WHEREAS, the Future Land Use Map of Rockdale County's Comprehensive Plan designates said property as Mixed Use/Employment Center. NOW, THEREFORE, be it ordained by the Board of Commissioners of Rockdale County, and by the authority of same as follows: Section I The Official Zoning District Map for Rockdale County, as amended, is hereby amended to rezone the 8.79-acre property, more particularly described in the legal description attached hereto as Exhibit "A" and depicted on Exhibit "B" attached hereto, from C-2 (General Commercial) to RM (Residential Multifamily). Conditions of Zoning 1. The site shall be developed in compliance with the Residential Multifamily (RM) Zoning District if adopted. 2. The site shall be restricted not to exceed 70 units. 3. The number of guest parking spaces shall be amended to meet code requirements. 4. A mandatory Homeowners' Association shall be established and shall be responsible for the maintenance of all common areas and facilities. 5. The Homeowners' Association covenants shall include a rental restriction of five percent (5%) of all townhome units. 6. All town-home units shall have a two-car garage. 7. All grass areas shall be sodded. 8. All utilities shall be placed underground. 9. Natural vegetation shall remain on the property until the issuance of a development permit. 10. Stormwater detention ponds shall be screened from view from adjoining residential properties. Screening plans shall be subject to review and approval by the Director of Planning and Development. 11. Any structures in the amenity areas shall be constructed using exterior building materials that complement the adjacent residential structures. The amenity areas may be in a single area or in multiple areas. Amenity areas shall be accessible by five-foot-wide concrete sidewalks. 12. No two immediately adjacent townhome facades shall be identical. a. Each unit's front façade shall incorporate at least three (3) distinct exterior elements selected from: - Siding color family (minimum of three families across the project) - Trim color - Shutter color - Accent color (e.g., door, window surround) - Exterior material (e.g., brick, stone, fiber cement) b. "Color family" means a coordinated set of hues derived from a single manufacturer color chart. No individual color may be used on more than two contiguous units. 13. Each block of attached units shall incorporate a minimum of two (2) offsets in the front building plane. a. Each offset shall measure at least 2 feet in depth. b. Offsets must occur between different units 14. The transitional perimeter landscape buffer shall be modified as follows: a. Minimum buffer width: 20 feet at all points. b. Average buffer width: 25 feet; and C. Where feasible, portions of the buffer may exceed 25 feet to achieve the average. 15. For every existing canopy tree of18-inch diameter at breast height removed, the developer shall plant two (2) native deciduous trees with a minimum caliper of 1.5 inches. 16. The developer shall submit a landscape plan that complies with Chapter 328 of the Rockdale County Code of Ordinances at the time of or before submitting an application for a preliminary plat. The landscape plan shall demonstrate where trees are being removed, where new trees are being planted, and where the transitional perimeter buffer exceeds twenty (20) feet. 6
