CITY OF GARASOA City of Sarasota Board of Adjustment Minutes October 25, 2023 The following are the motion minutes of the Board of Adjustment meeting held in the City Commission Chambers at City Hall, 1565 1St Street, on Wednesday, October 25, 2023. All in attendance stood for the Pledge of Allegiance. The meeting came to order at 1:30 p.m. Chair Ruch reminded everyone in attendance to silence their cell phones and stated that the microphones were live and recording. Roll call was taken. PRESENT: Matthew Ruch, Chair; Olga Hanlon, Vice Chair; Tiffany Nesbit, BOA Member; Chad Turnbull, BOA Member; Myra Schwarz, General Manager, Development Services, and Secretary to the Board; Angela McLeod, Administrative Assistant, Development Services ABSENT: None LEGAL COUNSEL: John Shamsey, Assistant City Attorney The June 28, 2023, and July 27, 2023, meeting minutes were approved as submitted. Ms. Schwarz introduced new Board of Adjustment Member, Tiffany Nisbet, and new Legal Counsel to the Board, Assistant City Attorney John Shamsey. Mr. Shamsey then explained the Quasi-judicial hearing procedures. Ex-parte communications were disclosed. Ms. Schwarz recited the Pledge of Conduct for all in attendance. Everyone intending to speak was sworn in. Time Limits were announced. Variance Petition No. 2023-VAR-11, Sean Jennings, owner, requesting three (3) variances to allow an existing, non-conforming residence to remain in its current configuration. The variances requested are: 1) a 13.1- foot reduction to the: required minimum 20-foot front yard setback along Whittier Drive; 2) a 7.20- foot reduction to the west side yard setback, when the south side yard has a setback of 8.50 feet, and the west side yard requires a setback of 12 feet to meet the minimum 20-foot combined side yard setback requirement; and 3) a 4.5% increase to the 35% maximum building coverage requirement, for a total building coverage of 39.5%. Zone District: RSF-2 (Residential Single Family). Patrick Seidensticker, Esq., agent. Ms. Schwarz provided an overview ofVariance Petition No. 23-VAR-11. Mr. Ruch invited the petitioners to approach the dais. Patrick Seidensticker, agent for the owner, approached the dais with Macaire King (Icard Merrill), and owners, Sean Jennings and Sofia Fazal. Mr. Seidensticker presented Variance Petition No. 23-VAR-11. The Board questioned the petitioners. There were no public speakers. The hearing was closed. The Board discussed the variances requested. Dr. Turnbull made a motion to approve Variance Petition No. 23-VAR-11. Ms. Hanlon seconded the motion. Mr. Shamsey confirmed that the motion to approve the variance also included the proffer made by the petitioner. The Board continued to discuss the variance petition. The public hearing was reopened.
