An email was sent to the USPS representative. On 3/4/25 Mr. Fox contacted staff about having issues with his neighbors about his mailbox placement and easement. On 3/12/25 He sent information about an easement agreement: - "In 1977 the county road named Indian shoals was closed and all parties with adjacent land to this road signed the easement referenced giving each access to a 20' easement based on the center line of the road. This easement is what allowed the county to close Indian shoals back in 1977 and is what Mr. hodges used to access the 26 acres we bought in 1997. With your understanding Rockdale County would have closed a road and left landowners without access. When we bought those 26 acres in 1997, that assignment of the easement is the legal document giving us access to those 26 acres. We have been using it since 1997 to access that land. Now all of a sudden, we are going build our house and these people and you and whoever you have talked to in the Rockdale County government feel you can all of a sudden take it away." On 3/24/25 he sent a copy of the reçorded deed book 176 and page number 580 ofhis property. On 5/8/25 Mr. Fox was informed that he needed to have an approved LDP before he could submit a building permit application. 6/13/25 Environmental Health approval was received. 6/17/25 No building permit application was received at this time. In 1998 we bought the adjacent 117 acres with a house and road frontage. In 2000 my In-laws moved into a new home we built at 4040 Haralson Mill Road. In 2002 we moved into a new home we built, 4050 Haralson Mill Rd. In 2022 we began talking to the planning department about bullding our retirement home. In 2024 we began the process of subdividing out a lot for our home (completed, parcel 0590030047). We began working on the site plan late 2024, I was in planning and development back In February or so and that is when they informed me about the moratorium. continued to work on my site plan knowing that I was going to ask for a waiver. So now I have been through one Building permit review and I'm working on fixing the missing Items. My hope is that will be done by the end of June and II would have a bullding permit by mid. August. Ift the stars all align and this happens just don't want to then run into the moratorium. That is why 1 am proactively trying to get my waiver in place now so that don't lose any construction time once I have permission to break ground. - look forward to meeting with you at your June meeting and hope that you will grant me this waiver.
