MINUTES OF THE SPECIAL SARASOTA CITY COMMISSION MEETING OF NOVEMBER 17, 1998, AT 1:00 P.M. PRESENT: Mayor Jerome Dupree, Commissioners Mollie Cardamone, David Merrill, and Gene Pillot, City Manager David Sollenberger, City Auditor and Clerk Billy Robinson, and City Attorney Richard Taylor ABSENT: None PRESIDING: Mayor Jerome Dupree The meeting was called to order in accordance with Article III, Section 9 (b) of the Charter of the City of Sarasota at 1:00 p.m. City Auditor and Clerk Robinson gave the Invocation followed by the Pledge of Allegiance. 1. APPOINTMENT RE: CITY COMMISSIONER TO DISTRICT NO. 2 COMMISSION SEAT - CONFIRMED THE VACANCY FOR THE DISTRICT NO. 2 COMMISSION SEAT: APPOINTED ALBERT HOGLE TO THE DISTRICT NO. 2 COMMISSION SEAT (AGENDA ITEM I) #1 (0012) through (1117) City Attorney Taylor stated that Article III, Section 5, Charter of the City of Sarasota, provides direction concerning the filling of vacancies on the Commission as follows: The vacated office shall be filled as follows: (b) If such vacancy occurs within one (1) year prior to the expiration of the commissioner's term, a majority of the remaining commissioners shall, within twenty-one (21) days, appoint a qualified elector to the vacant seat to serve the remainder of the unexpired term. City Attorney Taylor continued that the recommended order of business is as follows: 1) confirmation by vote of the vacancy for the District No. 2 Commission seat resulting from the resignation of former Vice Mayor Patterson, 2) determination of the process by which the Commission will make the appointment, and 3) appointment of a qualified elector of the City to fill the District No. 2 Commission seat for the remainder of the unexpired term which is through April 16, 1999. On motion of Commissioner Pillot and second of Commissioner Cardamone, it was moved to confirm the vacancy for the District No. 2 Commission seat created by the November 17, 1998, resignation of former Vice Mayor Patterson, who was elected to the Sarasota Board of County Commissioners and who will be sworn in on November 17, 1998. Commissioner Merrill nominated John Browning. Commissioner Cardamone stated that before reaching the point of accepting applications, consideration was given to reaching a decision concerning appointment to the District No. 2 Commission seat; that considerations included an individual with good business experience, a balanced career of successes, good neighborhood experience and leadership, and City advisory board service providing an understanding of City operations; that long-term City residency was also considered but is not the most important criterion; that careful consideration was given resulting in the identification of two City residents as possible candidates; that one individual does not live in District No. 2 and is, therefore, not eligible; that the other individual is eligible; that both individuals have been key members of the Planning Board/Local Planning Agency (PBLP) for many years; that both individuals could assume an immediate active role on the Commission due to the knowledge of City affairs; that Phase II of the proposed Land Development Regulations (LDRs) and continued work on the Comprehensive Plan, also called the Sarasota City Plan, are projects which will be presented to the Commission in the future; that land use decisions and requests for rezonings are acted upon by the PBLP and also comprise a significant amount of the Commission's activities; that the caliber of the applications received is exceptional. Commissioner Cardamone nominated Robert Lindsay for the District No. 2 Commission seat at this time. Mayor Dupree stated that all the applicants are highly qualified; that upon reviewing the applications, three possible nominees were identified: Albert Hogle, Robert Lindsay and Joyce Mintzer. Mayor Dupree nominated Joyce Mintzer. Commissioner Pillot stated that Albert Hogle has been actively involved in City business during 18 years of service as one of five Trustees on the Police Officers' Pension Fund Board, during which time the plan grew from approximately $8 million to over $100 million and has attended many Commission meetings as a result of duties as a police officer and administrator; that additionally, Albert Hogle has attended every regular and special Commission meeting since retirement in September 1998, indicating a sincere desire to develop an understanding of the specific issues currently being considered by the Commission. Mayor Dupree stated that Joyce Mintzer has been active in the community, concerned about issues with which the Commission has been dealing and has led the Dolphin Tower Condominium Association; that Joyce Mintzer is genuinely concerned about the City's future direction. Commissioner Pillot stated that, with respect, the position of opposing an announced candidate for the District No. 2 Commission seat in the March 1999 election is not supported; that appointing an announced candidate may be beneficial to the City as an advantage is provided to the candidate to decide if interested in running for office and also to the public to evaluate the individual; that the benefit to the candidate in the election is not known; however, in the November 1998 election, three elected seats were open: two for Commissioner to the Sarasota Board of County Commissioners and one for the School Board for Sarasota County; that the voters of the community are intelligent, insightful and incisive; that two of the three incumbents lost elected seats, even though having a record of four years and an opportunity to campaign; that the third incumbent almost lost, winning the primary election by a margin of only approximately 180 votes; that the evidence is recent and refers to three important elected seats in the community; that the community decided not to reelect two incumbents and almost not to reelect a third incumbent. Commissioner Cardamone stated that a possibility is to open the process to the four known candidates, allowing each to serve for one month. Commissioner Pillot stated that the feasibility or consistency with the Charter of the City of Sarasota is not known; that the appointment should be open to anyone with an interest.
