CTY OF SARASOA City of Sarasota Board of Adjustment Minutes June 28, 2023 The following are the motion minutes of the Board of Adjustment meeting held in the City Commission Chambers at City Hall, 1565 1st Street, on Wednesday, June 28, 2023. All in attendance stood for the Pledge of. Allegiance. The meeting came to order at 1:29 p.m. Chair Ruch reminded everyone in attendance to silence their cell phones and stated that the microphones were live and recording. Roll call was taken. PRESENT: Matthew Ruch, Chair; Olga Hanlon, Vice Chair; Shane LaMay, BOA Member; Chad Turnbull, BOA Member; James Lee, BOA Member Myra Schwarz, General Manager, Development Services, and Secretary to the Board; Angela McLeod Wilkins, Administrative Assistant, Development Services ABSENT: None LEGAL COUNSEL: Mike Connolly, Deputy City Attorney The March 29, 2023 meeting minutes were approved as submitted. Mr. Connolly then explained the Quasi-judicial hearing procedures. Ex-parte communications were disclosed. Ms. Schwarz recited the Pledge of Conduct for all in attendance. Everyone intending to speak was sworn in. Time Limits were announced. Variance Extension Request No. 23-VE-01. Andrei Mastrogiovanni, owner, requesting a one (1) year extension to previously granted Variance Petition No. 2022-VAR-09, to reduce the minimum lot area requirement of: 5,000 square feet to 4,736 square feet, for a total variance request of 264 square feet. Address: 0 Cocoanut Avenue. Zoning Code Section: V-108(c), and Zoning Code Table: VI-203. Legal Description: On file in the Zoning Division ofthe Development Services Department, City of Sarasota. Zone District: RSF-4 (Residential Single Family). Andrei Mastrogiovanni, petitioner. Ms. Schwarz provided an overview ofVariance Extension No. 23-VE-01. Mr. Ruch invited Andrei Mastrogiovanni, owner, and Ken Davin, Builder, to approach the dais. Mr. Mastrogiovanni presented a request to extend Variance Petition No. 23-VAR-07 for 0 Cocoanut Avenue. The Board discussed the relevance oft the request. Mr. LaMay made a motion to approve Variance Extension No. 23-VE-01 Mr. Lee seconded the motion. The motion passed 5-1. (LaMay - yes; Hanlon yes; Ruch - yes; Turnbull - yes; Lee yes) Variance Extension Request No. 23-VE-02. Henry P. Frieder, owner, requesting a one (1) year extension to previously granted Variance Petition No. 2022-VAR-13, for five (5) variances: 1) to restore the original platted separate Lots 164 & 165; 2) Lot 164 - to reduce the minimum lot area requirement of 21,780 square feet to 20,912 square feet, for a total variance request of 868 square feet; 3) Lot 164 - to reduce the minimum lot width requirement of 100 feet to 99.6 feet, for a total variance request of0.4 feet; 4) Lot 165 - to reduce the minimum lot area requirement of 21,780 square feet to 20,123 square feet, for a total variance request of 1,657 square feet; and 5) Lot 165 - to reduce the minimum lot width requirement of 100 feet to 96.2 feet, for a total variance request of 3.8 feet. Ms. Schwarz provided an overview ofVariance Extension No. 23-VE-02. Mr. Ruch invited Charles D. Bailey, Jr., agent, to approach the dais. Mr. Bailey presented a request to extend Variance Petition No. 23-VAR-13 for 1490 & 1500 (previously 1500 only) Hillview Drive. The Board questioned the applicant. Page 2 Ms. Hanlon made a motion to approve Variance Extension No. 23-VE-02. Mr. LaMay seconded the motion. Ms. Schwarz The motion passed 5-1. (LaMay - yes; Hanlon - yes; Ruch - yes; Turnbull - yes; Lee yes) NEW BUSINESS Variance Petition No. 2023-VAR-06, Michael and Laura Biersmith, owners, requesting an after-the-fact reduction to the required 20-foot front yard setback to 12.4 feet, for the addition of an attached garage. A total variance of 7.6 feet is requested. Address: 3424 Old Oak Drive. Legal Description: On file in the Zoning Division of the Development Services Department, City of Sarasota. Zone District: RSF-2 (Residential Single Family). Charles D. Bailey, Jr., agent. Mr. Connolly called on Bruce and Maria Sicilia, as they had requested Affected Person Status. Neither was present, and they were not granted Affected Person Status. The public hearing was opened. Charles D. Bailey, Jr., agent for the owner, and Michael Biersmith, owner, took seats at the dais. Mr. Bailey presented Variance Petition No. 23-VAR-06 for 3424 Old Oak Drive. The Board questioned Mr. Bailey and Mr. Biersmith. The Board discussed the variance petition. Mr. Bailey requested that the petition be continued in order for the Board to gather more information. The Board discussed the option of continuation and continued to question the petitioner. Dr. Turnbull made a motion to continue Variance Petition No. 23-VAR-06 to the July 26, 2023 Board of Adjustment meeting. Ms. Hanlon seconded the motion. Ms. Schwarz took the vote. The motion passed 5-0. (LaMay yes; Hanlon - yes; Ruch - yes; Turnbull - yes; Lee yes) Page 3 Mr. Connolly announced that Variance Petition No. 23-VAR-06 would be continued to July 26, 2023 at 1:30 p.m., City Hall, 1565 First Street. Presentation of Topics by Board Members Dr. Turnbull prompted a discussion regarding states of emergency and time frames for construction of] previously granted variances. Presentation of Topics by the City Administration or Legal Counsel to the Board Ms. Schwarz stated that the Board would hear the continued petition and one new petition at the July 26, 2023 meeting. Scheduling of Special Meetings There were no Special Meetings scheduled.
