May 7, 2019 The Cumberland County Board of Elections met at the Board of Elections Office at 1:00pm for an absentee meeting. Present: Linda Devore, Secretary Bobby Swilley, Member Helen Nelson, Member Irene Grimes, Member Terri Robertson, Director Staff: Angie Amaro and Vicki Hilburn Secretary Linda Devore called the meeting to Order. Secretary Devore stated that she reviewed minutes from previous years, and determined that the precedent is for the Secretary to preside at meetings in the absence of the Chairman. Director Robertson stated that is the way it has always been handled since she came to work at the Board of Elections. Member Bobby Swilley stated that this is a different Board than last where we had a Vice Chair. He stated that once we all walk past the door, we take off our political hats- we don't represent the party we represent the people; since there are two elected officers, it would be logical to appoint the next ranking officer. Member Irene Grimes stated that members should rotate stepping in for Chairman in his absence. Secretary Linda Devore stated that she feels it is important for the Board to follow precedent. ACTION: Linda Devore moved that the Board follow precedent in the absence of the Chairman and allow the Secretary to conduct the meeting. It was seconded, and the motion passed. Member Irene Grimes was the only vote in opposition. Vicki Hilburn presented the absentee report: 4 civilian absentee, 67 one stop voters from the last meeting. ACTION: Bobby Swilley moved that the Board approve the absentees as presented. It was seconded and unanimously approved. Secretary Devore asked about the subpoena memo from the State Board of Elections. Director Robertson stated that the original subpoena was sent in August of 2018; they wanted copies of voter registrations, absentee ballots, absentee envelopes of all person who voted in 2012-2018. She was asked to estimate the cost, and it was close to $500,000. The State Board asked the Attorney General to quash the subpeona and the BOE was given until January. The State Board has provided most of the information requested, so the county had only a few records to research. The email was marked as confidential, the email was encrypted, the names provided were checked and no one met the criteria they were looking for. ADJOURNMENT: There being no further business, the meeting was adjourned at 1:40PM.
