MINUTES OF THE SPECIAL SARASOTA CITY COMMISSION MEETING OF MAY 8, 2002, AT 1:00 P.M. PRESENT: Mayor Carolyn J. Mason, Vice Mayor Lou Ann R. Palmer, Commissioners Richard F. Martin, Mary J. Quillin, and Mary Anne Servian, City Manager Michael A. McNees, City Auditor and Clerk Billy E. Robinson, and City Attorney Richard J. Taylor ABSENT: None PRESIDING: Mayor Mason The meeting was called to order in accordance with Article III, Section 9(b) of the City of Sarasota Charter at 1:01 p.m. City Auditor and Clerk Robinson gave the Invocation followed by the Pledge of Allegiance. 1. INTRODUCTION RE: ATTORNEY- - CLIENT SESSION IN ACCORDANCE WITH SECTION 286.011(8) FLORIDA STATUTES (2002), TO DISCUSS STRATEGY RELATED TO LITIGATION EXPENSES ARISING OUT OF THE PENDING LAWSUIT AND POSSIBLE ARBITRATION AND MEDIATION IN THE MATTER OF CITY OF SARASOTA VERSUS TALIESIN ARCHITECTS, LTD. ET AL. CIRCUIT COURT FOR SARASOTA COUNTY, FLORIDA (CASE NO. 2001-CA-16413-NC) (AGENDA ITEM I) CD (01:02) through (01:07) Mayor Mason stated that the Special meeting has been called for the Commission to recess and reconvene into an attorney-client session; and requested that the City Attorney explain the procedure for the attorney-client, session. City Attorney Taylor stated that the Special meeting and the attorney-client session have been called in accordance with Section 286.011(8), Florida Statutes (2002), to discuss strategy related to litigation expenses and the arbitration demand and possible mediation arising out of the pending lawsuit in the matter of City of Sarasota versus Taliesin Architects, Ltd., et al., Circuit Court for Sarasota County, Florida, Case No. 2001-CA- 16413-NC; that for the record, the Special meeting commenced at 1:01 p.m.i that the attorney-client session will be confined to litigation expenditures and strategy related to an arbitration demand and possible mediation; that the request for the attorney- BOOK 51 Page 23262 05/07/02 2:00 P.M. BOOK 51 Page 23263 05/07/02 2:00 P.M. client session was made at the May 6, 2002, Regular Commission meeting in accordance with State Statute; that the parties to the case are: A City of Sarasota - Plaintiff Taliesin Architects, Ltd., et al. - Defendant City Attorney Taylor continued that the persons attending the attorney-client session will be : Carolyn J. Mason, Mayor; Lou Ann R. Palmer, Vice Mayor; Richard F. Martin, Commissioner; Mary J. Quillin, Commissioner; Mary Anne Servian, Commissioner; Richard J. Taylor, City Attorney; Michael A. McNees, City Manager; Douglas Lawless, City Litigation Counsel, City Attorney's Office; Robert Trohn and Jeffrey Keiner, Special Legal Counsels to the City; and a certified court reporter The Commission recessed at 1:07 p.m. into an attorney-client session in Room 109 in City Hall and reconvened in the Chambers at 2:00 p.m. 2. ANNOUNCEMENT RE: TERMINATION OF ATTORNEY - CLIENT SESSION IN ACCORDANCE WITH SECTION 286.011 (8), FLORIDA STATUTES (2002) (AGENDA ITEM II) CD (02:00) through (02:04) Mayor Mason announced the termination of attorney-client session in accordance with Section 286.011(8), Florida Statutes (2002), at 2:00 p.m. City Attorney Taylor stated that for the record, the attorney- client session was terminated at 2:00 p.m. 3.
