CITY SARASOA City of Sarasota Board of Adjustment Minutes May 26, 2021 The following are the motion minutes of the Board of Adjustment meeting held in the City Commission Chambers at City Hall, 1565 1st Street, on Wednesday, May 26, 2021. The meeting came to order at 1:38 p.m. Chair Israelson reminded everyone in attendance to silence their phones and asked that anyone intending to speak, speak into the microphones. Roll call was taken. PRESENT: Chair, Paul Israelson, Vice Chair, Philip DiMaria; BOA members; Olga Hanlon and Matthew Ruch; Briana Dobbs, Development Review Senior Planner and Secretary to the Board, Development Services; Angela McLeod Wilkins, Administrative Assistant, Development Services ABSENT: BOA Member Edward D'Agostino LEGAL COUNSEL: John Shamsey, Deputy City Attorney Ms. Hanlon made a motion to approve the meeting minutes for the January 27, 2021, meeting and the April 28, 2021, meeting. Mr. Ruch seconded the motion. Both sets of minutes were unanimously approved as submitted. Mr. Shamsey explained the quasi-judicial procedures. Ex-parte communications and site visits were announçed. Ms. Dobbs recited the Pledge of Conduct and everyone intending to speak was sworn in. Time Limits were announced. NEW BUSIINESS Variance Petition No. 2021-VAR-03, 816 22nd Street LLC, owner, requesting a setback variance to construct a new single-family dwelling. The variance would be 12 feet from the minimum front yard setback of20 feet (8 feet would be provided) due to the location of an existing grand tree. Address: 816 22nd Street. Zoning Code Section: VI-102(m). Legal description: On file in the Zoning Division of the Development Services Department, City of Sarasota. Zone district: RSF-E (Residential Single-Family Estate). Joel Freedman, agent for the owner. The public hearing was opened. Ms. Dobbs provided an overview ofthe requested variance. Joel Freedman, agent for the owner, approached the Board and presented the variance petition to the Board. He was accompanied by Mark Dempsky, architect for the owner. The Board questioned Mr. Freedman. The public hearing was closed. The Board discussed the variance request. Vice Chair DiMaria made a motion to approve the requested variance with the condition that the variance will be nullified if the subject tree were to fail prior to the' issuance of a building permit. The motion was not seconded. The motion failed. Mr. Ruch made a motion to deny the requested variance. The motion was seconded by Ms. Hanlon. The motion passed 3-1 to deny the variance. (Israelson yes; DiMaria no; Hanlon yes; Ruch - yes) ADMINISTRATIVE MATTERS Ms. Dobbs confirmed that the Board of Adjustment would be holding a June meeting. Vice Chair DiMaria stated that he would be unable to attend the June meeting. There was no scheduling of special meetings.
