PRESENTATION BY CITIZENS The City Council welcomes "Presentation by Citizens." 1 If you wish to speak, you must follow these guidelines Presentation by Citizens Guidelines: The Mayor will recognize those citizens who have signed up prior to the start of the meeting. Pursuant to Resolution No. 2020-12 Citizens are given three minutes (3:00) to speak during "Presentation by Citizens. 1 Members of the public may only speak once and cannot pass the individual's time allotment to someone else. Direct your comments to the entire Council, not to an individual member. Show the Council members the same respect and courtesy that you expect to be shown to you. The Mayor will rule any disruptive behavior, including shouting or derogatory statements or comments, out of order. Continuation of this type of behavior could result in a request by the Mayor that the individual leave the meeting, and if refused, an order of removal. In compliance with the Texas Open Meetings Act, no member of City Council may deliberate on citizen comments for items not on the agenda. (Attorney General Opinion - JC 0169) 5. CITY COUNCIL COMMENTS Pursuant to TEX. GOV'T CODE 551.0415, the Mayor, a City Council member and Staff may report on the following items of community interest:(1) expression of thanks, congratulations or condolences (2) information about holiday schedules (3) recognition of individuals (4) reminders about upcoming events organized or sponsored by the City Council (5) Information about community events and (6) announcements involving imminent threat to public health and safety. CONSENT AGENDA & DEPARTMENT REPORTS All matters listed under this item are considered routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. Approval - Building Permit Report 7. NEW BUSINESS 7.1. Discussion/Action: Council will discuss and consider approval of designating Benson Bros Wrecking as the City of Cumby's exclusive towing company for police-initiated tows and city-authorized vehicle removals. This agreement would establish Benson Bros as the sole provider, ensuring consistency in service, accountability, and streamlined administrative processes. (Chief of Police) 7.2. Discussion/Action: Council will discuss the need to seek a new City Attorney and Municipal Prosecutor due to the current attorney's fees being above the city's budgetary expectations. The City is exploring more cost-effective legal counsel options while ensuring quality representation for both general municipal matters and court prosecution. Recommended Action: Motion to authorize City Secretary to begin the process of identifying and evaluating candidates for City Attorney and Prosecutor services, and to bring recommendations back to Council for review. (City Secretary) 7.3. Discussion/Action: Council will review and consider approval of an Independent Contractor Agreement with Dennis Wagner to serve as a temporary Code Enforcement Supervisor. Mr. Wagner will provide oversight, guidance, and support to the City's Code Enforcement Officer in training, fulfilling the required one-year mentorship period. Recommended Action: Motion to approve the Independent Contractor Agreement with Dennis Wagner for Code Enforcement oversight through May 1st, 2026, as outlined in the proposed contract. (City Secretary) 7.4. Discussion: Confirm that the City of Cumby's website, cumbytx.com, will serve as the official method of posting public notices and city business, in accordance with Texas Government Code S 551.0530, which allows for internet posting of meeting notices by municipalities with a population under 48,000, provided physical access to the notice is also available. (Alderman 5/Mayor Pro Tem, Rosina Duckworth) 8. OLD BUSINESS 8.1. Discussion/Action: Update on various grants and other potential funding requests by City of Cumby (Alderman 5, Rosina Duckworth, and Miranda Randle, City Secretary) 8.2. Discussion/Action: Council to discuss and consider amending Resolution 2025-01 (Resolution 2025-01- A) to which originally imposed a $10.00 monthly Street Maintenance Fee on all utility accounts. The proposed amendment would reallocate the revenue generated by this fee to cover the annual balloon payment of $53,436.24 due each November 15th on the Cumby Volunteer Fire Department's pump truck loan. Purpose: To provide a stable, designated funding source to meet the City's financial commitment to the Cumby Volunteer Fire Department's critical firefighting equipment. Recommended Action: Motion to ms 3rh233 Page 213 approved amendment of Resolution 2025-01-A reallocating the $10 monthly street maintenance fee to cover the annual balloon payment of the Cumby Volunteer Fire Department's pump truck.
