WHEREAS, the Council ofthe Borough ofFelton (the "Borough" ") holds public meetings in accordance with the Pennsylvania Borough Code, 8 Pa.C.S. $ 101 et seq., (the "Borough Code") and the Pennsylvania Sunshine Act, 65 PaC.S. $ 701-716 (the Sunshine Act"); and WHEREAS, during such meetings, a quorum ofBorough Council gathers for the purpose of deliberating Borough business and taking official action; and WHEREAS, the Sunshine Act requires that during each public meeting Borough Council provide a reasonable opportunity for residents and taxpayers of the Borough to comment on matters of concern, official action, or deliberation which are or may be before Borough Council; and WHEREAS, the Sunshine Act authorizes Borough Council to establish reasonable rules and procedures for public comment and maintenance of order during its public meetings; and WHEREAS, Borough Council desires to establish reasonable rules and procedures for public comment and maintenance of order during its public meetings. NOW, THEREFORE, BE IT RESOLVED, the Council ofthe Borough ofFelton hereby resolves as follows, placing into immediate effect therules and procedures identified ini the policies set forth herein, and incorporating the above recitals by reference: SECTION 1. Public Comment Policy. Borough Council will entertain public comment at all public meetings as follows: 1. All persons making public comment at any public meeting must identify their first and last name and the nature of their comment on the sign in sheet available at the meeting place. 2. Public comment on listed agenda items will be heard at the beginning of each public meeting to permit comment on particular agenda items prior to official action. Other matters of concern unrelated to listed agenda items will be heard at the end of the meeting prior to adjournment. 3. Public comment shall be limited to ten (10) minutes total for each member of the public wishing to speak. 4. Public comment is not an opportunity to dialogue with the elected or appointed officials or demand explanations or answers. Elected and appointed officials may, but are not required to, follow up on public comment during the business portion of the meeting, at a later meeting, or after the meeting at another time. 5. In the event that there is insufficient time for public comment during a public meeting, Council President, at the discretion of Borough Council, may continue the public comment to Borough Council's next regular meeting or to a special meeting occurring in advance of the next regular meeting. SECTION 2. Rules of Decorum Policy. The following rules of decorum shall apply during all stages of a public meeting: 1. All public meetings shall be conducted in a courteous and dignified manner. Members of the public and members of Borough Council must be allowed to state their positions in an atmosphere of civility and respect, free ofinterruption, impertinent, or slanderous remarks, raised voices, and threats of violence. 2. All public comment shall be conducted in a calm and orderly manner, without boisterous activity such as yelling and shouting; there shall be no foul or vulgar language used or gestures made during any public meeting. 3, There shall be no defamatory content, abusive, or threatening speech, or personal attacks on the integrity of others, whether or not they are present during any public meeting. 4. At all times attendees shall respect the points of view of others, and no comment disagreeing with another's point ofview shall involve a personal attack on the character of others with a different point of view. 5. Any conduct disruptive of the public meeting and/or interfering with Council's ability to conduct Borough business, such as talking when not recognized by Borough Council, speaking beyond the allotted time, raising comments violative of this Policy, raising non-Borough related matters, and/or the inappropriate use of a cellphone or other device, shall not be tolerated. 6. Cellphones and other communicative devices shall be silenced while the meeting is being conducted. Emergency services personnel acting in their official capacity shall be exempt from this requirement 7. Any person who violates this Policy will be asked and given an opportunity to cease such violative behavior by Borough Council. If, after such an opportunity, any person continues to violate this Policy, they may be asked to leave the premises and may not retum for the remainder of that specific public meeting, unless he or she agrees to maintain civility and decorum and then does sO for the remainder oft the meeting. 8. Ifc order cannot be maintained at any time during a public meeting, Council President may recess the meeting in order to calm the situation and restore order so that business of the Borough may be conducted when the meeting resumes. SECTION3. Nothing contained in this Resolution is meant to restrict or diminish the authority vested in Borough Council by the Borough Code, the Sunshine Act, or other state or federal law. To the extent anything contained in this Resolution conflicts with any provision of the Borough Code, Sunshine Act, or other state or federal law, the Borough Code, Sunshine Act, or other state or federal law shall control. SECTION 4. All prior resolutions are hereby repealed in whole or in part to the extent inconsistent herewith. SECTION 5. This Resolution shall take effect immediately, unless otherwise provided by applicable law.
