City ofSarasota Minutes of the Board of Rules and Appeal June 5, 2019 at 3:00 pm I. CALL MEETING TO ORDER The Board of Rules and Appeals meeting of. June 5, 2019 was called to order by Board Secretary Larry Murphy, at 3:00 p.m. in room 112, at the City ofSarasota, 1565 1st Street, Sarasota, FL 34236. Board Present: Greg Wall, Dale Lewis, Larry Luther, Michael Walker, Justin Bogli, Curtis Ross, James Tille, David Parrish, Ryan Dalton, William Craig. Board Absent: Ellen Berman vacant seat = no vote Public Present: None II. APPROVAL OF MINUTES The minutes ofthe April 10, 2019 meeting were approved as submitted. III. APPEALS FROM THE FLORIDA BUILDING CODE - None IV. PRESENTATION OF TOPICS BY THE PUBLIC - None V. PRESENTATION OF TOPICS BY BOARD MEMBERS = Board Member Dale Lewis stated one of his clients applied for the consumer advocate position and that he is a new homeowner in Sarasota. He stated that his name is Gill Weiner and he's a retired attorney. An extensive discussion was held by Chairperson Michael Walker, Building Official/Board Secretary Larry Murphy and the board members regarding the board's excused / non- excused attendance ordinance. Secretary Murphy offered to research and report back to the board as to the clarification of the ordinance. Chairperson Walker asked Secretary Murphy about the push back of the tree ordinance by the commission and an extensive discussion was held. Secretary Murphy stated that the Commission was still looking at it due to the new statutory language that came out and that they may want more time to review it as it will probably impact whatever they decide. Secretary Murphy stated that the new language would allow a person to remove a tree if they had an arborist report that said the tree was diseased, causing harm to a structure, represented a danger to the community or health and safety that they would be allowed to remove the tree without a permit. Secretary Murphy stated that the ordinance did not define breast height, diameter or species. Chairperson Walker stated that the new website is user friendly and that it has for sure been brought up to the year 2019. Secretary Murphy stated that he is hoping it will get much better as we go on and that the new software will allow a lot more user access. Additional discussion was held regarding the new website, real time inspections, lotus notes and the old data and how it is maintained. 1 Board Member Lewis asked about the Statue of Limitation on expired permits. An extensive discussion by Secretary Murphy was held where he stated if a completed permit with approved inspections and after 10 years that the department no longer needs to keep records and that retainment is not required. He also discussed data storage and costs associated with retainment ofrecords. Board Member Lewis asked if there were any other legislation that was passed that affected the building department or codes. Secretary Murphy stated that it has been very busy in Tallahassee and that Governor DiSantis has SO many days to sign or veto any new laws. If he does not sign, then it automatically goes in to law. Secretary Murphy then discussed a bill that was out there to regulate the finances did not make it out oft the Senate, which would have impacted us to a point because we would have had to have done a lot of accounting and things of that nature because they were limiting two or three years of operating expenses to maintain in the budget. Secretary Murphy stated that it was defeated and never left the Senate. VI. PRESENTATION OF TOPICS BY ADMINISTRATION OR CITY ATTORNEY- Secretary Murphy gave an update on the implementation on the new system and the feedback from it. VII. SCHEDULE OF MEETINGS- The next meeting was scheduled for July 31, 2019 VIII.
