City of Sarasota Minutes ofthe Board of Rules and Appeal December 4, 2019 at 3:00 pm I. CALL MEETING TO ORDER The Board of Rules and Appeals meeting of December 4, 2019 was called to order by Board Secretary Larry Murphy, at 3:03 p.m. in room 112, at the City of Sarasota, 1565 1st Street, Sarasota, FL. 34236. Board Present: Greg Wall, Dale Lewis, Larry Luther, Michael Walker, James Tille, David Parrish, Ryan Dalton, William Craig, Marcia Wood and Gilbert Weiner Board Absent: Curtis Ross- Motion to approve absence by Chairperson Walker, 2nd by Member Weiner. Vote 10-0 Justin Bogli - Motion to approve absence by Chairperson Walker, 2nd by Member Parrish. Vote 10-0 Public Present: None II. REVIEW AND APPROVAL OF MINUTES The minutes of the July 31, 2019 meeting were approved as submitted. III. APPEALS FROM THE FLORIDA BUILDING CODE - None IV. PRESENTATION OF TOPICS BY THE PUBLIC - None V. PRESENTATION OF TOPICS BY BOARD MEMBERS - An extensive discussion was held by Member Dale Lewis and the board members regarding the suggestion of change to the City of Sarasota ordinance where they would require a certified design professional to certify all final drainage on properties including single family. Member Lewis stated the City Engineer is studying that and he suggested she call Sarasota County and find out how it works for them and to get their ordinance language. However, she is studying it and might even consider hiring a consultant. Member Lewis stated that he explained to City Engineer Alex Davis Shaw that this has been going on for years in other surrounding jurisdictions and it doesn't seem to be a problem. Member Lewis stated that the City Engineer stated that she would talk with everyone and study it. Additional discussion was held by Member Lewis regarding the Board now having the required consumer representative to meet the statutory requirement to where the board could have full disciplinary hearings and probable cause hearings for the disciplinary hearing. Member Lewis stated that he contacted the City Attorney's office and that they would start looking into this and would get with Larry Murphy regarding it. Member Lewis told the City Attorney's office about the County Board meeting that was going to occur in November and suggested that they might want to attend. Chairperson Walker welcomed new members Marcia Wood and Gilbert Weiner to the Board. He asked it they had any questions or concerns regarding the Board or the Sunshine Law. VI. PRESENTATION OF TOPICS BY ADMINISTRATION OR CITY ATTORNEY- An extensive discussion was held by Building Official Larry Murphy and the Board Members regarding the disciplinary hearings. Building Official Murphy stated he had already contacted and met with the City Attorney and they are reviewing the state statute language right now as far as it goes with governing and disciplining. Sarasota County Attorney's Office was also contacted, and Secretary Murphy and the City Attorney will be attending one of their meetings to see parlamentary how they handle the hearings. No date has been secured at this time. Building Official Murphy wants to attend both the Mechanical and Contractors Board Meeting that are coming up shortly. VII. SCHEDULE OF MEETINGS = The next meetings were scheduled by the Board for next year 2020: February 12th, May 20th, August 5th, and November 4th. VIII.
