ISSUES, REVIEW & FINANCE WORK SESSION May 29, 2025 A special meeting of the St. Clair Borough Council was held to review issues and finance on Thursday, May 29, 2025, beginning at 6:30 p.m. In attendance were council members Tony Klazas, Judy Stednitz-Julian, President Thomas Dempsey and Mayor Tomko. Absent were council members Joann Brennan, Cheryl Dempsey, Norm Diehl and Bill Dempsey. Others in attendance included Borough Secretary Roland Price, Treasurer Carol Sutzko, Barbara Artz, Tom Kelly, John Zachar, Mike Petrozino and Michael and Hallie Jackson. Due to lack of a quorum, no meeting was held. Roland Price Borough Secretary JUNE COUNCIL MEETING June 3, 2025 The June monthly Council Meeting of the St. Clair Borough Council was held on Tuesday, June 3, 2025, in Council Chambers, St. Clair Municipal Building, 16 S. Third Street, St. Clair. The meeting began at 6:30 p.m. Answering the roll call were council members: Joann Brennan, Cheryl Dempsey, Norm Diehl, Tony Klazas, Judy Stednitz-Julian, Council President Thomas Dempsey and Mayor Tomko. Absent was Bill Dempsey. Also, present included Solicitor Ed Brennan, Borough Engineer Brian Baldwin, Borough Secretary Roland Price, Treasurer Carol Sutzko, Sergeant Brad Blanner, Street Superintendent Kevin Dempsey, Barbara Artz, Tom Kelly, Blake Herndan, John Zachar, Mike Petrozino, Vaughn Vesay, Vincent Wentzel, Dave Linkchorst, Tony Syvester, Florence Gawley, Baboucarr Sey, Michael and Hallie Jackson. Pledge of Allegiance Council member Joann Brennan read the council prayer. Copies of the minutes of the previous meeting have been given to borough council members and Mayor Tomko, are there any errors or corrections? If not, they stand approved. ENGINEER'S REPORT On a motion made by Klazas, seconded by C. Dempsey, the report was unanimously approved, and it was made part of the minutes by reference. PUBLIC COMMENT Michael Jackson questioned if residents will have a reduction in taxes and in reassessment due to the close vicinity of the landfill. He also asked if anything can be addressed concerning fireworks. Mayor Tomko added that the police will enforce, however, local citizens must testify in court. Baboucarr Sey, NJ firefighter and owner of 30 Thompson Street discussed the proposed conservatorship of his property. He claims he has spent thousands of dollars and countless hours working on the house for a vacation home for his family. The neighbors can attest to this. He added, due to the direction of the solicitor, he has been denied water and electricity, despite the electrical inspection. The house is not blighted and abandoned. He asks to be treated fairly and for his family to enjoy their home. Solicitor Brennan disagrees with Mr. Sey. Litigation is ongoing with this situation. The issue will be discussed further in executive session. 2 MAYOR'S REPORT 1. Senior citizens who are interested in information concerning the Property Tax/Rent Rebate Program could call 1-888-222-9190 or if you have a computer go to www.revenue.pa.go4 2. Thanks are extended to Street Superintendent Kevin Dempsey and the Street Department for the work done to prepare the Borough Cemetery grounds for Memorial Day. 3. As vacation time is here, residents are reminded that they may obtain a Vacation Form from the St. Clair Police Dept. Once the form is completed and returned to the Police Department, patrols could increase, and the police could contact residents on vacation should there be an emergency at their property. Forms can be obtained by calling 570-429-2240 or 570- 429-3050 as well as the St. Clair Borough website. It goes without saying that those on vacation and away from home should not advertise that fact on social media until they return home. 4. Residents are reminded of the legal restrictions on the use of fireworks that have been enacted by the Pa. General Assembly. Some of these are: 1. Fireworks cannot be directed at another person. 2. Fireworks cannot be discharged from or directed at a building or a vehicle. 3. Fireworks cannot be discharged within 150 feet of a building or a vehicle. 4. Fireworks cannot be discharged by a person who is under the influence of alcohol or a controlled substance. Historical Note After our incorporation as a Borough in 1850, John Seitzinger was elected as the first Justice of the Peace. On a motion made by Diehl, seconded by Brennan, to accept the report, approved. Mayor Tomko discussed letters received from the Bureau of District Mining Operations concerning blasting and asked the solicitor to look into the revision of the Module:16 Blast Plan. He also suggested the article recently published in the Coal Region Canary, concerning the Burma Road and District Court Magistrate Judge Plachko condemning the illegal BRADS truck traffic, be sent to DEP. 3 SOLICITOR'S REPORT Solicitor Brennan reported that he reviewed the conservatorships in great detail last month. He is waiting on court order for 146 N. Nichols Street. The Borough Manager Ordinance has been advertised and is ready for potential adoption. He is reviewing two proposed Customer Owned Generation Ordinances and is in discussion with Roland and Bob. The Game of Skill Ordinance is being updated, Brenda will be sending an updated version. The solicitor discussed the conflict of interest for the qualifications for two school crossing guards to receive HOME funding. The crossing guard actually works for the school district. The solicitor requested an Executive Session to discuss personnel issues. Councilman Diehl inquired if the funds from the Game of Skill Ordinance that was recently adopted can be appropriated to fund playground equipment for the children. The solicitor cautioned that after the fee covers administrative costs, going forward, in the budget process, a certain amount can be allocated to a specific program. On a motion by C. DEPARTMENTAL REPORTS STREET DEPARTMENT REPORT On a motion made by Diehl, seconded by Brennan, the report was unanimously approved, and it was made part of the minutes by reference. Street Superintendent Kevin Dempsey asked if council wanted to put the old garbage truck out on bid. Secretary Roland Price added that we can advertise to other municipalities later this week. Councilman Diehl thanked the Street Department for all the work done on the pool. Council thanked the Street Superintendent and everyone who spent countless hours working on it. ELECTRIC LIGHT DEPARTMENT REPORT On a motion made by Klazas, seconded by C. Dempsey, the report was unanimously approved, and it was made part of the minutes by reference. President Dempsey questioned the Solicitor about the generator from Foster Township. The solicitor said they were actually owned by Wire Tele View, not Foster Township, therefore Wire Tele View would need to be contacted, TREASURER'S REPORT On a motion made by Klazas, seconded by Brennan, the report was unanimously approved, and it was made part of the minutes by reference. 4 TAX REPORT On a motion made by Brennan, seconded by C. COMMUNICATIONS May 22, 2025 - Actors Guild of Schuylkill County & Kelsey Theater will be presenting "A Musical Stroll: 175 Years in St. Clair" on Saturday, August 2 at 7 p.m. Admission is $15.00. The show pairs St. Clair history with the regional and national timeline, using popular, traditional, and local music from the eras to tie it together. It will highlight some interesting tidbits and local history of the town as well as nod to individuals and events significant to the times. OLD BUSINESS On a motion by Klazas, seconded by C. Dempsey to extend the deadline for the Rennick subdivsion/annexation contract, approved. 5 NEW BUSINESS On a motion by T. Dempsey, seconded by Diehl, to authorize the Borough Solicitor to render an opinion that the two crossing guards are eligible for HOME Program Funding, approved. On a motion by Klazas, seconded by Brennan to approve Borough Secretary Roland Price to attend the PMEA Annual Conference from Wednesday, September 3, 2025 thru Friday, September 5, 2025 in Bedford Springs, PA, and to cover mileage, meals, and hotel reservations, approved. On a motion by T. Dempsey, seconded by C. Dempsey to conditionally hire part time patrolman Braden Jones at the rate of $28.00 per hour, pending presenting a recent physical exam and evaluation, approved. On a motion by Klazas, seconded by C. Dempsey to hire the following students for the position of lifeguard for the 2025 swim season at a pay rate of $12.00 per hour: Alaina Bauers Samantha Brew Allyson Becker Approved. On a motion by Diehl, seconded by Brennan to hire Shawn Batory for the position of concession stand for the 2025 swim season at a pay rate of $9.00 per hour, approved. On a motion by C. Dempsey, seconded by Klazas to authorize potential grant opportunities, approved. On a motion by C. Dempsey, seconded by Brennan to adopt Ordinance #454 - Creating the Office of Borough Manager. Dempsey Council President 16S Third Street St. Clair, PA 17970 RE: Consulting Engineer's Report (CER) Benesch Project No. 0325-609049.02 Dear Mr. Dempsey: The following is the status of engineering services performed by our firm as of this date: ENGINEERING CONSULTATIONS & CONSTRUCTION PROJECTS Grant Assistance 0325-609049.02, Task 4) 2022 PCCD Police Grant The Borough provided the documentation to the PCCD to complete their audit, and as of May 15, 2025, the PCCD has considered the fiscal monitoring complete. No further action for this grant is anticipated. St. Clair Little League Project (31226.20) Since the last Council Meeting, the contractor did deliver additional Diamond-Tex infield mix for the Little League's use, and grass continues to grow. The project remains open as the Contractor has not yet requested the balance of the retainage $600. DCNR contract closeout activities still remain as well (DCNR grant expiration is December 31, 2025). Firehouse Addition (0325-609049.02, Task 7) On March 27, 2025, the Alert Fire Company did provide our office with their plans and specifications to use for bidding documents related to the $400,000 LSA grant received for the fire house addition. The Alert Fire Company and the Borough should enter into a cooperative agreement to define responsibilities for bidding and construction including costs, reimbursements, bidding, review, and inspections. Ar meeting between all parties is recommended, and the cooperative agreement should be in place prior to bidding the project. Ann Street Resurfacing (0325-609049.20) The contractor - Construction Masters Services, LLC (CMS) - intends to perform milling on June 4, concrete patching on June 5, and paving and pavement markings on June 6. There will be some temporary traffic control measures in effect, but access to the driveways and businesses will be maintained throughout construction. Northward Basketball Courts (0000-031433.20) Youth Basketball Court 0325-609049.21) Earlier this year the Borough received a PA DCED CFA Greenways, Trails, Recreation Program (GTRP) grant in the full-requested amount of $64,175 to construct a youth basketball court adjacent at the Third Street Playground. We intend to bid this project at the same time as the Northward Playground project since both are similar in scope. We are still working with the applicant's S plan preparerto address some minor outstanding issues. Once those are addressed, Borough signatures can be placed on the plans, In the interim, earlier today (June 3, 2025), the Applicant did submit a time extension request until the access easement issue is resolved. POTENTIAL FUNDING/GRANTSOURCES 0325-609049.02, Task 4) COMMUNITY FACILITIES AND VEHICLES USDA Rural Development: Community Facilities Direct Loan & Grant Program Current Status: OPEN Application Deadline: Applications accepted continuously throughout the year. Uses: Funds can be used to purchase, construct, and/orimprove essential community facilities (including police & fire stations), purchase equipment (including vehicles), and pay related expenses. Funding: Low interest direct loans and/or grants (max 75%). Most funding via low-interest loans. TRANSPORTATIONINNFRASTRUCTURE 2025 PA DCED Commonwealth Financing Authority (CFA): Multimodal Transportation Fund (MTF) Current Status: OPEN (as of Mar 1, 2025) Application Deadline: July 31, 2025 Uses: Funds may be used for the development, rehabilitation and enhancement of transportation assets to existing communities, streetscape, lighting, sidewalk enhancement, pedestrian safety, roadway drainage, connectivity of transportation assets, and transit-oriented development. Bridge replacements and rehabilitations are eligible. Funding: ) Grants are available for projects with a total cost of $100,000 or more. Grants shall not exceed $3M for any project. Typically requires 30% local match, although the local match requirement has been waived for municipalities fori the past several rounds. HOWEVER, most grants are not awarded the fully requested amount. Engineering & Inspection capped at 10% of total project costs. Thanks are extended to Street Superintendent Kevin Dempsey and the Street Department for the work done to prepare the Borough Cemetery grounds for Memorial Day. 3. As vacation time is here, residents are reminded that they may obtain a Vacation Form from the St. Clair Police Dept. Once the form is completed and returned to the Police Department, patrols could increase and the police could contact residents on vacation should there be an emergency at their property. Forms can be obtained by calling 570-429-2240 or 570-429-3050 as well as the St. Clair Borough website. It goes without saying that those on vacation and away from home should not advertise that fact on social media until they return home. 4. Residents are reminded of the legal restrictions on the use of fireworks that have been enacted by the Pa. General Assembly. Some of these are: 1. Fireworks cannot be directed at another person. 2. Fireworks cannot be discharged from or directed at a building or a vehicle. 3. Fireworks cannot be discharged within 150 feet of a building or a vehicle. 4. Historical Note After our incorporation as a Borough in 1850, John Seitzinger was elected as the first Justice of the Peace. Street Dept. Picked up garbage, recyclables, large items and ashes for the month. Cleaned playgrounds and parks daily. Cut trees and brush on Hancock Street. Cut all playgrounds, parks and properties several times throughout the borough. Kept all inlets, gutters and waterways open during heavy rain and flooding. Cleaned creek and bridges of debris from the heavy rain. Prepared the Borough Cemetery for Memorial Day, which consists of cutting dead trees, repairing graves, cutting grass and trimming tomb stones. Also, all flags were installed for our Veterans, Thank you for your Service! Ann Street is cut and prepped for paving projects. Pool nstalled new swale on West side of the pool and filled ity with #4 riprap stone. Extensive amount of concrete work; chipping and jackhammering pool surface. Patched and repaired 80% of concrete between the pool and scum gutter. Removed the old filtration system and installed the new system. Installed new water lines in the bath house. Pressured washed inside and outside of the entire facility. Acid washed the entire pool before painting. Blue and white paint was all redone. Gate valve down in the pit was repaired. Restrooms water shutoffs were replaced. would like to take this opportunity to thank Dean Padfield for installing the new 6 inch pipe to the new filtration system and all his work in helping the Borough with our pool. would like to thank the entire street crew for the effort they gave in getting the pool completed. Members found a tractor trailer tanker had an engine failure and leaked motor oil on the roadway. Members closed 600' 'of the driving lane of Rt.61 North and used oil dryt to contain the fluid and keep it from any waterway or storm drains. (VLF62) In service 150 minutes. Members ventilated the entire home and checked the chimney and reset the alarm, a vehicle running close to the open garage was what caused the alarm. (CO08) In service 1 hour.
