CITY OF ARASOA City of Sarasota Board of Adjustment Minutes November 20, 2024 The following are the motion minutes of the Board of Adjustment meeting held in the City Commission Chambers at City Hall, 1565 1St Street, on Wednesday, November 20, 2024 All in attendance stood for the Pledge of Allegiance. The meeting came to order at 1:32 p.m. Mr. Ruch reminded everyone in attendance to silence their cell phones and to speak into the microphones. Roll call was taken. PRESENT: Matthew Ruch, Vice Chairperson; Tiffany Nesbit, BOA Member; Lawrence Cherry, BOA Member; Natacha Denis, BOA Member; Kathryn Cooper, Alternate BOA Member; Alison Christie, General Manager, Development Services, and Secretary to the Board; Amanda Cisneros, Development Review Coordinator, Development Services LEGAL COUNSEL: John Shamsey, Assistant City Attorney Mr. Shamsey then explained the Quasi-Judicial hearing procedures. Ms. Christie recited the Pledge ofConduct for all in attendance. Everyone intending to speak was sworn in by Mr. Shamsey. Ex-parte communications were disclosed. Time Limits were announced. Variance Petition No. 24-VAR-07, 448 Bowdoin Circle Christopher G. Ontiveros Revocable Trust and Pamela J. Ontiveros Revocable Trust, property owners, propose an increase of the required five- foot maximum elevation above the Mean Low Watermark for seawalls to 5.65 feet above the Mean Low Watermark. Pursuant to Section VII-1304 of the Zoning Code, in no event shall seawalls or bulkheads exceed an elevation of plus five feet above the Mean Low Watermark. The applicant is requesting: a top height of 4.5 NAVD1988, which is 5.65 feet above the mean low water for a variance request of .65 feet. Zoning Code Section: VII-1304. Legal Description: On file in the Zoning Division of the Development Services Department, City of Sarasota. Zone District: RSF-2 (Residential Single Family-2). Kristin Tignor, agent to the owner. Kristy Tignor presented on behalf of the owner and provided an overview of Variance Petition No. 24- VAR-07. The Board briefly questioned the petitioner. The hearing was closed. The Board discussed the variance requested. BOA Member Nisbet made a motion to approve Variance Petition No. 24-VAR-07. BOA Member Cherry seconded the motion. The motion passed 5-0.
