MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BRADBURY HELD ON TUESDAY, JANUARY 18, 2022 EXECUTIVE ORDER NO. 25-20: Pursuant to Govemor Newsom's Executive Order N-25-20, the City is allowing Council Members, Staff and the public to participate in this City Council meeting by means of a Zoom video or telephone call. Participants will be able to hear the entire proceedings (other than the Closed Session) and be able to speak during Public Comment, Public Hearing, and other authorized times. MOTION TO APPROVE CONSENT CALENDAR: APPROVED: Hale and Lewis NOES: None ABSENT: Mayor Bruny Motion passed 4:0 CAL-AM PRESENTATION ON CITYWIDE WATER PRESSURE: City Manager Kearney stated that Staff recently became aware of water pressure deficiencies in certain parts of the City. Ar map was provided to the City Council in the agenda packet outlining where the deficiencies exist. Cal-Am representatives Brian Baretto, External Affairs Manager, and Mark Reifer, Engineering Manager, were present online to make a presentation on the issue and to discuss resolutions. The City Council inquired how the deficiencies were discovered. Mark Reifer replied that Cal-Am field tests of fire hydrants identified five areas (Sycamore Lane, Starlite Drive, the intersection of Dedoar Lane/Oak Knoll Lane, El Cielo Lane and Spinks Canyon) that need improvements to meet fire flow DISCUSSION: Minutes CC Meeting January 18, 2022 Page 2of7 requirements of 1,500 GPM. Councilmember Hale stated that he thought 2,500 GPM was required for two-story homes. Mark Reiferreplied that the Fire Departmentrequires1,500-GPM: Brian Baretto stated that construction to meet the fire fiow requirements is scheduled for the latter part of this year and the first quarter(s) of 2023. Councilmember Lewis was concerned about the time frame of 18 months from now because- (most of) Bradbury is in a High Severity Fire Zone. What is Cal-Am's contingency plan to bridge the gap? Mr. Baretto stated that Cal- Am is going to coordinate with the Fire Department. Councilmember Lewis wanted to know when the City will hear what the contingency plan is. Brian Baretto stated that the contingency plan should be ready in 3-6 months. Mayor Pro-Tem Lathrop inquired about the percentage of fire hydrants in the City that do not meet fire flow requirements. Councimember Lewis stated it will be scary during the next fire season but that the burn area from the Bobcat Fire gives us a City Manager Kearney stated that Cal-Am will come back to the City Council with the contingency plan when iti is ready. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRADBURY AMENDING THE BRADBURY MUNICIPAL CODE TOI ENACT CALIFORNIA STATE ORGANIC WASTE DISPOSAL REDUCTION REQUIREMENTS Management Analyst Musa stated the SB 1383 is a statewide effort to reduce emissions of short-lived climate pollutants (SLCP). CalRecycle is the state agency responsible for creating the regulatory standards for SB 1383 and will begin enforcement by April 1, 2022. Although the City of Bradbury is exempt from the organics recycling regulations, the City still needs to adopt an ordinance to implement relevant provisions Ordinance No. 282 implements and codifies regulations Mark Reifer stated less than 10%. little bit of a cushion. ACTION: INTRODUCTION OF ORDINANCE NO. 382: SUMMARY: ofSB 1383. applicable to the City of Bradbury, such as: Compliance with CALGreen Recycling Requirements Model Water Efficient Landscaping Ordinance Requirements (WELO) Procurement Requirements for City Departments, Direct Service Providers, and' Vendors Inspections and Investigations & Enforcement Senate Bill 1383 (Short-Lived Climate Pollutants Act) was adopted in 2016 and established methane emissions reductions targets and granted CalRecycle the authority to pass regulations to achieve those targets. This state mandate set the statewide goal for the reduction of organic waste to landfills by 50% by 2020, and 75% by 2025, in addition to the recovery of 20% edible food waste for human consumption. BACKGROUND: Minutes CC Meeting January 18, 2022 Page 3of7 SB 1383 requires local jurisdictions to update or develop programs that will address several program areas within the solid- waste and recycling discipline by-April-1,2022. SB 1383 requires cities to adopt and enforce an ordinance or enforceable mechanism to implement relevant provisions of SB 1383 regulations, but allows certain small cities to secure exemptions from some of those- requirements. Bradbury applied for and was granted a small jurisdiction exemption from the mandatory organics recycling portion of SB 1383. The term Itis recommended that the City Council introduce for first reading, by title only, Ordinance No. 382 and set the second reading and adoption for February 15, 2022. Mayor Lathrop opened the public hearing for public testimony. There being no public input, Mayor Pro-Tem declared the Councimember Lewis made a motion to introduce for first reading, by title only, Ordinance No. 382, and set the second reading and adoption for February 15, 2022. Fifteen (15) qualified vendors were contacted with a on the City of Bradbury website. Mariposa Tree Management and West Coast Arborists (WCA) were the only two vendors The last City Street Trimming program was spread over ai two- year period in Fiscal Years 2017-18 and 2018-19. The City's FY 2021-22 budget provides $15,000 for street tree trimming and maintenance, and it is anticipated that another $15,000 for tree trimming will be budgeted in 2022-23. The bid document states that the contract will be awarded to the bidder with the lowest base bid. Mariposa's base bid is Itisre recommended that the City Council award a two-year contract for tree trimming and maintenance services to West Cost Arborists, Inc. in an amount not to exceed $15,000 for SERVICES TO WEST COAST ARBORISTS: Request for Proposal (RFP). The RFP was also made available who responded to the RFP. BACKGROUND: FINANCIAL IMPACT: LOWEST BIDDER: RECOMMENDATION: $2,539 and' WCA's base bidi is $2,423. each of Fiscal Year 2021-22 and 2022-23. Councilmember Lewis seconded the motion, which was carried by the following AYES: Mayor Pro-Tem Lathrop Councilmembers Barakat, roll call vote: Hale and Lewis NOES: None ABSENT: Mayor Bruny Motion passed 4:0 APPROVED: DISCUSSION ABOUT BRADBURY NIGHT OUT: At the request of Mayor Pro-Tem Lathrop, the City Council discussed its desire to schedule a Bradbury Night Out (BNO) event in 2022. BNO is a recognition of Bradbury's incorporation on July 26, 1957. The Council has previously decided that Thursdays work best. If BNO were to be held, it could be either scheduled for Thursday, July 21 or. July 28, 2022. The City has budgeted $6,500 this fiscal year for BNO, but is uncertain at this time about holding the event because of Itis recommended that the City Council direct Staff on how to proceed with scheduling al Bradbury Night Out event. Councimember Hale suggested to revisit this item in 60 days. Councimember Barakat agreed to puti it off for 2-3 months. Mayor Pro-Tem Lathrop stated that he wants to put Bradbury The City Council will revisit this issue in 60-90 days. City Manager Kearney stated that there are a number of planning related items that need to be reviewed and discussed COVID-19. RECOMMENDATION: DISCUSSION: Night Out on the calendar. ACTION: DATE FOR A STUDY SESSION ON PLANNING RELATED ITEMS: with the City Council. These include: Reviewing the upcoming Housing Element Discussing a State mandated overlay density zone Revisiting the recently passed Urgency Ordinance Understanding the addition of State mandated family daycare homes (AB234) to residential: zoning Itis recommended that City Council set a date for a Study Session. It is preferred that the Study Session be held before the regular City Council meeting on February 15, 2022. The City Council scheduled the Study Session for Monday, February 7, 2022 at 6:00 pm. City Manager Kearney stated that he will invite Cal-Am to make a presentation on the project at the February 15, 2022 meeting.
