BOOK 50 Page 22079 11/07/01 12:00 NOON MINUTES OF THE STATUTORY SARASOTA CITY COMMISSION MEETING OF NOVEMBER 7, 2001, AT 12:00 NOON. PRESENT: Mayor Carolyn J. Mason, Vice Mayor Mary J. Quillin, Commissioners Richard F. Martin and Lou Ann R. Palmer, City Manager Designate Michael A. McNees, City Auditor and Clerk Billy E. Robinson, and City Attorney Richard J. Taylor ABSENT: None PRESIDING: Mayor Mason The meeting was called to order in accordance with Article IX, Section 6(b) of the Charter of the City of Sarasota at 12:02 p.m. City Auditor and Clerk Robinson gave the Invocation followed by the Pledge of Allegiance.. 1. ADOPTION RE: : PROPOSED RESOLUTION NO. 02R-1441, OF THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA, DECLARING THE OFFICIAL RESULTS OF THE FIRST ELECTION OF NOVEMBER 6, 2001; DIRECTING THE CITY AUDITOR AND CLERK TO NOTIFY, THE TWO CANDIDATES WHO RECEIVED THE FIRST AND SECOND LARGEST NUMBER OF VOTES, / BUT DID NOT RECEIVE THE SUPPORT OF A MAJORITY OF VOTERS THAT THEIR NAMES WILL APPEAR ON THE DECEMBER 4, 2001, BALLOT FOR THE SECOND ELECTION; AND PROVIDING AN EFFECTIVE DATE; ETC. - ADOPTED (AGENDA ITEM I) #1 (0037) through (0277) City Auditor and Clerk Robinson stated that the Charter of the City of Sarasota (1996) (City Charter) requires a meeting the day after an election to declare the results by resolution; and read proposed Resolution No. 02R-1441 declaring the results in the Commission election for the District 2 seat in its entirety which included the following: Candidate No. of Votes Percentage of Votes Dan F. Kennedy 825 28.83% Joyce Mintzer 691 24.14% Mary Anne Servian 1,346 47.03% City Auditor and Clerk Robinson stated that the total number of valid ballots cast for the Office of City Commissioner in District No. 2 was 2,862, including 165 valid absentee ballots; that 11 ballots were determined invalid and not considered in the total number of valid ballots for a variety of reasons including lack of signature or lack of. witness signature on absentee ballots, over and under voting, etc.; that proposed Resolution No. 02-1441 provides for a second election on December 4, 2001, as no candidate received the support of a majority of voters. On- motion of Vice Mayor Quillin and second of Commissioner Martin, it was moved to adopt proposed Resolution No:, 02R-1441. Mayor Mason requested that City Auditor and Clerk Robinson proceed with the roll-call vote. Motion carried unanimously (4 to 0): Martin, yes; Mason, yesi Palmer, yes; Quillin, yes. Mayor Mason thanked the three candidates for a well-run campaign and the District 2 residents for taking time to vote. Vice Mayor Quillin thanked Kathy Dent, Supervisor of Elections, and City Auditor and Clerk Robinson for a well-run Special Election; that the media assisted in reminding District 2 voters of the Special Election; that the three candidates participated in well-run campaigns; that voter turn-out was significant; that District 2 voting will be publicized and encouraged through the December 4, 2001, Special Run-Off Election.
