Okay, let's bring the court daughter, please. Let's stand for the opening prayer and the pleasure of allegiance. Mr. Dole, would you like to join us? Sure, feel by with me, please. Dear Heavenly Father, we thank you for the many blessings that you give us each and every day. And for those that, Lord, oftentimes we recognize and sometimes those that we don't. We ask Lord that you watch over each of us and we bless each and every individual and family and business that's represented in this room today. But ask Lord that you'd be with our men and women overseas as they were struggling to protect this great country. But ask Lord that you'd be with this court. Have our decisions pleasing in your eye. We ask all this and Jesus name, amen. Amen. I pledge allegiance to the flag of United States of America and to the Republic for which it stands one way I can undergar individual liberty and justice for all. I'll run the next slide of plenty of reasons to these answers. One would say undergar one on an individual. All right. For the record all members of the court are present. We need to motion on the agenda, please move. All in favor, say hi. Hi. Good. Mr. Zahe have no changes on consent. Uh, what about Texas S.R. Collector moving B1 to open or deferred it off his end? Let's just defer B1. Sounds good. Is there a motion on the consent that we defer that item move? Second. All in favor say aye Okay, under 8 a consider and acknowledge the receipt of a letter from JR Moore and connection with his retirement effective September 30th and name his successor Why don't we first vote on the accepting of the letter? I move second all in favor say aye and We need a motion for his successor. I make a motion that we prove or Tammy McCrae is a new tax successor collector from Montgomery County. There's a motion in a second. All in favor say aye. Congratulations Tammy. Congratulations Tammy. Where are you? There. I noticed Jeff showed up this morning. So he thinks he's going to get far that check. Tammy I know you'll do great things. I'm very very proud of you. Look forward to working with you Tammy. Too like to turn back now. JR I think you have done an excellent job. I've enjoyed working with you and you have really been good to East County. So JR and I have worked together for years I most. We've had a lot of lot of successes that we can build on JR and a lot of those are to your credit and I appreciate what you've done. Absolutely. Thank you very much. When it came time to point, Texas Collector came down to me in J.R. You still haven't gotten over that hangman. I'm thankful every day. That's what I mean. He was so good at what he does. I hold up better than what I would have been. But I've enjoyed working with you or the economic development impact that you have have had on Montgomery County's off the chart. It's amazing. I don't know how you've put a pencil to it. But you've done a tremendous job in making our tax base what it is today. That's not an easy task, but I've enjoyed working with you and we've got to stay in touch. Thank you. I do want to show that we remember now that we will be closed on the set of 2030. I think the fiscal year, because our second season day is December 31st, and we mean, as personal ability, it's a lot easier to do audits when you say everything that it's closed on. So September 30th is the fiscal year, and that's in great time to go say over that, no closing, stay left people over to do audits in the middle of the year. It will be a clear set of clean clear and clean I'm going to be counting the employees committee to collect a $10 fee during the Caffeist Festival. If the garage is listed on the agenda. I'll never say I. Consider an approved request from the Montgomery County Historical Commission to relocate in official Texas Historical Marker to properly located at the Montgomery County Courthouse Square on Main Street. In other words, the county just execute said documents. Larry and I walked the courthouse square last week picked a great location I think and I move. Second. All in favor say aye. All right. Okay we need to have a committee public here recessed this court to convene a public hearing to consider and adopt the budget for the fiscal year September 30th 2015. Do we have anybody here that would like to address the budget for this upcoming year? Okay, let's enjoy the public hearing or convene commission's court. The tax assessor collector. Do you go ahead and prove that budget judgment before you do the rates? I move on the second all of favor see I? All right. Okay, I wonder nine a consider adopt and set by resolution or the 2014 Avalon Tax Rate for maintenance and operation at 0.40008 per 100. Get emotional now. Move. Second. All in favor, CI. Item B, consider adopt and set by resolution or the 2014 Avalon Tax Rate for debt service at 0.0759. Move, second. All favor see I? The need to be read by a member of the court that's a requirement that that be a verbal. That's why it's bold there as a motion. So when you all will need to read that and then somebody second it and vote on it. That's usually the total rate. It's about the one in bold. You've got to read the exact wording. You may not deviate from it. D, you talk about. Mm-hmm. I move that the property tax rate be increased by the adoption of a tax rate of 0.4767, which is effectively a 5.89% increase in the tax rate. You move? I move second on favor say out. The last item there is the allocation red and I will prefer set. They are hang on just a second. On that statement, why do we have to say that exactly that? They lab does not allow us to just you know the bill. You can't deviate it. And in a case like that, the commissioner was actually coming up with the advertisement on $100,000 home is going to be $11 less. But it's a tax rate itself based on an effective rate. Your effective rate was $45.05. And that rate that you adopted is greater than that. And that's why you have to do that because they look at the same property that attacks the pre-views year and what would be the rate to generate the same funds and that's what an effective rate is and if you adopt a rate that exceeds that then you're required to use that motion. The same total revenue you tell me an overall for the county? No it's your tax rate. Doesn't have anything to do with the revenue. The revenue to come up with an effective rate, we have to use the same property that was taxing the previous year, using the new values. What would be the tax rate that you need to adopt to get the same dollars as the previous year on those? And that would be $45.05. And you're going with the $47.67. So you're gonna generate more dollars for maintenance and operation what you did the previous year understand That they're they're reasoning, but it just sounds confusing I would think to the average person to see that our tax rate went from 48 try try talking to 150 legislators and tell them how that's confusing and especially when I have to put my name on there's to the y'all Yeah, and they call them say well, I'm confused right. I don't understand it. Yes. So I have to go through this. We dropped our right. Seven tenths of a sentence. As we have a 5.89 percent increase in the tax rate. In the tax rate, it says not in taxes. It says the tax rate. Yeah. There's a different thing. Tax rate. Tax rate. Tax rate. Tax rate is decreased. Okay. Wait. wait till you get this next one. It's just, it's, I understand that it's just pretty much. Okay, the next one has to do with the allocation there. And before we allocate and fix that, I want you to know that this is based on what you have budgeted. And the one thing that you need to remember is the maintenance and operation is split into a rodent bridge and a general fund. At any time throughout the year, you can do a reallocation on that so you're not locked into that but you're locked into that M10 rate Just you can't mess with it with debt service So your rodent bridge fund and your your maintenance and operation rate which is Compose of a general fund in rodent bridge is what I'm gonna get the auditor to verify now for current tax under general fund You show a hundred and forty7 million nine sixty six seven fifty. That'll be a tax rate of point three five four four on current tax under rodent bridge. You show 19 million three seventy two six twenty. That'll be a tax rate of point over four six four for debt service fund. You show a revenue of thirty one million six eighty nine two sixty five is the debt service fund. You're showing a revenue of 31 million six 89 to 65 is the debt service requirement, which is 0759. If you look at your second item there, it's your fixing and allocating that rate. It shows to do that 4767 under number one is a general fund. That's the 3544 under the road bridge fund number two is 0464 Under number three, which is your debt service. It's 075 ban You can have one motion to approve that. I have a question kind of like Craig's on C on D Exactly what does and 16 mean. When you fix an allocated and you can take the maintenance and operation and you can have five or six different areas that you want to put it in. For example, as long as you take the M&O rate and it's a general fund and you break it out, you can do whatever you want to as far as doing that. Y'all always want to do that because the road and bridge fund is your dollars. What is fixing the right, we can adjust the budget. But the law only requires an immobil rate. And if you wanted to do a special fund like you discussed with me about roads and restricted, it would be called a farm to market level road, which remains you don't get to do anything. You can't allocate it. strictly that's what it's for and plus you have to give a homestead exemptions and you have to go through different hearings for that so my recommendation years ago was to go with what the court did and allocate it that way you've got flexibility especially with the growth that you've got and how many times you go into contingency? I mean in terms of the new meeting that you have you don't go into contingency. JR is a term new, is the term fixing new for this year in there? That language I just didn't. I'm sorry. The term fixing is that new language that is in there? No, that has been the language that we've had since they want to have been in office. Okay. All right. That's an allocating and fixing of the rate. Perfect. That service you notice didn't change. That's an allocating and fixing of the rate. That service you notice didn't change. You can't change that. I think we need a motion on that. Commissioner? Second. All in favor say aye. All right. We'll install a convention center. Thank you, Jay. Appreciate it. Have a good day. Thank you, Jay. Let me know how that retirement works out. I'd like to ask you to consider to prove the purchase of a thousand gallons of diesel fuel for the emergency generators located at the Longstark Invention Center estimated amount has approached me $4,290 based on the formula provided by the purchase and department. Please name a funding source. Do we use those emergency generators that much? Okay. We have not filled them up in over two years. They basically exercise every Monday. And so they're down and it's time to refuel them. I name contingency and I move. All in favor, sir? Thank you. Thank you. Thanks, Donald. Auditor. I need to consider an approve a request by the 9th District Court to use $941.31 from the Court Reporter Service Fund. Move. Second. All of the favor, sayah. Yes, I think it's to consider an approve a request by the Justice of the PACE 5 to use $1337.59 from the Justice Court Technology Fund. Move. Second. All of the papers here. Move. All right. Here. Court to sing. Morning, Judge and Commissioners. How are you, Darlene? Doing good. Thank you. Item 12A, no action. Item number V, consider and discuss the sale of three vacant tracks of land located on the South-East line of Riley Sousa Road and Fox Run Boulevard precinct 3. And determine a minimum bid amount for each track. Track A, is 2.990 acres. I need a minimum bid. And Darlu, we have this property appraised and Darlu on track 4A4B and 4C. I make a motion that we set the minimum bid at the apprace market value for each property. And that's right away you don't think you'll ever... No it's right away that it's behind land, it's owned by another land owner. And part of that is going to have a sound wall on it for the Grand Parkway. And it's right away that I don't foresee us needing in the future at all as a matter of fact we want to take those dollars and allocate them towards some additional right away purchase for the expansion of Rayford Road and for a turn lane additional right turn lane going west to north on 45. Sounds complicated. I'm not familiar with the location I just I know anytime we have right away anywhere I think ultimately we're gonna need more yeah now this one that'll all be state road as soon as Grand Parkway comes in you want to see where it's at yeah I'm just I'm not familiar I just yeah now we we don't see any any need for that in the foreseeable future. Okay. Is that a motion? Yes. Second all the We need to recess the commission's court if you mean a Montgomery County to wrote authority meeting. Authorized filing of reports, including the 2014 Frances tax report, public information report, change information report, change your registered agent, appoint Craig Dool as registered agent, payment of any associated fees, was previously approved on August the 25th, 2014. Move. Perfect. There's a motion in the second, all in favor, say. All right. Actually, we need to recess the court. Now you it. We did it correctly. Okay. That's right. You right. Okay. Alrighty. Uh, County attorney. We need to recess the railroad authority and recovent commission's court. County attorney. So Road Authority and Reconvince Commission's Court. County Attorney. Good morning. In 14 A, we're asking the Court to consider and discuss and take appropriate action regarding law enforcement services for Riverwalk POA. And this has been pre-saint floor. We are requesting an exemption from the step plan for this POA for the year. We're working with them to try to get the deputy, that is the subject of that contract into the step plan over time, but with this POA it's going to take us a little bit. So we, a contract would be coming probably September 15th at that court session, but we're right now in order for us to go ahead and draft the contract. We need an exemption from the step plan for the current year. It kind of like with Willis, I understand it's just a one-year extension in now. Yeah, we are trying to work with them and negotiate the contract. This would get us through the next year and we can make a decision after this year as to whether or not we want to continue or or set the salary at something higher. So all the HOAs are paying the same rate as we are for deputies. The contracts have been asked and what we've been doing is going around to all of our contracts, HOAs, POAs, San Jacina River Authority, trying to get them into the step plan, pursuant to those recommendations we made during the budget hearing. A move? Second. I'll look over to see out. Okay. And item 14B, we're asking the court to consider and approve the tax debatement agreement with clay partners and professional directional enterprises. This is a six-year abatement. It is supposed to be 20 new jobs plus the 231 existing jobs. This is an expansion as a facility to 15 acres. The improvement values are going to be from 9 million to 58 million and we'll add over 300 thousand dollars in revenue for the county. Well do you have anybody here from them from Clay Partners? I don't think they've shown up but one other thing that we need to include in this is Commissioner Reddenight talked about and we've got to tell Amy about They've asked for a 60 day extension on completing the building because of construction over-saxons stuff and I can I both agree to that so that's also a part of this. That need to be part of our motion that we have a 60 day delay on that that abatement but I move I've been a great asset to Montgomery County. I've been a great asset. Now I move. Thank you. All of every see I. All right. Real property. And I know 15A we're asking the court to consider and take action on an amendment contract between the Texas Department of State Health Services and Montgomery County contract to revise the scope of work and add fiscal year 2015 funding and authorized ed Sadler to sign this amendment. This is a very minor amendment. It basically adds fingerprinting to background checks as well as the contract before was a two-year contract term this spells out 2015 funding. Is this for the middle health? Yes, yes sir. What is the amendment? It adds fingerprinting to the background checks and it also just spells out the the contact before was a two-year term and this spells out a one-year term for 2015 and does an eight-second Second. All the papers they are. Oh some passes. Alrighty. Commissioner precinct one. Consider approved to open the position 6128902. Funding will be 44,000 out of 6125616,000 out of 612 eighty five fifty eight move All in favor see I Consider an approved open position six twelve thirty two or three funding will be forty thousand five hundred out of six twelve eighty five fifty eight. I move All in favor see I good. Yeah, we recessed it. I'd like to introduce some of y'all don't know my people that kept my head above the water for 15 years. It traces tilling and billsmiths, y'all stand up. These guys take care of me every day and I appreciate what you've done. I know you're going to continue to do that. Whoever you work for. So thank you all very much and I just wanted to go to see you all and see who has done my work for me for 15 years. Thank you all for being here. That's we have one other individual of county retiree bill etharges here and every time I see Billy come up out of the shop every time I saw him it cost me money you scared me to death when you walked in. He built it a great job in running our shop for a long time over precinct too. I'm glad to see you today. All righty under Article 551.07, one of the government code, let's recess this court for executive session. Okay, let's bring the court back to our please. Do we, there's no action necessary for the executive session? Do we have any citizens who would like to address the court today? If not, he may resources. Good morning, please consider to approve the Payroll Ch Requests Form. All in favor, CIA? Thank you. You're saying else, commissioners? I'm in the tenor. Check it. All in favor, CIA?
