CITY OF ARASOIA City of Sarasota Board of Adjustment Minutes March 30, 2022 The following are the motion minutes of the Board of Adjustment meeting held in the City Commission Chambers at City Hall, 1565 1st Street, 1st Floor Annex Building, on Wednesday, March 30, 2022. All in attendance stood for the Pledge of Allegiance. The meeting came to order at 1:30 p.m. Roll call was taken. PRESENT: Philip DiMaria, Chair; Matthew Ruch, Vice Chair; Olga Hanlon, BOA Member; Chad Turnbull, BOA Member; Kevin McAndrew, General Manager of Development Services and Secretary to the Board; Angela McLeod Wilkins, Administrative Assistant, Development Services ABSENT: Seat #BA3 - VACANT LEGAL COUNSEL: Mike Connolly, Deputy City Attorney Chair DiMaria reminded everyone in attendance to silence their cell phones and stated that the microphones were live and recording. The January 26, 2022, meeting minutes were approved as submitted. Mr. Connolly explained the Quasi-judicial hearing procedures and noted that one completed form for Affected Person Status had been received for one of the public hearings. Ex-parte communications were disclosed. Mr. McAndrew recited the Pledge of Conduct for all in attendance, and everyone intending to speak was sworn in. Time Limits were announced. NEW BUSINESS Variance Petition No. 2022-VAR-05, Douglas E. Olson and Kerri E. Kitson, owners requesting a variance to construct a replacement balcony which would encroach 7.8 feet into the required 30-foot waterfront setback where 22.2 feet is proposed from the mean high waterline and 30 feet is required for a total variance of 7.8 feet. Address: 554 Golden Gate Point, #5. Zoning Code Section: VII-1301(b). Legal Description: On file in the Zoning Division of the Development Services Department, City of Sarasota. Zone District: RMF-5 (Residential Multi-Family). Charles D. Bailey, III, Esq., agent. Ex-parte communications and site visits were announced. Mr. Connolly asked if David Band was in attendance, as he had completed and submitted a form for Affected Person Status. Mr. Connolly recommended that Mr. Band not be granted Affected Person Status, as he was not in attendance. The Board did not grant Mr. Band Affected Person Status. The public hearing was opened. Mr. McAndrew provided an overview of Variance Petition No. 22-VAR-05. Mr. McAndrew noted that, in addition to other letters of support received, Joan Lovell had also submitted a letter of support for the petitioner. Charlie Bailey, agent for the owners, and Doug Olson and Kerri Kitson, owners, approached the Board. Mr. Bailey presented the variance petition to the Board. Ms. Hanlon questioned Mr. Bailey regarding the size oft the proposed balcony. Citizens Bill Koeth, Tom Hedge, Max Bloom, and Craig Fitz were called to the dais. Each person spoke in support of the variance. The public hearing was closed. The Board discussed the variance. Vice Chair Ruch made a motion to approve the requested variance. The motion was seconded by Ms. Hanlon. The variance was approved 4-0. (Hanlon - yes; Turnbull -yes; Ruch - yes; DiMaria = yes) Variance Petition No. 2022-VAR-06, Parviz and Mahnaz K. Soroushian Family Revocable Living Trust, owner, requesting several variances in order to restore what is currently one parcel to its original configuration as two (2) parcels. To enable the boundary adjustment and restore the original two (2) parcel configuration, each parcel will require three (3) variances. The variances are: 1) to reduce the minimum required lot size of 7,500 square feet to 3,864 square feet for unit #3684 for a total variance of 3,636 square feet and to 3,865 square feet for unit #3688 for a total variance of 3,635 square feet being requested; 2) to reduce the minimum required lot width of 70 feet to 57.33 feet for unit #3684 for a total variance of 12.67 feet and to 57.34 feet for unit# 3688 for a total variance of 12.66 feet being requested; and 3) to reduce the minimum side setback where 6 feet is required and 0 feet is provided for a total variance of 6 feet for both unit #3684 & 3688. Dan Bailey, agent for the owner, and Parviz Soroushian, owner, approached the Board. Mr. Bailey presented the variance petition to the Board. The Board questioned Mr. Bailey. The public hearing was closed. The Board discussed the variance request. Ms. Hanlon made a motion to approve the requested variance. The motion was seconded by Mr. Ruch. The vote was 4-01 to approve variance request. (Hanlon - yes; Turnbull - yes; DiMaria yes; Ruch yes) PRESENTATION OF TOPICS BY BOARD MEMBERS There was no Presentation of Topics by any Board Member. PRESENTATION OF TOPICS BY ADMINISTRATION OR LEGAL COUNSEL Mr. McAndrew announced that the next Board of Adjustment meeting would be held on April 27, 2022 and stated that one petition was anticipated to appear on the agenda. Mr. McAndrew noted that the December date for the Board of Adjustment meeting would be discussed at the next meeting. SCHEDULING OF SPECIAL MEETINGS There were no Special Meetings scheduled.
