MINUTES OF THE SPECIAL SARASOTA CITY COMMISSION MEETING OF JANUARY 25, 1993, AT 2:00 P.M. Mr. Whelan stated that this is the third of three meetings that were requested for discussion on this matter; that the first was to discuss objectives; the second meeting was a discussion regarding strategies; and that this meeting regards a discussion of a proposal; that this proposal is not a final document and only for consideration; and that it embodies the Commission's objectives. Mr. Whelan continued that the proposal addresses owner occupied properties, home occupations and accessory apartments; that there has been a great deal of discussion on allowing home occupations as a general opportunity to City residents; that they have looked for ways to make that more attractive as an option in Gillespie Park; that both of these opportunities are not, by themselves, going to remedy the Gillespie Park neighborhood situation; that the problems of Gillespie Park need to be addressed soon; that they tend to be long range solutions; and that this proposal would only be part of a larger program of neighborhood improvement. There was a consensus of the Commission that accessory apartments should be allowed as long as it is limited to one accessory structure per premise. Commissioner Merrill stated that his concern is the 60% increase in traffic with the home occupations when there is already a traffic problem on many of the streets; that this proposal may improve Gillespie Park as a commercial enterprise but it will become less desirable as a place to live; and that he feels the wrong direction is being taken on many of the issues. Commissioner Merrill continued that in a residential area, the anonymity of business activities creates crime; that neighborhood watch programs in a quiet residential area can more easily identify strangers; and that the area would become more susceptible to crime. Bill Hewes, Building, Housing and Zoning Director, came to the Commission table. Vice-Mayor Pillot left the Commission table at 2:40 p.m. Commissioner Merrill questioned the determination of who lives in the residence; that homestead filing will not give a true picture since there is no requirement to reside on the property claimed as a homestead; that the term "owner occupant" cannot be realistically defined; that there is no big advantage to the owner occupancy laws; that the more movement toward a commercial overtone, the greater the commercial rather than residential value; and that this would purposefully bring into this neighborhood what most neighborhoods consider to be negative and yet this is viewed as a way to turn it around. Mr. Whelan stated that the proposal identifies amnesty for nonconforming character; that nonconformity resulting from the 1975 zoning ordinance is believed to be a significant problem; that nonconformity inhibits financing for acquisition and for home improvement; that this is particularly true where funds are underwritten by some federal agencies; that the consequence of nonconformity is that investment is discouraged; that the best approach would be to get out from under that even though it is not easy to do; that there is virtually universal nonconformity in the neighborhood; and that if the nonconformity were to be lifted by "grandfathering" in all of the property it would result in an upzoning because the existing density is greater than today's zoning standards. Mr. Whelan continued that this neighborhood cannot be controlled by the kind of ordinances that normally control new construction; that if the cloud is lifted and everything is grandfathered, the density would instantaneously increase and would probably be a mistake because it would behoove a developer to aggregate lots and build an apartment house in order to take advantage of the density that was created. Mr. Whelan stated further that there is no single district that can be applied to the whole area; that, consequently, the map shown identifies the zones that the properties would fall into; that the intention is to call it a "mixed zone" neighborhood and to apply the zoning restrictions to each of the zones for the properties as indicated; that this will work as far as density is concerned but many of the characteristics of use, such as the lot dimensions of the existing zones, are not reasonably applicable. Mayor Gurney asked if the zoning from 1935 and the zoning from 1973 has created a mess and would this proposal freeze this mess and make the most of it rather than attempting to do something that will, over time, correct the situation. Commissioner Patterson asked if it is possible that zoning and code enforcement could be combined with the grandfathering so that if one did not bring their property up to code over a particular period of time this "grandfathering" would not apply. Mr. Whelan stated that this is very similar to an amortization clause in an ordinance which requires that buildings within a period of years meet the zoning ordinance or be destroyed; and that this is not an unknown type of clause. City Manager Sollenberger stated that the administration recommends the concept of the zoning district that Mr. Whelan has proposed; that staff could refine the concept and the language of the proposed ordinance and bring it back to the Commission for review; that with respect to the discussion on buy-outs of multiple units, that is seen as a separate issue and one that can be addressed at another time; that programs may come available that can deal with those kinds of issues; that that is more of a non-zoning technique; that he recommends remaining with the zoning issue that was addressed to the staff and consultant; and that, in light of the complexity of the zoning issue, this is a sound recommendation. Mayor Gurney asked if this concept, as discussed today, will run parallel with the historic preservation element or become a major conflict. Mr. Sollenberger stated that there is a correlation between the two; that since staff is working on both, they need to be made aware of that; and that the Commission is viewing a specific problem here whereas the conservation zoning may be applied specifically for neighborhoods. Mayor Gurney stated that he would not want to preclude any options offered by the preservation or conservation element by adopting something quickly and "grandfathering" in an unusual situation and then lose the ability for something through the Historic Preservation Board. Mr. Sollenberger stated that the Planning Department will be working with both issues and will make sure that there is a correlation between the two. Mr. Sollenberger recommended a motion to accept the new zoning district concept of "residential mixed use" and to refer this matter back to staff for refinement and development of a draft ordinance for the Commission's review. Mr. Abbott stated that the AEMP outlines the long term goals for the Public Art program and that these goals should be implemented when possible; that the Master Plan Team has made many recommendations to the Public Art ordinance; and wishes to emphasize the following major recommendations: A That the Public Art ordinance be extended to cover public (i.e. municipal) as well as private construction. The allocation for Public Art be increased to a full one percent for public (i.e. municipal) projects. The ordinance be extended beyond the Core Business District (CBD) and the Theater and Arts District (TAD) to include the entire city. The advisability of creating a city-county combined program in the arts should be taken under advisement so as to streamline operations and avoid duplication. The cap on the maximum contribution for Public Art be eliminated. The city fund a permanent part-time administrator to coordinate and implement the Public Art Program for the city. The committee shall consist of five members, with at least two art professionals and one registered architect.
