Okay, let's bring the court to order. Please good morning everybody. Let's stand for the opening prayer in the pleads of allegiance. Mary, ladies and gentlemen, please. We have our hearts and our hands with you and we just look to you for the guidance and the direction that we need in our lives today. Father, I just especially want to lift up people to realize that voting is so important and it's the freedom that we have and that we don't use it, we could lose it. But Father, most of all, we come lifting up our military men and women and we just ask that you would just bring them all home, safe and sound to their families. But especially Lord, I would accept these commissioners and the judge that they'll make the decisions that are wise for this county and to help it grow further. But most of all, Lord, we can thank you that you are who you say you are and we can depend on that. And we ask all this in your name. Amen. Amen. I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Our honor and thanks by that I pledge allegiance to the Texas one state under God, One in the middle of this one. Okay, if the record all members of the court are present, we need to most know the agenda, commissioners. Who? Second. All in favor, state. Aye. Aye. Commissioners, we have quite a few resolutions this morning. First is EMS week May 18th through the 24th. Good morning. Good morning. My name is Mark Cole. I have the privilege of serving on the Board of Directors in Montgomery County Hospital District. And I'm here this morning with Jared Cosper, our NMS director, Kevin Nutt, our assistant EMS director, Randy Johnson, our CEO, Melissa Miller, our CEO and Jennifer Nichols, our president of the information officer. If I could read, I'd say very briefly. Thank you. Anna Cadote, that will explain the gifts you're about to get, just briefly before I read the confirmation I would appreciate it. According to legend, during World War I, challenge coins of a solid bronze were created by a rich American lieutenant for every member of his squadron as a token of their service together. One pilot placed this coin in a pouch worn around his neck. Later on the man was captured by the Germans when he was forced to land behind enemy lines due to a damaged aircraft. During transport to a permanent POW camp, the pilot was able to escape. When a French patrol passed by, the pilots who had most of his belongings confiscated, offered his military challenge coin as proof that he was an allied soldier, and it saved his life. Once the pilot returned to his squadron, they each agreed to carry the challenge coins at all times. The challenge coin today that we have given you serves as a symbol of the unity of an organization, which is why this one has been developed for the Montgomery County Classical District. It is a symbol that though we may work in different roles within the organization and in different parts of this great county, we remain as one. This coin also serves as a trophy to the men and women who dedicate themselves daily to serving as community in the office, in alarm, in the streets, or in the boardroom. So therefore, we collectively have been recognized as the MS provider of the year for the state of Texas. The MS provider of the year for the entire state of Texas with its many counties. And we will carry this as a symbol of our unity and pride. And in fact I have my coin with you with me and we'd like to ask you to keep your coins with you at all times just as a representation, a token of the dedication of the MS crew. So with that, if I can proceed to a proclamation, thank you. We're at Montgomery County Hospital District provides emergency medical services to the citizens of Montgomery County, Texas, and we're at access to quality emergency care dramatically improves the survival and recovery rate of those experienced sudden illness or injury. And whereas the members of emergency medical service teams, whether career or volunteer engage in thousands of hours of specialized training and continuing education to enhance their life-saving skills. And whereas Montgomery County Commissioner Court hereby supports and recognizes the Montgomery County Hospital District Emergency Services personnel as an integral partner to the citizens the Montgomery County Hospital District Emergency Services personnel as an integral partner to the citizens of Montgomery County. Now therefore be a resolve that the Commission's Court of Montgomery County Texas does here by proclaim this week of May 18th through May 24th, 2014 as Emergency Medical Services Week. And with that I would like to ask you to pass that proclamation. I move. Second. I'll never see it. Hi. ask you to pass that proclamation. I move. Second. Hall of V ever see. Hi. Thank you so much for reading that. Right. Congratulations. Thank you. You're not in a way of volunteer appreciation day. Julie good morning. Good morning. Thank you very much and what an honor to follow the EMS group. That's really quite an honor for our county to have the premier in the state. So congratulations guys, that's a lot of hard work goes into that. We'd like to ask you to support volunteers. You're not away and mostly run by volunteers across in our county. They're the ones that make the funding decisions. They're the ones that decide the strategic direction of our community. They're the ones that are making a difference every day. And as you know through our disaster work with Nikki Kelly, they are out there and involved after disaster to make a difference. So our proclamation reads, we're asked Montgomery County United Way is a local nonprofit whose mission is to improve lives by mobilizing the caring power of community. And whereas Montgomery County United Way encourages all residents of Montgomery County to live united, give, advocate, and volunteer to help strengthen the community, create lasting change, and achieve community level impact for our residents. And whereas Montgomery County United Way promotes fallen tourism through a county-wide website help our county.org that is used to easily match volunteers with opportunities posted by local nonprofit organizations, even during times of disaster, a natural disaster, whereas Montgomery County United Way limited the talents of time and local volunteers to address the most pressing needs in Montgomery County in the areas of education, financial independence, and health and wellness. And whereas Montgomery County United Way coordinates more than 552 days of caring projects with 1,752 volunteers from 61 companies and organizations at 64 homes and nonprofits leveraging $28,955 in donations and in-con goods. And whereas Montgomery County United Way's volunteer board of directors are strategic conscientious and thoughtful stewards of donor contributions. And whereas Montgomery County United Way volunteers facilitated more than 35 independent community living sessions representing diverse groups which demonstrated our current priority areas or focus of focus are of equal concern across the county countywide. Whereas Montgomery County United Way volunteers evaluate and recommend funding for programs operated by local nonprofit organizations which improve the significant number of lives in Montgomery County. Whereas Montgomery County United Way is the largest nonprofit fundraising and funding body in Montgomery County, we have more than $5.3 million in 2013 and over 60 million since it was formed in 1955. Now therefore be it resolved. Did in recognition of the value volunteers bring to the quality of life for residents of Montgomery County through Montgomery County United Way, the commissioner's court of Montgomery County declared May for residents of Montgomery County, through Montgomery County United Way. The commissioner's court of Montgomery County declares May 22nd as Montgomery County United Way volunteer appreciation day with all invited to attend a lunchtime celebration on the courthouse steps on that day. So we invite you to be there. Great, thank you Julie, go much. Awesome. Move. Second. All the favor say aye. Thank you all, much. Awesome. Move. Second. All the favor say aye. Thank you all very much. Thank you for tuning in. Thank you. Next, extension office. Come in, math. Oh, good. What you did. Good morning, Judge Sadler. Members of the court. Good morning. We appreciate and want to thank you for allowing us to share an important event and say, What he did. It's a morning Judge Sadler, members of the court. Good morning. We appreciate and want to thank you for allowing us to share an important event and say as far as the extension system and allowing us to go ahead and move forward with an educational system that we believe in and we work for and it's been in place for a long, long time. May 8, 100 years ago, President Woodrow Wilson signed into law and asked rock forward by Senator Hoax Smith of Georgia and asked very labor, which was South Carolina, which has brought a measurable benefit to the lives of people, businesses, communities across the United States. We've got a resolution that we would like to share and we would like to read it as a staff to commensurate, to commemorate this 100 years of service. Whereas May 8, 2014 marks a centennial of the beginning of Smith-Lee Rack, which established cooperative extension, the nationwide transformation education system, operating through Lankwright, universities, and partnerships with federal, state, and local governments. Whereas US-Hoke Smith of, and US Representative A. as the leader of South Carolina, authored Phil Smith, Leiber Act, to expand vocational, agricultural, and home demonstration programs in rural America by bringing the research-based knowledge of the Langrat universities to the people where they work and live. That's been our function. Good morning. Whereas the extension of the critical component of the three-part land grant, University Mission, and works collaboratively with research, particularly the Agricultural Experiment Station system and academic programs in 106 colleges and universities, including historically black, Native American, and Hispanic serving institutions in all 50 states. The District of Columbia and six U.S. territories to reach traditionally and underserved audiences in all communities. Where is the cooperative extension system to keep its state's federal programmatic leadership and support enabled by the Smith-Lever Ag and other legislation through the US Department of Agriculture's National Institute of Food and Agriculture. Whereas, cooperative attendance research-based education for farmers and ranchers helped establish the United States as a leading agriculture-producing nation in the world. Whereas, since 1924, when the Clover emblem was adopted by USDA to represent 4H, cooperative extensions nationwide youth development program which has reached millions of youth and helped prepare them for responsible adulthood. We're asked cooperative extensions prepare people for healthy productive lives to sustain education such as the expanded food and nutrition education program. Breaking the cycle of poverty and reducing the expenditures for federal and legal assistance. Whereas cooperative extension provides rapid response to the disasters and emergencies through the extension disaster education network and other similar efforts by providing real-time alerts and resources. So, extension educators can respond to urgent needs resulting from hurricanes, floods, oil spills, fire, droughts, past outbreaks, and infectious diseases affecting humans, livestocks and crop. We're asked for operative extension to translate science-based research for practical applications through local and online learning networks where educators are uniquely available to identify emerging research questions, connect with land-grant university faculty to find answers, and encourage applicants findings to improve economic and social conditions. Whereas cooperative extension engages in rural and urban learners through practical community-based and online approaches resulting in the acquisition knowledge, skills, and motivations to strengthen the profitability of animal and plant production systems. For tech natural resources help people make helpful lifestyle choices, and share a safe and abundant food supply and encourage community vitality and grow the next generation of leaders. Whereas many states are celebrating the centennial of the signing of the Smith-Leaver Act with resolutions and proclamations and many land-grant institutions also are commemorating the signage of this historic legislation. Therefore, be it resolved that the Senate and House of Representatives recognizes the significance of the Smith-Leaver Act to the establishment of Cooperative Extension nationwide, encourages the people of the mentally-grac to the establishment of Cooperative Extension nationwide, encourages the people of the United States to observe and celebrate the centennial with a focus on launching an innovative and sustainable future for Cooperative Extension. Honors the University and faculty and local educators to dedicate careers to providing trusted education to help people, families, youth, businesses, and community solve problems, develop skills, and build a better future. Thanks to Cooperative Extension Volunteers to provide thousands of hours to promote excellence for 4-H, Master Garders, family Consumer Sciences, and other programs in their community. Encourages continued collaboration and cooperation among federal, state, and local government to ensure cooperative extensions that stay in ability as the nation's premier, non-formal, educational network. And celebrates the millions of youth adult family farmers ranchers community leaders and others who engage in cooperative extension learning opportunities designed to extend knowledge and change lives. Move. Second. And by the way, I got eight miles in yesterday. there you go. We're tracking. At this time we'd like to have you on present the McMission's Court a plaque that's being presented to all commissioners courts across the state in building a better Texas award. Thank you. Thank you. Thank you. We appreciate the court tremendously for your support over the years. Again, it's a process that helps individuals but it can't happen without the support of the commissioners court and we very much thank you guys for your support over the years. Thank you all for coming to court this morning. Thank you very much. Congratulations. Thanks for all you do. With your help. There was a motion as your second. Second. All of the favors say aye. Employee committing. Good morning commissioners. Good morning. On behalf of the employee committee, I'm here to recognize the employee of the month for the month of May. And to present this award, I would like to call to the front, Constable Presence 3 Ryan Get Gabel. Good morning, Judge commissioners. Thank you. Good morning, Judge commissioners. How are you, Ryan? Morning. Good morning, everyone. We'd like to recognize Felicity Davis. Felicity, if you come up. Is it okay to read this letter. On behalf of the Council's office, we're honored here today to be able to provide or recognize Felicity with the employee of the month, but Sergeant Police behind Steve O'Hare wrote a letter that says to whom it might be starting on behalf of Montgomery County Council, I would present free with nominated Felicity Davis and Art Department led by Council for I'm Gable for Employee of the Month. That's one of the long-term 19 year members of Montgomery County family. Felicity Davis has spent for many years of pre-sick free with Council for the Hollywood field and currently my office driving improvements throughout the department. With the goal of excellence in all areas, Felicity Davis leads five sample. She was 100% dedicated to serving and protecting the people and businesses in present-free and expects the same quality of service from all members of this department. We all depend on her extensive experience knowledge among the county policies and procedures. She is a valued employee. I'd like to say that we're honored to have you here today. We couldn't do it without Felicity. She is my assistant. She leads our clerical staff, all the clerical duties within the Constable's office. Some of the words that we utilize around the office is that's fantastic and phenomenal. We just would call her fee and so we're just so proud of you and Congratulations. Thanks, guys. You bet. Good morning, Commissioner Zendred. Morning. Would you pull the microphone towards you there? My name is Melissa Baker. I'm the chairman of the Montgomery County Employees Committee, and it is my pleasure today to announce this year's employee scholarships. This year we are offering two scholarships, one for a county employee and one for a county employee's family member. The first one that I'd like to announce is Delaney Ophill. Delaney is the daughter of Lisa Ophill of the County Clerk's Office. She loves music and children which led her to choose Sam Houston State University School of Music as the next step in her education. She has been an active member in the band for the past two years and is also a baseball scorekeeper. The Laney has also been on the AB honor roll for the past two years. In Delaney's own words, college means having the opportunity to take my passion and learn how to share it with others. College means getting the chance to take the two things I love, music and children, and be around them both for the rest of my life. Congratulations to Laney. We wish you continued success and hope that this $500 scholarship will help you in pursuing your academic goal. And the next award winner is a county employee or Lando Gray. Orlando is currently employed in the juvenile detention department. He is also a current student at Sam Houston State University. His master's degree plan is in public administration and education with his goal of working with the Texas Board of Paroles and Partins or as a principal academic advisor or counselor. He is the community service chairperson for two different organizations and volunteers regularly at the Hospitality House of Huntsville, Huntsville Healthcare Center, YNCA of Huntsville and Sam Houston Elementary School. Orlando has been on the deans list for five semesters and is a member of the honors college. In Orlando's own words, college means everything to me. The decision for me to continue my education has not only afforded me the opportunity to one day pursue a career in criminal justice administration, but also gave me the privilege to be the first male in my family to graduate from college. Congratulations Orlando, we wish you continued success and we are pleased to offer you a $500 scholarship this year. Thank you very much. Thank you. Orlando and Elaine, congratulations. I know you'll use this money wisely. All right, the commissioners on the county clerk would need to prove the minutes. Move. Second. All in favor, say aye. All in favor, the commissioners, we need to remove item 9B2. This is under the tax assessor collector on page 3. That's the only change I have. Move on consent. All in favor, see how? Okay, ten. Part of the vote. Do we not vote? Okay, ten. Part of the vote. Who's the motion in second? All the favor, C.I. I'm going to send. Aye. Motion passes. I'm going to let us sign it. Okay, we need to accept Gerald Derrickson's resignation from Montgomery County Historical Commission. Move. Second. All the favor, C.I. Move second all in favor see aye We need to approve Ron Sakewski to the Montgomery County Historical Commission and also Mark Canada That's BNC second all in favor see I Merge your management I'm more in judge information. Morning. I ask court to considering September 2012. Grant adjustment notice from the Texas Department of Public Safety and Authorized Judge Sadler to execute agreement. We have completed all of our projects in this agreement. We'll de-obligate the remaining $257,750 and 25 cents. Nikki, were you able to do projects at a lesser cost or were some of them cut out? Some of the commissioners, we, some of this because this is more, the grants have changed to more of the statement. Calls, some money is put in there in case some were I quimmy were to break. Some of it we had, because the grant years have changed. We had main disease that were different parts of the year. So some of them I just closed them out at the end of the year and carrying them to a new year. Okay. For 24 or 12 month period. So we didn't spend as much on them this year as we would next year. So that was a we did save some money but we overestimate. The money does stay in the region. So go back to the you know I see here in Houston so let's stay here. Great. I move. Thank you. I'm a favor to say aye. Motion passed. Thank you. Thank you. Justice number four. Morning Judge. We would ask that you consider approval of the purchase of technology related items using funds from just the piece of technology funds. An Apple iPod with a protective cover and a stylish for the judge to use while he's out on death scenes in the middle of the night that way you can just transmit the information automatically to the forensic center. Move. Second. All in favor say aye. Thank you gentlemen. Motion passes. Thank you. Mr. Attorney. Morning. How are you? Some of you may recall, we pay a supplement to our attorney that reports her kind of criminal law out of her after torture and how to prove that previously. Those are the reasons for us to our attention that one of our paralegals has been served by the civil law. She's practicing in our civil law abduction and we thought that only fair and easy to think and that we're doing for our turn. Money comes out of our ass, for your account. It's only paid if we have money in our ass to for your account. So he would ask that you approve the same supplement for her and we have approved for our board certified attorney. That should be noted, she would be only practicing, thoroughly go, and civil law and in my numbering town in the forms of the government. Move, I think it's great. All in favor say aye. Motion passed. Thank you. Is that applied to me? I just signed up for that course. I'm out of the form of this. Oh, thank you. All righty, library. I'm here to ask for the authorization for a temporary full-time library assistant position for the period of 5.19 through 7.31. We have an individual on leave who's indicated that they would retire at the end of July. We're at our peak demand time. Summer reading program will be starting in a few weeks. Hundreds of children will be out of school and coming into our libraries. We hope to both inform them and entertain them with educational programming, but that also means that they will be coming in to check in and out materials. And we are no longer able to use a part-time individual or several of them to fill the gap lost by this 40-hour week position. And so I would ask your authorization to have this position for this limited period of time and also to approve the transfer of sufficient funds within the library system systems salary budget. We do have the funds to cover the cost. There is some difference of opinion with regard to benefits because it's a temporary position. Normally it would not have benefits, but now we have the Affordable Health Care Act guidelines that if you work more than 29 hours you must be offered benefits. So we do have sufficient funds depending upon which way this really falls when we get through with all the calculations. I would ask your approval of the position and authorization with the transfer of sufficient funds. And you've got the money in your budget? I do, sir. I'm moving. Second. All the favor, C.I.? Hi. Let's just a quick question. Do we know if a temporary position is there, even though they're working full-time hours, if the position is only temporary, we still require to provide benefits? We're required to provide benefits. Is there some time, a period of time that we don't have to if it's short enough for you? That's where the Affordable Health Care Act has sort of left us in limbo. I certainly do not want the library to be the one department that causes a multi-million dollar fund so we want to follow all of the guidelines to achieve. Thank you. And thanks for letting us close the library for Iron Man. It went great parking lot was well used. Yeah I think it was very busy times all around. It was thanks. Okay Constable 4. Morning Judge Commission. Considering a pre-request for additional funds for fuel for precinct 4 and then amount of 22,800 to be placed in line out of 5541 7354. Do you have, have they set the date for the runoff election for SD4? They've given us an idea of it taking place on August 5th, but that's not been coming up. Yes, yes, it's crazy. Yes, hasn't been finalized yet. Man, thank you. Bill bond board. Joe, before we do that, go back to Rattis precinct 4. After we made that move, I think, consult precinct 5, whispering back area, you know. Is all of the constables running out of fuel money? Well, I think you need to all approach court. You can address that during the budget time, you know, I agree. Is some of that related to the deputies changing from a car allowance to county vehicles? Is that something we're going to have to pay a lot closer attention to at budget time this next year? I don't know. Y'all are going to make it through the year, Constable, you think? We have no one driving on vehicles. It's this time. Okay. Okay. Okay. Okay. Good. Well, Phil, y'all didn't have anybody to switch from car allowance, but you're out of, you're going to be out of money. Okay. Bill Bonboard. Okay, bill bond board. Considering a approved designation of justice at peace just to the Montgomery County bill bond board. Move. Who's name one? It's going to be Wayne Mack. Correct. He's the only one here, so guess what? I know why it is show up. There's a second on paper sale. Motion passes. Drug court. Congratulations Wayne. Good morning. Let's be considered an approved changement in the amount of $100 so we can give a change for when participants amount of $100 so we can give and change for when participants are paying their monthly fees. I advise that I be bringing to you the requirement or the request for you to sign for maintaining the same retirement contribution rate. They have changed their process, so I'm just asking you to accept the form. They don't need anything from you unless there's a change. So I'm just asking you to accept the form stating the current rate. Move. So, I'll in favor, see you. So I'm just asking you to accept the form stating the current rate. Move. Second. All in favor, see ya. Okay. Okay. The next item is a request from the Office of JP1 to use JP Technology Funds in the amount of $5,355.73. This is for some items like computers in the courtroom or the judge's bench or an iPad to be able to work on scene. Move. Second. All in favor say aye. Thank you. Next we have purchasing. The project will involve over 73 million of investment and taxes will be abated on the first $67.4 million of that at 100% for three years with the abatement, percentage decreasing by 20% for the five subsequent years. It will be fully taxable in 2022. It's just got here this piece. Yes, how you do? We're glad to have you. Would you like to address the court? Or we're glad to have you? Well, we just thank the judge and the commissioners for the consideration on that. All corporation is a very old company. Great history here in the on-roadroe we've been here for 27 years now Getting bigger here in this county We're very Christian you were one of the first first ones here We're glad you're here. We're glad you're staying Are you the one I've been talking to doing a phone, Jeff? No. I've been talking to somebody out about that back road that goes in there. If you could get them to call me, I would have called them. I can't remember who it was. But anyway, thanks for coming today and I move. So I can. All my papers say aye. Thank you, Jeff. Thank you. It could be the public hearing Priced for Partial replat of Harper's Reserve Section 1 to be known as retreat at Harper's Preserves. Anyone here to address that? I'll repeat this report. Morning gentlemen. This particular application is for a partial replat and has been submitted to engineering in our office for review. We have not yet completed the The particular application is for a partial replat and has been submitted to engineering in our office for review. We have not yet completed the review process, so today this is just to establish the public hearing portion as required by the section. The partial replat is for a 7.705 acre commercial track of land that will be designated as a commercial reserve just north of the Harpers Preserve entrance. The replat of the acreage is from previously unplatted acreage that's being combined with a portion of land that was part of the original Harpers Reserve Platt and as such requires us to to proceed through a replat application process. I have received confirmation from the H.O.A. that they are of no objections to this. And then as I noted earlier, this is just to complete the requirement per statute of the public hearing. We are not submitting the plat for approval at this time. Thank you. Thank you. All right. Let's adjourn the public hearing. We can meet commission Court. And move. Second. It's hard to hear you back here in the back. Tell us what you're saying. This is Paul and Carla Shaos representing a top club of Lake Conroad. They've been big supporters of our department for many, many years. These folks are constantly helping us with something one way or the other. They've come forward and wanted to donate to check $500 Prior to part of my to go to the marine division to help my equipment and whatever we might need out there And I just think they deserve to be recognized and I apologize that I didn't stand up earlier and say something about overlooking them Great. Thank you so much down that five hundred Some yeah, that that five hundred dollars go to help finding our little drone. Well, it could go for that. As far as buying some of our equipment or some information. Thank you all for your help. And we intend to point adding to that this year. Great. Thank you. We'll continue those funds as we have in the past. What is the top group? What would have top stands for the Texas Offshore Performance Powerboat Squadron. And what it is is all the fast big shiny boats that you see out there every weekend. That's our group. We're a group of very successful people in Montgomery County that you invest a lot of money in our hobby and this way are giving back to the community. What kind of boat do you have? I have a 45-foot Donzie. Alright, well. My wife, Carla. I'm a car star. It's 1800 horsepower. 18 times. And I'm one of the slow boats out there. So you've got two or three engines. Three engines. Yes, sir. How long does it take to get across like Conrail? For us it takes a little while. It takes us from the dam up to the north side, about 15 minutes. Our boat only runs 80 miles an hour.
