PRESENT: Mayor Mary Anne Servian, presiding, Vice Mayor Fredd "Glossie" Atkins, Commissioners Danny Bilyeu, Lou Ann R. Palmer, and Ken Shelin, City Attorney Robert M. Fournier, City Manager Michael A. McNees, and City Auditor and Clerk Billy E. Robinson ABSENT: None The meeting was called to order by Mayor Servian at 6:00 p.m. INVOCATION AND PLEDGE OF ALLEGIANCE: City Auditor and Clerk Robinson 1. FIRST PUBLIC HEARING RE: PROPOSED RESOLUTION NO. 05R-1848, APPROVING A BUDGET; AND MAKING APPROPRIATIONS OF SUMS OF MONEY FOR ALL EXPENDITURES OF THE CITY OF SARASOTA AND THE ST. ARMANDS SPECIAL BUSINESS NEIGHBORHOOD IMPROVEMENT DISTRICT FOR THE FISCAL YEAR BEGINNING ON OCTOBER 1, 2005, AND ENDING ON SEPTEMBER 30, 2006; PRESCRIBING THE TERMS, CONDITIONS AND PROVISIONS WITH RESPECT TO THE ITEMS OF APPROPRIATION AND THEIR PAYMENT; PROVIDING FOR SUPPLEMENTAL APPROPRIATIONS AND REAPPROPRIATIONS; PROVIDING FOR THE SEVERABILITY OF PARTS HEREOF IF DECLARED INVALID; ETC. (TITLE ONLY) (AGENDA ITEM I) A presentation was made by Finance Director Gibson Mitchell and Deputy Finance Director Christopher Lyons. The following person spoke: Joseph Nickelson City Auditor and Clerk Robinson read oroposed Resolution No. 05R-1848 by title only. A motion was made by Commissioner Shelin, seconded by Vice Mayor Atkins, to adopt proposed Resolution No. 05R-1848 (FTR 6:20). In response to a comment by Commissioner Palmer to schedule the budget workshops early sO that all Commissioners can attend, Director Mitchell stated that Staff would like to schedule the budget workshops in January 2005. Mayor Servian stated that scheduling the budget workshops in January 2005 is acceptable. In response to a comment by the Director Mitchell, Mayor Servian stated that holding the budget workshops over two consecutive days rather than the four days scheduled in the past would be preferable. Mayor Servian called for a vote on the motion, which carried by a 5-0 vote. 2. PUBLIC HEARING RE: PROPOSED ORDINANCE NO. 05-4643, TO CORRECT AND MODIFY PROJECTS RELATED TO LEVEL OF SERVICE STANDARDS IN THE CAPITAL IMPROVEMENTS CHAPTER OF THE COMPREHENSIVE PLAN OF THE CITY OF SARASOTA (AIKIA THE SARASOTA CITY PLAN [1998]); STATING FINDINGS OF FACT; ADOPTING BY REFERENCE AN UPDATED SCHEDULE OF LEVEL OF SERVICE PROJECTS INTO THE CAPITAL IMPROVEMENTS CHAPTER OF THE SARASOTA CITY PLAN (1998); REPEALING ORDINANCES IN CONFLICT; PROVIDING FOR THE SEVERABILITY OF THE PARTS HEREOF; ETC. A motion was made by Commissioner Bilyeu, seconded by Commissioner Shelin, and carried by a 5-0 vote to pass proposed Ordinance No. 05-4643 on first reading (FTR 6:35). 3. SECOND READING RE: PROPOSED ORDINANCE NO. 05-4628 TO REZONE VARIOUS PROPERTIES LOCATED IN THE GILLESPIE PARK AND PARK EAST NEIGHBORHOODS AND MORE PARTICULARLY DESCRIBED HEREIN TO THE DOWNTOWN NEIGHBORHOOD (DTN) ZONE DISTRICT, AN URBAN ZONE DISTRICT, GENERALLY APPROPRIATE FOR RESIDENTIAL NEIGHBORHOODS LOCATED IN CLOSE PROXIMITY TO DOWNTOWN; ALLOWING A MAXIMUM OF TWELVE (12) DWELLING UNITS PER ACRE AND A MAXIMUM BUILDING HEIGHT OF THREE (3) STORIES; ALLOWING FOR CERTAIN DEVELOPMENT RIGHTS AS MORE FULLY SPECIFIED HEREIN; PROVIDING FOR THE SEVERABILITY OF THE PARTS HEREOF; ETC. A motion was made by Commissioner Bilyeu, seconded by Commissioner Shelin, and carried by a 3-2 vote with Mayor Servian and Commissioner Palmer voting no to adopt proposed Ordinance No. 05- 4630 on second reading with the addition to remove the area in the Commercial Central Business District (CCBD) Zone District known as Burns Court and move it into the Downtown Core (DTC) Zone District. SECOND READING RE: PROPOSED ORDINANCE NO. 05-4631, TO REZONE VARIOUS PROPERTIES LOCATED IN DOWNTOWN SARASOTA AND MORE PARTICULARLY DESCRIBED HEREIN TO THE DOWNTOWN BAYFRONT (DTB) ZONE DISTRICT, AN URBAN MIXED USE ZONE DISTRICT GENERALLY APPROPRIATE FOR THE DOWNTOWN SARASOTA BAY FRONT AREAS BETWEEN MOUND STREET AND 10TH STREET WHICH ARE NOT DEVOTED TO RECREATIONAL USES; ALLOWING A MAXIMUM OF 50 DWELLING UNITS PER ACRE AND A MAXIMUM BUILDING HEIGHT OF EIGHTEEN (18) STORIES; ALLOWING FOR CERTAIN DEVELOPMENT RIGHTS UNDER EXISTING ZONING TO TEMPORARILY CONTINUE AND PROVIDING FOR VESTING OF CERTAIN DEVELOPMENT RIGHTS AS MORE FULLY SPECIFIED HEREIN; ETC. A motion was made by Commissioner Vice Mayor Atkins, seconded by Commissioner Shelin, and carried by a 5-0 vote to adopt proposed Ordinance No. 05-4631 on second reading (FTR 7:03). 7. OTHER MATTERS/ADMINISTRATIVE OFFICERS (AGENDA ITEM VIII) A. In response to a request from Commissioner Palmer, Mayor Servian noted Commission consensus for Staff to consider possible modifications to the Downtown Urban Mixed Use Future Land Use Classification as part of the Evaluation and Appraisal Report (EAR) process and to revise the minutes of the August 8, 2005, Special Commission meeting regarding the EAR to reflect the consensus. City Auditor and Clerk Robinson stated that the minutes of the August 8, 2005, Special Commission meeting will be revised to reflect the consensus and returned to the Commission for approval.
