consider an improvement in our local cooperation agreement for jail services between Montgomery County and Jefferson County and the Southwest Correctional LLC which is a private entity which runs that jail. If it proves, please approve the sending source. This is similar to the jail services contract we brought you earlier this year with San Jacino County. The cost is $44 per person per day. They transport. They include routine medical things that other people aren't doing. It seems to be a good deal for the county if we get in a situation where we need to send some of our inmates out. How many can they take? As many as we need to send. It looks like our numbers are trending down. It's pretty good, so that's great. Are you still using the San Jacinda County at 22 a day? We are, but that's a little bit just, but the thing about this is, Sheriff's County, I mean, they transport them and they're like a TVC and medical. Don't have to go get them and bring them back. That's big. Take care of medical. You think they'll take about 1,038 more? San Jacinto, San Jacinto County has Okay. I'm going to take care of medical. You think they'll take about a thousand, thirty eight more? Stand just in our, stand just in our county has. Move. I'll play Roussia. Items 25b3 and 4 we'd ask the court to consider together. This is for purchase of property located along US Highway 59 and grant the authority for Commissioner Ed Reinhardt, BD Griffin or myself to sign any and all documents related to the purchase thereof. Who? Say it. Okay. Home of purposely not. Item is 25C1. We'd ask the Court to consider and approve a termination of a partial assignment of lease agreement dated March 5, 2014, located at Longstar Executive Airport. Thank you. All favor say yes. All right, I'm 25 C2. We'd ask the Court to consider and approve a partial assignment of lease agreement between Montgomery County, Texas and David Christie to Joe A. Waltz and Nancy L. Waltz for 16.47.75 square feet of land located at Longstar Executive Airport. Move. Okay. I don't favor say I. And finally, consider and approve assignment of lease agreement with between Montgomery County, Texas and David Christie to James and Carol Fahoski and Gerald and John White for 1429.36 square feet of land located and within the Longstar Executive Airport. Second. All in favor say aye. Thank you. say aye. Thank you. All righty commissioners we need to recess the commissioners court to convene a public hearing for precinct four. Discuss a partial revasion of Dearwood subdivision five to be known as Dearwood section five. Replant number one. New one here to discuss that. John. go for it. On this particular item a proposed application for replat of Dearwood Section 5 in the HS Williams and Survey Abstract 635 was provided to the county to be known as Dearwood Section 5 replat number 1. The purpose of the proposed replat is to sit in the right away north. This was submitted by the developer himself. Earlier this year we approved a plat. They made some changes to that and simply need to file the replat so that they can continue with their production. On September 29th this quarter approved an order setting the public hearing for today and post it required us to post notice on the Montgomery County website and mailing notice to the property owner's 200 feet within the treks replatted. Our office posted that notice and we have mailed those notices. We received no responses from any of the neighbors and we believe this replat meets all the requirements of the Montgomery County subdivision rules and regulations. And as such, should be eligible for approval by the court. Alrighty. We need to agenda public hearing and recommence was court. I move second. I move. Second. I want to favor see I. All right. Commissioner to. We're considering to prove the joint order of the Montgomery County Emergency Service District. Number five and number nine calling for an election on May the night, 2015 for the purpose of consolidating both districts into a newly created Montgomery County emergency service district number nine. The effect of June 9, 2015 I move. I'll take a great move. Craig? I do too and I would encourage other ESDs to follow that same path and I know that is happening in other places so to the ESDs that are here today thank you Chief. Hey Ellen Povercy huh? Hi. Question passes. places so to the East East that are here today. Thank you Chief. Hey, all in favor. See how? Motion passes. Okay, under Article 551.071 of the government code, let's read this this court for executive session. Okay, let's bring the court back to order, please. We need a motion to defend Montgomery County and expand the necessary money in connection with the rusty Cleon Gant versus Montgomery County case. All in favor say aye. Do we have any citizens that would like to address Montgomery County bill of some of them assigned up. Good morning. Morning. First thing I'd like to do is I'd like to invite everybody next Monday the town green park to 4 p.m. in the afternoon to the observation of the Marine Corps birthday. It's turned 239th Marine Corps Bertha. This year the theme, there are 16 Marines and one Navy corpsman on the monument from Texas who have won the Medal of Honor. Of the 16 Marines, 25% are Hispanic and we're going to make special note of them at the ceremony. Second, I wanted to discuss what happened regarding the woodlands rejecting, participating in the customs facility. It wasn't about our participation with the county. We have no absolutely, from the meeting, nobody has a problem with that. We contribute a large amount of tax money in the county and you get paid to make decisions for the county on our behalf. So there's no problem with that. It was the additional funds where we think others are going to achieve a lot more benefit from it in terms of taxes, sales taxes, real estate sales, etc., which we won't share. So the people's general objection to it was that. And I don't think people's idea would change if you named the airport or put somebody on a board. I don't think that would happen. So that's what, and nobody spoke up for it at the meeting. Nobody came representing the airport or made the argument. And it was all people in opposition that night. Thank you. Thank you. Do we have any other citizens it would like to address commissioners court today? If not anything else, commissioners. Will we adjourn? All in favor, see you.
