Palmer and Mary Anne Servian, City Attorney Robert M. Fournier, and City Auditor and Clerk Billy E. Robinson ABSENT: Commissioner Ken Shelin, due to illness, and City Manager Michael A. McNees The meeting was called to order by Mayor Atkins at 3:03 p.m. INVOCATION/PLEDGE OF ALLEGIANCE: City Auditor and Clerk Robinson 1. INTRODUCTION RE: ATTORNEY-CLIENT SESSION IN ACCORDANCE WITH SECTION 286.011(8). FLORIDA STATUTES (2005), PURSUANT TO A REQUEST BY THE CITY ATTORNEY FOR THE PURPOSE OF MEETING IN A CLOSED SESSION TO DISCUSS SETTLEMENT NEGOTIATIONS AND STRATEGY RELATED TO LITIGATION EXPENDITURES IN THE MATTER OF WILLIAM F. SULLIVAN, IV, AS PERSONAL REPRESENTATIVE OF THE ESTATE OF JOSE RAMIREZ-CASAS. DECEASED, ET. AL VERSUS CITY OF SARASOTA, SARASOTA COUNTY CASE NO. 2004 CA 11944 NC (AGENDA ITEM I) City Attorney Fournier stated that the Commission was advised of the desire for an out-of-the-sunshine, attorney-client session to obtain advice regarding a settlement proposal and/or strategies related to litigation expenses in the matter of City of Sarasota versus William F. Sullivan, IV, as Personal Representative of the estate of Jose Ramirez-Casas, deceased, et. al, Sarasota County Case No. 2004 CA 11944 NC; that the plaintiff is William F. Sullivan, as Personal Representative of the estate of Jose Ramirez-Casas, deceased, et. al, and the defendant is the City of Sarasota. City Attorney Fournier continued that the out-ol-the-sunshine, attorney-client session is anticipated to last approximately 30 minutes; that following persons will be attending the out-of-sunshine, attorney-client session: Fredd "Glossie" Atkins, Mayor, Danny Bilyeu, Vice Mayor, Lou Ann R. Palmer, Commissioner, Mary Anne Servian, Commissioner, City Attorney Robert M. Fournier, City Attorney, Whitney C. Coyne, Assistant City Attorney, James Rolfes, Special Legal Counsel for City, and a certified caurt reporter, The Commission recessed at 3:05 p.m. into an out-of-sunshine, attorney-client session in Room 109, City Hall, and reconvened in the Chambers at 3:38 p.m. 2. ANNOUNCEMENT RE: TERMINATION OF ATTORNEY-CLIENT SESSION IN ACCORDANCE WITH SECTION 286.011(8), FLORIDA STATUTES (2005) (AGENDA ITEM II) Mayor Atkins stated that for the record, the out-of-sunshine, attorney-lient session concerning the matter of William F. Sullivan, IV, as Personal Representative of the estate for Jose Ramirez-Casas, deceased, et. al, versus City of Sarasota concluded at 3:36 p.m. In response to a question from Mayor Atkins concerning action required by the Commission, City Attorney Fournier stated that no further action is required by the Commission; therefore, a motion is not necessary. 3.
