CITY OF HAMPTON STATE OF GEORGIA ORDINANCE NO. 2025-26 AN ORDINANCE FOR THE PURPOSE OF GRANTING A CONDITIONAL USE TO PROPERTY LOCATED IN THE CITY OF HAMPTON, GEORGIA; AND FOR OTHER PURPOSES. "Personal Care Home", "home" or "facility" means any dwelling, whether operated for profit or not, which undertakes through its ownership or management to provide or arrange for the provision of housing, food service, and one or more personal services for two or more adults who are not related to the owner or administrator by blood or marriage. 3) The property owner shall provide Personal Services as defined by DCH GA 111-8-62- .03 Definitions. "Personal Services" includes, but is not limited to, individual assistance with or supervision of self-administered medication, assistance with ambulation and transfer, and essential activities of daily living such as eating, bathing, grooming, dressing, and toileting. 4) The property shall not be used for the following purposes [Authority O.C.G.A. 26-5-1, 31-2-7, 31-7-1 et seq. and 37-1-20(18)); Boarding homes or rooming houses, temporary emergency shelter; assisted living communities, hospices, traumatic brain injury facilities, drug abuse treatment facilities; facilities providing residential services for federal, state, or local correctional institutions; facilities regulated by the Department of Behavioral Health and Developmental Disabilities; Host home; group residence; Charitable organization providing shelter and other services without fees; Community living arrangements subject to DCH GA Chapter 290-9-237. 5) The licensed Personal Care Home shall admit residents to the home subject to the requirements of DPH 111.8-62-15 Admission. 6) The property owner is responsible for maintaining the congregate nousing services in perpetuity. Upon discovery that the operation of the conditional use has or had ceased for a period of 365 days or more and the owner of the property has not requested voluntary termination of the conditional use, the Zoning Administrator shall forward a report to City Council which may recommend that action be taken to remove the conditional use permit from the property through a City initiated zoning action. 7) The conditional use approval shall be limited to assisted living care personal care services provided by property owner Opeoluwa Adebayo and is not transferable to another person or entity. The approved conditional use shall expire upon property ownership change or alteration to exclude homestead exemption and primary residency status for Opeoluwa Adebayo at 280 Kyndal Drive, Hampton, GA 30228. The property is currently developed with a single-family home and as storage shed. The use and structures are compliant with development regulations for R-2 Single-family Residential zoning district. The home is located at the end of Kyndal Dr. It appears to have adequate buffers on the rear and West side to provide a protective area between properties. Addressing the identified needs seeks to benefit households of low- to moderate income and special needs individuals who should receive high priority in HOUSING the expenditure of federal funds. This includes homeless persons and households, those threatened withl homelessness, the elderly, persons with disabilities, persons living with HIVIAIDS and at-risk youth. Staff highlights the goals above believed supported through property owners utilizing their own resources to provide niche services that can prosper our community. WHEREAS, the City of Hampton (hereinafter "City") is governed by the Mayor and Council; and WHEREAS, the City desires to rescind and revoke Resolution 08-2 passed by the City on January 2, 2008; and WHEREAS, Resolution 08-02 allowed for a return of utility deposits allowing for accounts to be closed with unpaid balances; and WHEREAS, this new Resolution shall disallow the return of deposit practice and provide for an updated schedule of fees for utility deposits; and WHEREAS, the City Manager shall have the authority to create any forms and other necessary and corresponding documents required to ensure proper implementation of this Resolution; and WHEREAS, the effective date of adoption is immediately; NOW THEREFORE IT IS HEREBY RESOLVED THAT: Resolution 08-02 is rescinded and revoked in its entirety. The following fees and rules shall reflect the new utility deposits. CITY OF MILTON APPEAL PENDING BEFORE THE GEORGIA SUPREME COURT WHEREAS, the Chang V. Milton litigation involves a claim of liability against the City of Milton, Georgia, for personal injuries due to a 2016 vehicle collision with a fixed obstruction (a masonry planter) located on City-owned right of way where the obstruction was outside the motoring lanes of travel; WHEREAS, the masonry planter had been at the same location since 1992 and had never been the subject of a complaint or prior accident; WHEREAS, at the trial court, the City of Milton was found to be partially at fault and a jury awarded money damages against the City of Milton of $35,000,000; WHEREAS, on September 16, 2024, the Court of Appeals affirmed the findings of the trial court, City of Milton V. Chang, et. al., 373 Ga. App. 667 (2024) (Court of Appeals ruling); WHEREAS, on June 24, 2025, the Supreme Court of Georgia granted certiorari, Supreme Court docket number S25G0476; WHEREAS, the Georgia Supreme Court identified three issues upon which it wanted the Parties to focus in their appellate briefing: 1. Is the design and placement of objects on a shoulder of a roadway part of the ministerial duty of a municipality to keep its "streets and sidewalks in a reasonably safe condition" or is it a governmental function? NOW THEREFORE BE IT RESOLVED, that the CITY does hereby authorize participation in an amicus brief before the Georgia Supreme Court asking that the Court of Appeals ruling be reversed and that the Supreme Court's three proffered questions be answered in a way that is legally advantageous to Georgia's cities.
