ROCKDALE COUNTY ORDINANCE NO. #O-2025- CONYERS, GEORGIA AN ORDINANCE TO AMEND CHAPTER 22, BUSINESSES, OF THE CODE OF ROCKDALE COUNTY, GEORGIA, AS AMENDED, SO AS TO REPEAL ARTICLE II, LICENSING OF SAID CHAPTER; AND FOR OTHER PURPOSES. WHEREAS, In 1993, the Georgia General Assembly passed laws pertaining to the payment of occupation taxes. Under that law, each business has to pay an occupation tax. Not all businesses, though, have to pay a regulatory fee or business license. There is a legal distinction between the two. Only certain businesses are subject to regulatory fees. The businesses that a regulatory fee can be charged to are listed in O.C.G.A, $ 48-13-9; and WHEREAS, O.C.G.A. $ 48-13-8, specifically states that it supersedes any local ordinances that addressed regulatory fees and business licenses; and WHEREAS, Rockdale County has not updated its ordinances SO as to reflect the change in Georgia law other than to legally provide that only certain businesses can be subject to a specific licensing requirement. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of Rockdale County, Georgia, and it is hereby ordained by the authority of same as follows: Section 1. That Article II, Licensing, or Chapter 22, Businesses, of the Code ofRockdale County, Georgia, as amended, is hereby further amended by repealing said Article II of Chapter 22 in its entirey. Section 2. It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part ofthe Code of Rockdale County, Georgia, and that the sections of this ordinance may be renumbered to accomplish that intention. Section 3. All ordinances or parts thereof which conflict with the provisions oft this ordinance are, to the extent ofs such conflict and except as hereinafter provided, hereby repealed. Section 4. Should any provision of this ordinance be declared invalid by a Court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole or any provision thereof other than the provisions specifically declared to be invalid. The governing body declares that it would have passed this ordinance and each subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more subsections, sentences, clauses or phrases may be declared invalid. B0r-340 Section 5. This ordinance shall be in full force and effect upon its official adoption by the governing body of Rockdale County, Georgia. This the day of 2025.
